How many women died from illegal abortions prior to Roe v. Wade?

Pro-abortion professor testifies against Heartbeat Bill using bogus, debunked abortion statistics

Prior to the legalization of abortion, those who sought to legally end the lives of preborn children falsely marketed their position by claiming that women were dying by the thousands (and even millions) from illegal abortions. However, there is absolutely no evidence to back up those figures.

Despite this, those figures continue to be repeated by abortion advocates any time they sense that the so-called “right” to abortion is potentially in jeopardy.

A pro-abortion professor, testifying under oath before Congress, unfortunately used these disputed and highly suspect statistics regarding the number of women who died from illegal abortions in an effort to oppose the federal pro-life Heartbeat bill, HR490, which proposes to stop abortions at a point when it can be documented that the preborn child’s heartbeat can be detected:

In her testimonyProfessor Priscilla Smith claimed that 5,000 women died annually from illegal abortions prior to Roe v. Wade:

Women have been obtaining abortions since the beginning of time, before Roe when abortions were illegal… An estimated 1.2 million women each year still resorted to illegal abortion in the US. As many as 5000 of these women — already born – living, breathing, lungs working, hearts beating, women, many with children at home who depended on them — 5,000 of them died each year as a result of illegal abortions and many more were severely injured. This is the world we would return to if HR490 went into effect….

But the facts don’t agree with Smith’s claims. A 1975 report by National Academy of Sciences, Institute of Medicine, entitled, “Legalized Abortion and the Public Health: Report of a Study,” disputes these statistics (emphasis added):

It is difficult to find credible estimates of the number of deaths associated with illegal abortion. One estimate, which has been frequently quoted, is between 5,000 and 10,000 deaths per year. That is hardly plausible, considering that the total number of deaths of women aged 15-44 from all causes in the United States is approximately 50,000 annually, and the total number of deaths due to abortion reported by the National Center for Health Statistics (NCHS) has been below 500 since 1958 and below 100 since 1971.

The 5,000 figure originates from a piecemeal of several sources based largely on assumptions, and comes straight from the largest abortion lobby group in the nation: National Abortion Rights Action League (NARAL.)  NARAL’s footnote quotes from a source that allegedly “discussed Dr. Christopher Tietze’s estimate of nearly 8,000 deaths from illegal abortion annually in the United States.” The truth is that Tietze disputed the 5,000 to 10,000 number, as did records of maternal deaths reviewed by the Centers for Disease Control (CDC) in the years just prior to national legalization.

In fact, in Lawrence Lader’s book “Abortion,” also sourced, he clearly states, “Tietze places the figure nearer 1,000.” But, as Dr. John C. Willke explains in the video below, that trend decreased over time:

Tietze was a senior consultant to the Center for Policy Studies of the Population Council, a radical organization founded by John D. Rockefeller III. That organization’s second president was Frederic Osborn, a founding member of the American Eugenics Society who signed Margaret Sanger’s “Citizens Committee for Planned Parenthood,” published in her review in April of 1938. (Osborn may have coined Planned Parenthood’s “Every Child a Wanted Child” slogan, and once wrote, “Eugenic goals are most likely attained under a name other than eugenics.”)

In 1967, Dr. Tietze, who was speaking at a conference on abortion sponsored by the Harvard Divinity School and Joseph P. Kennedy Jr. Foundation, called the 5,000 illegal abortion deaths, “unmitigated nonsense,” according to a September 13, 1967 article in the Berkshire Eagle.  The paper went on to give substantially fewer numbers by Tietze, writing, “The known deaths attributed to abortion in 1964 were 247 and he thinks it is fairly safe to estimate that the real figure may be double that, even a little more, but certainly no more than a thousand.” Note that Dr. Tietze was no pro-lifer: In 1973, he was awarded Planned Parenthood’s infamousMargaret Sanger Award, named after a eugenicist who gave at least one speech to the Ku Klux Klan.

The Kingsport News reported on that same conference, pointing out that Tietze disputed the reported illegal abortion totals, which some claimed ranged from 200,000 to 1.2 million annually. The paper quotes Tietze as saying, “we have no real basis for guessing which extreme is closer to the truth.”

Tietze, who favored abortion on demand, also opined that legalizing abortion would “not have a big impact on mortality.”

The Register, a Virginia paper, notes in its article entitled, “Supporters of Liberal Abortion Laws use Inflated Statistics, Expert says,” that Tietze suggested that the larger numbers (5,000 to 10,000) were made up to scare politicians into legalizing abortion. “The higher estimates are made by people who feel in order to raise sympathy for liberalized abortion laws they have to make people afraid.”

Tietze was right.

Dr. Bernard Nathanson, one of the early founders of NARAL (then known as the National Association for the Repeal of Abortion Laws), revealed that he and his colleagues fabricated the large numbers of deaths from illegal abortion in an attempt to sway public opinion toward making abortion legal.

In his book, “The Abortion Papers,” Dr. Nathanson admitted that the 5,000 to 10,000 figure which was fed “to the public and the media in the late 1960’s,” was fabricated because it was a “nice, round, shocking figure.” And, just like they do today, the media — willingly and with no documentation — repeated that figure with no demand for proof.

However, there was data available, and it didn’t support those fabricated figures.

On October 19, 1959, Mary S. Calderone, a medical director of Planned Parenthood Federation of America, presented a paper before the Maternal and Child Health Section of the American Public Health Association (APHA) at the Eighty-Seventh Annual Meeting in Atlantic City, New Jersey, where she also gave far fewer numbers than Professor Smith:

In 1957 there were only 260 deaths in the whole country attributed to abortions of any kind. In New York City in 1921 there were 144 abortion deaths, in 1951 there were only 15; and, while the abortion death rate was going down so strikingly in that 30-year period, we know what happened to the population and the birth rate.

In 1967, New York Assemblyman, Albert Blumenthal, who sponsored a law to legalize abortion that year, was quoted by the media as claiming that between 35 and 60 deaths from illegal abortions were reported in New York City annually. That same year, an Illinois Health Director by the name of Dr. Herbert Ratner called the 5,000 to 10,000 figure “outlandish,” noting, “This hardly leaves room for deaths from other causes.”

Dr. Ratner also correctly warned that the liberalization of abortion, which he called “exterminative medicine,” would start a dangerous trend in medicine — a prophetic insight America has sadly seen come true.

By 1969, the very first abortion surveillance report was published by the Centers for Disease Control, noting a “lack of accurate incidence, prevalence, morbidity and mortality data” on abortion. At that time, five states had passed abortion legislation and 24 others had bills under review. According to this same CDC report, in 1966, the National Center for Health Statistics reported 189 maternal deaths from abortion complications.  And, while no one would diminish those numbers, they are a far cry from the 5,000 touted by Professor Smith.

By 1970, the CDC reported that in just a six month period (July to December), out of sixteen reported abortions in New York City, eight women — yes, HALF — had died from legal (not illegal) abortions. In total, the 1970 report states that 25 women died in New York City (where abortion had been liberalized), and eleven of those were from illegal abortions. The report also noted that Black and Puerto Rican women suffered higher legal abortion mortality rates.

According to that CDC document, “although there was substitution of legal for illegal abortion deaths, no significant decrease in total abortion mortality occurred following institution of the new law….”

In 1972, the year prior to national legalization, CDC reports revealed that deaths from illegal abortion were nothing close to Professor Smith’s 5,000 figure. In this table from the CDC report (shown below), just 39 women died from illegal abortion in 1972 while 24 died from legal abortion.

Live Action News previously documented that the majority of illegal abortions were performed by physicians, and many of those same doctors went on to perform legal abortions, some of whom have seriously injured and even killed women. But, today, instead of protecting the women who are being butchered or are dying from legal abortion, advocates like Professor Smith spew made up numbers from the illegal abortion days.

It would appear that abortion advocates do not actually care about the safety of women or even about real statistics; they care only about legalizing abortion at any cost.

Planned Parenthood and Guttmacher both get millions in tax dollars to promote abortion

As pro-lifers expose how government funding of abortion business Planned Parenthood is increasing annually, reports from Planned Parenthood’s research arm reveals that government funding is pouring into that pro-abortion organization as well. And, while the Guttmacher Institute claims to be a separate entity from Planned Parenthood reports from both agencies show that money is flowing between the organizations.

In 1968, Dr. Alan F. Guttmacher, a one time president of Planned Parenthood, established the Guttmacher Institute. The Institute described him this way, “no one was better able to unite the Planned Parenthood organization or summon it to carry out its historic mission.” Guttmacher’s “history” page reveals more of their connection to Planned Parenthood:

    “The Guttmacher Institute was founded in 1968 as the Center for Family Planning Program Development…The Center was originally housed within the corporate structure of Planned Parenthood Federation of America (PPFA). Its program, however, was independently developed and overseen by a National Advisory Council separate from the PPFA Board of Directors. Its early development was nurtured by Alan F. Guttmacher, an eminent obstetrician-gynecologist, teacher and writer who was PPFA’s president for more than a decade until his death in 1974. The Center was renamed in Dr. Guttmacher’s memory, and the Guttmacher Institute incorporated as an entirely independent nonprofit policy research institute with its own Board in 1977.”

The Guttmacher Institute has admitted that they were affiliated with Planned Parenthood but also say the affiliation has been terminated:

    “In 2007, Guttmacher’s special affiliation status with PPFA was terminated, and PPFA’s financial support to the Institute, then at $395,000 (3.3% of Guttmacher’s total budget), was phased out over the following three years. In 2010, PPFA’s final contribution in support of the Institute’s program, in the amount of $75,000, constituted 0.6% of Guttmacher’s nearly $13 million budget. In 2013, PPFA made a one-time contribution of $50,000 to the Cory L. Richards Memorial Scholarship Fund; this gift did not support the Institute’s programmatic work.”

The Guttmacher Institute which supports and promotes the full agenda of Planned Parenthood has been successful in convincing the media that they are the most credible source on all things “family planning” and “abortion.” They have also persuaded the media that they are totally separate from Planned Parenthood. But a glance at this 2002 annual report shows that Planned Parenthood support was 7% of Guttmacher revenue that year.

In 2010, Guttmacher’s President and CEO, Sharon Camp told CUNYTV that they were not associated with Planned Parenthood, “In 1977, call it the divorce that didn’t work because we remained for a number of years after that a special affiliate of Planned Parenthood,” the Guttmacher president said.

She then tells the host that because of those who opposed their abortion agenda they decided to completely unaffiliated from Planned Parenthood, stating, “We both, together with Planned Parenthood, decided that we needed to make the divorce final. And, so we have for the last 4 or 5 years been completely unaffiliated with Planned Parenthood.”

When Ryan Bomberger over at the Radiance Foundation heard the claim, he did some research of his own. In an article published by Life News Bomberger discovered that Planned Parenthood gave millions to Guttmacher, writing:

    “A quick look at the nation’s largest abortion chain’s 990 tax filings reveals how “completely unaffiliated” Guttmacher has been. Planned Parenthood…gave $2,142,076 of our tax dollars to their “research” arm, Guttmacher…That’s a lot of unaffiliation! Most of us would love to be “unaffiliated” with large organizations with over $1 billion in asset, as long as it’s not PPFA of course. The corporate memo apparently didn’t get to PPFA as it listed Guttmacher, in its 2007 tax filing, as an “Independent Affiliated Organization”.

Now, it has come to light that the payout between Guttmacher and Planned Parenthood has gone both ways. A review of the past 14 years of Planned Parenthood annual reports has revealed that not only has Planned Parenthood funded Guttmacher, but Guttmacher has been very generous to Planned Parenthood as well.

A look at Planned Parenthood’s 2000-2001 annual report indicates that Guttmacher gave the abortion business, $6.4 million that year. But, the payout did not end there. A review of other Planned Parenthood annual reports shows similar “contributions.

In 2001, Guttmacher funneled $16.7 million into Planned Parenthood and by the end of 2002, Guttmacher lavished Planned Parenthood with an additional $7.8 million. In 2003 Guttmacher gave Planned Parenthood $7.6 million and continued the pay-outs in 2005 when they gave Planned Parenthood $7.9 million for a total of at least $40 million.

And where would a non-profit get that kind of money? From you and I the taxpayer. In fact, as recent as 2014, the American tax payer gave $827,961 to Guttmacher.

But the 2014 figure is relatively smaller than the contributions Government agencies deposited into Guttmacher Institute’s coffers years earlier. A look at some of the organization’s annual reports reveals the following was also paid out to Guttmacher by the taxpayer:

*Note that some of Guttmacher’s annual reports indicate that they received support from Planned Parenthood or IPPF. Similarly, several Planned Parenthood reports which documented receiving Guttmacher dollars also stated that they supported Guttmacher as evidenced below.

So, in summary, the taxpayer gives money to Guttmacher and Planned Parenthood. Both support abortion, admitted they were, in fact, affiliated and both have given financial support to each other. So, the next time you read a report from Guttmacher or Planned Parenthood quotes Guttmacher as unbiased – keep this in mind.

And, one more thing, when you write that letter or call your Congressman/woman to ask them to defund Planned Parenthood, ask them to defund the Guttmacher Institute as well!

The lead investigator who exposed Planned Parenthood for harvesting aborted baby body parts has said he will unveil more tapes as millions in tax dollars are granted to PP from HHS for a teen pregnancy pregnancy.

Earlier this week, the Center for Medical Progress (CMP) unveiled a shocking three year undercover investigation into Planned Parenthood’s grisly baby body parts operation.

Video clips of CMP investigators talking with a top Planned Parenthood medical doctor casually over sips of wine about the way a buyer could obtain organs such as livers, lungs, and brains from aborted children, has received almost 2 million hits.

I think these are really horrific and troubling actions for 99 percent of Americans,” CMP’s lead investigator, David Daleiden told to CBS News.

“Planned Parenthood is still receiving $50, $75, sometimes $100 per specimen per fetal part. So all of that is just straight up profit that goes to their bottom line,” Daleiden added.

Daleiden explained his investigation to Bill O’Reilly earlier in the week and how their investigators posed as real life middlemen from biotech companies in order to get the Planned Parenthood abortionist to meet with them.

Despite denials from Cecile Richards, president of Planned Parenthood, Daleiden said he believes his deeply embedded investigation will show Planned Parenthood is involved in illegal activity.

Planned Parenthood has been involved in selling the body parts of the babies that they abort for decades now at this point,” he told O’Reilly.

Asked if he was saying that Planned Parenthood was doing “something illegal” Daleiden replied, “absolutely.

Daleiden told CBS News that his group has up to a dozen more under videos he plans to unveil soon.

HHS FUNDS PLANNED PARENTHOOD WITH MILLIONS IN TAX PAYER DOLLARS

Last week it was discovered that the Department of Health and Human Services (HHS) granted Planned Parenthood $18.5 million in federal money.

The discovery came from a press release published by the largest chain of abortion clinics, that Planned Parenthood received the $18.75 million from the Office of Adolescent Health (OAH) which is under the Department of Health and Human Services.

As Life Dynamics has previously reported, and additional $5.6 million dollars in federal money was allocated in July to various Planned Parenthood affiliates under a teen prevention program run by HHS.

That announcement came July 4, 2015 from the Office of Adolescent Health, which is responsible for implementing and administering the national, evidence based Teen Pregnancy Prevention (TPP) Program.

After hearing about the $5 million to Planned Parenthood, Life Dynamics president Mark Crutcher told OneNewsNow that Planned Parenthood is not interested in reducing the number of teen pregnancies rather they only want to reduce the number of teens that actually have their babies.

What you have to understand is that Planned Parenthood’s interest is not in reducing the number of teenage girls that get pregnant,” Crutcher alleges.

“It’s in reducing the number of teenage girls that have babies, and those are two totally different things which they often try to sell as the same thing.”

Crutcher and his team recently documented again how Planned Parenthood and the abortion industry cover child rape.

The latest report, entitled, “The Cover-Up of Child Sexual Abuse” gives horrific criminal case summaries of pedophiles who used abortion to cover their crimes. When sexual rapists take their young victims to an abortion facility or Planned Parenthood center they know that the chances they will be reported to authorities are slim.

The report also shows how the failure of abortion and Planned Parenthood clinics to comply with mandatory reporting laws is harming these minors who are often returned into the arms of their abusers after the abortion.

This week, Speaker of the House John Boehner called for congressional hearings into the practices of Planned Parenthood.

He then called for the head of HHS to denounce, and stop, Planned Parenthood’s gruesome practices.

Perhaps asking HHS to defund Planned Parenthood should be added to the Speaker’s list as well.

Her recent video is laughable.

She apologizes for the abortionist’s tone but does not deny they gather and use the body parts of aborted children.

She then refers to her “100 year history,” one that was grounded in racist eugenics I might ad.

In the video one of our staff members speaks in a way that does not reflect that compassion,” Richards states.

This is unacceptable and I personally apologize for the staff member’s tone and statements,” Richards adds.

White House protects abortion provider, allows cuts to community health centers

The American Principles Project (APP) Wednesday criticized the Obama administration for allowing the elimination of $600 million for Community Health Centers while protecting funding for Planned Parenthood as part of last week’s budget deal agreed to by Congress and the White House.

Touting Planned Parenthood as a key women’s health-care provider, Democrats held firm to their promise not to allow cuts to the nation’s largest abortion provider. Community Health Centers, which do not perform abortions, provide health services to the needy — including mammograms and pre- and post-natal care.

According to the American Principles Project last year Community Health Centers performed 320,000 mammograms while Planned Parenthood did none.

“Coating its ideology in flowery language about women’s health and alleged Republican mean-spiritedness, liberal Democrats refused to cut one dime out of Planned Parenthood’s plump federal purse during the budget debate,” said the president of APP, Frank Cannon. “All the while a sharp knife was being taken to community health centers that actually perform full-scale exams for the needy. These health centers offer prenatal care to women and their babies – 480,000 times in 2009 alone. Planned Parenthood? Their 850 clinics average less than one prenatal visit a month, in other words, it’s not their line of work.”

Following passage of the stimulus in 2009, at Unity’s Upper Cardozo Health Center in Washington, D.C., First Lady Michelle Obama praised the allocation of $851 million in grants to Community Health Centers across the country and explained their indispensability to the less fortunate.

“Community Health Centers provide care to the Americans who need it most and their work has never been more important,” said Obama. “These grants will help Unity’s Upper Cardozo and thousands of centers across the country expand and serve more Americans who simply can’t afford insurance coverage anymore.“
According to the White House these health centers serve more than 17 million patients a year.

Planned Parenthood received $349.6 million in tax dollars in the fiscal year ending on June 30, 2008, and $363.2 MILLION Dollars on Government Grants ( Tax Dollars) in 2009– that is ONE MILLION DOLLARE PER DAY of taxpayer money !!!
Planned Parenthood then took those hard earned dollars away from poor and middle class hard working people and and it paid its president, Cecile Richards, $385,163, plus another $11,876 in benefits and deferred compensation. ( View 2008 990 here )

The $385,163 in pay Planned Parenthood President Richards received in the organization’s fiscal year ending June 30, 2008 was recorded in the group’s publicly available Internal Revenue Service Form 990 filed for that year.

Richards also received $346,285 in total compensation from Planned Parenthood and $38,476 in total compensation from related groups in the organization’s fiscal year that ended on June 30, 2009, according to the organization’s Form 990 for that year.

Other Officers at the National Level received the following compensation:

CFO, MARIA ACOSTA received $89,691 from Planned Parenthood $5,725 from related organizations and $2,362 in estimated compensations

CHIEF OPERATING OFFICER MARYANA ISKANDER received $245,814 from Planned Parenthood and $23,696 in estimated compensations

VICE PRESIDENT OF DEVELOPMENT KIM MEREDITH received $220,427 from Planned Parenthood $24,492 from related organizations and $24,076 in estimated compensations. Before joining PPFA in 2006, Meredith spent nearly nine years as the chief operating officer at the now defunct and now disaffiliated Planned Parenthood Golden Gate, a Planned Parenthood clinic which sqandered tax dollars and will close and never repay their debtors .

NATIONAL POLITIC AND FIELD DIR, ELLEN GOLOMBEK received $203,843 from Planned Parenthood $10,729 from related organizations and $15,288 in estimated compensations, she has since left Planned Parenthood to work in the Colorado Governor’s Administration.

These figures do not account for each Planned Parenthood director – there are over 800 locations, making triple digits in many cases as welll….

Planned Parenthood Federation of America’s Web site shows that it performed 332,278 abortions in 2009, up 8,270 from 2008. Why should the taxpayer be forced to fund abortion?

Planned Parenthood also PROFITED $64 million dollars in that same year ! Why do they need you and I to fund them?

But, Planned Parenthood’s profits are politicians gains. Just look at this analysis from Open Secrets which monitors 501C3 organizations and how they distribute and collect their funding:

The organization’s political action committee, for example, donated more than $148,000 to federal candidates — almost all Democrats –– during the 2010 election cycle. The PAC spent more than $443,000 overall.

Planned Parenthood also recorded $905,796 in independent expenditures during the 2010 cycle — money spent in support of, or in opposition to, federal political candidates, largely through advertisements. The top beneficiaries of this money were Barbara Boxer (D-Calif.) and Patty Murray (D-Wash.).

In 2010 alone, Planned Parenthood and a California affiliate together spent more than $700,000 on federal lobbying efforts, a Center for Responsive Politics analysis of federal lobbying records finds. By comparison, all other organizations that primarily advocate for abortion rights collectively spent $247,280 on federal lobbying efforts during the same period.

So, not only does taxpayer money make Planned Parenthood officials RICH FAT CATS, they also expand the coffers of the politicians who support them- see how the cycle works?

PHILADELPHIA – A doctor whose abortion clinic was described as a filthy, foul-smelling “house of horrors” that was overlooked by regulators for years was charged Wednesday with murder, accused of delivering seven babies alive and then using scissors to kill them.

Dr. Kermit Gosnell was also charged with murder in the death of a woman who suffered an overdose of painkillers while awaiting an abortion.

In a nearly 300-page grand jury report filled with ghastly, stomach-turning detail, prosecutors said Pennsylvania regulators ignored complaints of barbaric conditions at Gosnell’s clinic, which catered to poor, immigrant and minority women in the city’s impoverished West Philadelphia section.

Prosecutors called the case a “complete regulatory collapse.”

“Pennsylvania is not a Third World country,” the district attorney’s office declared in the report. “There were several oversight agencies that stumbled upon and should have shut down Kermit Gosnell long ago.”

Gosnell, 69, was arrested and charged with eight counts of murder in all. Nine of Gosnell’s employees — including his wife, a cosmetologist who authorities say performed abortions — also were charged.

Prosecutors said Gosnell made millions of dollars over three decades performing thousands of dangerous abortions, many of them illegal late-term procedures. His clinic had no trained nurses or medical staff other than Gosnell, a family physician not certified in obstetrics or gynecology, prosecutors said.

At least two women died from the procedures, while scores more suffered perforated bowels, cervixes and uteruses, authorities said.

Under Pennsylvania law, abortions are illegal after 24 weeks of pregnancy, or just under six months, and most doctors won’t perform them after 20 weeks because of the risks, prosecutors said.

In a typical late-term abortion, the fetus is dismembered in the uterus and then removed in pieces. That is more common than the procedure opponents call “partial-birth abortion,” in which the fetus is partially extracted before being destroyed. Prosecutors said Gosnell instead delivered many of the babies alive.

He “induced labor, forced the live birth of viable babies in the sixth, seventh, eighth month of pregnancy and then killed those babies by cutting into the back of the neck with scissors and severing their spinal cord,” District Attorney Seth Williams said.

Gosnell referred to it as “snipping,” prosecutors said.

Prosecutors estimated Gosnell ended hundreds of pregnancies by cutting the spinal cords, but they said they couldn’t prosecute more cases because he destroyed files.

“These killings became so routine that no one could put an exact number on them,” the grand jury report said. “They were considered ‘standard procedure.'”

Defense attorney William J. Brennan, who represented Gosnell during the investigation, said: “Obviously, these allegations are very, very serious.”

The grand jury report came out a day after new Republican Gov. Tom Corbett took office. Spokesman Kevin Harley pledged that Corbett’s administration, through his new health secretary, would do more to oversee such clinics.

“What needs to be done is regulators, whether on the local or state or federal level, need to properly regulate, inspect and do their jobs,” Harley said. “The safety of our citizens should be first and foremost.”

Authorities raided Gosnell’s clinic early last year in search of drug violations and stumbled upon “a house of horrors,” Williams said. Bags and bottles holding aborted fetuses “were scattered throughout the building,” the district attorney said. “There were jars, lining shelves, with severed feet that he kept for no medical purpose.”

Prosecutors said the place reeked of cat urine because of the animals that were allowed to roam freely, furniture and blankets were stained with blood, instruments were not properly sterilized, and disposable medical supplies were used over and over.

Gosnell didn’t advertise, but word got around. Women came from across the city, state and region for illegal late-term abortions, authorities said. They paid $325 for first-trimester abortions and $1,600 to $3,000 for abortions up to 30 weeks. The clinic took in $10,000 to $15,000 a day, authorities said.

“People knew near and far that if you needed a late-term abortion you could go see Dr. Gosnell,” Williams said.

White women from the suburbs were ushered into a separate, slightly cleaner area because Gosnell believed they were more likely to file complaints, Williams said.

Few if any of the sedated patients knew their babies had been delivered alive and then killed, prosecutors said. Many were first-time mothers who were told they were 24 weeks pregnant, even if they were much further along, authorities said.

Prosecutors said Gosnell falsified the ultrasound examinations that determine how far along a pregnancy is, teaching his staff to hold the probe in such a way that the fetus would look smaller.

Gosnell sometimes joked about the babies, saying one was so large he could “walk me to the bus stop,” according to the report.

State regulators ignored complaints about Gosnell and the 46 lawsuits filed against him, and made just five annual inspections, most satisfactory, since the clinic opened in 1979, authorities said. The inspections stopped completely in 1993 because of what prosecutors said was the pro-abortion rights attitude that set in after Democratic Gov. Robert Casey, an abortion foe, left office.

Williams accused state Health Department officials of “utter disregard” for the safety of women undergoing abortion, and said the testimony of agency officials “enraged” the grand jury. But he said he could find no criminal offenses with which they could be charged, in part because too much time has elapsed.

“These officials were far more protective of themselves when they testified before the grand jury. Even (Health Department) lawyers, including the chief counsel, brought private attorneys with them — presumably at government expense,” the report said.

The state’s reluctance to investigate, under several administrations, may stem partly from the sensitivity of the abortion debate, Williams said. Nonetheless, he called Gosnell’s conduct a clear case of murder.

“A doctor who with scissors cuts into the necks, severing the spinal cords of living, breathing babies who would survive with proper medical attention commits murder under the law,” he said. “Regardless of one’s feelings about abortion, whatever one’s beliefs, that is the law.”

Four clinic employees were also charged with murder, and five more, including Gosnell’s wife, Pearl, with conspiracy, drug and other crimes. All were in custody. Gosnell’s wife performed extremely late-term abortions on Sundays, the report said.

One of the murder charges against Gosnell involves a woman seeking an abortion, Karnamaya Mongar, who authorities said died in 2009 because she was given too much of the painkiller Demerol and other drugs.

Gosnell wasn’t at the clinic at the time. His staff administered the drugs repeatedly as they waited for him to arrive at night, as was his custom, the grand jury found.

Mongar and her husband, Ash, had fled their native Bhutan and spent nearly 20 years in camps in Nepal. They had three children. A man who answered the phone Wednesday at a listing for Ash Mongar in Virginia did not speak English, while their daughter did not immediately return a message.

The malpractice suits filed against Gosnell include one over the death of a 22-year-old Philadelphia woman, a mother of two, who died of a bloodstream infection and a perforated uterus in 2000. Gosnell sometimes sewed up such injuries without telling the women about the complications, prosecutors said.

Gosnell earned his medical degree from Thomas Jefferson University in Philadelphia and is board certified in family practice. He started, but did not finish, a residency in obstetrics-gynecology, authorities said.

Assistant District Attorney Joanne Pescatore said: “He does not know how to do an abortion. Once he got them there, he saw dollar signs and did abortions that other people wouldn’t do.”

Planned Parenthood Drastically Increases Abortions, Decreases Adoption Referrals in 2008

Washington, DC (10 September 2010) – American Life League has revealed that Planned Parenthood Federation of America committed 324,008 abortions in 2008 – a 6.1-percent increase over 2007, reported ALL vice president Jim Sedlak.

The total number of abortions committed by Planned Parenthood since it first began in New York state in 1970 is now 4,987,817.

While abortions are on the rise at Planned Parenthood, adoption referrals declined to just 2,405 – a staggering 51-percent drop since 2007. Thus Planned Parenthood now commits 134 abortions for every adoption referral.

“Keep in mind that Planned Parenthood is a business making a very clear business decision,” said Rita Diller, national director of ALL’s Stop Planned Parenthood International (STOPP) project. “Abortion is its most lucrative ‘service,’ and like all businesses, Planned Parenthood is simply maximizing its profits from its primary moneymaker. This becomes macabre when one stops to consider that Planned Parenthood is in the business of killing preborn children. Each one of those 324,008 abortions took the life of a unique, innocent and unrepeatable human person.”

Planned Parenthood is the nation’s largest single abortionist – committing 26.8 percent of the estimated 1.21 million abortions in the United States in 2008. Planned Parenthood also runs the nation’s largest abortion chain, with over 300 medical and surgical abortion facilities across the country.

Despite the increase in abortion, Planned Parenthood showed a decline in a number of other areas, including a drop of four percent (almost 100,000 visits) in its primary customer base – female birth control customers.

While Planned Parenthood often emphasizes that it is the only provider of health care in many areas of the nation, primary-care patients accounted for only one-tenth of one percent of its business in 2008.

Planned Parenthood founder, Margaret Sanger, was a member in good standing with the racist American Eugenics Society. Sanger had board members who were known for their racist writings and Sanger published many of those in her publications. She also associated with people who praised the German Nazi Party leader- Adolf Hitler. Sanger called for parents to have a QUOTE: LICENSE TO BREED controlled by people who believed in her eugenic philosophy. She wanted all would be parents to go before her eugenic boards to request a “PERMIT TO BREED“.

Sanger also called for those who were poor and what she considered to be “morons and immoral‘ , to be shipped to colonies where they would live in “Farms and Open Spaces” dedicated to brainwashing these so-called “inferior types” into having what Sanger called, “Better moral conduct”.

I consider that the world and almost our civilization for the next twenty-five years, is going to depend upon a simple, cheap, safe contraceptive to be used in poverty stricken slums, jungles, and among the most ignorant people. Even this will not be sufficient, because I believe that now, immediately, there should be national sterilization for certain dysgenic types of our population who are being encouraged to breed and would die out were the government not feeding them.

The New York Times is reporting: I.R.S. Looks at Finances of Planned Parenthood By KATHARINE MIESZKOWSKI 9/2/2010

The criminal division of the Internal Revenue Service is looking into the finances of Planned Parenthood Golden Gate, while the organization has brought in forensic accountants to evaluate its books.

The local nonprofit became Golden Gate Community Health on Friday, as the national Planned Parenthood organization stripped the Bay Area clinics of their affiliation, citing financial and administrative problems.

“It’s exactly the same entity with just a different name,” said Therese Wilson, interim chief executive of the new organization.

Agents for the criminal division of the I.R.S. interviewed a former employee of Planned Parenthood Golden Gate on Tuesday at the Oakland field office, in response to a complaint he had lodged.

That informant, who declined to be named for fear of how it might affect his future job prospects, said he raised concerns about the financial relationship between the organization and its political arm, as well as about accounting practices.

Jennifer Fong, a special agent for the I.R.S., declined to comment on whether an investigation was under way. “We don’t give specific details as to what we do to evaluate or investigate information we receive,” Ms. Fong said.

According to the Bay Citizen:

On October 21, 2008, 30 clinicians and doctors who work for PPGG sent a “letter of concern” to CEO Dian Harrison. The letter was also copied to Cecile Richards, the president of Planned Parenthood, and other executives at the national organization.

In the letter, the clinicians detail a myriad of problems in the organization, including their concerns about “the misappropriation and mismanagement of PPGG’s funds.” The letter accuses the executive staff of profligate spending during lean times:

Executive staff’s personal expenditures are excessive and are not aligned with the mandatory fiscal restrictions. Flagrant use of PPGG funds to pay for personal belongings, personal services and exorbitant technology products is seemingly unchallenged and not subject to the same financial scrutiny that clinic supplies and staff salaries are, for example.

The IRS should consider the fact that news of Planned Parenthood Golden Gate’s pattern of fraud, misappropriation of funds, mismanagement may not be a one time occurrence. In fact, I believe that the IRS should investigate all the offices since they get millions of tax dollars per year from the government?

Here are my reasons:

In 2008, Planned Parenthood cut ties with several South Florida offices for accusations of “terrible mismanagement and possibly fraud,” alleged sexual harassment against a former CEO, and a rumor that its 2006 annual report was plagiarized:

One of the nation’s best-known groups of health centers has permanently shut down a cluster of clinics in Broward and Palm Beach counties.

Planned Parenthood officially severed its ties Monday with five local clinics — four in Broward and one in Boca Raton — whose top administrator has acknowledged a history of “terrible mismanagement and possibly fraud.”

The disaffiliation allowed the national organization to wash its hands of the local chapter once known as Planned Parenthood of South Palm Beach and Broward Counties.

The chapter is dealing with many problems, including harassment complaints and possible misuse of nearly $450,000 — slightly less than they received in public funding in 2005.

“All these issues are now issues that they will have to face without us,” said Karen Ruffato, vice president of operations for the Planned Parenthood Federation of America.

The attitude has angered Ruth Lynch, the former Broward chapter’s CEO, who said the national organization bailed out before the local chapter could resolve its problems.

Lynch, who replaced former CEO Mary Capobianco in March, said that within two weeks of her arrival she found she could not account for $440,000 of the chapter’s $3 million budget.

“We take responsibility that there was horrible management,” Lynch said. “But that was then. This is now. We have a new board.”

CHAPTER’S PLANS

Lynch said that the chapter’s board of trustees plans to eventually open and continue medical services at the five clinics — in Oakland Park, Fort Lauderdale, Pembroke Pines, Deerfield Beach and Boca Raton — but without the trusted name of Planned Parenthood, one of the nation’s most recognized clinics in the field of reproductive heathcare.

“We don’t feel this was simple disaffiliation, we feel this was a hostile takeover,” Lynch said.

“And it was more about the Planned Parenthood trademark than it was about helping the community.”

At least 16,000 people used the five clinics for services such as breast exams, testing for HIV and abortions. In 2005, it received $500,000 in taxpayer funding.

HARSH REVIEW

The disbanding of the relationship ended a months-long back and forth between the Broward chapter and the national organization, which temporarily shut down the clinics in March after delivering a harsh review about the chapter’s administration.

Popular employees were fired. An employee alleged sexual harassment against a former CEO, Capobianco. The local board was investigating a rumor that its 2006 annual report was plagiarized.

SHUT DOWN

Ruffato said Planned Parenthood wanted to disaffiliate from the Broward chapter as soon as possible.

By March, the clinics were temporarily shut down.

They began the process in April to permanently strip the five clinics of the Planned Parenthood name.

Instead, Ruffato said they entrusted the more-reputable Planned Parenthood of Greater Miami, Palm Beach and the Treasure Coast to open one clinic in Broward and one in Boca Raton.

Ruffato said the Greater Miami chapter is one of the country’s best.

‘UNFORTUNATE’

“This is a very rare situation and a very unfortunate situation,” Ruffato said. “And as sad and as hard as moving through a disaffiliation is, I believe our ultimate responsibility is to the mission. And ultimately we need to make sure that your community clinic has the best healthcare and meets our high standards.”

For now, Planned Parenthood is concentrating on replacing the five clinics with at least two, said Judith Selzer, spokeswoman for the Greater Miami chapter. Officers plan to select one site by next month.

Selzer said they will add clinics “as quickly and swiftly as the community needs.”

The chapter plans to include Broward residents on the staff and board of trustees.

Said Selzer: “We’re poised and we’re ready to do this.”

An Audit Shows Planned Parenthood Owes Thousands, sources say debt stands at $1 million

EL PASO, Texas — KFOX has confirmed Friday that Planned Parenthood Center of El Paso owes more than $150,000 to the county’s University Medical Center.

Through an open records request, KFOX has learned that PPCEP owes UMC $154,814. Sources close to PPCEP claim their total debt stands at more than $1 million.

University Medical Center declined any comment on PPCEP’s current balance. They did not disclose what type of contract was established.

As KFOX reported, a state audit found that PPCEP violated its state contracts after it requested reimbursement for bills that were never paid.

State representatives have told KFOX that it is unclear if the money will ever be collected, and PPCEP is currently under bankruptcy protection.

Planned Parenthood Golden Gate’s former employees blame the organization’s longstanding pattern of financial mismanagement, former PPGG CEO, Dian Harrison. Because of this, the national Planned Parenthood organization has announced it will divorce itself from the networks of clinics that serve patients in five Bay Area counties, citing fiscal and administrative problems with the local organization. Effective Sept. 3, 2010, Planned Parenthood Golden Gate must operate under another name, a representative of the national organization said that Planned Parenthood Golden Gate had failed to uphold the “standards and guidelines” by which each separately incorporated affiliate must abide, but that the details of the situation were confidential.

“They were not meeting our standards for administrative and fiscal management,” said Karen Ruffato, vice president of affiliate services for the national organization.

A report in the Bay Citizen:

The most recent tax documents filed with the I.R.S. suggest that PPGG has not only been losing money in recent years, but is in financial disarray. For the tax year ending June 30, 2009, it showed a loss of $2.8 million.

Yet, from financial information for the previous year, it’s unclear just how much money the organization lost because it filed three separate sets of numbers with the I.R.S. In the filings, losses ranged between nearly $1.9 and $2.8 million. Two different accounting firms signed off on the various filings.

Tax documents also show that the organization’s financial problems did not start with the catastrophic recession and California’s fiscal crisis, which has delayed MediCal reimbursements from the state. Tax documents for the year ending June 30, 2007 show that the organization lost $181,000 that year.

Yet, the organization’s fiscal problems date farther back. Documents associated with a 2004 accreditation review of Planned Parenthood Golden Gate show that the local affiliate did not meet the national federation’s financial standards for its affiliates. Of nine indicators of financial health, Planned Parenthood Golden Gate was given a “not met” rating for five of them. For instance, the affiliate had only 11.4 days of cash on hand, as opposed to the required 60 days.

Planned Parenthood Federation of America executives refused to comment on the accreditation documents on the grounds that they’re internal and confidential.
On Wednesday, the charitable trusts division of the state’s attorney general’s office sent a warning letter to the Planned Parenthood Golden Gate Action Fund, the political advocacy and public policy arm of the affiliate, because the organization has failed to file copies of its tax documents with that that office for at least 10 years.
“We do not have any reports on file for them,” Rebecca MacLaren from the attorney general’s press office wrote in an e-mail.

The warning cautioned that if the organization fails to file those forms within 30 days, its registration would be suspended and officers would be personally liable for late fees.

In the letter, the clinicians detail a myriad of problems in the organization, including their concerns about “the misappropriation and mismanagement of PPGG’s funds.” The letter accuses the executive staff of profligate spending during lean times:

It is apparent that while Medical Services has been mandated and has complied with financial reform and cost savings, the Executive Administrative members have failed to adhere to their own mandate for financial restrictions. Executive staff’s personal expenditures are excessive and are not aligned with the mandatory fiscal restrictions. Flagrant use of PPGG funds to pay for personal belongings, personal services and exorbitant technology products is seemingly unchallenged and not subject to the same financial scrutiny that clinic supplies and staff salaries are, for example.

When Harrison replied to their concerns in a letter dated November 14, 2008, she assured the clinicians and doctors that administration was feeling the fiscal pain, too: “Administration has temporarily or permanently frozen a number of positions, budgets were cut, expenses were halted for a period of time and office supplies were not purchased,” she wrote.

This week’s announcement that Planned Parenthood Federation of America (PPFA) was severing ties with Planned Parenthood Golden Gate (PPGG) came as no surprise to some former employees, who have for months been trying to sound the alarm that the chapter was being mismanaged, had major financial problems, and was in a steep decline that could threaten important reproductive care services that low-income women rely on.

A former PPGG employee with knowledge of the organization’s internal affairs described a longstanding pattern of financial mismanagement when former president and CEO Dian Harrison was at the helm. There was widespread concern about spending on expensive marketing campaigns and lavish functions, the person said, and a high level of employee turnover and discontent.

Warning signs of financial difficulties surfaced at least a year ago. Dan Cohen, a spokesperson of the Packard Foundation — a major donor to PPGG — told the Guardian that Packard awarded PPGG a 12-month, $30,000 “organizational effectiveness” grant, which will expire in September. The grant “allows an organization to select a talented, external provider to help them think through some of these challenges,” Cohen explained. The Packard Foundation also awarded a 3-year grant for general operating support for $800,000, which will also expire next month.

Another former employee told the Guardian that she would love to discuss internal problems, but was made to sign a confidentiality agreement upon leaving the organization.

Therese Wilson, executive vice president of Planned Parenthood Golden Gate — who took over PPGG when Harrison left last year on medical leave — did not return repeated calls seeking comment.

An internal PPGG document provided to the Guardian displays the agency’s on-hand cash reserves as compared with other affiliates, suggesting that the reserve ratios were at or below the minimum required by the national Planned Parenthood federation for all but one year from 1998 to 2007 — and well below that of other affiliates of similar size. That is a key requirement for meeting accreditation standards.

When we asked Elizabeth Toledo, a PPFA representative, about this apparent pattern she said she could not comment because she had not seen the documents. She also said the accreditation reviews were confidential. “Understanding the true financial picture for health care providers takes a very in-depth evaluation,” Toledo said. “PPFA and PPGG were working together over the last few years to resolve fiscal challenges.”

Despite delays at the state level in awarding nonprofit funding and the loss of support from the national organization, Toledo and a union representative for PPGG employees both said they believe the clinics will continue serving patients under a different name.

“They plan to stay open, and employees are planning to stay,” said SEIU Local 1021 representative Sarah Sherpun-Zimmer, who has been a union rep for PPGG employees for the last two years. “Folks are really happy working there and they feel like it’s going in a good direction.”

PPGG operated eight clinics, which will lose their Planned Parenthood accreditation Sept. 3, effectively severing their ties to a trusted entity that thousands of low-income women rely upon for birth control, abortion procedures, and other forms of reproductive health care. PPGG operates clinics in San Francisco, Alameda, San Mateo, Sonoma, Marin, and Mendocino counties, serving about 55,000 women per year.

Roughly 92 percent of the clients they serve live at or below the federal poverty line, according to PPGG’s 2008 annual report.

Planned Parenthood affiliates Mar Monte and Shasta Diablo are in the process of hatching plans for taking over some of the eight affected clinics or otherwise growing their own operations to cover any gaps in service area, according to Toledo. She said neighboring affiliates are in a position financially to be able to cover a wider territory and added that they have been in “expansion mode,” adding new clinics over the past couple years.

“It’s unusual to have a disaffiliation,” she said. “But it’s not unusual for national committees to have a reallocation of service area. That part is well-practiced.” Toledo added that “Every effort possible will be made” to ensure continuity of care.

Planned Parenthood’s missing millions, New GAO report reveals disturbing financial discrepancies

According to Rita Dillar , a new report from the U.S. Government Accountability Office (GAO) on federal tax money funneled into Planned Parenthood and similar organizations raises more questions than it answers about the nation’s largest abortion chain.

Planned Parenthood Federation of America’s (PPFA) audits show the organization spent just $657.1 million between 2002 and 2008 from federal government grants and programs, but the abortion behemoth’s own annual reports show that it took in $2.3 billion from government grants and programs during the same time period.

That’s not pocket change. Why the discrepancy?

The report (the first of its kind since 2002) was released in response to a request from 31 U.S. senators and representatives and in an atmosphere increasingly hostile to abortion. Not surprisingly. then, its findings are fueling an escalating outcry to defund Planned Parenthood.

Since 2009, at least five nationwide polls have confirmed that a majority of Americans consider themselves pro-life.

Someone, then, needs to explain to all those people why $2.3 billion in tax dollars have been doled out to an organization that admits to systematically having killed more than 1.8 million pre-born babies between 2002 and 2008 and then reports it only spent $657.1 million in federal dollars.

Has Planned Parenthood managed to tuck away megamillions of our tax dollars, seemingly unnoticed? Or is that much of its government funding coming from sources other than the federal government? Or is there a problem with the way Planned Parenthood is reporting its expenditure of our federal monies?

In just two weeks, Planned Parenthood will complete its 2009-10 fiscal year. Yet it still has not released its annual report for its 2008-09 fiscal year. In light of the discrepancy revealed in this GAO report, we must ask: What is Planned Parenthood trying to keep secret?

It’s time for Planned Parenthood to come clean – if such a thing is possible.

Yes, Planned Parenthood has other sources of government funding – state and local – but historical data indicate it is simply not believable that such a large amount of its funding is from local and state sources.

GAO reports for prior years show that from 1997 through 2001, PPFA expenditures of federal money accounted for an average of 72 percent of its government income.

Yet this new report shows PPFA expenditures of federal money making up an average of just 32 percent of its government income from 2002 through 2008.

Planned Parenthood’s abortion business has increased year after year in lock step with its increasing government funding, as evidenced by the included chart.

Obviously, every penny Planned Parenthood receives feeds its abortion business in one way or another.

For instance, Title X money is not to be used for abortions. However, according to Abby Johnson, former director of Planned Parenthood’s abortion center in Bryan/College Station, Texas, it is used to gain the trust of women in minority neighborhoods in order to bring them into Planned Parenthood facilities, supposedly for health care, and then persuade them to become Planned Parenthood birth-control clients. Then, when the birth control fails, the organization has a built-in minority clientele for abortion, which Ms. Johnson says is Planned Parenthood’s big cash cow.

Planned Parenthood affiliates continue to build huge abortion megacenters in minority neighborhoods in an attempt to polish its image and gear up for the veritable tsunami of clients that will be headed its way under President Obama’s health care plan, which earmarks $11 billion for community health centers.

Is there no end to the amount of our hard-earned tax dollars that will be poured down the bottomless pit known as Planned Parenthood to quench this social-engineering agency’s thirst for sexualizing our children, stealing their souls and dumping the mutilated bodies of our children’s children into our nation’s waste bins?

On May 14, Gallup produced its third consecutive poll showing that most Americans identify themselves as pro-life. It is unthinkable that American citizens continue to be forced to fund, by the sweat of their brows, the organization that commits one-third of our nation’s abortions.

A 2010 article in the Philadelphia Bulletin headlined: Federal Funds Misappropriated By New Jersey Family Planning, Planned Parenthood By KATHLEEN GILBERT on August 24, 2010 reads:

TRENTON, N.J. – Audits by the United States Inspector General (IG) have uncovered that family planning clinics, including Planned Parenthood, have improperly taken Medicaid reimbursement for family planning services.

The audits were released by New Jersey Right to Life (NJ RTL) as pro-abortion state lawmakers lobby not only to restore $7.5 million in state family planning funds, but to acquire a federal waiver that would permanently secure the 90 percent Medicaid reimbursement rate for family planning clinics. Pro-life Governor Chris Christie has withdrawn a waiver application and, last month, vetoed an attempt to restore the state funding, a move lawmakers are angling to override.

While the state of New Jersey has taken responsibility for the incorrect recording of services, the audits leave open the question of how far the clinics themselves were complicit in the misappropriation of funds. The reports show that a total of almost $3 million was misappropriated over the course of 2001-2005.

One report, issued in 2008, singled out Planned Parenthood providers as guilty of billing all claims to Medicaid as “family planning,” including services that did not meet federal criteria for the 90 percent reimbursement rate. The normal Medicaid reimbursement rate is about 50 percent. In that report, the state was urged to reimburse almost $600,000 in Medicaid funds, and to amend their billing processes.

Instead of services that “prevent or delay pregnancy,” which are eligible for the waiver, the report found that services such as treatment for swollen ankles and a rash were listed as “family planning,” as well as other services administered to patients well beyond childbearing age. Others simply lacked documentation.

Another 2008 report found New Jersey to have improperly received reimbursement for 111 of 161 examined claims, requesting over $160,000 to be returned. A 2007 report requested the return of over $2.2 million thanks to the state of New Jersey incorrectly designating 227 National Drug Codes as related to family planning.

“The facts cannot be denied,” said New Jersey Right to Life in a press release. “Planned Parenthood’s supporters not only want to use $7.5M in taxpayer dollars to fund these family planning clinics, they also want the state of New Jersey to permanently apply for a federal waiver to reimburse family planning clinics 90 percent for every Medicaid service they provide despite the clinics’ history of improperly billing Medicaid and contributing to the nearly $3M in fees calculated by the Federal Government to be refunded to them.”

“Taxpayers should be outraged”

NJ RTL Executive Director Marie Tasy expressed disappointment that the IG audits went unnoticed as Planned Parenthood gained favor with the media during its fight for more taxpayer funds. “It’s sinful that the press did not do their homework when this issue was being used in the news,” Ms. Tasy told LifeSiteNews.com, adding that the arrogance behind the misappropriation “is astounding.”

Whether it’s Planned Parenthood or the state’s fault, she said, the audits reveal a “systematic abuse” that funnels taxpayer cash towards family planning.

Also in 2010 , the United States Court of Appeals for the Ninth Circuit has ruled in favor of the American Center for Law and Justice’s (ACLJ) client in a multi-million dollar fraud case against Planned Parenthood (PP) affiliates in California. ACLJ attorneys are representing a former employee of the PP affiliate in Los Angeles, who is now a federal whistleblower. A federal district court in California had dismissed the case, but the Ninth Circuit’s ruling, dated yesterday, reinstates the lawsuit.

“The question on appeal was whether the former PP employee is a proper whistleblower under the False Claims Act”

“This is a tremendous victory,” said Jay Sekulow, Chief Counsel of the ACLJ. “While this case is by no means over, winning this appeal means we have gotten the federal claim over the threshold hurdles and can now get down to the heart of this case: the alleged fraud.”

The federal False Claims Act (FCA) forbids government contractors from submitting “false or fraudulent” claims for payment. The FCA also authorizes private individuals to bring suit against the offenders to recover the fraudulently obtained funds.

The allegation in this case is that PP affiliates in California illegally marked up the supposed cost of various birth control drugs when seeking government reimbursement, resulting in tens of millions of dollars of overbilling – at taxpayer expense. State audits in both California and Washington State have found PP affiliates guilty of overbilling.

When a former PP staffer sued the PP affiliates in federal court, charging the defendants with having fraudulently overbilled the state and federal governments in the amount of tens of millions of dollars, a prominent law firm began representing the PP defendants in the case at no cost to the defendants. The PP attorneys asked the federal district court to dismiss the case on technical jurisdictional grounds.

The federal district court accepted their arguments in part, and dismissed the case. ACLJ attorneys then entered the case to handle the appeal.
“The question on appeal was whether the former PP employee is a proper whistleblower under the False Claims Act,” said Sekulow. “We contended that the answer is ‘Yes,’ and now a three-judge panel of the Ninth Circuit has unanimously agreed with us.”

This report by Texas Watchdog from August 26,2010 shows a campaign manager for Planned Parenthood in Texas was fined. Planned Parenthood of North Texas PAC fined $3,000 for campaign finance violations

The Texas Ethics Commission has fined Cary Jennings, the campaign treasurer for Planned Parenthood of North Texas‘ political action committee, $3,000 for failing to disclose spending $26,695 to support four political candidates in the November, 2008 state elections.

The Ethics Commission also found Planned Parenthood of North Texas Action Fund Political Committee had either failed to report or made mistakes with political contribution and expenditure totals on more than 17 monthly reports required by state law.

The political action committee in a November 2008 report said it spent $26,695 for mass mailings the previous month. However, the report failed to say the mailings were made in support of Wendy Davis, who was running for state Senate and Dan Barrett, Carol Kent and Chris Turner, who were running for state House seats, according to the Ethics Commission findings.

The following month, the political action committee reported spending $15,410 in one day to the same company for a blitz of campaign telephone calls on behalf of Davis, Kent, Turner and Robert Miklos, who was running for the House. The Commission took note that this disclosure of candidate support was not reflected on the report’s cover page.

The committee filed 17 corrected campaign finance reports on Sept. 14, 2009. Texas Watchdog has a call in to Planned Parenthood, and will update the blog if we hear back from the group here .
