During an interview with Alex Jones , Civil Rights Attorney John Whitehead revealed that shortly before his release, psychiatrists had threatened to forcibly medicate Veteran Brandon Raub in order to “brainwash” him.

WTVR is reporting that Brandon Raub was questioned by FBI agents about his Facebok postings and then hauled away from his Chesterfield County home in handcuffs on Thursday, Aug. 16. His posts question the government’s version of the 9/11 and the role of the Federal Reserve.

In a video interview released Tuesday by Rutherford Institute, a Charlottesville-based civil liberties group whose lawyers represented Raub, the former Marine talks about his time in the service, his controversial Facebook posts and what led up to his detention.

Raub said some of the posts were between he and some friends playing a card game where different factions compete to try to take over the world.

Additionally, Raub said one of the posts on his page was simply lyrics from a Swollen Members song. Raub said the lyrics “Sharpen up my axe; I’m here to sever heads” are a metaphor.

“The truth is very powerful and has the ability to cut,” said Raub. “And the truth is not always nice. Sometimes it can be very specific, if that makes any sense.
Raub said he talked with two FBI agents from inside his door for about 10 to 15 minutes. He said the agents mentioned his Facebook posts, but were not very specific and seemed to be prodding for him to elaborate on the messages.

However, the discussion them moved outside and Raub said he started going into specifics about government conspiracy theories. He said one of the FBI agents was scribbling down what he said. He also said that at no point was he read his Miranda rights, but that he was handcuffed.

Yesterday, Circuit Court Judge Allan Sharrett, dismissed the unlawful detainment and FBI case against US veteran Brandon Raub.

The FBI petitioned the court to have Raub involuntarily detained and forced to have psychiatric evaluations after a previous hearing wherein the Special Justice Walter Douglas Stokes granted the governmental request citing entries on Raub’s private Facebook page was “terrorist in nature”.

Stokes originally sentenced Raub to 30 days commitment to a psychiatric ward at the Veterans Hospital in Salem, North Carolina.

Sharrett dismissed Stokes’ ruling citing that the original petition was “devoid of any factual allegations that it could not be reasonably expected to give rise to a case or controversy.”

John W. Whitehead, president of the Rutherford Institute, said:
“This is a great victory for the First Amendment and the rule of law. Brandon Raub was arrested with no warning, targeted for doing nothing more than speaking out against the government, detained against his will, and isolated from his family, friends and attorneys. These are the kinds of things that take place in totalitarian societies. Today, at least, Judge Allan Sharrett proved that justice can still prevail in America.”

On August 16th, Raub was removed from his Virginia home by the FBI and Secret Service without having been read his rights or presented with an arrest warrant.

According to the psychiatric manual, the DSM-IV-TR, oppositional defiant disorder (ODD) is a mental disease wherein free thinkers, non-conformists, civil disobedience supporters, those who question authority and are perceived as being hostile toward the government are labeled mentally ill. Psychiatrists refer to this mental defect as “Mentality III”.

According to Infowars: Despite controversy at the time, DHS chief Janet Napolitano said she stood by an April 2009 DHS intelligence assessment that listed returning vets as likely domestic terrorists.

Just a month later, the New York Times reported on how Boy Scout Explorers were being trained by the DHS to kill “disgruntled Iraq war veterans” in terrorist drills.
The FBI has also gone out of its way to characterize returning veterans from Iraq and Afghanistan as a major domestic terrorist threat.

Whitehead pointed to efforts on behalf of health authorities in the United States to characterize distrust of authority as a mental illness under the label “oppositional defiant disorder” or ODD.

As we highlighted earlier today, veterans in particular are being targeted in police raids to confiscate their firearms based on the manufactured pretext that they are “mentally defective.”

Earlier this year, we also reported on a similar case involving David Sarti, one of the participants in the National Geographic Channel’s Doomsday Prepper show. Sarti visited his doctor complaining of chest pains, only to have the doctor later commit him to a psychiatric ward and alert authorities, before Sarti was declared “mentally defective” and put on an FBI list that stripped him of his second amendment rights.

FEDS: Anarchist willing to use IED’s during Presidential conventions

FBI, ” on occasion, law enforcement officers take additional steps by conducting surveillance on groups of protestors, collecting information or intelligence about protestors, or commencing an investigation directed at members of a group. Although, in many situations, these law enforcement activities may be permissible, they carry the potential to raise important constitutional and public concerns to which law enforcement agencies should be sensitive.

Fox reports that the FBI has long warned of potential dangers posed by “anarchist extremism,” particularly during global summits and big events hosted in the United States.

The federal law enforcement official told Fox News there is “no credible threat” tied to international terrorism, but there is always concern that big events such as the political conventions are “attractive targets.”

According to Government Security News, which covers homeland security and IT issues, the behavioral recognition software from BRS Labs will be deployed in video cameras anywhere from a few block to a few miles around the convention sites.

Law enforcement officials are concerned about possible violence by anarchist extremists at the upcoming Republican and Democratic national conventions, according to an intelligence bulletin prepared by the FBI and Department of Homeland Security.

The seven-page bulletin, obtained by WBTV, outlines information about potential anarchist extremism-related violent criminal activity and threats to public safety during the national political conventions, which start next week in Tampa.

At one point, the Joint Intelligence Bulletin states that anarchists could try to use improvised explosive devices.

“Anarchist extremists and other domestic extremist groups probably lack the capability to overcome the heightened security measures at the RNC and DNC venues,” the report states, “but could target nearby infrastructure, including local businesses or transportation systems and law enforcement personnel.”

The report states that a majority of anarchist activities during major events usually involve acts of property damage, vandalism and trespassing. Past extremists have escalated to violent tactics such as assault and arson.

According to the unclassified document, individuals were reported coordinating criminal actions against the Bank of America in Charlotte, via a free downloadable software application, in May 2012.

A spokesperson for the Charlotte office of the FBI told WBTV that she could not comment on the document.

“I can tell you the FBI utilizes a variety of means to communicate with law enforcement and share information to assist in their overall situational awareness.” she told WBTV.

The document notes anarchists have a history of trying to disrupt major events.

“During past national and international political and economic events, anarchist extremists have blocked streets, intersections, and bridges to disrupt or impede local business operations and public transportation access and, in some instances have initiated violent confrontations with police,” the document states.

“FBI and DHS assess with high confidence anarchist extremists will target similar infrastructure in Tampa and Charlotte, with potentially significant impacts on public safety and transportation,” according to the law enforcement alert.

The FBI routinely issues intelligence bulletins in advance of many major events to warn local law enforcement of possible security concerns.

The bulletin says that law enforcement agencies believe most protesters at the conventions will obey laws and not commit violent acts, but that anarchists are the most likely exceptions.

The notice warns of certain things state and local law enforcement should be on the watch for.

Those include anarchists acquiring materials that could be used to make improvised explosive devices, obtaining firearms training and preparing for violence with groups they oppose — such as white supremacists.

Anarchists often research potential targets, according to the bulletin.

“Extremists will likely use secure communication methods and social networking sites, Internet chat rooms, message boards, and mobile devices such as smart phones to coordinate and facilitate violence or criminal activity,” the document states.

The report states that while the FBI and Homeland Security believe a majority of protesters at the DNC will be lawful and non-violent, the RNC will be a test for the extremists.

“The perceived success or failure of the anarchist extremists actions leading up to the conventions, as well as at the earlier RNC in Tampa, will likely impact the strategies of anarchist extremists preparing to disrupt the DNC.”

ST. PAUL, Minn. — A Minnesota state lawmaker who authorities say admitted having a liaison with a 17-year-old boy at a rest stop faced calls from party leaders Monday to give up his re-election bid.

Rep. Kerry Gauthier, 56, hasn’t been charged in the July incident, and authorities said he wouldn’t be because the boy was older than 16, the legal age of consent, and no money was exchanged. Police say the teenager responded to the lawmaker’s Craigslist ad for “no strings attached” sex.

Gauthier admitted to the liaison, according to police reports made public late last week. The teen told police the two had oral sex, according to the reports.

The scandal has hurt Democrats’ hopes of retaking at least one chamber of the Legislature. They need to pick up at least six seats in the House, and Gauthier’s Duluth-area seat usually is reliably Democratic. But if he drops out, any Democrat seeking to replace him would have to run as a write-in candidate, making the race much more difficult to win.

Terroristic Concerns a reason to arrest NJ street preachers

Two Christian evangelists were arrested in West Windsor, New Jersey early Tuesday morning after preaching the Gospel without obtaining permission and for attempting to record the encounter with police.

Robert Parker and Don Karns state that they have been preaching at the Princeton Junction train station for several years, which is a part of the New Jersey Transit system, a provider of public transportation.

They explained to Christian News Network that after they had finished preaching and witnessing to those waiting for trains, and were leaving, they were approached by Sergeant Kathleen Shanahan and Officer Sandy Crowe. Parker and Karns said that Shanahan was “extremely hostile.”

The officers stated that the evangelists had violated the law for speaking at the train station without a “permit,” and demanded identification. Parker and Karns attempted to record the encounter with their cell phones, but were ordered to turn them off, which they did.

“[Sergeant Shanahan] started repeatedly saying, ‘Put the phone down; put the phone down,’” Karns recounted. “You guys are big guys, and I’m just a little officer. You know how scary it is when you have a camera in your hand. How do I know you’re not terrorists? I have no way of knowing that’s not a bomb.”

Homeland Security on guard for ‘right-wing extremists’

WorldNet Daily WASHINGTON – In April of 2009, a newly unclassified Department of Homeland Security report warns against the possibility of violence by unnamed “right-wing extremists” concerned about illegal immigration, increasing federal power, restrictions on firearms, abortion and the loss of U.S. sovereignty and singles out returning war veterans as particular threats.

The report, titled “Right-wing Extremism: Current Economic and Political Climate Fueling Resurgence in Radicalization and Recruitment,” dated April 7, states that “threats from white supremacist and violent anti-government groups during 2009 have been largely rhetorical and have not indicated plans to carry out violent acts.”

However, the document, first reported by talk-radio host and WND columnist Roger Hedgecock, goes on to suggest worsening economic woes, potential new legislative restrictions on firearms and “the return of military veterans facing significant challenges reintegrating into their communities could lead to the potential emergence of terrorist groups or lone wolf extremists capable of carrying out violent attacks.”

The report from DHS’ Office of Intelligence and Analysis defines right-wing extremism in the U.S. as “divided into those groups, movements and adherents that are primarily hate-oriented (based on hatred of particular religious, racial or ethnic groups) and those that are mainly anti-government, rejecting federal authority in favor of state or local authority, or rejecting government authority entirely. It may include groups and individuals that are dedicated to a single issue, such as opposition to abortion or immigration.”

“[T]he consequences of a prolonged economic downturn – including real estate foreclosures, unemployment and an inability to obtain credit – could create a fertile recruiting environment for right-wing extremists and even result in confrontations between such groups and government authorities similar to those in the past,” the report says.

It adds that “growth in these groups subsided in reaction to increased government scrutiny as a result of the 1995 Oklahoma City bombing and disrupted plots, improvements in the economy and the continued U.S. standing as the pre-eminent world power.”

“Proposed imposition of firearms restrictions and weapons bans likely would attract new members into the ranks of right-wing extremist groups as well as potentially spur some of them to begin planning and training for violence against the government,” the report continues. “The high volume of purchases and stockpiling of weapons and ammunition by right-wing extremists in anticipation of restrictions and bans in some parts of the country continue to be a primary concern to law enforcement.”

Most notable is the report’s focus on the impact of returning war veterans.

“Returning veterans possess combat skills and experience that are attractive to right-wing extremists,” it says. “DHS/I&A is concerned that right-wing extremists will attempt to recruit and radicalize veterans in order to boost their violent capacities.”

The report cites the April 4 shooting deaths of three police officers in Pittsburgh as an example of what may be coming, claiming the alleged gunman holds a racist ideology and believes in anti-government conspiracy theories about gun confiscations, citizen detention camps and “a Jewish-controlled ‘one-world government.'”

It also suggests the election of an African-American president and the prospect of his policy changes “are proving to be a driving force for right-wing extremist recruitment and radicalization.”

The report also mentions “‘end times’ prophecies could motivate extremist individuals and groups to stockpile food, ammunition and weapons. These teachings also have been linked with the radicalization of domestic extremist individuals and groups in the past, such as the violent Christian Identity organizations and extremist members of the militia movement.”

“DHS/I&A assesses that right-wing extremist groups’ frustration over a perceived lack of government action on illegal immigration has the potential to incite individuals or small groups toward violence,” the report continues.

The report states the DHS will be working with state and local partners over the next several months to determine the levels of right-wing extremist activity in the U.S.

Last month, the chief of the Missouri highway patrol blasted a report issued by the Missouri Information Analysis Center that linked conservative groups to domestic terrorism, assuring that such reports no longer will be issued. The report had been compiled with the assistance of DHS.

The report warned law enforcement agencies to watch for suspicious individuals who may have bumper stickers for third-party political candidates such as Ron Paul, Bob Barr and Chuck Baldwin.

It further warned law enforcement to watch out for individuals with “radical” ideologies based on Christian views, such as opposing illegal immigration, abortion and federal taxes.

Chief James Keathley of the Missouri State Patrol issued a statement that the release of the report, which outraged conservatives nationwide, prompted him to “take a hard look” at the procedures through which the report was released by the MIAC.

“My review of the procedures used by the MIAC in the three years since its inception indicates that the mechanism in place for oversight of reports needs improvement,” he wrote. “Until two weeks ago, the process for release of reports from the MIAC to law enforcement officers around the state required no review by leaders of the Missouri State Highway Patrol or the Department of Public Safety.”

“For that reason, I have ordered the MIAC to permanently cease distribution of the militia report,” he said. “Further, I am creating a new process for oversight of reports drafted by the MIAC that will require leaders of the Missouri State Highway Patrol and the Department of Public Safety to review the content of these reports before they are shared with law enforcement. Remember the Occupy Movement? Since last November, when the NYPD closed the Zuccotti Park encampment in downtown Manhattan –the Movement’s birthplace and symbolic nexus—Occupy’s relevance has seriously dwindled, at least as measured by coverage in the mainstream media. We’re told that this erosion is due to Occupy’s own shortcomings—an inevitable outcome of its disjointed message and decentralized leadership.

According to Business Insider: While that may be the media’s take, the U.S. Government seems to have a different view.

If recent documents obtained by the Partnership for Civil Justice Fund (PCJF) are any indication, the Occupy Movement continues to be monitored and curtailed in a nationwide, federally-orchestrated campaign, spearheaded by the Department of Homeland Security (DHS).

In response to repeated Freedom of Information Act (FOIA) requests by the Fund, made on behalf of filmmaker Michael Moore and the National Lawyers Guild, the DHS released a revealing set of documents in April. But the latest batch, made public on May 3rd, exposes the scale of the government’s “attention” to Occupy as never before.

The documents, many of which are partially blacked-out emails, demonstrate a surprising degree of coordination between the DHS’s National Operations Center (NOC) and local authorities in the monitoring of the Occupy movement. Cities implicated in this wide-scale snooping operation include New York, Oakland, Atlanta, Washington, D.C., Denver, Boston, Portland, Detroit, El Paso, Houston, Dallas, Seattle, San Diego, and Los Angeles.

Interest in the Occupy protesters was not limited to DHS and local law enforcement authorities. The most recently released correspondence contains Occupy-related missives between the DHS and agencies at all levels of government, including the Mayor of Portland, regional NOC “fusion centers,” the General Services Administration (GSA), the Pentagon’s USNORTHCOM (Northern Command), and the White House. Mara Verheyden-Hilliard, Executive Director of the PCJF, contends that the variety and reach of the organizations involved point to the existence of a larger, more pervasive domestic surveillance network than previously suspected.

These documents show not only intense government monitoring and coordination in response to the Occupy Movement, but reveal a glimpse into the interior of a vast, tentacled, national intelligence and domestic spying network that the U.S. government operates against its own people. These heavily redacted documents don’t tell the full story. They are likely only a subset of responsive materials and the PCJF continues to fight for a complete release. They scratch the surface of a mass intelligence network including Fusion Centers, saturated with ‘anti-terrorism’ funding, that mobilizes thousands of local and federal officers and agents to investigate and monitor the social justice movement.

As alarmist as Verheyden-Hilliard’s charge may sound, especially given the limited, bowdlerized nature of the source material, the texts made available contain disturbing evidence of insistent federal surveillance. In particular, the role of the “Fusion Centers,” a series of 72 federally-funded information hubs run by the NOC, raises questions about the government’s expansive definition of “Homeland Security.”

Created in the wake of 9/11, the Fusion Centers were founded to expedite the sharing of information among state and local law enforcement and the federal government, to monitor localized terrorist threats, and to sidestep the regulations and legislation preventing the CIA and the military from carrying out domestic surveillance (namely, the CIA ban on domestic spying and the Posse Comitatus Act).

Is nonviolent, albeit obstructive, citizen dissent truly an issue of national security? The DHS, for its part, is aware of the contentiousness of civilian monitoring. That’s why, in a White House-approved statement to CBS News included in the dossier, DHS Press Secretary Matthew Chandler asserts that

Any decisions on how to handle specifics (sic) situations are dealt with by local authorities in that location. . . DHS is not actively coordinating with local law enforcement agencies and/or city governments concerning the evictions of Occupy encampments writ large.

However, as a reading of the documents unmistakably demonstrates, this expedient PR nugget is far from the truth. In example after example, from its seeking of “public health and safety” grounds from the City of Portland for Occupy’s ejection from Terry Schrunk Plaza, to its facilitation of information sharing between the police departments of Chicago and Boston (following a 1500-person Occupy protest in Chicago), the DHS’s active ”coordinating” with local authorities is readily apparent. Other communiqués are even more explicit in revealing a national focus, such as the DHS’s preemptive coordination with the Pentagon about a port closure in Oakland, and its collection of identity and contact information of Occupy protesters arrested at a Bank of America in Dallas.

Those Pesky Amendments

The right to public assembly is a central component of the First Amendment. The Fourth Amendment is supposed to protect Americans from warrantless searches—with the definition of “search” expanded in 1967 to include electronic surveillance, following the Supreme Court’s ruling in Katz v. United States. Assuming the Occupy protesters refrain from violence—and the vast majority do, in accord with a stated tenet of the Occupy movement—the movement’s existence is constitutionally protected, or should be.

The DHS’s monitoring, documenting, and undermining of protesters may in fact violate the First Amendment. In a recent piece for Dissent Magazine, sociologist James B. Rule explains the fundamental importance of a movement like Occupy in the American political landscape.

This surveillance campaign against Occupy is bad news for American democracy. Occupy represents an authentic, utterly home-grown, grassroots movement. Taken as a whole, it is neither terrorist nor conspiratorial. Indeed, it is hard to think of another movement so cumbersomely public in its deliberations and processes. Occupy is noisy, disorderly, insubordinate, and often inconvenient for all concerned—statements that could equally well apply to democracy in general. But it should never be targeted as a threat to the well-being of the country—quite the contrary.

Accordingly, Rule calls for the White House to rein in the ever-expanding surveillance activity of the DHS—which he contends is motivated by its own funding interests, and which prioritizes security at the expense of civil liberties.

The resource-rich Department of Homeland Security and its allies no doubt see in the rise of the movement another opportunity to justify their own claims for public legitimacy. We can be sure that many in these agencies view any noisy dissent as tantamount to a threat to national security.

Nobody who cares about democracy wants to live in a world where simply engaging in vociferous protest qualifies any citizen to have his or her identity and life details archived by state security agencies. Specific, overt threats of civil disobedience or other law-breaking should be dealt with on a piecemeal basis—not by attempting to monitor everyone who might be moved to such actions, all the time. Meanwhile, the White House should issue clear directives that identification and tracking of lawful protesters will play no further role in any government response to this populist moment.

Optimistic as it may be, Rule’s appeal to the White House is a problematic one, given the ubiquitous influence of the DHS revealed by these documents. If the White House-approved press release is any indication, the Oval Office, while not directly authorizing the DHS’s initiatives, is certainly turning a blind eye to the Department’s focus on the Occupy movement as a potential terrorist threat. Federal surveillance of citizens in the Bush years, most visible in NSA warrantless wiretapping controversy, has apparently not ceased with Obama’s inauguration.

Which raises the question: Does Obama, as he claims, “stand with the 99 percent,” or with those who cannot stand them?

Obama Executive Order: Peacetime Martial Law!

This Executive Order was posted on the WhiteHouse.gov web site on Friday, March 16, 2012, under the name National Defense Resources Preparedness. In a nutshell, it’s the blueprint for Peacetime Martial Law and it gives the president the power to take just about anything deemed necessary for “National Defense”, whatever they decide that is. It’s peacetime, because as the title of the order says, it’s for “Preparedness”. A copy of the entire order follows the end of this story.

Under this order the heads of these cabinet level positions; Agriculture, Energy, Health and Human Services, Transportation, Defense and Commerce can take food, livestock, fertilizer, farm equipment, all forms of energy, water resources, all forms of civil transporation (meaning any vehicles, boats, planes), and any other materials, including construction materials from wherever they are available. This is probably why the government has been visiting farms with GPS devices, so they know exactly where to go when they turn this one on.

Specifically, the government is allowed to allocate materials, services, and facilities as deemed necessary or appropriate. They decide what necessary or appropriate means.

UPDATE: BIN reader Kent Welton writes: This allows for the giving away of USA assets and subsidies to private companies: “(b) provide for the modification or expansion of privately owned facilities, including the modification or improvement of production processes, when taking actions under sections 301, 302, or 303 of the Act, 50 U.S.C. App. 2091, 2092, 2093; and (c) sell or otherwise transfer equipment owned by the Federal Government and installed under section 303(e) of the Act, 50 U.S.C. App. 2093(e), to the owners of such plants, factories, or other industrial facilities.”

What happens if the government decides it needs all these things to be prepared, even if there is no war? You likely won’t be able to walk into a store to purchase virtually anything because it will all be requisitioned, “rationed” and controlled by the government. Construction materials, food like meat, butter and sugar, anything imported, parts, tires and fuel for vehicles, clothing, etc. will likely become unobtainable, or at least very scarce. How many things are even made here in the USA any more?

A bit of history… During WWII, price stabilization didn’t begin until May of 1942, which froze prices on nearly all every day goods and rationing started in 1943. Why would the government want to control everything before a war?

Under this new Executive Order, cabinet heads are authorized to loan money, offer loan guarantees and even subsidize payments at above market rates (no bid contracts?) for whatever they need. This could make Solyndra or Halliburton look like Junior Achievement. Nothing like a war will generate these kinds of huge profits for the corporate “partners” and you can bet the bankers and contractors are already lining up for this one—because under this order no war is even required!

In a crisis situation, the government will be able to take whatever they need, print money to get whatever they want and distribute it as they see fit….for the benefit of a “war effort” or the politically connected corporations and individuals. All other contracts except those for employment are superseded by this executive order, it’s all here in black and white.

Specifically, it orders:

“to require acceptance and priority performance of contracts or orders (other than contracts of employment) to promote the national defense over performance of any other contracts or orders, and to allocate materials, services, and facilities as deemed necessary or appropriate to promote the national defense, is delegated to the following agency heads:

the Secretary of Agriculture with respect to food resources, food resource facilities, livestock resources, veterinary resources, plant health resources, and the domestic distribution of farm equipment and commercial fertilizer;
the Secretary of Energy with respect to all forms of energy;
the Secretary of Health and Human Services with respect to health resources;
the Secretary of Transportation with respect to all forms of civil transportation;
the Secretary of Defense with respect to water resources; and
the Secretary of Commerce with respect to all other materials, services, and facilities, including construction materials.

Democrats to continue Internet coup with new cyber bill

Senate Majority Leader Harry Reid, following a recent anti-piracy legislative debacle with SOPA and PIPA, will lead his second effort of 2012 to push Internet-regulating legislation, this time in the form of a new cybersecurity bill. The expected bill is the latest attempt by the Democrats to broadly expand the authority of executive branch agencies over the Internet.

Details about the bill remain shrouded in secrecy. Clues available to the public suggest that the bill might be stronger than President Barack Obama’s cybersecurity proposal, which was released in May 2011. Reid said that he would bring the bill — expected to come out of the Senate Homeland Security and Government Affairs Committee, chaired by Connecticut independent Sen. Joe Lieberman — to the floor during the first Senate work period of 2012.

A classified meeting behind closed doors in October 2011 between key Senate committee leaders with jurisdiction over cybersecurity and White House officials, took place at the request of the Obama administration. Lieberman, in an interview with The Hill in October, said that past Senate cybersecurity bills were considerably stronger than the White House proposal.

The White House proposal recommended that the Department of Homeland Security be given broad regulatory authority for cybersecurity matters over civilian networks. The White House proposal also recommends that the DHS program be “developed in consultation with privacy and civil liberties experts and with the approval of the Attorney General.”
