Free speech at stake in NAF lawsuit against CMP as judge is set to issue opinion

A federal judge has ruled that secret recordings from a pro-life group who infiltrated a National Abortion Federation meeting to expose a grisly baby parts harvesting operation does not show criminal activity, according to a report by the Associated Press.

In July, the National Abortion Federation (NAF) sued the Center for Medical Progress (CMP) accusing CMP of using fake names, infiltration, and hidden cameras to obtain the damning evidence. San Francisco Judge William Orrick granted NAF a temporary restraining order to prevent the release of the tapes. But, while the effort to suppress the videos were making their way through the courts,GotNews.com published them, claiming they were leaked to them by a hacker.

In their lawsuit, NAF claimed that CMP infiltrators “snuck into” their allegedly secure and supposedly private meetings to obtain video evidence that their members were buying fetal tissue. In response to the lawsuit, CMP claimed that their investigators conducted their investigation legally, and that NAF welcomed lead investigator David Daleiden and the other investigators as dealers in fetal tissue believing that Daleiden’s test company, BioMax, would pay abortion providers for fetal specimens. “NAF even provided Daleiden unsolicited information about the meeting’s agenda and location,” attorney’s for CMP stated.

But, according to the AP report, Judge Orrick does not agree. From the story:

Recordings secretly made by an anti-abortion group at meetings of abortion providers do not show criminal activity and could put the providers at risk, a federal judge said Friday, citing the recent shooting at a Colorado Planned Parenthood clinic.

U.S. District Judge William Orrick made the comments during a hearing over the National Abortion Federation’s request for a preliminary injunction that would continue to block the release of the recordings. Orrick did not immediately issue a ruling. He previously issued a temporary restraining order blocking the recordings pending the outcome of the preliminary injunction hearing.

Pro-lifers who have viewed the leaked tapes say that the NAF lawsuit is equivalent to censorship because NAF does not want the public to know the truth about abortion. The videos show plenty of evidence that NAF members were not only involved in harvesting fetal tissue but were holding presentations about the process during their meetings. A sampling of a few of the recordings show that NAF members:

Continuing with the AP report:

Orrick made a statement that doctors who appeared in CMP’s videos have received death threats. He also cited suspected arson at abortion clinics and the November shooting at the Colorado Springs Planned Parenthood clinic that left three people dead and nine wounded.

Catherine Short, an attorney for the Center for Medical Progress, said there was no evidence the Colorado shooter was motivated by the group’s videos or that doctors have been directly threatened. The release of the recordings is vital to furthering public discussion about topics such as whether the country’s abortion laws are too loosely written, she said. The center says in court documents its work is the equivalent of investigative journalism and protected by the First Amendment.

And, Short is correct, investigative journalism is not only protected by the First Amendment but the tactics used by CMP have been used by journalists in all sorts of investigations as Live Action News has detailed here. In fact, free speech issues in this case are so great that the U.S. Reporters’ Committee filed a ‘friend of the Court’ submission before the district court hearing NAF’s case, protesting that ‘any prior restraint on speech that is issued by a court has the potential to significantly affect the First Amendment rights of the news media and the public at large.’

Tom Brejcha, Thomas More Society President and Chief Counsel which presented arguments against NAF in the case agreed accusing NAF of working with Planned Parenthood to suppress Daleiden’s First Amendment rights.

“Equally as any other investigative journalist working for ABC, NBC, CBS, Fox News, or your local print or electronic media outlet may regularly resort to undercover journalism tactics to ferret out hidden crime, so too David Daleiden should have the right to penetrate the criminal underworld of America’s abortion providers and report all the evidence he has uncovered of criminal wrongdoing to law enforcement and to members of the public.”

The brief that Thomas More Society and co-counsel have filed on behalf of Daleiden in opposition to NAF’s preliminary injunction includes:

    Information about the precedent set by the recent Animal Legal Defense Fund v. Otter case, where the 9th Circuit ruled definitively that investigative journalism is not “fraud” and fully protected by the First Amendment.

    Admissions from NAF and Planned Parenthood abortion providers about their criminal participation in trafficking in aborted baby body parts documented at NAF meetings, redacted from the public filing and prevented from release by court order.

    The blatantly unconstitutional character of prior restraints on speech.

If NAF wins this case, criminals will rejoice and journalists will weep,” Brejcha said.

Both sides are watching for the decision to be released.

Pro-life cease and desist letter demands Planned Parenthood prez apologize and retract accusations of violence

The national pro-life group, Operation Rescue said that “Cease and Desist letters” are going out to Planned Parenthood CEO Cecile Richards and ABC News on behalf of their president Troy Newman seeking an apology and retraction of, “false, defaming statements made by Richards during an interview that aired on the July 26 edition of This Week with George Stephanopoulus.

According to the group, Richards attacked Newman and wrongly accused him of being “behind” acts of violence, including “the bombing of clinics, the murder of doctors in their homes, and in their churches.”

“I cannot stand by while Planned Parenthood’s Cecile Richards and ABC News air false allegations against me that are now being repeated as fact in numerous news sources. I have never condoned violence against abortion providers or businesses and Richards’ patently false statements against me must be retracted,” said Newman.

The demand letter, sent by Operation Rescue’s Chief Counsel, Brian Chavez-Ochoa, stated that Richards’ statements on the ABC News show hosted by George Stephanopoulus were “reckless and malicious. Its reckless and malicious conduct gives rise to substantial liability for defamation.”

The interview was prompted by the release of undercover videos made by the Center for Medical Progress that show evidence of Planned Parenthood’s involvement in the illegal selling of aborted baby remains. Newman appears to have been targeted by Richards because he serves as a Board Member for the Center for Medical Progress.

The videos also show evidence that Planned Parenthood’s abortionists illegally alter abortion procedures to ensure that marketable organs are protected during the abortion process.

The pro-life group continued saying:

    At least one video describes the use of the banned Partial Birth Abortion method in which living babies are extracted from the birth canal and killed before they can be fully birthed. This gives rise to concerns that some of the babies have been born alive then killed for their organs, which can fetch hundreds of thousands of dollars for Planned Parenthood affiliates.

Planned Parenthood is lashing out and trying to deflect from their own appalling and allegedly illegal behavior by attacking me. With ongoing criminal investigations in at least 11 states, Planned Parenthood is desperate to change the subject. Last week, the National Abortion Federation (NAF) was granted a preliminary injunction against the Center for Medical Progress in an attempt to silence the pro-life group from releasing more damming video evidence of a possible illegal baby parts business.

A temporary restraining order has also been granted to Stem Express, the tissue procurement company used by Planned Parenthood.

Both orders are temporary as parties prepare to make their case for or against them before a judge in the near future.

The latest transcripts released by the Center for Medical Progress revealed that Planned Parenthood was using aborted baby parts for humanized mice research.

The use of aborted baby parts implanted in animals is not new and the gruesome experimentation has been documented on this blog here.

The National Abortion Federation (NAF) has filed for a request for a preliminary injunction against the group that is exposing Planned Parenthood’s baby parts operation.

(UPDATE: Friday afternoon, San Francisco Judge William Orrick issued the temporary restraining writing that NAF would likely suffer irreparable injury absent a temporary restraining order.)

The National Abortion Federation is considered by some as the professional voice of the abortion industry. I guess if a federation of child killers could be credible, this would describe NAF.

But, truth be told, both NAF and NARAL are in bed with the two Planned Parenthood docs, and have an investment that would motivate them to preserve now questionable reputations.

Dr. Deborah Nucatola head of Planned Parenthood’s medical services department bragged how she will crush above or crush below the desired child’s organ to appease “buyers” of the fetal body parts.

Planned Parenthood’s Medical Directors’ Council President Mary Gatter described on tape how she would modify the abortion procedure, performing a “Less Crunchy” technique to obtain more “whole specimens.” Gatter then joked about wanting a Lamborghini.

NAF’s lawsuit was announced on the abortion lobby group’s website this morning.

The suit, filed in U.S. District Court for the Northern District of California, asks that the Defendants be preliminarily and permanently enjoined from publishing or otherwise disclosing any recordings or confidential information from NAF annual meetings, publishing or otherwise disclosing the names or addresses of any NAF members that they learned at NAF annual meetings, and attempting to gain access to any future NAF meetings.

NAF meetings are one of the only places where abortion providers can come together to learn about the latest research and advances in their field, and network without fear of harassment or intimidation. Many of the attendees are high-profile targets of anti-abortion extremists,” NAF stated in the press release.

The suit claims the pro-life group new dates, times, and locations of NAF meeting and that NAF’s annual meetings have already been referenced in the tapes released thus far, including references to conversations the conspirators had with Dr. Matthew Reeves, NAF’s Medical Director.

Troy Newman, president of Operation Rescue responded, “How dare a cabal of baby-killers attempt to cast aspersions on my good name when it is they themselves that are ore than likely engaging in the illegal and repulsive practice of trafficking and profiting from fetal organs obtained during abortions.”

The NAF suit claims that it could suffer “irreparable harm” if the videos were made public.

This suit is a panicked attempt to prevent the truth from being told about NAF involvement in profiteering from aborted baby remains,” said Newman.

“It is really a cover-up of potential evidence of their own wrong doing. They obviously have a lot to hide.”

“We will fight to preserve our precious freedom of speech and freedom of the press along with the ability for citizen journalists to engage in investigative journalism. The NAF’s attempt to intimidate us and sue us into silence will not succeed,” Newman added.

Earlier this week, CMP’s Lead investigator spoke about a Stem Express restraining order.

David Daleiden said Stem Express wanted to censor the vids because they showed conversations with the profitable procurement company officials admitting that they get fully intact babies from abortion clinics possibly violating federal law.

Judge grants TRO to Stem Express which collects Planned Parenthood baby parts

A Press Release issued by Stem Express, a fetal tissue procurement company tied to Planned Parenthood’s baby harvesting operation, which also provided human fetal kidneys to implant in animals (read here), claims they have been successful in obtaining a temporary restraining order against the pro-life group publishing damaging under cover videos.

The restraining order will remain in place until a hearing on Aug. 19.

    On July 28, 2015, a Los Angeles County Superior Court judge issued a temporary restraining
    order (“TRO”) prohibiting the Center for Medical Progress (“CMP”) and David Daleiden from releasing any illegally and secretly recorded videos of StemExpress employees and awarding other relief to our company.

    StemExpress sought a TRO on the grounds that CMP and Daleiden violated California’s
    anti-wiretapping law under Penal Code § 632 (Invasion of Privacy Act). The court granted our TRO and will consider our request for a preliminary injunction next month.

    We will continue to pursue all available legal remedies against CMP and Daleiden.

    In a statement Wednesday, center leader David Daleiden said StemExpress was using “meritless litigation” to cover up an “illegal baby parts trade.”

    “The Center for Medical Progress follows all applicable laws in the course of our investigative journalism work,” he said.

    StemExpress is a Placerville-based company started in 2010 that provides human tissue, blood and other specimens to researchers. Planned Parenthood is one of the company’s providers of fetal tissue.

    A company spokesman said StemExpress is “grateful its rights have been vindicated in a court of law.”

In the third video released by The Center for Medical Progress, former Stem Express employee, Holly O’Donnell, who worked as a licensed phlebotomist told CMP that she unsuspectingly took a job as a “procurement technician” at the fetal tissue company and biotech start-up StemExpress in late 2012 after responding to an ad.

Stem Express is a company that hires procurement techs to draw blood and dissect dead fetuses and sell the parts to researchers,” the former employee states.

The owner, Cate Dyer, she used to be a procurement tech and then she went and started her own business. And now she’s making a lot of money based off the poor girls who half the time don’t even want to get abortions.” O’Donnell adds.

City arrests 79 year old pro-life Grandma protesting Planned Parenthood

In March of 2014, a pro-life grandmother was hauled off to jail for exercising her first amendment rights to protest at a Keokuk Iowa Planned Parenthood abortion clinic.

Police say that Donna Holman violated an injunction which she said is the result of a bogus charge of harassment in 2006.

The Holmans claim that Donna was convicted on hearsay evidence. The person she purportedly harassed did not show up for court.

The Johnson County Order of Protection was for 5 years to be applied to the Iowa City Planned Parenthood. With no hearing or prior notification, Planned Parenthood had the order extended another 5 years! Now it is alleged that the order is modified and extended to “all Planned Parenthoods!”

It does not specify a person or a place of avoidance; it reads:”Planned Parenthood, all employees, contract workers, volunteers, patients of Planned Parenthood, and anyone accompanying them.”

In 2002, as part of their Child Predator project, the pro-life group Life Dynamics had an undercover caller posing as a 13 year old child impregnated by a 22 year old adult man call a KEOKIK, IA PLANNED PARENTHOOD located 206 1/2 N 7TH ST. This location appears to be a different location from where Donna was protesting (unless they relocated there.)

The staff worker at the Planned Parenthood told the caller that they could not provide her an abortion and she would need parental consent, but informs her that in Illinois, they do not require parental consent.

But, even though Planned Parenthood knew the caller was a minor impregnated by an adult male, she appears to coach the caller in how to conceal the age of the man to avoid any trouble. Here is part of the transcript:

Planned Parenthood: Yes, I do.

CALLER: You do? About birth control?

Planned Parenthood: If I know — no, not about the birth control, but if you come in and tell me your boyfriend is 22 years old, I have to turn him in for sexual abuse.

CALLER: What? But we’re in love. I don’t understand.

Planned Parenthood: If you come in and you don’t tell me, you know, that your boyfriend is 22 years old, I don’t know how old your boyfriend is. You know? I mean, that’s none of my business. But if you come in and you tell me that your boyfriend is 22 years old, he’s going to get charged for statutory rape first of all.

Later in the conversation:

CALLER: But like if I came in and got a pregnancy test you guys wouldn’t have to tell my parents about that?

Planned Parenthood: No, I would not tell your parents you had a pregnancy test, no.

CALLER: Okay. So nobody would have to know at all?

Planned Parenthood: No one would have to know at all. You’re exactly right.

CALLER: Okay.

Planned Parenthood: Okay?

CALLER: Okay.

Planned Parenthood: Do you — would you like to call back later and make an appointment for a pregnancy test?

Permanent injunction to shut down New Woman All Woman Abortion Clinic

An ambulance arrived at the Jackson Women’s Health Organization, the only abortion clinic in Mississippi, at about 12:20 p.m. on Wednesday, August 7, and transported a female patient who emerged from the clinic in Mississippi on a gurney. The pale-skinned, brown-haired woman was covered head to toe with a blanket.

Activists from Pro-Life Mississippi photographed the incident. Those photos and a brief video taken at the scene were provided to Operation Rescue.

According to the Clarion Ledger, Around 12:20 p.m. on Wednesday an ambulance was called to the state’s only abortion clinic.

“We understand that a female patient was taken by ambulance to UMC,” said Dana Chisholm, president of Pro Life Mississippi.

The clinic is currently in the midst of a lawsuit fighting the Magnolia State’s law that says abortion clinics can employ only physicians with local hospital admitting privileges.

Pro-Life Mississippi reports that the abortionist on duty was Bruce Elliot Norman, an employee of abortion clinic owner Diane Derzis. Norman has no hospital privileges in Mississippi or in Alabama, where he also aborts babies at another abortion clinic owned by Derzis.

The Mississippi abortion clinic is owned by Diane Derzis, who also owns a clinic in Alabama.

A combination of shady practices, injured patients, and building code violations resulted in the culmination of a 76 page deficiency report filed by the Alabama Department of Public Health against (Birmingham, Ala.) New Woman All Women abortion clinic in March 2012.

According to Operation Rescue, Last year, three women who were subjected to abortions by Norman at Derzis’ Birmingham abortion clinic were hospitalized due to abortion complications at New Woman All Women. The ADPH inspected the clinic and discovered 76-pages of health and safety code deficiencies. The clinic was forced to close after the ADPH and Derzis agreed to a consent order that banned Derzis from having anything to do with any future abortion clinic or from hiring Norman to do abortions. After two failed attempts to relicense the clinic, Derzis and Norman reopened the clinic without licensure and have been operating illegally as a “doctor’s office” whose only “service” is abortions.

Justice aborted for Linda Gibbons

Justice is supposed to be blind. Too bad she ain’t.

Consider the differing treatment given to protesters arrested at the G20 summit and anti-abortion protester Linda Gibbons.

At the G20, more than 1,000 people were arrested, more than 800 of those jailed and, last week, more than 300 of them were given a mass court appearance. Some even had their charges dropped. All but those who were considered violent and dangerous were released on bail.

Then there is Linda Gibbons.

Gibbons has spent most of the last two decades protesting against abortion and for her efforts has been locked up for eight out of the last 16 years.

Her crime? Breaking a temporary injunction issued in 1994 prohibiting abortion protests outside the doors of Toronto’s Scott Clinic.

In essence Gibbons has spent more time behind bars than some murderers for getting too close to a private abortion clinic while walking on a public sidewalk.

It has shades of the changes brought in by Ontario’s Dalton McGuinty government that told police they could arrest anyone that got too close to the G20 summit.

But unlike anti-globalization protesters, university activists and union leaders with a cause — defending the rights of Linda Gibbons is not fashionable.

Gibbons and her lawyer head back to court Thursday. Daniel Santoro will seek to have the charges against his client thrown out and the temporary injunction issued by the NDP government of Bob Rae quashed. If Santoro is unsuccessful, he says his client will face a maximum penalty of six months in prison for disobeying a court order.
She’s already been in jail for 19 months.

Santoro calls the injunction unjust and a violation of his client’s Charter protected right to free expression.

He also questions how a “temporary injunction” can last this long.

The 62-year-old great-grandmother could actually be free right now but will not sign an agreement saying she will stop protesting outside of the Scott Clinic. Based on her history, if she were released she would be right back at it.

Other activists are much the same.

When Jaggi Singh, an anti-globalization hero, was released in July on charges stemming back to the G20 it was on the condition he not take part in protests until his charges were dealt with.

After his release Singh told the Toronto Star, “I personally find the no-protest and no-organizing conditions to be humiliating. It’s so patently unconstitutional.”
He’s right and the same applies to Gibbons.

Ontario has no bubble-zone law that restricts free speech outside of abortion clinics. There is no permanent injunction in place for this particular clinic either. The one put in place by long-ago attorney-general Marion Boyd was supposed to be a short-term measure. It has stuck and been enforced by police ever since.

If a similar attempt to shut down free speech outside of a legislature or city hall or even a gathering of world leaders had taken place, there would be an uproar. The civil liberties groups would demand the law be overturned. There would be daily warnings about Canada turning into a police state. Opposition politicians at the federal and provincial level would demand answers.

All of that did happen when there was an attempt to shut down free speech at the G20 summits.
