Planned Parenthood has a history of failing to protect patient privacy under HIPAA

Americans are told that abortion is a “right” based on privacy. But when abortion providers like Planned Parenthood violate the privacy of women, abortion-friendly media and politicians are silent.

Planned Parenthood receives half a billion dollars annually from taxpayers and claims the majority of these dollars are Medicaid reimbursements. According to the Centers for Medicare and Medicaid Services (CMS), recipients of government programs that pay for health care, like Medicaid, must comply with the Health Insurance Portability and Accountability Act known as HIPAA.

But is Planned Parenthood following HIPAA laws? Multiple instances of privacy breaches at Planned Parenthood say no.

The latest video released by the Center for Medical Progress (CMP) further confirms what many already know all too well: when it comes to the privacy of abortion patients, Planned Parenthood is anything but trustworthy. Former Stem Express procurement technician, Holly O’Donnell, told CMP that Planned Parenthood revealed private patient medical information to third party contractors at fetal tissue procurement agency StemExpress in order to meet the company’s quotas for harvesting body parts from Planned Parenthood abortions:

O’Donnell said Planned Parenthood staff provided StemExpress contractors with private medical information of pregnant women coming into Planned Parenthood: “We’d go to the head nurse, let the nurses know, hey, this is what I’m looking for today. They’d give you a sheet of the appointments, which women were coming in, and it would tell you how many patients, what time they were coming in, their name, and if they knew how far along they were.”

Clearly, disclosing patient names is a violation of HIPAA.

According to HHS, the Privacy Rule protects all “individually identifiable health information held or transmitted by a covered entity or its business associate, in any form or media, whether electronic, paper, or oral… Individually identifiable health information includes many common identifiers (e.g., name, address, birth date, Social Security Number).”

In 2016, the Washington Times reported, “The day before abortions were scheduled to take place… StemExpress was notified by fax by the clinics and granted medical files on individual patients.” O’Donnell told CMP that Planned Parenthood handed over a list of patient names and other private information to third party contractors before these patients signed a consent to release their personal information.

O’Donnell also reveals that Planned Parenthood gave StemExpress access to patient medical charts and even to the clinics’ computer network to download patient schedules across the entire Planned Parenthood affiliate. Emails from StemExpress management instruct procurement technicians: “EVERY Friday – please provide schedules for all the clinics you work in,” and, “All computers have access to other clinics.”

While this should shock politicians and media alike, tragically, accusations of carelessness and lack of concern for patient privacy at Planned Parenthood is not new.

In September of 2016, Live Action News released a two-part series exposing the way Planned Parenthood and the general abortion industry recklessly handles patient privacy. In those reports were documented case after case where Planned Parenthood was given a slap on the wrist for violating patient privacy — and in the cases reviewed at that time, no civil penalties had been issued.

CMS states that the U.S. Department of Health and Human Services Office for Civil Rights “enforces the HIPAA Privacy, Security, and Breach Notification Rules. Violations may result in civil monetary penalties. In some cases, criminal penalties enforced by the U.S. Department of Justice may apply.”

Breaches expose thousands of individuals

1. Planned Parenthood of Greater Washington and North Idaho (PPGWNI): 10,700 individuals exposed

A review of archived privacy breaches on file with the Office for Civil Rights (OCR), which affect more than 500 patients, reveals that in August 2016, Planned Parenthood of Greater Washington and North Idaho (PPGWNI), reported a breach which exposed 10,700 individuals.

2. Planned Parenthood Southwest Ohio: 5,000 individuals exposed

Another breach report states that on October 1, 2014, Planned Parenthood Southwest Ohio disposed of binders containing protected health information (PHI) for 5000 individuals, including names, dates of birth, lab results, and medications. Exactly what occurred in the privacy breach? Planned Parenthood’s archived prescription dispensing logs and waived lab test logs were left in an unlocked closet after business hours and a custodian mistakenly put them in a trash dumpster. The following morning, the dumpster was emptied by the trash collector, who took it to be buried with other garbage at a landfill that same day. And, as Planned Parenthood often claims it does when it violates government requirements, Planned Parenthood told the OCR that they conducted an investigation and re-trained all staff regarding HIPAA policies and procedures.

3. Planned Parenthood of the Heartland: 2,506 individuals exposed

Still under investigation is a July 2016 breach report reported by Planned Parenthood of the Heartland. This breach for “Unauthorized Access/Disclosure” affected 2,506 individuals. No additional information is available from OCR; however, HIPAA Journal reported the following:

The health center permanently closed its doors to patients this April year and the premises was listed for sale and was sold. However, hard copies of patient files were left in the Dubuque health center. In April 2016, individuals entered the medical center and could potentially have viewed and/or copied patient files. The potential breach was discovered by Planned Parenthood on May 6, 2016. The files have now been removed from the premises and have been secured. Planned Parenthood said this was an isolated incident and is not representative of the stringent privacy standards usually maintained by the healthcare organization.

Health Care Compliance Association summarized another case where Planned Parenthood violated privacy of a patient.  In January 2017, HCCA wrote, “a complaint filed against Planned Parenthood alleged that an employee posted a description of the procedure the individual had performed at the clinic on the individual’s public Facebook page.”

In response, HCCA states, “OCR sent Planned Parenthood the regulatory section on reasonable safeguards
and encouraged it to “assess and determine whether there may have been noncompliance… and if so, to take steps to ensure such noncompliance does not occur in the future.”

Other breaches

In addition to those listed above, the following are known instances of privacy breaches at Planned Parenthood:

  • California Planned Parenthood patient reported that following her visit, she received two text messages from an anonymous number, reading, “Damn, you have an STD WOW.”
  • Napa Planned Parenthood receptionist admitted to state officials that she had looked at private patient records because she was curious.
  • Alleged Planned Parenthood patient wrote online, “a worker there told a family member of mine about my privacy.”
  • In 2011, OCR received a complaint alleging that a worker at Planned Parenthood in New York “impermissibly disclosed” the complainant’s health information to her sister’s friend.
  • In 2012, a complainant informed the governing body that she had received a call from Planned Parenthood of Northeast Ohio asking her to contact them regarding recent test results. During the call, it was determined that she was not the correct patient.
  • In 2013, OCR was notified that Planned Parenthood of Delaware violated the Federal Standards for Privacy of Individually Identifiable Health Information.
  • That same year, Melody Meanor, the former Health Center Manager of Family Planning at Planned Parenthood of Delaware in Wilmington went public to expose the center’s privacy policies. A video and transcript of her statement is available online.
  • In 2013, a complaint was filed against a Planned Parenthood in Chicago, Illinois, which alleged that an employee impermissibly disclosed her private health information to a third party on Facebook.
  • complaint received by OCR in 2014 alleged that a Planned Parenthood in Trexlertown, Pennsylvania, violated the Federal Standards for Privacy Identifiable Health Information after sending a bill for a patient to the wrong person.
  • A 2014 complaint filed with the Texas Medical Board by former Planned Parenthood director, Abby Johnson, alleges that a Texas Planned Parenthood e-mailed their abortionist the ultrasound information of their patients — but not in encrypted form.
  • TAB, a records management company working with PPFA for over a decade, identified what they called “some serious problems” with the records of Planned Parenthood of Illinois, which oversees 17 branch locations.

In CMP’s video interview, O’Donnell tells David Daleiden that she has witnessed her colleagues log onto Planned Parenthood’s computers. O’Donnell provided copies of e-mails to CMP to support her claims.

“They would let us look at the physical charts outside the room,” O’Donnell stated, claiming that she was even asked to write in a Planned Parenthood patient’s chart, which she says she refused to do.

So much for privacy at Planned Parenthood.

HHS gives Planned Parenthood over $5 million with grant money from Office of Adolescent Health

This blog has been exposing the Office of Adolescent Health otherwise known as OAH for a while.

It was created by the Obama Administration and operated under the division of the Health and Human Services Department and funded to the tune of $105 million.

Now, Life Dynamics has discovered that the OAH has allocated over 5 million dollars in federal grant money to various Planned Parenthood affiliates under a teen prevention program run by HHS.

TPP Teen Pregnancy Prevention Program Planned Parenthood

The announcement came July 4, 2015 from the Office of Adolescent Health, which is responsible for implementing and administering the national, evidence based Teen Pregnancy Prevention (TPP) Program.

The TPP program is described by OAH as, “one of a growing number of federal programs that focus on providing evidence of what works, investing in new and innovative approaches, and fostering a culture of learning.”

The Office of Adolescent Health (OAH) was established in the Office of the Assistant Secretary for Health in 2010.

According to OAH:

    OAH coordinates adolescent health promotion and disease prevention programs and initiatives across the U.S. Department of Health and Human Services (HHS) and works in partnership with other HHS agencies to, “support evidence-based approaches to improve the health of adolescents.”

    OAH operates grant programs aimed at reducing teen pregnancy and supporting expectant and parenting teens and maintains an evaluation portfolio associated with these grants. OAH operates a website with extensive resources regarding adolescent health and leads collaborative activities with other federal agencies and national groups that serve adolescents

Since the program’s inception, OAH has worked in collaboration with HHS’ Administration on Children and Families, Family and Youth Services Bureau and the Centers for Disease Control and Prevention’s Division of Reproductive Health to, “extend the reach of teen pregnancy prevention in targeted communities.”

According to OAH, a total of 81 organizations received the grant money to:

    Support replication of evidence-based TPP programs in multiple settings in communities with the greatest need;
    Increase capacity of organizations to implement evidence-based TPP programs focusing especially on serving especially vulnerable youth, including homeless youth, parenting youth and those in juvenile detention and foster care;

    Support and foster early innovations to fill gaps in the knowledge of what works to prevent teen pregnancy; and

    Develop and rigorously evaluate new, innovative approaches to combating teen pregnancy.

Grants for OAH’s 5 year program to run from 2015-2019 included abortion giant Planned Parenthood.

Under what OAH labels their Tier1A, “Capacity Building to Support Replication of Evidence- Based TPP Programs” they gave $750,000 to Planned Parenthood of the Great Northwest Seattle Washington for “vulnerable youth.”

$1,000,000, was allocated for “Family-based intervention for rural youth and their parents or caregivers” and another $1,000,000 for “Clinic-based intervention for LGBTQ teens and health care providers.”

In addition to the grants listed above, the abortion giant recorded receiving $528.4 million dollars in tax money, according to their 2013 to 2014 annual report.

Planned Parenthood uses the grant money and the federal tax dollars to line the pockets of their board members, presidents and directors of their abortion centers with six-digit salaries.

A document filed by Planned Parenthood to the IRS shows that their president, Cecile Richards, took home a salary of $451,752 plus $31,405 in compensation from related organizations and $107,771 in other compensation from Planned Parenthood.

Planned Parenthood does not need more funding to conquer their goal of “making abortion normal” and this is just one more example of how the American people are being financially raped to fund abortion.

Planned Parenthood calls ambulance for patient because they could not stop bleeding

New 911 recordings obtained by Operation Rescue show that a Planned Parenthood patient in Spokane who was transported to the hospital on April 15, 2015, was hemorrhaging.

The emergency was at the Planned Parenthood located at 123 E Indiana Ave in Spokane, Washington, Operated by: Planned Parenthood of Greater Washington and North Idaho.

From their report:

    This is Angie from Planned Parenthood. We need an ambulance for a patient we can’t get to stop bleeding,” a Planned Parenthood caller told a 911 dispatcher.

    The Planned Parenthood worker was transferred to a Fire Department dispatcher who asked her what happened. The rest of the recording was redacted.

    Planned Parenthood in Spokane had no ability to treat this patient who suffered a common abortion complication. Many women are not aware that free-standing abortion facilities cannot help them in the event of a medical emergency and that there will be delays in receiving emergency care,” said Operation Rescue President Troy Newman.

    Pro-life activists with Sidewalk Advocates for Life of Spokane shot video footage as an ambulance loaded a patient at the Indiana Health Center of Planned Parenthood abortion facility in Spokane, Washington, then sped away to a local hospital with lights flashing and sirens blaring.

Although there is no documentation the woman was having an abortion, Planned Parenthood has been negligent in getting help for abortion patients who were bleeding in the past.

Case in point is 24-year-old Tonya Reaves who bled for five hours after her abortion at a Chicago Planned Parenthood.

By the time Planned Parenthood got Tonya to the hospital it was too late and she died.

The CEO of Planned Parenthood of Greater Washington and North Idaho, once said the organization had an “image problem.”

When asked by a member about Planned Parenthood being known for abortion Karl Eastlund, President of Planned Parenthood of Greater Washington and North Idaho, responded, “We unfortunately do have a marketing and an image problem, so, we have not been able to sell to the public, and to inform them of the services we do as well as we would like to…”

Well, one thing is for sure, we can add “valet services” to that list. That is, they will call an ambulance for you – hopefully in time to help!

Karl Eastlund was appointed Chief Executive Officer of Planned Parenthood of Greater Washington and North Idaho in November of 2011 after serving for five months in the interim position.Karl joined Planned Parenthood in 2003 as the Chief Financial Officer and quickly became the organizations Chief Operating Officer.

According to a 2009, 990 filed by Planned Parenthood of Central Washington, Eastlund made $100,648 base compensation , $5,000 in Bonus and incentive pay,$3,408 in retirement and other compensation, $5654 in non-taxable benefits, for a grand total of $114,710. Eastlund only worked on average 37.50 hours per week for that salary.

Former CEOs Anna Franks received $212,513 from the tax funded Planned Parenthood and Medical Director Sara Cate was paid $145,683

Planned Parenthood of Central Washington has now become Planned Parenthood of Greater Washington and North Idaho and given the salary of their previous CEO Anna Franks, it is expected that Eastlund will earn well over $200,000 from the TAX FUNDED organization.

Planned Parenthood received $349.6 million in tax dollars in the fiscal year ending on June 30, 2008, and $363.2 MILLION Dollars on Government Grants ( Tax Dollars) in 2009– that is ONE MILLION DOLLARS PER DAY of taxpayer money !!!

The organization formerly known as Planned Parenthood of Central Washington has been ordered to pay a former employee more than $106,000 in damages after firing her because of a disability.

The money awarded to Shannon Sharp by a Benton County Superior Court judge includes more than $86,000 for back wages and $20,000 for emotional distress.

Karl Eastlund, the organization’s CEO, also was ordered to pay Sharp $30,000 for emotional distress. ( Keep in mind his salary in general-above)

Sharp waged an eight-year battle against her former employer that culminated in a jury verdict in her favor in late June.

Her lawsuit claimed that Planned Parenthood fired her from her job as a regional manager after she was diagnosed with degenerative arthritis in her neck and back that required ongoing medical treatment.

Her neck and back pain sometimes made Sharp unable to perform all of her job functions, and her lawsuit alleged that Planned Parenthood fired her rather than provide reasonable accommodations, court documents said.

Planned Parenthood — now Planned Parenthood of Greater Washington and North Idaho — claimed in court that it fired Sharp because of her performance.

“In our view, we followed all laws and professional protocols when we terminated her employment due to performance; however, recently a court agreed that the former employee’s claims had some merit,” Planned Parenthood officials said in a statement at the time of the verdict. “While we believe we followed all laws, we respect the court process, and we are grateful this legal process has concluded so that we can continue to focus on patient care.”

Court documents said Sharp had never received a negative performance evaluation or reprimand, and that the organization’s human resources department performed no independent investigation.

The lawsuit was filed in 2004 but was delayed for several years because Washington’s anti-discrimination law was unsettled because of court battles and legislative changes, Sharp’s attorney, Michael Saunders, told the Herald.

The case finally came to trial in June, and a jury found that Sharp was fired because of her disability.

Some questions about monetary payments remained, and Judge Cameron Mitchell on July 23 signed the judgments against Planned Parenthood for $106,000 and Eastlund for $30,000.

Planned Parenthood CEO tells church – “WE HAVE AN IMAGE PROBLEM”

In the video below, Karl Eastlund, President of Planned Parenthood of Greater Washington and North Idaho attempts to tell members of the Bethany Presbyterian Church in Spokane that that Planned Parenthood has an “Image Problem” ….

When asked by a member about Planned Parenthood being known for abortion which is the taking of unborn children in the womb in all months of pregnancy, Eastlund responds, ” We unfortunately do have a marketing and an image problem, so, we have not been able to sell to the public, and to inform them of the services we do as well as we would like to...”, then Eastlund uses the code word “SOCIAL JUSTICE” in attempting to lure these members into buying their Koolaid.

To add to their already dismal image problem: Planned Parenthood of Central Washington, recently lost a lawsuit to a former employee who charged the so-called pro-woman organization with discrimination for her disability.

Shannon Sharp worked for Planned Parenthood of Central Washington as a regional manager before being diagnosed with degenerative arthritis in her neck and back that required ongoing medical treatment, her attorney Mike Saunders of Seattle told the media.

Her neck and back pain sometimes made Sharp unable to perform all of her job functions, and her lawsuit alleged that Planned Parenthood fired Sharp rather than provide reasonable accommodations. The case came to trial in June of 2012, and a jury on June 27, 2012 awarded more than $136,000 to Sharp after finding that she was fired because of her disability.

Planned Parenthood founder, Margaret Sanger, was a member in good standing with the racist American Eugenics Society. Sanger had board members who were known for their racist writing and Sanger published many of those in her publications. Sanger called for parents to have a QUOTE: LICENSE TO BREED controlled by people who believed in her eugenic philosophy. She wanted all would be parents to go before her eugenic boards to request a “PERMIT TO BREED“.

Margaret Sanger once said, “More children from the fit, less from the unfit — that is the chief aim of birth control.” Birth Control Review, May 1919, p. 12

Planned Parenthood’s top award is called the Margaret Sanger Award, despite the fact that Sanger was an admitted Klan speaker. This is what Sanger wrote in her autobiography, “I accepted an invitation to talk to the women’s branch of the Ku Klux Klan…I saw through the door dim figures parading with banners and illuminated crosses…I was escorted to the platform, was introduced, and began to speak…In the end, through simple illustrations I believed I had accomplished my purpose. VICE PRESIDENT OF DEVELOPMENT KIM MEREDITH received $220,427 from Planned Parenthood $24,492 from related organizations and $24,076 in estimated compensations. Before joining PPFA in 2006, Meredith spent nearly nine years as the chief operating officer at the now defunct and now disaffiliated Planned Parenthood Golden Gate, a Planned Parenthood clinic which squandered tax dollars and will close and never repay their debtors .

NATIONAL POLITIC AND FIELD DIR, ELLEN GOLOMBEK received $203,843 from Planned Parenthood $10,729 from related organizations and $15,288 in estimated compensations, she has since left Planned Parenthood to work in the Colorado Governor’s Administration.

Planned Parenthood Federation of America’s Web site shows that it performed 332,278 abortions in 2009, up 8,270 from 2008. Why should the taxpayer be forced to fund abortion?

Planned Parenthood also PROFITED $64 million dollars in that same year ! Why do they need you and I to fund them?

But, Planned Parenthood’s profits are politicians gains. Just look at this analysis from Open Secrets which monitors 501C3 organizations and how they distribute and collect their funding:

The organization’s political action committee, for example, donated more than $148,000 to federal candidates — almost all Democrats –– during the 2010 election cycle. The PAC spent more than $443,000 overall.

Planned Parenthood also recorded $905,796 in independent expenditures during the 2010 cycle — money spent in support of, or in opposition to, federal political candidates, largely through advertisements. The top beneficiaries of this money were Barbara Boxer (D-Calif.) and Patty Murray (D-Wash.).

In 2010 alone, Planned Parenthood and a California affiliate together spent more than $700,000 on federal lobbying efforts, a Center for Responsive Politics analysis of federal lobbying records finds. By comparison, all other organizations that primarily advocate for abortion rights collectively spent $247,280 on federal lobbying efforts during the same period.

So, not only does taxpayer money make Planned Parenthood officials RICH FAT CATS, they also expand the coffers of the politicians who support them- see how the cycle works?

Karl Eastlund was appointed Chief Executive Officer of Planned Parenthood of Greater Washington and North Idaho in November of 2011 after serving for five months in the interim position.Karl joined Planned Parenthood in 2003 as the Chief Financial Officer and quickly became the organizations Chief Operating Officer.

According to a 2009, 990 filed by Planned Parenthood of Central Washington, Eastlund made $100,648 base compensation , $5,000 in Bonus and incentive pay,$3,408 in retirement and other compensation, $5654 in non-taxable benefits, for a grand total of $114,710. Eastlund only worked on average 37.50 hours per week for that salary.

Discrimination:

In 2012 Planned Parenthood of Central Washington was ordered to pay a former employee more than $106,000 in damages after firing her because of a disability.

The money awarded to Shannon Sharp by a Benton County Superior Court judge includes more than $86,000 for back wages and $20,000 for emotional distress.

Karl Eastlund, the organization’s CEO, also was ordered to pay Sharp $30,000 for emotional distress.

Sharp waged an eight-year battle against her former employer that culminated in a jury verdict in her favor in late June.

Former CEOs Anna Franks received $212,513 from the tax funded Planned Parenthood and Medical Director Sara Cate was paid $145,683

Planned Parenthood of Central Washington has now become Planned Parenthood of Greater Washington and North Idaho and given the salary of their previous CEO Anna Franks, it is expected that Eastlund will earn well over $200,000 from the TAX FUNDED organization.

Planned Parenthood received $349.6 million in tax dollars in the fiscal year ending on June 30, 2008, and $363.2 MILLION Dollars on Government Grants ( Tax Dollars) in 2009– that is ONE MILLION DOLLARS PER DAY of taxpayer money !!!

Perhaps the hard working American public would like to think that an organization that receives TAX DOLLARS could pay their employees a little less than 6 digit salaries.

To add to their already dismal image problem: Planned Parenthood of Central Washington, recently lost a lawsuit to a former employee who charged the so-called pro-woman organization with discrimination for her disability.

Shannon Sharp worked for Planned Parenthood of Central Washington as a regional manager before being diagnosed with degenerative arthritis in her neck and back that required ongoing medical treatment, her attorney Mike Saunders of Seattle told the media.

Her neck and back pain sometimes made Sharp unable to perform all of her job functions, and her lawsuit alleged that Planned Parenthood fired Sharp rather than provide reasonable accommodations. The case came to trial in June of 2012, and a jury on June 27, 2012 awarded more than $136,000 to Sharp after finding that she was fired because of her disability.

Before joining PPFA in 2006, Meredith spent nearly nine years as the chief operating officer at the now defunct and now disaffiliated Planned Parenthood Golden Gate, a Planned Parenthood clinic which squandered tax dollars and will close and never repay their debtors .

Former Planned Parenthood employee wins lawsuit in Benton County

After an eight-year battle, a former Planned Parenthood employee won a lawsuit in Benton County alleging that the organization fired her because of a disability.

Shannon Sharp worked for Planned Parenthood of Central Washington as a regional manager before being diagnosed with degenerative arthritis in her neck and back that required ongoing medical treatment, her attorney Mike Saunders of Seattle told the Herald.

Her neck and back pain sometimes made Sharp unable to perform all of her job functions, and her lawsuit alleged that Planned Parenthood fired Sharp rather than provide reasonable accommodations.

Planned Parenthood — now Planned Parenthood of Greater Washington and North Idaho — claimed in court that it fired Sharp because of her performance.

The lawsuit was filed in 2004, but Washington’s anti-discrimination law was unsettled for several years because of court battles and legislative changes, Saunders said.
The case finally came to trial in June, and a jury on June 27 awarded more than $136,000 to Sharp after finding that she was fired because of her disability.

As part of their defense of child killing in the womb, Planned Parenthood says that abortions are acceptable if the child is going to be disabled.
