Daleiden: sale of fetal tissue business model for most Planned Parenthood affiliates

The mastermind behind undercover videos which has resulted in Planned Parenthood being defunded in several states, claims that the sale of fetal tissue was the business model for most Planned Parenthood affiliates and shares behind the scenes information about the investigation.

The allegations came in a recent interview the Washington Examiner conducted with Center for Medical Progress (CMP) founder, David Daleiden. CMP’s series of undercover footage documented Planned Parenthood officials negotiating for the body parts of babies they aborted. Daleiden, who described his expertise as “hands-on immersion” in “regenerative medicine and stem cell science,” told the news outlet:


    “It’s definitely a little bit of a difficult toss-up between profiteering off of fetal tissue versus doing illegal abortion methods. I think it is easier to prove, and the evidence is best, for Planned Parenthood’s illegal profiteering. In order to prove partial-birth abortion, you kind of need to have the body or someone in the procedure room. But in terms of the for-profit sale of fetal tissue, it’s very clearly the business model Planned Parenthood was using at most of their affiliates.

    “In that model, where you have an outside procurement company sending harvesting technicians into the clinics to do all the work of fetal tissue collection, for Planned Parenthood it’s free. There’s no cost to Planned Parenthood to do that, and yet they’re still getting paid per fetal organ by these companies. There’s no way that model is legally defensible.”

Daleiden is referring to Planned Parenthood’s procurement company Stem Express whose former employee went on record with CMP to tell how she was instructed to cut an aborted baby’s face in half to get brain tissue. As Live Action News previously reported, Holly O’Donnell, shared grisly details about cutting the chin of the baby upward on the child’s face to obtain an intact brain. O’Donnell, who quit shortly after this experience, testified in the CMP video that when her supervisor tapped the baby’s heart, it started beating again.

Daleiden told the Examiner that at the time CMP put out the first video, it had been 15 years since the last time the trafficking of aborted fetal tissue had been in the news. He was referring to a shocking investigation conducted by Life Dynamics in 1997. In his analysis of that investigation, Life Dynamics president, Mark Crutcher noted that the process of selling aborted babies is not illegal.

    “On the surface, this is not illegal. In fact, this process is used in all sorts of medical clinics across the country for medical research. The loophole is that site fees and retrieval reimbursement amounts are unregulated. The law requires that such payments be reasonable and reflect the actual cost of securing the parts; but there are no state or federal laws which establish guidelines or set limits regarding these payments, and no one is appointed to oversee the system.”

In 1999, after Crutcher’s investigation, the United States General Accounting Office (GAO) issued a report on the sale of aborted baby body parts and estimated that the National Institutes of Health (NIH) had awarded approximately $17.0 million for 103 research grants using human fetal tissue that year. The GAO report stated that principal investigators who responded to the GAO survey acquired 12,116 human fetal tissue samples in fiscal years 1997 through 1999 for use in NIH- sponsored research.

Unlike what we see in the CMP videos where high ranking officials haggled over the costs of baby parts, with one Planned Parenthood medical director joking that she wants “a Lamborghini” before negotiating for $150.00 a “specimen,” the GAO had found that the costs of acquiring human fetal tissue were “generally low.”

The GAO noted in their report that more than four-fifths of the researchers who received tissue from health clinics i.e. abortion clinics paid no fee. “The fees per sample of human fetal tissue from health clinics ranged from $2 to $75, with an average of $22,” they wrote.

“In fiscal year 1999, 49 percent of the principal investigators in our survey received human fetal tissue without paying an acquisition fee. Among those who did pay an acquisition fee, the average fee per sample was $80 in fiscal year 1999. The median number of tissue samples received by principal investigators in fiscal year 1999 was 26.”

Daleiden, who described his role in the undercover sting as “the nerdy science geek persona to portray,” spoke about his interaction with abortionist Mary Gatter as one which gave him some concern as an undercover operative:

“For a long period of that lunch she was very tense and was quite aggressive in her questioning of myself. After that meeting I was concerned for a couple of days as to what Dr. Gatter’s suspicion level might have been, but then we saw her again at the Planned Parenthood medical directors meeting and she was perfectly friendly and congenial, so I came to learn that was her personality. She has that ornery personality when she first meets you and then warms up to you later.”

He then opened up a little about his friendship with Planned Parenthood Federation Senior Director of Medical Services, Dr. Deborah Nucatola. She was featured in CMP’s first video where she shockingly explains how she would, “crush below” and “crush above” to “see if I can get it all intact.”

“Deb [Nucatola] was our best friend the whole time. I still consider her a friend. I don’t know how she feels about me,” the CMP founder stated.

Daleiden was recently indicted by a Houston grand jury for, of all things, allegedly offering to purchase fetal organs. But he defends his actions by pointing out that undercover stings are commonly used by investigative journalists.

“For the public at large, undercover work, I think most people realize, is a key part of both journalism and law enforcement and most people really don’t find that controversial.”

When the Examiner asked Daleiden about the fact that no one has proven Planned Parenthood broke the law, he responded by explaining that, “even the contractors themselves, Stem Express and other companies, make it clear the payments are on a per specimen basis and Planned Parenthood only gets the payments if the specimen is a high enough quality so it meets the specifications.” He later points out that Planned Parenthood has never accused him of saying anything that was not true:

“It’s interesting that the lawsuit Planned Parenthood filed kind of threw everything but the kitchen sink at me, but the one thing they did not sue for is defamation. They are upset by the way we went about doing it, but they are not claiming in a legal sense that we said anything that was untrue.”

The CMP founder said that his work has made him a target and admitted receiving death threats and other threats of bodily harm. But, He reiterated that his focus and that of CMP remains “on investigative journalism with a focus on bioethical issues that impact human dignity in a significant way.” Of the upcoming Congressional hearings into the use of baby parts, Daleiden said that he was pleased, “I was hoping for maybe just one congressional investigation after we released the videos … it turns out there were five,” he said.

Earlier this month, the chair of a U.S. House investigative panel announced that they issued subpoenas to Stem Express and two other agencies in order to obtain documents regarding the possible sale of aborted baby body parts. According to Rep. Marsha Blackburn (R-TN) who chairs the Select Investigative Panel on Infant Lives the first hearing will be held on Wednesday, March 2, 2016.

Although Daleiden hinted that CMP may have other investigations in the works, he said that right now he remains focused on exposing Planned Parenthood grisly baby parts operation and noted that, “there’s still plenty of unreleased footage” to be released.

Dispelling Planned Parenthood’s claim that abortion is only 3% of the services it offers.

As Center for Medical Progress videos showing Planned Parenthood’s gruesome baby parts harvesting operation make their way into the homes of many Americans, the abortion biz is regurgitating an old myth, that abortion is a small percent of what Planned Parenthood does.

In 2013, Planned Parenthood reported performing 327,653 abortions.

In 2012, they reported 327,166 abortions and in 2011, they admitted to killing 333,964 unborn children through abortion.

A few years ago, Life Dynamics president, Mark Crutcher, addressed Planned Parenthood’s claim that abortion is only 3% of what they do.

Do you find it strange that whenever someone correctly points out that Planned Parenthood is the nation’s number one abortion profiteer, Planned Parenthood enthusiasts tie themselves up in knots trying to sell the lie that abortion is only 3 percent of what they do?” Crutcher asked in a video posted to YouTube.

“Of course, this is like defending the Ku Klux Klan by claiming that lynching is only 3 percent of what they do, but I’ll leave that issue for another time. After all, I don’t want the Klan to come after me for comparing them to Planned Parenthood,” he states in his video message.

Crutcher points out that when there is even the most innocuous legislation proposed that might have the effect of reducing the abortion rate even a tiny amount, Planned Parenthood will oppose it claiming that restricting abortion will shut down all their clinics.

Cruther asked that if abortions are only a small percent of what Planned Parenthood does, why would Planned Parenthood say they will have to close down their clinics if abortion is restricted?

The only plausible answer is baby killing is a lot more than 3 percent of their profit. And that’s the reality. The bottom line is that this is just one more pro-choice lie. These people know exactly how barbaric abortion is, and they are desperate to do whatever they can to advocate it without being linked to it. And that’s another reason why they are losing this battle,” he stated.

According to the pro-life group, Students for Life (SFL), “Planned Parenthood preys off young girls in crisis, locating right near our high schools and college campuses, telling them abortion is their only real option in their moment of desperation,” the largest pro-life student organization says on their website.

SFL research found that 79% of Planned Parenthood centers are located within 5 miles of a college campus.

Students for Life used Planned Parenthood’s 2013 annual report and noted the following:

    Planned Parenthood facilities performed 327,653
    This means they committed 897 abortions every single day.
    And 94% of Planned Parenthood’s pregnancy services were abortions.
    Planned Parenthood received $528.4 million in U.S. taxpayer funding, making up 46% of their annual revenue.

Since 2009:

    Planned Parenthood’s contraceptive services have dropped by 7%, and their cancer screening and prevention services have dropped by 50%.
    Planned Parenthood has performed over 1.9 million abortions.
    And their U.S. taxpayer funding has increased by 46%.

Research from Rita Dillar, national director of American Life League’s Stop Planned Parenthood Project, showed that Planned Parenthood, which wants to normalize abortion, committed 31.6 percent of all abortions in the United States in 2011.

In other words, she says, Planned Parenthood committed one out of every three abortions in the United States in 2011.

Diller didn’t just look at 2011 she compared abortion figures based on the Guttmacher report entitled “Abortion Incidence and Service Availability in the United States, 2011,” and Planned Parenthood’s annual reports, showing Planned Parenthood’s ever-increasing share of the U.S. abortion market and found the following:

    Planned Parenthood committed 31.6% of abortions nationwide in 2011
    Planned Parenthood committed 23.3% of abortions nationwide in 2006
    Planned Parenthood committed 16.5% of abortions nationwide in 2001
    Planned Parenthood committed 11.3% of abortions nationwide in 1996
    Planned Parenthood committed 8.5% of abortions nationwide in 1991
    Planned Parenthood committed 6.2% of abortions nationwide in 1986

Writing for Breitbart, Austin Ruse, who heads the Center for Family and Human Rights (C-Fam) , called Planned Parenthood’s 3% claim an enormousness lie.

It is fairly easy to look behind the claim, however, and do it using “the organization’s own data.” Ruse writes.

“Planned Parenthood arrives at this percentage by dividing 330,000 annual abortions into 11,000,000 annual “services.” All “services” are therefore equal…and abortion is the most expensive service Planned Parenthood provides,” he adds.

The 3 percent figure is an artifice and a dodge, but even taking it on its own terms, it’s not much of a defense. Only Planned Parenthood would think saying that they only kill babies 3 percent of the time is something to brag about. How much credit would we give someone for saying he only drives drunk 3 percent of the time, or only cheats on business trips 3 percent of the time, or only hits his wife during 3 percent of domestic disputes?” Lowry says.

Adding:

    By its own accounting in its 2013–2014 annual report, it provides about as many abortions as Pap tests (380,000).

    The group does more breast exams and provides more breast-care services (490,000), but not by that much.

    The 3 percent figure is an artifice and a dodge, but even taking it on its own terms, it’s not much of a defense.

    The 3 percent figure is derived by counting abortion as just another service like much less consequential services. So abortion is considered a service no different than a pregnancy test (1.1 million), even though a box with two pregnancy tests can be procured from the local drugstore for less than $10.

    By Planned Parenthood’s math, a woman who gets an abortion but also a pregnancy test, an STD test, and some contraceptives has received four services, and only 25 percent of them are abortion. This is a little like performing an abortion and giving a woman an aspirin, and saying only half of what you do is abortion.

While all this seems great if you are pro-life, the claim has also been criticized by an abortion leaning online media outlet.

A 2013 article , published in Slate Magazine, not known for being pro-life on abortion, called Planned Parenthood’s claim that abortion is 3% of all it’s services, “the most meaning abortion stat ever.”

From the report:

    Amanda, it’s been so long since I’ve seen a reference to the claim that abortions make up only 3 percent of the services that Planned Parenthood provides that I thought maybe they’d stopped trying. It might not be a technically incorrect number, but it is meaningless—to the point of being downright silly— for several reasons. Not the least of which being that Planned Parenthood “unbundles” all of its services so that a pack of pills, an STD test and an exam are three separate services.

    It’s impossible to know how much money Planned Parenthood brings in for abortion. Because as specific as the annual report is about the number of services it provides, it’s far less detailed when talking about where its revenue comes from (They are within their rights, so whatever). But it’s easy to calculate, as the Weekly Standard did, that Planned Parenthood gets at least a third of its clinic income—and more than 10 percent of all its revenue, government funding included—from its abortion procedures.

    Ask anyone who runs a for-profit business or nonprofit charity if something that brings in one-third of their revenue is “central” to their endeavor, and the answer is likely to be yes. So yes, abortion is central to what Planned Parenthood does.

Civil Rights matter to everyone not just those who survive the womb

51 years ago today, President Lyndon B. Johnson signed the Civil Rights Act of 1964 outlawing racial discrimination in public accommodations such as hotels, theaters, parks, restaurants, and other public places.

The Act guaranteed full and equal enjoyment of goods and services and public accommodations without discriminating or segregating on the basis of race, color, religion, or national origin.

LBJ signed the document protecting the basic civil rights of minorities, stating that, “It’s purpose is not to divide but to end divisions,” he said.

Life Dynamics‘ president Mark Crutcher points out that this nation still has a long way to go in protecting the rights of all Black people.

What we learned in Maafa21 tells us we still have a long way top go,” Crutcher stated.

Maafa21 documents how the Black community has been targeted with eugenics trough abortion and birth control since the days of slavery and the plot is still being carried out to this day.

Sadly, Life Dynamics also uncovered that Johnson was not without his flaws.

As Life Dynamics points out in the film, during the 1960’s a growing number of civil-rights activists discovered that that “family planning” was a code word for abortion and birth control and that it was being pushed by the government as way to avoid putting money into the black community.

One of those who pushed this plan was the Democrat President, who, in June of 1965, stated that every five dollars the government spent on population control was worth more than a hundred dollars invested in economic growth.

Then, at the urging of Republican Congressman, George Bush, Johnson became the first U.S. president to endorse federal funding for birth control.

In 1966, LBJ would also accept Planned Parenthood’s highest award, the Margaret Sanger Award, for his policies pushing family planning on foreign countries.

Sanger founded Planned Parenthood and in her autobiography she discussed a speech she gave at a Ku Klux Klan rally in Silver Lake New Jersey. She bragged about the fact that, afterward, she was invited by 12 other Klan chapters to speak at their events. Sanger wrote that she found the Klan to be an interesting group.

It was at about this same time that political leaders from both parties began to increase their demands that aid to the poor – whether abroad or within the United States – be tied to birth control.

In 1965, former Republican President, Dwight Eisenhower, complained that the United States was spending money to slow the population growth of responsible families while at the same time providing financial incentives for ignorant, feebleminded and lazy people to have more babies.

He said that history would rightly condemn the United States if we didn’t link welfare to family-planning.

At that time, Eisenhower was the co-chairman of a Planned Parenthood fund-raising campaign along with former Democratic President, Harry S. Truman.

And Johnson’s views were apparently shared by his Republican successor as well.

John Ehrlichman, who was an assistant to President Richard Nixon, wrote that Nixon once told him that African-Americans could not really benefit from federal programs because they are genetically inferior to whites.

Later, Nixon would label birth control a national priority and sign legislation to make it available as a service of the U.S. government.

Then in March of 1972, the Commission on Population Growth and the American Future which Nixon had created three years earlier with the help of Congressional Democrats, began calling for the nationwide legalization of abortion.

Although Johnson’s 1964 Civil Rights Act is worthy of celebration today, we should also remember that there is another civil war being waged against an entire class of people going on today, the unborn child in the womb.

Millions of babies have been murdered by abortion since the Supreme Court legalized it in all fifty states back in 1973.

And tragically, today, more Blacks are killed by abortion than by all other causes of death combined.

Planned Parenthood “Heck Yes” to Ginsburg comes on heels of Gruber abortion comments

On the heels of a video by disgraced ObamaCare architect, Jonathan Gruber who said that abortion would save the taxpayers money because it would basically eliminate the poor, comes Planned Parenthood’s “Heck Yes” on another eugenics leader who said something similar.

No sooner did eugenics documentary and Planned Parenthood history film producer, Mark Crutcher release a statement comparing Jonathan Gruber’s comments on abortion to statements made by Supreme Court Justice and radical abortion advocate Ruth Bader Ginsburg – that – abortion giant Planned Parenthood gave her the “Heck Yes” award.

Planned Parenthood continues, “U.S Supreme Court Justice Ruth Bader Ginsburg gave us our “Heck Yes!” Moment of the Year for her scathing dissent in the Court’s decision in favor of Hobby Lobby. In June, she wrote that the Court’s ruling — which lets some bosses deny their employees birth control coverage — is so startlingly broad that it can override the health care needs of employees and their dependents across the country.

“There were so many gripping lines from her 35-page dissent it’s hard to pick our favorite. In one of the most ominous, she warned that the precedent being set “would deny legions of women who do not hold their employers’ beliefs access to contraceptive coverage. The Court, I fear, has ventured into a minefield.”

“Here’s my question: when she said that abortion was legalized to deal with populations we don’t want to have too many of, do you get the feeling she was suggesting that there might be too many rich white people in the world? Or is it possible she might have had some other folks in mind?

Ironically, just yesterday during a Congressional hearing with ObamaCare architect Jonathan Gruber, Kentucky Representative Thomas Massie exposed the very thing that Ginsburg stated in 2009 during his questioning of Gruber.

MASSIE:I have a question for you have you. Have you had any ethics training at MIT or Harvard ?

GRUBER: I as a condition for receiving federal grants we have to take a human subjects

MASSIE: okay so this is a little bit philosophical what I’m gonna ask you now but you’re doctor of philosophy so to speak. Under what circumstances is it ethical to deceive someone for their own benefit?

GRUBER: Uh…I’m not aware circumstances in which I ..

MASSIE: Could you could you imagine maybe an adult could withhold information from children for their own benefit?

GRUBER: I guess

MASSIE: Now so if you understand that then you understand why my constituents are so offended by your proposition that it’s okay to deceive or obfuscate for somebody’s benefit compounding the insulted you delivered to them is the fact that they pay your salary . Do you did you understand fully why it was so insulting? You patronize them you were condescending.

GRUBER: I was

MASSIE: And my colleagues on the Democrat side of the isle are upset with you simply because you committed candor- you said what you thought- you said what they were all thinking -when they wrote road Obamacare – that they knew what was best for my constituents. I submit to you my constituents are not your children. And they have the right to self-determination. So this gets me to another instance where you commit candor.

In 1997 you co-authored a paper entitled , “Abortion legalization and child living circumstances who was the marginal child?” On page twenty you conclude that abortion legalization appears to be associated with an improvement in the average living circumstances and birth outcomes among a birth cohort and on page 26 you state that your research indicates that the legalization of abortion saved the government fourteen billion dollars in welfare payments through 1994.

Is providing more access to abortion – is that a worthy social outcome to achieve cost savings for the government?

GRUBER: That is uh not what my paper was about. It was a philosophical paper it was about empirical facts…

MASSIE: tell us what you meant by this sentence by 1993 all cohorts under the age 18 were born under legalized abortion and we estimate steady state savings of 1.6 billion dollars per year from positive selection. What did you mean by positive selection? Because in this paper you’re talking about providing more access to abortions to a socio-economic strata of our constituents.

MASSIE: What did you mean by positive selection?

GRUBER: In that paper, we were studying the characteristics of children who were born before and after abortion was legalized. By comparing those characteristics you can infer the characteristics as a ….

MASSIE: So what’s you inferred I find chilling. What you inferred is that if we reduce the number of people of children born life would be better for the rest of us still living. Specifically, you seem to suggest that if we eliminate or reduce the number of poor people that are born this will make life better for all Americans. And this gets me to my final point, which is the Independent Payment Advisory Board, my constituents fear that this is in fact a method by which Obamacare will ration health care for the elderly and therefore implement cost savings for Medicare. So, my question to you is, is your philosophy on abortion, that it can save money and improve outcomes, have any implications in the realm with end of life care? You argue that abortions for poor (?) children raise the average living circumstances in your paper, for the rest of us and save the government money. So, Dr. Gruber, if there are fewer elderly people, particularly poor elderly people, wouldn’t that save a ton of money to? As an economist wouldn’t that would save money too and do you understand the dangerous implications of going down this path?

GRUBER: I have no philosophy of abortion. I have no philosophy of end of life care. My job’s an economist is to deliver the empirical facts ( ??) can make the necessary..

MASSIE: And what would your facts be on the elderly?

GRUBER: I don’t understand the question?

MASSIE: the end of Life Care? Do you advocate that the federal government should ration that?

GRUBER: no I …

MASSIE: as an economist would it save money?

Crutcher summarized Gruber’s comments well, “Gruber tried bobbing and weaving around Congressman Massie’s questions but, in the end, it was clear his position was that legalized abortion has allowed our country to kill off the children of the poor and, thereby, provide a higher quality of life for those who are still living. In one of his previous writings he had described the victims of abortion as “marginal children” and referred to the process of eliminating them as “positive selection.” During his testimony he refused to define exactly what “positive selection” means, but you’d have to actually be as stupid as Gruber thinks you are not to understand what he was saying.

“So let’s recap. Now we have not one, but two, radical, high-profile, godless abortion supporters, confirming what we documented in Maafa 21. First, Ruth Bader Ginsburg admits that eugenics was the driving force behind the legalization of abortion, and then Jonathan Gruber admits that it’s working exactly as it was intended. And make no mistake, everyone at the top of the abortion lobby food chain has also known that this was the agenda since day one. They know that this issue is about political power, money, race and eugenics, but unlike Ginsburg and Gruber, they don’t go out in the public and talk about it.”

Bro-choicer Hunter Biden dismissed from Navy tight with Abortion Lobby Group

The news media is all a-buzz that Hunter Biden has been dismissed from the Navy after reports that he used cocaine.

Apparently this occurred months ago and no one in the media was aware until now. Funny how that happened that way?

Hunter Biden, the vice-president’s youngest son was also tight with the abortion lobby group NARAL.

Navy spokesman Cmd. Ryan Perry tells NPR’s Tom Bowman:

“Ensign Hunter Biden was selected for commission through the Direct Commission Officer Program in 2012. In May, 2013 he was assigned to the Navy Public Supports Element East in Norfolk, Virginia. He was discharged from the Navy Reserve in February, 2014. Like other junior officers, the details of Ensign Biden’s discharge are not releasable under the Privacy Act.”

The Wall Street Journal reported Thursday that Biden was discharged after failing a drug test in June 2013.

Hunter Biden Joins Navy

He applied for a commission into the reserve as a public affairs officer at age 42. Because of his age, Biden needed a waiver to apply. The Journal reported he needed a second waiver because of a drug-related charge when he was younger, a request that is not unusual.

According to the Washington Post, the Navy declined to confirm that Biden tested positive for cocaine use.

Only a few month’s after he was accepted into the Navy, Hunter Biden attended the inaugural of NARAL Pro-choice America’s, “Men for Choice and the Women Who Love Them” fundraiser, according to their guest list. NARAL is the the lobbying group for abortion rights.

In a statement released by his attorney, Biden said he respected the Navy’s decision and was moving forward with his family’s love and support. He did not give a reason for his discharge.

The vice president’s office declined to comment. Hunter Biden’s attorney didn’t respond to inquiries about whether Biden had used cocaine, according to One News Now.

Hunter Biden is Vice President Joe Biden’s second son, and stepson to Joe Biden’s wife Jill Biden. He is a licensed attorney and managing partner at Rosemont Seneca Partners, LLC.

Just like the discharge, I doubt that the media will be quick to report Hunter’s connection to abortion and their lobby efforts.

However, at the time NARAL recruited Hunter Biden for their Men for Choice campaign, pro-life leader Mark Crutcher, president of Life Dynamics, Inc., pointed out that that polls have consistently shown that men have always been abortion’s strongest supporters.

He went on to state, “What abortion is, is a safety net for sexually predatory and sexually irresponsible males. It gives these guys a way to avoid any commitments to the women whose bodies they use or any responsibility for the children they father. Not only that, but the woman are the ones who take all the risks associated with the operation.”

Today, Life Dynamics, Inc., a national pro-life organization located in Denton, Texas, has responded to a statement made by the Governor of Vermont calling Planned Parenthood’s work “extraordinary” despite the fact that Planned Parenthood has been exposed for covering the sexual abuse of minors impregnated by adult male predators.

Governor Pete Shumlin, along with several other candidates gathered at the Planned Parenthood of Vermont’s Administrative Offices where the Governor stated, “Vermont is unusual we should be blessed to live here with a planned parenthood that does extraordinary work and a legislature that will stand behind you.

Vermont Governor Pete Shumlin was receiving an endorsement by Planned Parenthood when he made the statement.

In 2002, the pro-life group, Life Dynamics conducted an undercover investigation sting where they documented that abortion clinics associated with both Planned Parenthood and the National Abortion Federation are, with very few exceptions, completely ignoring the mandatory reporting statutes.

The caller portrayed a 13-year-old child impregnated by her 22-year-old adult male boyfriend. Her story to these clinics was that she wanted an abortion because she did not want her parents to discover their sexual relationship.

A Planned Parenthood located in Barre, Vermont, told Life Dynamics’ undercover caller that she could obtain confidential services from them and, “It doesn’t matter how old your partner is.”

CALLER: Okay. Well, I’ll be 14 next month, and my friend told me that you guys would have to tell my parents. But —
CLINIC: No.
CALLER: — my boyfriend’s 22. Is that all right?
CLINIC: No, no. You don’t have to tell your parents.
CALLER: Okay.
CLINIC: It doesn’t matter how old your partner is.

At a Planned Parenthood in Bennington, which no longer appears to be open, the young caller is told that they will not tell anyone about her boyfriend.

CALLER: Hi. Yeah. I was calling to see if you guys do abortions there.
CLINIC: No, we don’t.
CALLER: Okay. Well, do you know of anyplace that does?
CLINIC: Yeah. They do them at our Rutland Center. They do them in Burlington and West Lebanon. And also there’s one or two private doctors that do them also.
CALLER: Okay. Well, do you have the number for the one in Burlington?
CLINIC: Okay. Just one sec. Burlington is 802-863-6326 or 6327.
CALLER: Okay. The thing is, I’m going to be 14 later on this month, and my friend said that you guys would have to tell my parents. But my boyfriend’s 22. Could he just sign whatever it is, and you wouldn’t have to tell anybody about anything?
CLINIC: Well, probably if you’re only 14 I think you’ll have to come here for a pre-exam first and a sizing and a pregnancy test. And then you can set it up there. And right now I don’t think we have to notify your parents. I could get you in Thursday for that. Have you been here for anything before?

The caller, portraying a 13 year old child tells the Planned Parenthood operator that she will need to get her 22 year old boyfriend to take her and Planned Parenthood is fine with as long as she is able to pay them:

CALLER: Well, the only thing is, me and my boyfriend talked about all this, and we don’t want anybody to know about us.
CLINIC: Right.
CALLER: Would you have to tell anybody if he was paying for everything?
CLINIC: Okay. Yeah, that’s okay.
CALLER: Really?
CLINIC: As long as you can pay for it, that’s not a problem. So why don’t you check with him and let me know, and then we can set something up for Thursday.

The Brattleboro Planned Parenthood also said they would keep the relationship confidential.

CALLER: Well, I’d have to call my boyfriend to see, but I was really wondering also if like — well, my friend told me that since like I’ll be 14 next month that you guys would have to tell my parents, but my boyfriend’s 22. Is he old enough to take care of it and you wouldn’t have to tell anybody?
CLINIC: No. In Vermont you don’t have to do that.
CALLER: Oh, okay…

Later in the call…

CALLER: Oh, okay. Well, it’s just me and my boyfriend were talking about all this, and we decided we don’t want a whole bunch of people to know about us.
CLINIC: You’re fine. Nobody — it’s a confidential.
CALLER: Well, he said that he was going to pay for everything, but would he have to sign anything if he was paying?
CLINIC: Well, it’s only within our system, so it’s not that — you know. In fact, you would have a free pregnancy test. There would be no charge.

After the caller tells the Hyde Park Planned Parenthood that her boyfriend is 22 years-old, Planned Parenthood warns the teen that she needs to be aware of what information she gives them, but that they won’t be able to guess his age by the way he looks.

CALLER: Well, if he was there — well, what should I do?
CLINIC: You just need to really be aware and you need to be aware of what information you’re giving out.
CALLER: Okay.
CLINIC: Okay?
CALLER: Well, would it be bad if he was there with me? Because he was going to pay for everything.
CLINIC: No, not if — I mean, we can’t guess someone’s age by the way they look.
CALLER: Okay.

The Rutland Planned Parenthood made it very clear to the caller that they would have to report the incident as statutory rape according to the law, but she also tells the caller, “ I’m giving you this information because that’s what the law is, and we’re not going to lie to you and say nothing about that when really there is a law that says if a man over a certain age is having sexual intercourse with a woman under a certain age, it’s against the law,” the clinic says.

This call proves that all the other Planned Parenthood facilities knew the law required them to file a report.

However, in Rutland, knowing that a 13-year-old is admitting to having sex with an adult man, they tell the caller that they will not report if all she needs is birth control.

CALLER: Okay. It’s just me and my boyfriend don’t want to have to worry about all this again.
CLINIC: Right.
CALLER: But would you have to tell anybody if I was on birth control though?
CLINIC: No.

After admitting the age of her boyfriend to the St Albans Planned Parenthood, the caller is told that they do not do abortions. However, even though the caller tells Planned Parenthood that her boyfriend is 22 years-old they say they won’t tell anyone if she comes in for a pregnancy test.

CALLER: Okay. Well, I would just rather go there. My friend told me to go to you guys. I’m going to be 14 next month, and my friend told me that you guys would have to tell my parents. But my boyfriend’s 22. Is he old enough to take care of it, and you wouldn’t have to tell anybody?
CLINIC: That’s something you would discuss with them for this. We are confidential —
CALLER: Oh, okay.
CLINIC: — and we wouldn’t tell anybody.
CALLER: So if I came in there for a pregnancy test you wouldn’t have to tell anybody?
CLINIC: No.

Group seeks attorneys for litigation against abortion clinics and Planned Parenthood centers

“As horrific and indefensible as the pedophile priest situation is, in sheer numbers it pales when compared to what’s happening within America’s family planning establishment,” Life Dynamics president, Mark Crutcher.

Today, Life Dynamics, Inc., a national pro-life organization located in Denton, Texas has announced that they are launching a national litigation plan to educate attorneys on how they can help stop the scandal of family planning centers covering up for men who rape children.

Last week, Life Dynamics released the second part of their child predator investigation which covers actual criminal cases against pedophiles who used abortion to cover their crimes.

The report, entitled, “The Cover-Up of Child Sexual Abuse”, clearly proves that the failure of family planning clinics to comply with mandatory reporting laws is having profound, real-world consequences for the victims of child sexual abuse.

Life Dynamics president, Mark Crutcher, explains, “In all 50 states, sexual activity with underage children is illegal. Every state also has mandatory reporting statutes that compel the reporting of reasonable suspicions of child sexual abuse to a designated law enforcement or child protective services agency. That entity is then responsible to investigate in order to determine whether a sexual offense has occurred. Those who are classified as mandatory reporters vary from state to state, but in every jurisdiction healthcare workers are included. The responsibility for determining that an underage girl has, or has not, been a victim of sexual abuse lies solely with the state. Healthcare workers have no obligation and no authority to investigate suspicions of child sexual abuse or make decisions about whether a crime has been committed. Whatever conclusions they might draw relative to these situations are unrelated to their mandatory reporting duties.”

Life Dynamics tells interested attorneys that Forbes Magazine once described sexual abuse litigation as “The Next Wave of Litigation.” In the article, Massachusetts trial attorney, Roderick MacLeish, Jr., stated that, “There is an absolute explosion of sexual abuse litigation, and there will continue to be. This is going to be a huge business.”

Crutcher elaborates on how this applies to litigation against family planning clinics, “America’s high rate of teen pregnancy is being driven by an epidemic of illicit sexual contact between underage girls and adult males. Life Dynamics has shown that this tragedy is being abetted by family planning service providers affiliated with organizations like Planned Parenthood and the National Abortion Federation. The focus of the Forbes article was limited to the pedophile priest scandal in the Catholic Church and it failed to see the much larger picture. As horrific and indefensible as the pedophile priest situation is, in sheer numbers it pales when compared to what’s happening within America’s family planning establishment. Every day, these organizations have contact with thousands of sexually active minor girls – the majority of whom are victims of illegal sexual abuse. This scandal allows the abuse to continue with physical and emotional consequences that can be devastating for the victims. Representing the children and parents victimized by these groups fits the business model outlined in the article.”

Life Dynamics explains that in addition to the various criminal charges that could be brought against someone who violates mandatory reporting statutes, civil causes of action exist for, or on behalf of, any child who suffers physical or psychological injuries after being denied the protection of these statutes.

Plaintiffs in these lawsuits could be the minor child, her parents, or both.

Tortious Interference with Parental Rights: It is common for family planning service providers to assist, or even encourage, minor children to conceal their sexual activity from their parents. Even in states that allow children to receive family planning services without the knowledge of their parents, providers of these services are still required to comply with mandatory reporting statutes. The agency that investigates the report could determine that an interview with the child’s parents is warranted. Therefore, anyone who violates the mandatory reporting statutes may be interfering with the parent-child relationship by denying the parents an opportunity to act in the best interests of their child.
Kidnapping or False Imprisonment: Taking a child without the authority of the child’s parents or guardian is kidnapping. Holding or confining a child without lawful authority is false imprisonment. This applies to any school district or state agency that takes a child for family planning services without her parent’s knowledge. Further, when a child is brought to a family planning service provider by anyone other than her parent or guardian, and the provider “keeps” her in the facility for the benefit of another (such as an adult who is having sexual relations with her) the facility becomes party to the tortious conduct. The cause of action is not related to the provision of services, but the circumstance under which the services are provided.

Civil Rights Violations: Whenever a reporting statute is violated, the girl involved is denied the protection of a law that was specifically intended to protect her. When that violation is by a state agency, a family planning services provider, or under color of law, a civil rights cause of action may exist. Statutory violations become civil rights issues when it can be demonstrated that the victim class is disproportionately made up of minorities.

In this case, it is well established that family planning service providers target minority communities, apply for government funds on that basis, and locate a disproportionate number of their facilities in or near those communities. The result is that African-American females now have abortions at a rate more than three times that of white females. Therefore, an underage girl may be less likely to have her sexual abuse investigated if she is black than if she is white.

Class Actions: Life Dynamics’ research shows that among family planning service providers, violations of mandatory reporting statutes are seldom, if ever, isolated events. Depending on the location of the facility and the demographic makeup of the clientele, Life Dynamics knows that the non-reporting rate generally exceeds 90 percent. In fact, during one of the undercover calls conducted by Life Dynamics, to family planning centers, a counselor volunteered to our caller that the facility she worked for had “never reported anyone.”

Clearly, this behavior opens the door for class action suits. The rules for bringing this type of litigation vary among state and federal courts and the qualification of the client as a representative member of a class will be determined by these factors.

Crutcher concludes, “Evidence needed to pursue litigation against family planning service providers is both current and readily available. Data put out by Planned Parenthood and the National Abortion Federation proves that they have had contact with hundreds of thousands of sexually active underage girls every year for more than three decades, and government documentation confirms those figures. The data also shows that in only a tiny fraction of these instances were reports of suspected abuse made.

“Since we began releasing the details of our investigation, neither of these organizations has altered their practices regarding this issue. The result is that the flaunting of mandatory reporting laws that we originally documented continues unabated. Given that they provide services to several thousand sexually active underage girls every day, it is clear that the number of potential plaintiffs is enormous and growing daily.
