Child porn, harassment, and rape: Is Planned Parenthood a haven for sex offenders?

Planned Parenthood’s political organizer president Cecile Richards recently expressed concern about accusations brought by women claiming to have been sexually harassed by men in power. While these accusations and admissions are greatly concerning, it seems Richards has overlooked her own back yard, so to speak. Plenty of Planned Parenthood employees have had their own share of troubles in this arena.

CALIFORNIA

Jorge Martin-Santana

According to Sacramento Superior Court records, Jorge Humberto Martin Santana was arrested in 2013 and charged with one count of misdemeanor sexual battery, under criminal code PC 243.4(E)(1), which reads in part:A California jury found a Planned Parenthood medical assistant guilty of misdemeanor sexual battery after inappropriately touching a patient during the course of his duties at Planned Parenthood.

Any person who touches an intimate part of another person, if the touching is against the will of the person touched, and is for the specific purpose of sexual arousal, sexual gratification, or sexual abuse, is guilty of misdemeanor sexual battery…

In February of 2015, Martin-Santana pleaded “not guilty,” but on April 9, 2015, he was sentenced to 140 days in a sheriff’s work project and three years of probation.

DELAWARE

Timothy Liveright Planned Parenthood abortionist accused of sexual harassment

In 2013, Planned Parenthood RN Jayne Mitchell-Werbrich, who worked at Planned Parenthood Delaware’s Dover and Wilmington clinics, told blogger Jill Stanek that abortionist Timothy Fouch Liveright had sexually harassed employees and patients.

“I have noted Dr. Liveright inappropriately look up and down patients as well as staff members in a sexual kind of way. He actually stands back with a grin and slowly directs his eyes up and down a patient’s body.”In 2013, Planned Parenthood RN Jayne Mitchell-Werbrich, who worked at Planned Parenthood Delaware’s Dover and Wilmington clinics, told blogger Jill Stanek that abortionist Timothy Fouch Liveright had sexually harassed employees and patients.

Jayne resigned from Planned Parenthood after her letters of complaint to management were ignored. The nurse also said she observed Liveright “acting condescending to African American patients by implying they were ignorant,” among other charges.

Liveright worked for several Planned Parenthood locations.

A Delaware Medical Licensure complaint filed against Liveright claims Planned Parenthood reprimanded him for “unprofessional, disrespectful, and inappropriate” conduct, including “yelling, screaming, and cursing” in front of employees and patients and “sexual harassment of female employees.”

According to USA Today, Liveright played an abortionist in the 2010 Hollywood movie, “Blue Valentine“:

In 2013, media reported that Liveright surrendered his license to practice medicine in Delaware, but a November 2017 query reveals that Liveright’s Pennsylvania license is still active.

FLORIDA

In July 2008, the Miami Herald reported that Planned Parenthood’s national office cut ties with several Florida centers after accusations of “terrible mismanagement and possibly fraud,” including alleged sexual harassment against a former CEO:

The disaffiliation allowed the national organization to wash its hands of the local chapter once known as Planned Parenthood of South Palm Beach and Broward Counties.

The chapter is dealing with many problems, including harassment complaints and possible misuse of nearly $450,000 — slightly less than they received in public funding in 2005.

ILLINOIS

Several female patients claimed Illinois Planned Parenthood physician, Carl E. Burpo, “engaged in improper conduct during a gynecological examination” at Burpo’s office and at Planned Parenthood, where he worked part-time. He was eventually indicted on 21 counts of sexual misconduct.

One complaint alleged that Burpo fondled patients’ “breasts and in some cases made other sexual advances toward seven patients in 1990 and 1991 while examining them.”

A 1993 report states that Burpo was suspended from practicing at Planned Parenthood. A jury acquitted him in two of the cases but in February 1995, the Illinois Supreme Court reinstated eight of the criminal sexual assault charges.

His medical license was suspended in 1995.

MASSACHUSETTS

Roger Ian Hardy

Former Planned Parenthood abortionist Roger Ian Hardy was forced to surrender his Massachusetts medical license in January 2014, amid allegations that he sexually molested patients during fertility treatments at Fertility Centers of New England.

Operation Rescue notes, “Why Hardy eventually left Planned Parenthood is unknown, but a Boston Globe article published on May 1, 2014, indicates that Hardy’s abhorrent sexual misconduct stretched back as far as 20 years. Hardy was working for Planned Parenthood during that time, in which Planned Parenthood abortion patients were likely exposed to molestation by Hardy as well.”

MINNESOTA

In 1987, the Minnesota Board of Medical Examiners revoked the license of Hideo D. Mori for alleged sexual improprieties involving 10 patients over 23 years in Grand Meadow. A report states that administrative law judge Allan W. Klein found Mori had “inappropriately massaged some of his patients, telling one of them… that he needed to stimulate her genital area to fit her properly for a diaphragm.”

Klein wrote that Mori claimed to have romantic feelings toward the patient, caressing her body and kissing her to make her sexually aroused, understanding “that it was not medically indicated.”

While Mori served as a volunteer physician for Planned Parenthood nearly 18 years, there are no indications that his patients there were victims in this case.

NEW YORK

The NY State Department of Health accused Planned Parenthood of Rochester and Monroe County physician, Joseph L. Lizardi, of sexual misconduct, including sexually stimulating one patient and telling another she was pretty while touching her breasts.

According to the document, Lizardi was also accused of speaking with another patient in an “obscene, threatening and disparaging manner.”

OHIO

Jerry Gonzales PP volunteer

On December 29, 2004, 46 year-old Planned Parenthood volunteer, Jerry Steven Gonzales, was convicted of raping a 12-year-old boy, as well as unlawful sex with a minor and two counts of pandering sexually oriented material involving juveniles, for incidents with two 16-year-old boys. In addition, he was convicted of felonious assault for having sex with a 17-year-old boy and not telling the victim about his HIV status. The incidents occurred at Gonzales’ home in Ohio.

Police claim Gonzales pleaded guilty to a “similar, misdemeanor charge in Michigan in 1989 but was not required to register as a sex offender.”

Gonzalez worked as a volunteer at Planned Parenthood of North West Ohio’s HIV Outreach center until his arrest on October 12, 2004.

Gonzalez was sentenced to 20 years in prison.

TEXAS

Planned Parenthood CEO arrested for indecent exposure

“I deeply regret creating a situation in my personal life that potentially creates a distraction from these goals, and I apologize to the people in the Lubbock community for the incident,” Thornton stated. “I will work with my attorney through the appropriate court process to correct any misinformation and take responsibility for errors.”

According to the county clerk, the charges in Thornton’s case #2012-469-378 were dismissed on February 28, 2013, in the “interest of justice.”

In 2010, Thornton helped Planned Parenthood purchase a closed facility — renamed Planned Parenthood Women’s Health Center, Inc. — after the owners retired.

2. In 2005, Planned Parenthood employee Aymara Castro said Planned Parenthood of Houston and Southeast Texas subjected her to “unlawful sexual harassment, and to disparate terms, conditions and privileges of employment because of her sex.” She won her claim, filed with Equal Employment Opportunity Commission (EEOC), which found Planned Parenthood had “failed to take corrective action to stop the harassment and retaliated against her for engaging in protected activity.”

WASHINGTON STATE

1. In 2008, former abortionist for Planned Parenthood of Columbia-Willamette, George Elliott Kabacy, was sentenced in U.S. District Court in Tacoma, WA, for possession of child pornography. Kabacy was not practicing at Planned Parenthood at the time of his December 2006 arrest. According to the US Attorney’s office:

Kabacy admitted in his plea agreement that he knowingly possessed more than 8,000 images of minors engaged in sexually explicit conduct. Kabacy also admits to possessing videos of minors engaged in sexually explicit conduct, both on his computer and on 36 compact disks. Some of the images depict children under the age of 12. Kabacy admitted that he communicated with other people over the Internet, expressing his interest in having sex with minors and exchanging more than 40 images of child pornography with these other people over the Internet.

Kabacy’s OregonWashington State and California medical licenses were later revoked. 

2. Douglas Attig was accused by authorities of inappropriate, sexually oriented comments and contact with patients.

The commission’s statement of charges alleges that Attig repeatedly spanked, kissed and hugged a patient, also sending her “copious amounts” of inappropriate and suggestive e-mail.

The complaint, filed in 2000, does not state where the incidents occurred. While there is no indication the assaults occurred at Planned Parenthood, news reports show that the organization admitted Attig occasionally committed abortions for them after he was targeted by an explosive device in 2001.The commission’s statement of charges alleges that Attig repeatedly spanked, kissed and hugged a patient, also sending her “copious amounts” of inappropriate and suggestive e-mail.

On July 13, 2001, the Board suspended Attig’s license but issued a stay allowing him to continue to practice on a probationary term.

Many additional troubling actions by Planned Parenthood have been documented, including a failure to report child sexual abuse. Reports also show that victims of sex trafficking are sometimes taken to Planned Parenthood centers for forced abortions by their pimps.

Former Planned Parenthood staffers explain how Medicaid fraud is being committed

In 2015, seven former Planned Parenthood (PPFA) employees informed the House Energy and Commerce Subcommittee on Oversight and Investigations that Planned Parenthood should be investigated for a number of potentially criminal and fraudulent acts. These former employees told Committee members in a formal letter that because Planned Parenthood receives half a billion in taxpayer funding annually, Planned Parenthood should “[…] merit close Government attention as to whether or not these funds are being spent appropriately.”

The former Planned Parenthood staffers’ letter noted, “we are of one mind that the extent of theses problems with the organization is not fully understood by the American people….” They added that they “could personally attest” that Planned Parenthood has “operated as a law unto itself, gladly accepting tens of millions of dollars of taxpayer support while using the rubric of ‘reproductive rights’ to claim exemption from the normal standards of accountability that every other recipient of public funds is expected to meet.”

In recent years, additional former Planned Parenthood staffers have come forward to accuse the abortion corporation of fraudulently overbilling Medicaid, milking American taxpayers for millions of dollars.

In August 2013, the whistleblower case of Karen Reynolds, a former employee of Planned Parenthood Gulf Coast, resulted in the Houston-based Planned Parenthood affiliate paying $4.3 million to resolve civil allegations made by Reynolds under the False Claims Act in the Eastern District of Texas. According to a Department of Justice release:

The government alleged that between 2003 and 2009, Planned Parenthood Gulf Coast billed and was paid by government programs, Texas Medicaid, Title XX, and the Women’s Health Program, for certain items and services related to birth control counseling, STD testing and contraceptives when such items and services were either not medically necessary, not medically indicated or not actually provided.

According to a 2017 report called “Profit No Matter What,” published by Alliance Defending Freedom (ADF) and the Charlotte Lozier Institute (CLI), Planned Parenthood’s facilities were required “to constantly increase their ‘pay per visit’ goals which were the bills charged to Medicaid for every patient visit.”

A recent interview with former Planned Parenthood manager, Sue Thayer, indicated that Planned Parenthood also had abortion quotas:

Patricia Carroll

Patricia Carroll was employed as the Accounts Receivable Manager by Planned Parenthood Gulf Coast and stated in her claim against Planned Parenthood that she noticed “a large revenue increase” of 314.76% for PP in Huntsville “while preparing the monthly Projection report.” The Dallas Morning News said about Carroll’s Medicaid fraud accusation:

Carroll worked as the accounts receivable manager at Planned Parenthood Gulf Coast from 2007-2012. In that position, she said she discovered “a fraudulent Medicaid scheme” that dated back to 2002. She alleged that a Planned Parenthood clinic in Huntsville had an employee visit a charter school called Gulf Coast Trade Center and perform STD/HIV tests on the students there, all of whom receive Medicaid benefits.

Carroll said Planned Parenthood incorrectly coded the visits to collect Medicaid reimbursements, estimating the clinic received about $200 per student. “Thousands of claims were filed” in the ten year span, according to Carroll’s original complaint.

In May 2014, a federal district judge in Houston ruled that Carroll had “adequately pleaded factual content that allows the court to draw the reasonable inference that Planned Parenthood knowingly filed false claims.”

The ADF/CLI report added that “at least some of the services were not medically necessary due to the duplication of visits, teens already having been tested at the jails or court systems they came from, and the higher-level staff already onsite at the school who could provide the same testing and education at no cost.”

Carroll’s lawsuit was dismissed on January 29, 2016, for an undisclosed settlement amount, the ADF/CLI report states.

P. Victor Gonzalez was employed as Vice President of Finance and Administration by Planned Parenthood of Los Angeles (PPLA). Gonzalez accused Planned Parenthood affiliates in California of marking up the cost of birth control drugs between 1997 and 2004 for government reimbursement, resulting in improper reimbursements — at taxpayer expense — far in excess of $200 million.

“An internal email from Gonzalez states that PPLA’s actual acquisition cost for oral contraceptive pills was $1-2, but that it was charging the government $12-48 per pack – a ‘hefty markup’ ‘proscribed by DHS regulations.’ Gonzalez estimates the impact on PPLA alone as approximately $4 million in revenues in a single typical year,” the ADF/CLI report states.

Sue Thayer, former manager for Planned Parenthood of the Heartland’s Storm Lake and LeMars facilities in Iowa, claimed Planned Parenthood defrauded Medicaid out of millions by overcharging for services, illegally billing for abortion-related care.

In 2015, Thayer testified before a Congressional committee about the claim, accusing Planned Parenthood of filing “[…] false claims totaling about $28 million with Iowa’s Medicaid program for (1) illegally dispensing “medically unnecessary” quantities of oral contraceptive pills and birth control patches to C-Mail Medicaid patients and doing so without a prescription; (2) fraudulently billing the Iowa Medicaid program for abortion-related services; and (3) coercing “donations” from Medicaid patients.

In an op-ed Thayer wrote in 2017, she elaborated further:

Planned Parenthood advertises that services and supplies are free, but when Medicaid-eligible women are served, it is expected they donate fifty percent of the total cost for the visit…. Planned Parenthood receives $542,000,000 in federal funding, yet asks women who live at or below the poverty line, who depend on federally-funded healthcare to make a donation — proof that Planned Parenthood is much more concerned about its bottom line than women in need.

“Planned Parenthood counted those payments as voluntary donations and billed the full amount to Medicaid,” Thayer recounted in her 2015 testimony, adding, “There is a reason that, despite technically being a nonprofit, Planned Parenthood has reported $765 million in excess revenue over the last 10 years. It is run very much like a business – focused on increasing revenues, placing its own bottom line above the interests of women. And yet leadership would take expensive trips to Europe and Russia and throw elaborate parties at fancy venues.”

Abby Johnson

Abby Johnson, the former director of an abortion center operated by Planned Parenthood Gulf Coast, (formerly Planned Parenthood of Houston and Southeast Texas) accused Planned Parenthood in her lawsuit of “repeated false, fraudulent, and ineligible claims for Medicaid reimbursements” through the Texas Women’s Health Program:

In violation of its duty to report such false, fraudulent, and/or ineligible claims and/or to reimburse the United States and/or the State of Texas for monies wrongfully received by Planned Parenthood of the Gulf Coast, Planned Parenthood Gulf Coast knowingly or willfully concealed the making of such false, fraudulent, and/or ineligible claims and knowingly or fraudulently retained funds which Planned Parenthood Gulf Coast knew it was not entitled to retain.

According to the ADF/CLI report, Johnson “alleged that Planned Parenthood of Houston and Southeast Texas filed at least 87,075 false, fraudulent, or ineligible claims with the Texas Women’s Health Program.”

As a result, Planned Parenthood wrongfully received and retained reimbursements totaling more than $5.7 million, Johnson alleged.

According to a report published by LifeSiteNews, the lawsuit also claimed:

… Planned Parenthood held a meeting in late 2008 or early 2009 to inform its clinic directors that it had been falsely billing the Texas WHP since January 1, 2007.  Johnson says that when she asked “what are we going to do about” the money that Planned Parenthood had improperly received, her supervisor answered, “Well, we are going to hope we don’t get caught.”

A 2017 op-ed written by Ramona Trevino, a former Planned Parenthood North Texas facility manager, claimed further that “Medicaid patients are like mini cash cows for Planned Parenthood.” Trevino added, “Patients who went to Planned Parenthood abortion centers used federal funds to pay for post-abortion exams at Planned Parenthood’s non-abortion centers….”

Today, due in part to the broken promises of politicians to defund Planned Parenthood, American taxpayers are still forced to hand over $1.5 million per day to this fraudulent organization.

Government tax dollars going to Planned Parenthood in just the past ten years now total in the billions of dollars with little to no oversight, while Planned Parenthood continues to send hefty “campaign contributions” to its allies through its political arm. And, despite accusations of fraud, another half a billion in taxpayer dollars is slated to be handed over to Planned Parenthood in 2018.

It is past time to stop this abuse and defund Planned Parenthood.

Free speech at stake in NAF lawsuit against CMP as judge is set to issue opinion

A federal judge has ruled that secret recordings from a pro-life group who infiltrated a National Abortion Federation meeting to expose a grisly baby parts harvesting operation does not show criminal activity, according to a report by the Associated Press.

In July, the National Abortion Federation (NAF) sued the Center for Medical Progress (CMP) accusing CMP of using fake names, infiltration, and hidden cameras to obtain the damning evidence. San Francisco Judge William Orrick granted NAF a temporary restraining order to prevent the release of the tapes. But, while the effort to suppress the videos were making their way through the courts,GotNews.com published them, claiming they were leaked to them by a hacker.

In their lawsuit, NAF claimed that CMP infiltrators “snuck into” their allegedly secure and supposedly private meetings to obtain video evidence that their members were buying fetal tissue. In response to the lawsuit, CMP claimed that their investigators conducted their investigation legally, and that NAF welcomed lead investigator David Daleiden and the other investigators as dealers in fetal tissue believing that Daleiden’s test company, BioMax, would pay abortion providers for fetal specimens. “NAF even provided Daleiden unsolicited information about the meeting’s agenda and location,” attorney’s for CMP stated.

But, according to the AP report, Judge Orrick does not agree. From the story:

Recordings secretly made by an anti-abortion group at meetings of abortion providers do not show criminal activity and could put the providers at risk, a federal judge said Friday, citing the recent shooting at a Colorado Planned Parenthood clinic.

U.S. District Judge William Orrick made the comments during a hearing over the National Abortion Federation’s request for a preliminary injunction that would continue to block the release of the recordings. Orrick did not immediately issue a ruling. He previously issued a temporary restraining order blocking the recordings pending the outcome of the preliminary injunction hearing.

Pro-lifers who have viewed the leaked tapes say that the NAF lawsuit is equivalent to censorship because NAF does not want the public to know the truth about abortion. The videos show plenty of evidence that NAF members were not only involved in harvesting fetal tissue but were holding presentations about the process during their meetings. A sampling of a few of the recordings show that NAF members:

Continuing with the AP report:

Orrick made a statement that doctors who appeared in CMP’s videos have received death threats. He also cited suspected arson at abortion clinics and the November shooting at the Colorado Springs Planned Parenthood clinic that left three people dead and nine wounded.

Catherine Short, an attorney for the Center for Medical Progress, said there was no evidence the Colorado shooter was motivated by the group’s videos or that doctors have been directly threatened. The release of the recordings is vital to furthering public discussion about topics such as whether the country’s abortion laws are too loosely written, she said. The center says in court documents its work is the equivalent of investigative journalism and protected by the First Amendment.

And, Short is correct, investigative journalism is not only protected by the First Amendment but the tactics used by CMP have been used by journalists in all sorts of investigations as Live Action News has detailed here. In fact, free speech issues in this case are so great that the U.S. Reporters’ Committee filed a ‘friend of the Court’ submission before the district court hearing NAF’s case, protesting that ‘any prior restraint on speech that is issued by a court has the potential to significantly affect the First Amendment rights of the news media and the public at large.’

we are compelled to write at this early juncture because any prior restraint on speech that is issued by a court has the potential to significantly affect the First Amendment rights of the news media and the public at large. The ramifications of having such a restraint in place go well beyond the unique facts of this dispute, they wrote.

Tom Brejcha, Thomas More Society President and Chief Counsel which presented arguments against NAF in the case agreed accusing NAF of working with Planned Parenthood to suppress Daleiden’s First Amendment rights.

“Equally as any other investigative journalist working for ABC, NBC, CBS, Fox News, or your local print or electronic media outlet may regularly resort to undercover journalism tactics to ferret out hidden crime, so too David Daleiden should have the right to penetrate the criminal underworld of America’s abortion providers and report all the evidence he has uncovered of criminal wrongdoing to law enforcement and to members of the public.”

The brief that Thomas More Society and co-counsel have filed on behalf of Daleiden in opposition to NAF’s preliminary injunction includes:

    Information about the precedent set by the recent Animal Legal Defense Fund v. Otter case, where the 9th Circuit ruled definitively that investigative journalism is not “fraud” and fully protected by the First Amendment.

    Admissions from NAF and Planned Parenthood abortion providers about their criminal participation in trafficking in aborted baby body parts documented at NAF meetings, redacted from the public filing and prevented from release by court order.

    The blatantly unconstitutional character of prior restraints on speech.

If NAF wins this case, criminals will rejoice and journalists will weep,” Brejcha said.

Both sides are watching for the decision to be released.

It is difficult for the media which has been so admittedly pro-abortion to keep focus, so I will let them in on a little secret:

The recent lawsuit filed by the National Abortion Federation (NAF) against a pro-life group exposing a gruesome baby parts operation is nothing more than a Trojan Horse of distraction.

By now we have all seen those undercover videos produced by the Center for Medical Progress (CMP) showing Planned Parenthood’s horrific baby parts harvesting operation.

As a result, late last month San Francisco Judge William Orrick granted the National Abortion Federation a temporary restraining writing that NAF would likely suffer irreparable injury absent a temporary restraining order.

The suit, filed in U.S. District Court for the Northern District of California, asks that the Defendants be preliminarily and permanently enjoined from publishing or otherwise disclosing any recordings or confidential information from NAF annual meetings, publishing or otherwise disclosing the names or addresses of any NAF members that they learned at NAF annual meetings, and attempting to gain access to any future NAF meetings.

NAF meetings are one of the only places where abortion providers can come together to learn about the latest research and advances in their field, and network without fear of harassment or intimidation. Many of the attendees are high-profile targets of anti-abortion extremists,” NAF stated in the press release.

FAKE COMPANY

In their lawsuit, NAF claims that CMP created a “fake company” to expose the Planned Parenthood scheme, writing:

    Defendants The Center for Medical Progress (“CMP”), David Daleiden, Troy Newman and individuals acting in concert with them conspired to defraud and did defraud NAF by setting up a fake company (Defendant “Biomax Procurement Services”), which held itself out as a legitimate fetal tissue procurement organization. Daleiden and his cohorts pretended to be officers and employees of their fake company, Biomax Procurement Services. They assumed false identities, used fake driver’s licenses and approached NAF in order to gain access to its annual meetings. Using their fake names and identities, they signed agreements with NAF, agreements designed to protect NAF members from exactly the type of anti-abortion harassment that is the subject of this lawsuit…

Yet, this is just the sort of thing that whistle blowers and investigators do all the time as this 20/20 episode below proves:

As for the use of undercover video, we all know this tactic has been used by journalists for years.

This 20/20 investigation on “Repair Shop Fraud” where a reporter did not “use his real name” is just one example.

There are literally hundreds of these “investigations” out there.

HIDDEN CAMERAS

The NAF lawsuit against the pro-life group also lists CMP’s use of video as a cause to censor their message further:

    In order to gain access to NAF’s annual meetings, they then signed agreements with NAF promising not to record video or audio tape, to only use information learned at NAF’s national meetings to enhance the quality and safety of services provided by NAF members, and not to disclose any information learned at NAF’s annual meetings to any third parties. All of these promises were false and fraudulent when they were made.

Undercover video and hidden cameras are used by the media all the time to produce reports and investigations.

Just one example is this CBS affiliate who went “undercover” inside several Los Angelas restaurants:

Lest you think the tactic of video in undercover investigations is only reserved for law enforcement or journalists, they are not.

In fact, several mission driven non-profits have used under cover investigations to make their case.

As one example, prominent on the Humane Society website is an undercover video exposing the mistreatment of pigs.

    A video from an undercover investigation of a pig factory farm earned both a 2013 Webby People’s Voice Award and a Webby Winner Award. The video, called “Undercover at a Tyson Pig Supplier,” was shot in April 2012 at Wyoming Premium Farms, a pig factory farm in Wheatland, Wyo. that at the time of the investigation was supplying pigs to meat giant Tyson Foods. It shows workers kicking living piglets like soccer balls, swinging sick piglets in circles by their hind legs, striking mother pigs with their fists and repeatedly and forcefully kicking them as they resisted leaving their young. As a result of the exposé, five Wyoming Premium workers recently pleaded guilty to criminal animal cruelty.

Even the abortion rights group NARAL which supports Planned Parenthood’s baby parts operation used under cover tactics to sting what they referred to as “fake pregnancy centers”

Writing for RH Reality Blog, Nina Liss-Schultz, explained the process:

    NARAL Pro-Choice California sent women undercover over the past year to more than a quarter of the state’s 167 crisis pregnancy centers (CPCs), gathering information on the quality and kind of services offered by the anti-choice groups that run those facilities, in addition to the experience a person might have using a CPC as a resource during a pregnancy.

A report conducted by, Vice News revealed that a committed abortion advocate running a project whose sole purpose is to take down pro-life pregnancy centers, recorded conversations with pro-life counselors using hidden cameras.

Katie Stack, who founded The Crisis Project admitted to Vice News that she uses hidden cameras to film the counseling and admitted to using “fake pee” so the counselors would think she was pregnant.

In October 2011, rather then condemn Stack’s undercover vids as “fake” she was published in the New York Times op-ed section for her critique of crisis pregnancy centers, “When I Needed Help, I Got Propaganda.”

Like CMP’s David Daleiden, Stack is also a young person in her twenties. However, because she was attacking the pro-life effort to help women, her undercover “investigation” was praised by the media.

But, as I have stated, the use of hidden cameras for undercover investigations is nothing new. A simple search on “Hidden Camera Investigations” on youtube will prove the tactic is universally used.

FAKE NAMES

NAF also accused CMP investigator’s of using fake names….but…that is also a Trojan Horse when you understand that this tactic is used to expose any number of illegal or unethical actions.

French Journalist

When a French female journalist went undercover to find out why teens were flocking to ISIS by setting up a fake Facebook account and a fake name and persona, CBS praised the effort.

Feminist author Gloria Steinem also used the “undercover” “fake name” tactic to expose Playboy.

She wrote about her experiences in Show Magazine in an article entitled, “A Bunny’s Tale.”

The NAF lawsuit against CMP complains that the cunning undercover investigators were able to “infiltrate” their “secret” meetings, writing:

    Defendants Daleiden, Newman, CMP, and others associated with the Enterprise, and were willing participants in it. Each had a common purpose and interest in the establishment and operations of the scheme. They also agreed to the manner in which the Enterprise would be conducted, i.e., as evidenced by Daleiden’s own statements, the creation of an admittedly fake company (Biomax Procurement Services) in order to infiltrate by false and fraudulent pretenses NAF’s annual meetings, and to infiltrate the offices and clinics of its constituent members, all for the purposes of portraying NAF and its constituent members in a false light, destroying their professional repuations, and placing NAF members in personal jeopardy. At all relevant times, Daleiden, CMP, Biomax and Newman were generally aware of each other’s conduct in furtherance of the scheme, and were knowing and willing participants in that conduct.

Yet infiltration is also a part of American investigations.

He was inspired in part by a tale told by an interview subject whose friend had been the victim of a racial murder in Key West,” the New York Times writes.

According to that Daily Mail report:

    Ron Stallworth was an investigator for the Colorado Springs Police Department in 1979 when he answered a newspaper ad placed by a new KKK group, who were looking for local members.

    Writing about the experience in a new book, Black Klansman, Stallworth explains how the hate group not only made him a member, but voted to make him the chapter’s leader after only one year.

    ‘So they took a vote, they took a unanimous vote and they wanted Ron Stallworth to become the leader of the Ku Klux Klan chapter because he was quote loyal and a dedicated Klansman,” Stallowrth told Salt Lake City’s ABC 4.

    Oscar-winning director Alex Gibney (“Taxi to the Dark Side,” “Enron: The Smartest Guys in the Room”) remembers how he reacted the first time he was offered the chance to do a film on the Church of Scientology.

    “I turned it down,” he told Business Insider…

    Gibney’s approach to secrecy came from his talks with Wright, who used similar methods when he interviewed former church members for his book. “I often used throw-away phones and encrypted email,” he said. “People were so frightened.”

The film was not condemned by the left and even premiered at the Sundance Film Festival.

Interestingly, after the Church of Scientology attempted to discredit his investigation Gibney responded, “They are playing a PR game with them to say, ‘Look at these evil people who are attacking us. Look how valiantly we are trying to defend our organization,‘” he said.

Sound familiar?

As much as the media is crying foul when CMP exposes Planned Parenthood, they remained relatively quiet when the left leaning PETA organization infiltrated a KFC supplier using those infamous undercover videos and posing as a worker for the chicken factory.

A look at NAF’s requirements for becoming a member reveals that the “infiltration” issue is more a culpability on their part than on CMP.

    Because NAF and our members have been the targets of anti-abortion activity, our application asks for references. Specifically, we ask for references from current NAF members or from other people or institutions known to us. Did NAF ask for references or did they allow the pro-life undercover operatives into their inner circle with no or little scrutiny? Whichever is the case, NAF’s first and foremost concern must be their own multi-million dollar pockets. If the CMP vids are released as they should be, the one who should be sued here by anyone who attended their conference is the National Abortion Federation in my view.

But, it’s not just their attendees that are a concern to NAF.

The organization which touts the highest standards for abortion care happens to have as their members the same Planned Parenthood centers now under investigation for possible illegal activity.

A breakdown of each Planned Parenthood exposed by CMP and their ties to NAF are listed below:

In that second video, Gatter was also caught haggling over payments for intact fetal specimens and offering to use a “less crunchy technique” to get more intact body parts.

NAF, with all their talk about high standards, is spending far more time attacking the Center for Medical Progress than investigating the allegations of illegal activity by Planned Parenthood.

Although NAF supports the use of aborted babies for research they claim to require their members to obey all laws regarding their procurement as well as forbidding any monetary compensation, something Planned Parenthood is being accused of doing.

NAF says they support fetal tissue donation as long as Federal laws and regulations are observed and according to NAF:

    I.Informed consent for fetal tissue donation may not be obtained until after a patient has given full informed consent for the abortion.
    II.A woman’s decision to donate fetal tissue must be voluntary and uncoerced.Providers must not offer any financial or other incentives to the patient.
    III.Clinics and providers cannot financially gain from their participation in fetal tissue donation. Remuneration is limited to “reasonable payments associated with the transportation, implantation, processing, preservation, quality control, or storage of fetal tissue” (NIH Revitalization Act of 1993).
    IV.Providers cannot change abortion procedures specifically to accommodate fetal tissue collection needs.

In NAF’s Fetal Tissue Donation Position Statement they state:

    NAF requires that all members adhere to the applicable local, state, and federal laws and regulations governing fetal tissue donation…NAF strongly supports existing prohibitions against financial gain from fetal tissue donation.

The American Medical Association also states that no financial benefit should be granted to those who abort the child whose tissue is later donated for research.

It’s time to stop focusing on NAF’s Trojan Horse and start asking why the organization which allegedly creates guidelines and standards for the abortion industry isn’t saying more to condemn Planned Parenthood!

    NAF is suing under the Federal Civil RICO statute, civil conspiracy, breach of contract, and various state statutes.

    CMP’s attorneys will no doubt point out that damages for emotional distress or any personal injury claimed by NAF members are not cognizable under civil RICO. See, e.g., Grogan v. Platt, 835 F.2d 844, 846 (11th Cir. 1988); James v. Meow Media, Inc., 90 F. Supp.2d 798, 814 (W.D. Ky. 2000); Moore v. Eli Lilly & Co., 626 F. Supp. 365, 367 (D. Mass. 1986); City and County of San Fransisco v. Philip Morris, 957 F. Supp. 1130, 1138-39 (N.D. Cal. 1997).

    Similarly, “reputational injuries” from alleged defamation are not actionable under RICO. Santana v. Cook County Bd. of Review, 679 F.3d 614, 623 (7th Cir. 2012).

    But this doesn’t mean they won’t try, because…they’re doing it right now.

    This will be an interesting trial because any evidence of a civil conspiracy on CMP’s part will also be evidence of a criminal conspiracy on NAF’s part.

Adding:

    NAF brought the fight, but it plays right into CMP’s hands.

    Why?

    Because the basis for each of NAF’s assertions of fact and law is discoverable.

Pro-life cease and desist letter demands Planned Parenthood prez apologize and retract accusations of violence

The national pro-life group, Operation Rescue said that “Cease and Desist letters” are going out to Planned Parenthood CEO Cecile Richards and ABC News on behalf of their president Troy Newman seeking an apology and retraction of, “false, defaming statements made by Richards during an interview that aired on the July 26 edition of This Week with George Stephanopoulus.

According to the group, Richards attacked Newman and wrongly accused him of being “behind” acts of violence, including “the bombing of clinics, the murder of doctors in their homes, and in their churches.”

“I cannot stand by while Planned Parenthood’s Cecile Richards and ABC News air false allegations against me that are now being repeated as fact in numerous news sources. I have never condoned violence against abortion providers or businesses and Richards’ patently false statements against me must be retracted,” said Newman.

    Operation Rescue began as a peaceful protest movement that engaged in non-violent civil disobedience at abortion facilities. Since then, under Newman’s leadership, Operation Rescue has evolved into a well-respected watchdog group that focuses on documenting and reporting substandard and unlawful practices within the abortion industry and seeking enforcement of existing abortion laws.

The demand letter, sent by Operation Rescue’s Chief Counsel, Brian Chavez-Ochoa, stated that Richards’ statements on the ABC News show hosted by George Stephanopoulus were “reckless and malicious. Its reckless and malicious conduct gives rise to substantial liability for defamation.”

The interview was prompted by the release of undercover videos made by the Center for Medical Progress that show evidence of Planned Parenthood’s involvement in the illegal selling of aborted baby remains. Newman appears to have been targeted by Richards because he serves as a Board Member for the Center for Medical Progress.

The videos also show evidence that Planned Parenthood’s abortionists illegally alter abortion procedures to ensure that marketable organs are protected during the abortion process.

The pro-life group continued saying:

    At least one video describes the use of the banned Partial Birth Abortion method in which living babies are extracted from the birth canal and killed before they can be fully birthed. This gives rise to concerns that some of the babies have been born alive then killed for their organs, which can fetch hundreds of thousands of dollars for Planned Parenthood affiliates.

Last week, the National Abortion Federation (NAF) was granted a preliminary injunction against the Center for Medical Progress in an attempt to silence the pro-life group from releasing more damming video evidence of a possible illegal baby parts business.

A temporary restraining order has also been granted to Stem Express, the tissue procurement company used by Planned Parenthood.

Both orders are temporary as parties prepare to make their case for or against them before a judge in the near future.

The latest transcripts released by the Center for Medical Progress revealed that Planned Parenthood was using aborted baby parts for humanized mice research.

The use of aborted baby parts implanted in animals is not new and the gruesome experimentation has been documented on this blog here.

The NAF suit claims that it could suffer “irreparable harm” if the videos were made public.

This suit is a panicked attempt to prevent the truth from being told about NAF involvement in profiteering from aborted baby remains,” said Newman.

“It is really a cover-up of potential evidence of their own wrong doing. They obviously have a lot to hide.”

David Daleiden said Stem Express wanted to censor the vids because they showed conversations with the profitable procurement company officials admitting that they get fully intact babies from abortion clinics possibly violating federal law.

Judge grants TRO to Stem Express which collects Planned Parenthood baby parts

A Press Release issued by Stem Express, a fetal tissue procurement company tied to Planned Parenthood’s baby harvesting operation, which also provided human fetal kidneys to implant in animals (read here), claims they have been successful in obtaining a temporary restraining order against the pro-life group publishing damaging under cover videos.

The restraining order will remain in place until a hearing on Aug. 19.

It states:

    On July 28, 2015, a Los Angeles County Superior Court judge issued a temporary restraining
    order (“TRO”) prohibiting the Center for Medical Progress (“CMP”) and David Daleiden from releasing any illegally and secretly recorded videos of StemExpress employees and awarding other relief to our company.

    StemExpress sought a TRO on the grounds that CMP and Daleiden violated California’s
    anti-wiretapping law under Penal Code § 632 (Invasion of Privacy Act). The court granted our TRO and will consider our request for a preliminary injunction next month.

    We will continue to pursue all available legal remedies against CMP and Daleiden.

    In a statement Wednesday, center leader David Daleiden said StemExpress was using “meritless litigation” to cover up an “illegal baby parts trade.”

    “The Center for Medical Progress follows all applicable laws in the course of our investigative journalism work,” he said.

    StemExpress is a Placerville-based company started in 2010 that provides human tissue, blood and other specimens to researchers. Planned Parenthood is one of the company’s providers of fetal tissue.

    A company spokesman said StemExpress is “grateful its rights have been vindicated in a court of law.”

In the third video released by The Center for Medical Progress, former Stem Express employee, Holly O’Donnell, who worked as a licensed phlebotomist told CMP that she unsuspectingly took a job as a “procurement technician” at the fetal tissue company and biotech start-up StemExpress in late 2012 after responding to an ad.

Stem Express is a company that hires procurement techs to draw blood and dissect dead fetuses and sell the parts to researchers,” the former employee states.

The owner, Cate Dyer, she used to be a procurement tech and then she went and started her own business. And now she’s making a lot of money based off the poor girls who half the time don’t even want to get abortions.” O’Donnell adds.

She describes the first time she witnessed seeing aborted babies here.

Dyer said that samples can get as specific as age, gender and ethnicity, she told a local news outlet.

STatement on Stem Express from CMP

A response to the lawsuit has been published on the pro-life group’s website and reads:

    StemExpress, a for-profit company partnered with over 30 abortion clinics, including Planned Parenthood, to harvest and sell aborted baby parts and provide a “financial benefit” to Planned Parenthood clinics, is attempting to use meritless litigation to cover-up this illegal baby parts trade, suppress free speech, and silence the citizen press reporting on issues of burning concern to the American public. They are not succeeding—their initial petition was rejected by the court, and their second petition was eviscerated to a narrow and contingent order about an alleged recording pending CMP’s opportunity to respond. The Center for Medical Progress follows all applicable laws in the course of our investigative journalism work and will contest all attempts from Planned Parenthood and their allies to silence our First Amendment rights and suppress investigative journalism.
