Law requires guardian ad litem for unborn baby whose mom is on life support

A Texas lawmaker has proposed legislation to grant a legal guardian to an unborn children when the pregnant mothers is strategically on life support on the state.

The law stems from the case of over a year ago involving pregnant mother Marlise Munoz after her family was forced to go to court to remove her from life support.

In November of 2013, when Marlise Munoz was 14 weeks pregnant she suffered a pulmonary embolism. Her husband and her parents asked John Peter Smith Hospital (JPS) to discontinue all life-sustaining treatment for her, which would have resulted not only in her death, but that of her unborn baby.

Hospital officials refused the family’s request citing the Texas Advance Directives Act, a law which prohibits withdrawal of life-sustaining treatment from a pregnant patient.

But the family vowed to take their request before a court alleging the unborn child was damaged and unhealthy.

After the news went public, pro-lifers stood vigilant outside JPS Hospital in Ft Worth reminding hospital officials that there were two patients to consider and one of them, the unborn child, was not getting a voice.

Within weeks, District Judge R.H. Wallace ruled the pregnant mother should be removed from life support.

Pro-lifers were saddened and held a memorial outside the hospital to remember both Marlise and her unborn child.

Now, a Texas state Representative has filed a unique law that would grant an unborn child a guardian ad litem in cases like the Munoz case.

The law, known as the Unborn Child Due Process Act, was filed by Texas Congressman Matt Krause.

Current Texas law states that life-sustaining treatment may not be removed from a pregnant patient. Should a family desire to remove their unconscious, pregnant family member from life support they must first go to court and get permission from a judge,” said Rep. Matt Krause, who filed the proposed legislation. “H.B. 1901 amends the law so that even if it appears that the mother is brain dead, as long as the unborn child is maturing and developing, life-sustaining treatment may not be removed. The appointed guardian ad litem’s job is to look after the interest of the unborn child and ensure that the judge has the best information possible on the condition of the child when making their ruling.”

H.B. 1901 doesn’t force a family to go to court. It only ensures that an unborn child’s voice is heard,” said Rep. Matt Krause in his press release. “Our Constitution clearly states that no person shall be deprived of life without due process of law. I will continue to defend that unalienable right for the voiceless.”

The lawmaker appeared on Dallas’ Lonestar Politics this Sunday to discuss the bill.

Rep. Krause said that this legislation could have helped the court in the Munoz case make a more informed decision by providing a spokesperson for the unborn child, “Anytime there is a court battle weighing these decisions we thought how about there is a voice for the unborn child,” Krause told the news station.

The bill has been filed and referred to State Affairs Committee and is awaiting a hearing.

He explained that the guardians for the unborn child would be appointed from a registry put together in advance by the State’s Attorney General.

The state rep said that normally he would not favor intruding in a family’s personal medical decisions, but, “In this situation there’s an extra life that comes into play which kind of changes the whole dimension and whole dynamic of the situation. And, that’s why we’re looking to give that unborn child representation.”

Krause was asked about how giving a fetus legal representation could affect abortion rights.

“You can never say for sure what’s going to happen,” Rep. Krause said, “But this is such a rare an extremely rare circumstance that I don’t think there’s that danger there that its going to create a whole new class of rights. You’re just saying….maybe there should be that voice for the unborn…”

Unfortunately, members of the Munoz family have introduced what they call, Marlise’s Law, which is legislation that would remove part of the Texas Advanced Directives Act which states “a person may not withdraw or withhold life-sustaining treatment” from a pregnant patient.

The bill, was filed this month by Austin Democrat Rep. Elliott Naishtat and introduced to the media in a press conference hosted by the ACLU of Texas.

Pro-life leaders determined to send message to Speaker Boehner as protest nears

This Wednesday please join us for a pray-in/sit-in at Speaker Boehner’s office as we call for legislation banning all abortions after 20 weeks. Sadly, the House has failed to schedule a vote on this bill. People, it’s time to be a voice for those who have no voice!

Those are the words of a Washington D.C. pastor, and director of the Christian Defense Coalition, Patrick Mahoney, one of three pro-life leaders organizing a public protest at the offices of Speaker John Boehner this week.

Rev. Mahoney, along with former nurse and well-known pro-life blogger Jill Stanek and Operation Rescue president, Troy Newman are planning a sit-it Wednesday at the speaker’s office because GOP leaders broke a promise and cancelled a vote on the “The Pain Capable Unborn Child Protection Act.”

The law would outlaw abortions after 20 weeks when many believe that there is documentation that unborn children can feel pain.

It was so disappointing to have you pull the Pain-Capable Unborn Child Protection Act from being voted on earlier this year.” the group wrote in an open letter to the Speaker recently.

The letter continues:

    “It was even more troubling to have this life-saving legislation withdrawn on the eve of the 2015 March for Life, when hundreds of thousands of Americans had come to Washington, D.C. to embrace human rights and equality for all, and we were promised it would be passed on January 22.

    “Although we are sure this was not your intention, millions felt betrayed by your actions and those of the Republican House leadership. Just one day before scores would be marching in the harsh winter conditions of January, we were still being assured a vote would happen the next day.

    Imagine our further sense of betrayal that, almost two months later, no vote has been rescheduled for the Pain-Capable Unborn Child Protection Act.”

Protest organizers have called the failure of Republican party leaders to introduce the bill not only a betrayal of the pro-life movement but a betrayal of America’s children.

We expect them to act,” Newman said in an interview with WorldNet Daily, “It’s exactly why the voters put them there. It was in their platform, what they ran on.”

Newman’s determination to send a clear and uncompromising message to party leaders on Wednesday came through loud and clear just days before the sit-in will take place. Newman said he won’t back down, “We are going there to put pressure on Boehner to get this bill pushed forward,” he told Saynsumthn.

Newman questioned Boehner’s leadership in passing a law most Americans support, “This is the the most “pro-life Congress” in US History but they can’t pass a bill they passed last session?” Newman asked.

Stanek says that she helped organize this protest after Rep. Renee Ellmers sabotaged the bill when it was originally supposed to be brought forward, that was January 22nd this year, the anniversary of Roe, the law which legalized abortion.

After that, I, for the most part, kept my silence, waiting… and waiting… and waiting for the GOP House leadership to circle back and fix their mess,” Stanek writes on her blog.

The GOP must have mistaken our silence for indifference – when really it was a grand display of unmerited patience – because after January 22 the House leadership went silent itself about the 20-week ban.

“So finally a small group of us said enough and organized a protest for March 25, at 11:00 a.m., at Speaker Boehner’s office, at whose door the buck stops.”

A week before the protest is to occur, Speaker Boehner told Life News that there is no purposeful delay in bringing the bill back to the floor, that it is very important to him and he and Republican leaders are committed to bringing it back to the floor for a vote.

The Pain Capable Unborn Child Protection Act is the most significant pro-life legislation to come before Congress since enactment of the ban on partial-birth abortions, and it remains an important priority for our majority. We have a moral obligation to defend the defenseless, and we will continue to fight to ensure our nation’s laws respect the sanctity of unborn human life,” the Speaker added.

But protest organizers were not convinced by the Speaker’s grand standing as evidences by Stanek’s response to Boehner, “Words, words,” she writes.

Stanek’s impatience comes from her own personal experience of holding a dying aborted child in her arms, “For me, it always comes back to the 21-week abortion survivor I held until he died. That sweetheart would be alive today had a 20-week abortion ban been in place.”

Days before the protest, Stanek told Saynsumthn that she is feeling determined to see that the GOP knows she is not going away as a voice for these children, “Wherein lies one of the pro-life movement’s problems. We’re obviously not respected or feared enough to have had someone(s) in the political party that is supposed to uphold our interests carefully shepherd the 20-week abortion ban through the process like it was truly a Big Deal.

Right now I am feeling determined… angry… fed up… and disgusted,” Stanek said.

Rev. Mahoney is encouraging pro-lifers to join them on Wednesday, citing holocaust survivor and Nobel Peace prize winner, Elie Wiesel, on the group’s events page, “The opposite of love is not hate, it’s indifference.The opposite of art is not ugliness, it’s indifference. The opposite of faith is not heresy, it’s indifference. And the opposite of life is not death, it’s indifference.”

“I, as a nurse at a hospital in Chicago, held an abortion survivor for 45 minutes until he died, and he was 21 weeks old,” Stanek told WorldNet Daily. “An abortion ban such as this would save babies like I held. This is very real to me. I have actually seen and held the babies that the House is just playing around with willy-nilly right now.”

Another Planned Parenthood vid uses a Black woman to pitch abortion as “good” and refers to her unborn children as “The Pregnancy.”

In the newest marketing ploy, Shawanna says that she was young when she became pregnant and went to Planned Parenthood.

She says that the eugenics founded abortion clinic chain gave her three options, as she describes, “Keeping the pregnancy, adoption or abortion.” Shawanna chose abortion claiming, “It was the best option for me at the time…it was the best decision.”

Shawanna claims that after she aborted “The Pregnancy” her life became better because she got to finish going to school and became a certified nurses assistant who went on to work for the abortion giant.

It is strange for a woman to refer to her unborn child as “The Pregnancy” until you realize that the person works for the largest chain of abortion clinics in the nation, Planned Parenthood. After all, keeping women and especially Black women in the dark about what “The Pregnancy” is helps accomplish their population control goals.

Man uses bat to demo how to get rid of an unborn baby on video

A video uploaded on YouTube jokes about striking a pregnant woman with a baseball bat to kill her unborn child.

The video, titled, “Hood Sponsor Testimony on Abortion Ultrasound Bill,” shows a young man demonstrating how you can get rid of a baby with a baseball bat.

With what appears to be his pregnant girlfriend sitting on the couch, the man who calls himself “Hood Abortionist” picks up a bat and demonstrates, “you just swing your bat no more baby.”

Mark Crutcher, President of Life Dynamics, Inc., a national pro-life organization located in Denton, Texas, has documented that violence inflicted on pregnant women by pro-choice men who want their pregnancy aborted is nothing new.

Life Dynamics has collected data on a large volume of these cases and compiled the data in a report entitled, “Under-the-Radar Violence in the Conflict Over Abortion.”

The report details the death of 16 year old Karesse Ebron whose boyfriend Ryan Ross drove Ms. Ebron to a wooded area near her home and bludgeoned her to death with a baseball bat. In 2007, he confessed to the murder and was sentenced to 22-years-to-life in prison. He told investigators that he killed Ms. Ebron because she was pregnant with his baby and would not have an abortion.

It also highlights the murder of 29 year old JoAnn Crystal Harris whose boyfriend decided that her pregnancy would ruin his marriage. Scott Allen Ansman was convicted of beating Ms. Harris to death with a baseball bat in 2007. According to authorities, Ansman was married and having an affair with the victim and, when she became pregnant, he demanded that she have an abortion. Because she refused, he tried to recruit someone to beat her enough to cause a miscarriage. When that was unsuccessful, he decided to kill her himself. In 2009, Ansman was given life without the possibility of parole.

In 2005, a 17 year-old Cheri girl was murdered in Virginia after she refused her lovers demand she have an abortion. Cheri Washington was pregnant by 27-year-old, Carlos Diangilo Williams, who demanded that she have an abortion. When she refused, he tied her up with duct tape, beat her with a baseball bat and stomped on her stomach with his boot. In 2005, Williams was convicted in the case and sentenced to 48 years in prison.

Crutcher warns women, “So if you are female, before you jump into bed with someone, it would be a good idea to find out his position on abortion. After all, you don’t want to be like the women listed here and find out the hard way that the kind of man who can be pro-choice about your baby could also be pro-choice about you.

Apparently the author of this video thinks that striking a pregnant woman with a bat to get rid of her unborn child is a joke, or…maybe not!

The East Village doctor was convicted of performing an illegal third-trimester abortion in which he severed the arm of a fetus. The doctor was the first person convicted of conducting an illegal abortion in New York State in more than a decade.

In Feb of 1993, after four and a half days of deliberation, a jury in State Supreme Court in Manhattan found Dr. Abu Hayat guilty of assault on Rosa Rodriguez and her baby, Ana Rosa. He was also convicted of two counts of assault on another patient.

In her testimony Rodriguez describes how she was strapped in stirrups and held down by Hayat and his assistants while she pleaded with him to stop the abortion. She testified that she changed her mind about the abortion after Hayat stuck a four inch needle inside her stomach which she claims was dirty, and that she could hear other women in the clinic screaming. She asked the abortionist why the women were screaming and she testified he responded, “Not everyone can pay for anesthesia.”
