Free speech at stake in NAF lawsuit against CMP as judge is set to issue opinion

A federal judge has ruled that secret recordings from a pro-life group who infiltrated a National Abortion Federation meeting to expose a grisly baby parts harvesting operation does not show criminal activity, according to a report by the Associated Press.

In July, the National Abortion Federation (NAF) sued the Center for Medical Progress (CMP) accusing CMP of using fake names, infiltration, and hidden cameras to obtain the damning evidence. San Francisco Judge William Orrick granted NAF a temporary restraining order to prevent the release of the tapes. But, while the effort to suppress the videos were making their way through the courts,GotNews.com published them, claiming they were leaked to them by a hacker.

In their lawsuit, NAF claimed that CMP infiltrators “snuck into” their allegedly secure and supposedly private meetings to obtain video evidence that their members were buying fetal tissue. In response to the lawsuit, CMP claimed that their investigators conducted their investigation legally, and that NAF welcomed lead investigator David Daleiden and the other investigators as dealers in fetal tissue believing that Daleiden’s test company, BioMax, would pay abortion providers for fetal specimens. “NAF even provided Daleiden unsolicited information about the meeting’s agenda and location,” attorney’s for CMP stated.

But, according to the AP report, Judge Orrick does not agree. From the story:

Recordings secretly made by an anti-abortion group at meetings of abortion providers do not show criminal activity and could put the providers at risk, a federal judge said Friday, citing the recent shooting at a Colorado Planned Parenthood clinic.

U.S. District Judge William Orrick made the comments during a hearing over the National Abortion Federation’s request for a preliminary injunction that would continue to block the release of the recordings. Orrick did not immediately issue a ruling. He previously issued a temporary restraining order blocking the recordings pending the outcome of the preliminary injunction hearing.

Pro-lifers who have viewed the leaked tapes say that the NAF lawsuit is equivalent to censorship because NAF does not want the public to know the truth about abortion. The videos show plenty of evidence that NAF members were not only involved in harvesting fetal tissue but were holding presentations about the process during their meetings. A sampling of a few of the recordings show that NAF members:

    NAF held presentations on harvesting aborted baby parts
    NAF members and a majority of the women they service know they are killing a baby
    Abortion clinics dispose of preborn children in garbage disposals
    Burning aborted babies for energy fuel may really be happening
    A cold and callous disregard for the dead
    A Planned Parenthood abortionist and NAF attendee admitted being involved in fetal tissue research with, “independent / individual researchers”

Continuing with the AP report:

Orrick made a statement that doctors who appeared in CMP’s videos have received death threats. He also cited suspected arson at abortion clinics and the November shooting at the Colorado Springs Planned Parenthood clinic that left three people dead and nine wounded.

Catherine Short, an attorney for the Center for Medical Progress, said there was no evidence the Colorado shooter was motivated by the group’s videos or that doctors have been directly threatened. The release of the recordings is vital to furthering public discussion about topics such as whether the country’s abortion laws are too loosely written, she said. The center says in court documents its work is the equivalent of investigative journalism and protected by the First Amendment.

And, Short is correct, investigative journalism is not only protected by the First Amendment but the tactics used by CMP have been used by journalists in all sorts of investigations as Live Action News has detailed here. In fact, free speech issues in this case are so great that the U.S. Reporters’ Committee filed a ‘friend of the Court’ submission before the district court hearing NAF’s case, protesting that ‘any prior restraint on speech that is issued by a court has the potential to significantly affect the First Amendment rights of the news media and the public at large.’

Tom Brejcha, Thomas More Society President and Chief Counsel which presented arguments against NAF in the case agreed accusing NAF of working with Planned Parenthood to suppress Daleiden’s First Amendment rights.

“Equally as any other investigative journalist working for ABC, NBC, CBS, Fox News, or your local print or electronic media outlet may regularly resort to undercover journalism tactics to ferret out hidden crime, so too David Daleiden should have the right to penetrate the criminal underworld of America’s abortion providers and report all the evidence he has uncovered of criminal wrongdoing to law enforcement and to members of the public.”

The brief that Thomas More Society and co-counsel have filed on behalf of Daleiden in opposition to NAF’s preliminary injunction includes:

    Information about the precedent set by the recent Animal Legal Defense Fund v. Otter case, where the 9th Circuit ruled definitively that investigative journalism is not “fraud” and fully protected by the First Amendment.

    Admissions from NAF and Planned Parenthood abortion providers about their criminal participation in trafficking in aborted baby body parts documented at NAF meetings, redacted from the public filing and prevented from release by court order.

    The blatantly unconstitutional character of prior restraints on speech.

If NAF wins this case, criminals will rejoice and journalists will weep,” Brejcha said.

Both sides are watching for the decision to be released.

David Gregory accused of wanting journalists prosecuted for covering whistleblowers of Secret Court and NSA

NBC “Meet the Press” host David Gregory got a rise out of Glenn Greenwald on Sunday by asking the Guardian reporter why he shouldn’t be charged with a crime for having “aided and abetted” former National Security Agency analyst Edward Snowden.Greenwald replied on the show Sunday that it was “pretty extraordinary that anybody who would call themselves a journalist would publicly muse about whether or not other journalists should be charged with felonies.”

CNN Whistleblower says Obama Admin pays media for censorship and propaganda

The Obama administration is suffocating investigative journalism at an alarming rate through the abuse of the Espionage Act of 1917, an act more prone to be used to protect government secrecy than national security. Before Obama, the act had been used only three times total since 1917. The current administration has used it six times to go after whistleblowers and the journalists who protect and reveal their information.

President Obama was bold enough to use the Espionage Act to subpoena New York Times journalist James Risen in an attempt to force him to ‘give up’ information on a CIA whistleblower. Risen accused the administration of trying to silence journalists and refused to acquiesce stating,

“Can you have a democracy without aggressive investigative journalism? I don’t believe you can, and that’s why I’m fighting.”

Risen predicted Obama’s attack against him would have an unprecedented chilling effect on mainstream investigative journalism in the US. He was right.
I was on the brunt end of the Obama-generated censorship while employed at CNN as an investigative correspondent.

On at least a weekly basis, and to my constant frustration, my superiors and CNN’s lawyers were quick to remind me that we need to be extra careful because “President Obama has gone after more journalists and whistleblowers than any president in history”. The leash around my neck began to tighten.

Investigative Journalists could start being ‘disappeared’ under the NDAA

The NDAA frightens journalists because it turns us into criminals. There are no provisions within the law to protect journalists. As journalists, we take a vow to never reveal our confidential sources. If the U.S. government, or corrupt corporations pressuring authorities, want information on our confidential sources, the NDAA gives them the power to indefinitely detain us by saying the refusal to reveal sources is an act that is “aiding terrorists” .

We are all ‘terrorists’

Another disturbing aspect of the NDAA is that it allows the government to imprison anyone suspected of or even associated with ‘terrorism’. This power is open to wide interpretation under the law and can and will be abused.

Who in the heck is a terrorist anymore? We’ve witnessed the U.S. government and Military-industrial complex mold the term ‘terrorist’ to their subjective and financial goals too many times to trust any use of that word. Even Nobel Peace Prize-winner Nelson Mandela was once considered a terrorist by governments worldwide and put on U.S. terrorist watch lists.

As Pulitzer Prize-winning journalist Chris Hedges told Democracy Now, the term ‘terrorist’ is too loose so what the NDAA is really doing is setting up a legal mechanism to criminalize dissent.

“We saw an attempt to link the U.S. Day of Rage with Al Qaeda. Once they link you with a terrorist group, then these draconian forms of control can be used against legitimate forms of protest, in particularly the Occupy Movement,” Hedges said. Corrupt corporations can use the NDAA to pressure the government to crush banking protests, environmental protests, strikes… it’s a slippery slope.

FBI informants include journalists, WH and Congressional staffers, and clergy, lawsuit suggests

If Salt Lake City attorney Jesse Trentadue is right, there are journalists around the country who also happen to be informants for the FBI.

And the journalists might not be alone. FBI informants might also be found on the White House staff, in the offices of U.S. congressmen, in the courts and among the clergy.

The allegations stem from Trentadue’s ongoing legal battle with the FBI and the Department of Justice over the August 1995 death of his brother Kenneth Trentadue, who died under mysterious circumstances in Oklahoma City’s transfer center for federal inmates.

Jesse Trentadue has long scoffed at federal authorities’ explanation that his younger brother killed himself. According to Jesse Trentaude, Kenneth died as the result of an interrogation prompted by his resemblance to an early suspect in the April 19, 1995, bombing of the Alfred P. Murrah Federal Building.

Then-Chief Medical Examiner Fred Jordan, following a contentious investigation, determined the death a suicide but later claimed he had been pressured by the FBI and state prosecutors to make that ruling.

In Trentadue’s latest attempt to gather information on the bombing and its possible connection to his brother’s death, he filed a federal lawsuit Oct. 18 demanding the DOJ and the FBI surrender unredacted manuals that reveal the existence of a government program for recruiting and training informants.

Trentadue said he has proof that the manuals exist as well as government documentation on an ABC News executive identified by an FBI informant number. His lawsuit states: “FBI defendants’ disturbing practice of using private citizens as spies in the media, on defense teams, in religious organizations as well as state and federal government is designed to and does result in the circumvention of the protections guaranteed to American citizens by the Bill of Rights and the Separation of Powers Doctrine.”

Trentadue said he does not want the names of the informants.

“I know I’ll never get that,” he said. “But we’re entitled to know who they’re targeting to become informants.”

An informant at ABC?

Trentadue said he first became aware that some journalists were working for the FBI when he filed a Freedom of Information Act request for surveillance videotapes of the Murrah bombing. During his exchange with the bureau, the government released some documents referring to a tip from an informant identified as NY 29000- SI-DT. The informant had contacted Supervisory Special Agent Thomas E. Nicoletti the evening of April 19, 1995, with information about who might have carried out the attack.

Michelle Goldberg mouthpiece for abortion and Planned Parenthood

Michelle Goldberg is an author and senior contributing writer for The Daily Beast, Newsweek, New York Times and other publications and she often writes articles about Planned Parenthood and abortion where she will demonize the pro-life position.

What the public may not know and certainly the so-called bipartisan media will not state is that Goldberg receives funding from Planned Parenthood. Goldberg has been a featured speaker for Planned Parenthood events and Planned Parenthood has funded Goldberg’s speaking events, where she promotes her books. It is clear that Goldberg has an investment in seeing that Planned Parenthood is NEVER discredited.

According to media announcements of Goldberg’s speaking arrangements with Planned Parenthood- we also find out that Goldenberg has been involved in Planned Parenthood for many years, originally in Minnesota where she used to live. In 2011, the paper reports that Goldberg is also a member of the First Choice Luncheon Committee and the area affiliate board, and had this to say “My concern is for the future — my kids, my grandkids. I want them to have the same choices we had or we made for ourselves. I care a lot because I feel each person should have a choice in this very personal matter,” said Goldenberg. “There is such a need for more education, and Planned Parenthood is good at filling that need. I don’t feel the public understands what Planned Parenthood mission is. It’s primarily an educational organization, definitely not a contraceptive or abortion mill.”

Michelle Goldberg continues to write articles about abortion and Planned Parenthood, but, has not in full disclosure revealed that she is on the board of Southwest & Central Florida Planned Parenthood.

Journalist group wants to outlaw the term: Illegal Alien
