Over the past few years, a total of sixteen babies have been born alive after attempted abortions in the state of Florida, according to online reports. The information, collected by the state from abortion providers, is compiled in the report, “ITOP Report of Infants Born Alive, By County Where Terminations Occurred, Florida,” on file at the Agency for Health Care Administration (AHCA). According to a spokesperson from the AHCA, ITOP stands for “Induced Termination of Pregnancy.”

Thus far in 2018, one baby has been born alive in Florida during an abortion attempt. In 2017, there were 11 abortion survivors. There were none recorded born alive in 2016 or 2013, but there were four abortion survivors in 2015.

A previous Live Action News report noted that in 2015 alone, there were several reports of abortion survivors: one in Michigan, five in Minnesota, and, as already mentioned, four in Florida — three in Alachua County and one in Jackson County. That same year, 5,132 elective abortions were reportedly committed on women between the 13th and 24th week of pregnancy; that number has since been updated to 5,195 with a total of 5,695 for all reasons, including various “health” reasons.

Now, only a few years later, that number has increased substantially, especially in Alachua County.

Although the documents do not indicate whether the reports of abortion survivors originated from a hospital or an abortion facility, records currently on file with the state reveal that there are only two licensed abortion facilities in Alachua County where ten babies have been reported to have survived abortion attempts since 2015. One is an abortion facility called Bread and Roses, and the other is the All Women’s Health Center, a chain which operates multiple abortion facilities in the state — including the only licensed abortion facility in Seminole County, where one baby was reported to have survived an abortion in 2017.

State records also show that there are six licensed abortion facilities in Hillsborough County, where three babies survived abortion attempts in 2017. Of those six facilities, two are Planned Parenthood centers. In Jackson County, where one baby survived an abortion in 2015, there are currently no licensed abortion facilities.

In Orange County, where another baby survived an abortion attempt in 2017, there are currently three licensed abortion facilities (down from five in 2016 and six in 2017) including two Planned Parenthood facilities and a late-term facility operated by the infamous James Scott Pendergraft.

Florida’s official definitions for how abortion providers are to file their reports define a baby born alive as one that is breathing, has a beating heart, or has voluntary muscle movements after expulsion:

Was/were the infant(s) born alive during or immediately after attempted abortion? – Select the appropriate response. “Born alive” is defined in 390.011(4), F.S. as: “Born alive” means the complete expulsion or extraction from the mother of a human infant, at any stage of development, who, after such expulsion or extraction, breathes or has a beating heart, or definite and voluntary movement of muscles, regardless of whether the umbilical cord has been cut and regardless of whether the expulsion or extraction occurs as a result of natural or induced labor, caesarean section, induced abortion, or other method.

What happened to the babies who survived the attempted abortions is unclear, as no additional information was available from the reports.

Florida law requires that “[a]n infant born alive during or immediately after an attempted abortion must be immediately transported and admitted to a hospital pursuant to s. 390.012(3)(c) or rules adopted thereunder.” The law also requires that any employee of a hospital, physician’s office, or an abortion clinic who is aware of a violation of the born-alive law must report it.

In 2013, as Live Action News has previously reported, during hearings in Florida about protecting abortion survivors, lobbyist Alisa LaPolt Snow (representing the Florida Alliance of Planned Parenthood Affiliates), admitted to the Florida legislature that Planned Parenthood takes issue with allowing infants born alive after failed abortions to be transported to a hospital.

In the video, the Planned Parenthood spokesperson states that the organization believes the decision about whether to assist a baby who survives and abortion should be left up to the woman and her abortion provider. The shocking dialogue shows the depraved mentality behind abortion – that even if the baby escapes the horrific procedure alive and is struggling to survive on the table, abortion providers still want the power to terminate that child’s life.

Since 2015, the state of Florida has reported nearly 221,000 abortions (YTD) including over 13,000 “elective” second trimester (13 to 24 weeks) abortions out of a total of 16,000 second trimester abortions for all reasons, including “health of the mother or baby.”

To date, the state has only reported one third trimester abortion since 2015.

Reports detailing health inspections at Florida abortion facilities for 2016 reveal that deficient practices were identified in 23 of the 68 inspections conducted by health officials that year, and 15 out of 55 in 2017. Inspectors found expired medications, missing documents, discrepancies in medical records, inadequate equipment, and one including missing documentation on gestational age, among other infractions. In addition, in 2016, state fines were issued in 20 instances where abortion facilities filed late ITOP reports. The following year, in 2017, fines were assessed in 10 instances for facilities which filed late reports.

Infants born alive inside abortion facilities have haunted the abortion industry for many years, as Live Action News has documented several times. In fact, one national news outlet even dubbed the term the “dreaded complication.” In 2013, Live Action’s undercover cameras exposed the chilling admissions of abortionists inside America’s late-term abortion industry during third trimester abortions and partial-birth abortions. Although these abortionists confess to the humanity of often viable, fully developed children, they inflict inhuman and cruel abortion procedures against them.

In the video above, you can hear one abortion staffer telling Live Action’s undercover patient that “one medical definition of a baby, I think, is, technically, until it’s born. Until then, when it’s in gestation it’s considered a fetus.”

This kind of delusional dehumanization of preborn children is the very reason why abortion is so prevalent today.

Documents from three states indicate that babies may be born alive after abortions more often then we might expect. Published data for 2015 shows that ten babies in just Florida, Minnesota, and Michigan were reported to have been born alive following an abortion attempt. The documents indicate that many more may have been born alive after abortions in previous years.

Florida law requires that “[a]n infant born alive during or immediately after an attempted abortion must be immediately transported and admitted to a hospital pursuant to s. 390.012(3)(c) or rules adopted thereunder.” The law also requires that any employee of a hospital, physician’s office, or an abortion clinic who is aware of a violation of the born-alive law report it.

Based on data reviewed for this article, most of the cases of live births following an abortion were reported by a hospital rather than a clinic. But public reports show that abortion clinics have experienced the “dreaded complication” of live-birth abortions as well. Live Action News has detailedseveral instances.

One chilling report from an abortion clinic came in 2005. It was documented in the heart-wrenching phone call below, made after a Florida woman contacted 911, reporting that her friend’s baby was born alive and left to die:

The mother told blogger Jill Stanek that the infant, named Baby Rowan, was delivered alive in the toilet.

“The very moment I saw my son was alive, nothing else in the whole world mattered but Rowan’s safety! I fell immediately in love with my baby boy and was afraid of nothing that I ever feared before. Only one thing mattered to me: getting Rowan help. I begged, repeatedly.”

She then relayed to Stanek how she waited 11 minutes for help to arrive while clinic workers turned ambulance drivers away claiming the call was placed by a hysterical patient.

MINNESOTA

The state of Minnesota also requires that abortion staff report whether any abortion resulted in a born-alive infant.

In 2015, there were five born-alive incidents, according to a report of induced abortions presented to the legislature. The cases occurred in “two hospitals, included in Table 1.1 as ‘Independent Physicians,’” according to the report.

Minnesota state law requires that:

When an abortion is performed after the twentieth week of pregnancy, a physician, other than the physician performing the abortion, shall be immediately accessible to take all reasonable measures consistent with good medical practice, including the compilation of appropriate medical records, to preserve the life and health of any born alive infant that is the result of the abortion.

Despite this fact, the report states that all of the infants were reported to “have lethal fetal anomalies incompatible with life and thus no measures were taken to preserve the life of these infants.”

Sadly, none of the babies survived. They were instead left to die, based on their disabilities.

MICHIGAN

report entitled “Number of Reported Induced Abortions by Evidence of Life,” from the State of Michigan, indicates that in 2015, one baby survived an abortion attempt.

The information can be found under Abortion Statistics, published by the Michigan Department of Health and Human Services (MDHHS). To view the report, scroll under the heading “Abortion,” then “Michigan Occurrences, by Evidence of Life.”

A spokesperson with MDHHS said the term “present” in the report pictured below indicates that life was present in the baby, upon the complete expulsion or extraction from the mother. The reports are sent in anonymously, and MDHHS does not conduct any follow-up to determine what occurred or whether the child survived.

Information published in the State’s Physician’s Handbook on the Reporting of Abortions shows that abortion providers must answer, “Did the Fetus Show Evidence of Life When Separated, Expelled or Removed From the Woman? (yes/no).”

It goes on to define a live birth from an abortion:

Evidence of life is constituted by breathing, beating of the heart, pulsation of the umbilical cord or definite movement of voluntary muscles. A fetus showing such evidence of life must be reported as a live born, in which case BOTH AN ABORTION REPORT AND A CERTIFICATE OF LIVE BIRTH MUST BE FILED.

Additional abortion reports from previous years show that a number of babies showed “evidence of life” after abortions in Michigan:

  • 2008 – Out of 25,970 abortions, life was present in one baby, and one was not reported.
  • 2009 – Out of 22,357 abortions, life was present in one baby.
  • 2010 – Out of 23,307 abortions, life was present in one baby. and two were not reported.
  • 2011 – Out of 23,366 abortions, life was present in five babies, and seventeen were not reported.
  • 2012 – Out of 23,230 abortions, life was present in one baby, and two were not reported.
  • 2013 – Out of 26,120 abortions, life was present in two babies, and six were not reported.

Clearly, babies are being born alive following an abortion, but Michigan is not following up on what abortionists or their staff are doing to these babies or on what is happening in the unreported cases. According to MDHHS, “not reported” means that neither yes nor no was checked on the required form.

Born-Alive Protection Acts

In 2002, the Federal Born Alive Infant Protection Act passed both Houses of Congress with bipartisan support, due in part to testimony from Stanek, formerly a labor and delivery nurse, who once held a born-alive infant in her arms after the baby survived an abortion performed at an Illinois hospital.

Stanek’s grueling testimony reads in part:

One night, a nursing co-worker was taking a Down’s syndrome baby who was aborted alive to our Soiled Utility Room because his parents did not want to hold him, and she did not have time to hold him. I could not bear the thought of this suffering child dying alone in a Soiled Utility Room, so I cradled and rocked him for the 45 minutes that he lived. He was between 21 and 22 weeks old, weighed about 1/2 pound, and was about 10 inches long. He was too weak to move very much, expending any energy he had trying to breathe. Toward the end he was so quiet that I could not tell if he was still alive. I held him up to the light to see through his chest wall whether his heart was still beating. After he was pronounced dead, we folded his little arms across his chest, wrapped him in a tiny shroud, and carried him to the hospital morgue where all of our dead patients are taken.

Today, thanks to born-alive protections in some states and federally, there has been at least one documented occasion where an abortion provider requested emergency assistance after a baby survived:

This case is believed to be an outlier, as life-saving efforts dedicated to a baby who is born alive after an attempted abortion are rare.

In fact, comments made by a former Planned Parenthood medical director shed light on the real situation that often occurs in abortion clinics and even in some hospitals. Dr. DeShawn Taylor, who was caught in undercover footage by the Center for Medical Progress, told the CMP investigator that identifying “signs of life” after a baby survives an abortion is contingent upon “who’s in the room.”

Another violent act against pro-life sidewalk counselors, are they on the increase?

The media continues to portray pro-lifers as crazed and violent people who go around attacking women, but the truth is, there are many acts of violence that occur against activists who oppose abortion. Case in point is an incident which occurred recently in Orlando Florida where two pro-life sidewalk counselors say they felt threatened as they warned the parents of a young girl taking their daughter for an abortion that the clinic had a bad reputation.

Pro-lifers Michele Herzog and Sandra Diaz were outside the EPOC abortion clinic in Orlando, Florida, which is owned by the notorious James Pendergratft when they had an altercation with an abortion advocate. Diaz told Live Action News that when they noticed when a car with New Hampshire license plates pull into the abortion clinic they observed how young the girl in the vehicle was.

    I told Michele she is very young.

Diaz said that Herzog, who regularly counsels outside Florida abortion clinics, was only trying to give the couple some materials warning them about how dangerous that facility was when the woman in the car came towards her in a very aggressive manner.

    The woman came out of the back seat and didn’t go towards the abortion clinic. She went at Michele in an aggressive way.

Diaz said the woman was screaming at Michele and making describing her daughter’s preborn baby as small claiming that the baby would not feel pain. In a video of the incident provided to Live Action News, you can hear the woman angrily say:

    The fetus is this small.

Herzog pointed out to the angry woman that abortion clinic kills children up to 24 weeks. That is when the woman noticed that Diaz had her camera phone out and was recording the altercation. Herzog detailed what happened next:

    The woman began screaming at us and ran toward me and stood right in my face, it looked like she was going to punch me so Sandra got her camera out to video tape, and when she saw that, she went ballistic and lunged toward Sandra and ripped the phone out of her hands. She walked off with it and wouldn’t give it back.

Diaz said that she asked the woman to please return her phone but the abortion mom charged to the other side of driveway, where her son was standing and yelled at him as well.

    I told her get away from my son. And I realized that she was being demonic so I said ‘I rebuke you Satan.

Diaz and Herzog flagged down a police officer and as he pulled into the clinic, the woman ran to his car but, according to Diaz did not immediately listen to the officer to back away. The officer eventually retrieved the phone and returned it to Diaz where the video Diaz was able to capture collaborated Diaz’s story. Diaz was given a victim sheet to fill out and has requested that theft charges be filed against the women. She has yet to hear what authorities intend to do.

Meanwhile, Diaz states that the young girl never had the abortion and the family left the clinic after the incident.

Police called to Planned Parenthood after man threatens prolife with gun

In another example that occurred over a year ago, Gloria Boze, who is a regular outside a Planned Parenthood in Colorado, told Live Action News that after she was threatened with a gun. authorities refused to prosecute the offender. According to the pro-life sidewalk counselor, she petitioned a man to take his wife and leave Planned Parenthood when he threatened her with a gun. Boze recalled his words.

    I have a gun in my car, and I’m going to shoot you.

She said their pro-life group immediately called the police who arrived within minutes as the man was about to leave Planned Parenthood.

    He was taken out of his car, placed in handcuffs, and put in the back of a police cruiser.

She said that when police searches his car they found the fully loaded weapon in the back seat.

    There was also an ammo clip hanging from the rear view mirror. We were all so shocked.

    After about 2 hours the man was released and went back in to Planned Parenthood. It was stunning to think that a man could threaten to kill you, be found to have a loaded gun in his car, and then return to his life, no harm, no foul. The police never
    spoke to us again to let us know that the man had been let go.

According to Boze, when the police report came out there was no mention of the gun whatsoever!

    Because we had the video, and told them so, they amended their report and then included the gun. Several months later I got a call from the district attorney handling the case informing me that she would not bring it to trial. The reason being that there was no way that a jury would find the defendant guilty due to the emotionally charged reasons this man was at Planned Parenthood. He and his wife were at the abortion clinic because she was dying of terminal cancer and had to terminate the pregnancy. Absurd.

And, where guns are concerned this isn’t the first time pro-lifers have been threatened. In 2010, Operation Rescue documented that an abortion advocate threatened to gun down a pro-life activists at a late-term abortion clinic in Albuquerque, New Mexico. Also in 2010, Charleston Police arrested abortionist Gary Boyle after he pointed a gun at three abortion protesters near the back entrance of the Charleston’s Women’s Medical Center abortion center in South Carolina.

In 2015, an Indiana man was arrested after he threatened anti-abortion activists with a gun at an Illinois Planned Parenthood. Then, in July of that same year, Bristol, Tennessee, police arrested Derrick Doss just outside the Bristol Women’s Clinic abortion clinic after he brandished a gun at pro-life demonstrators as he walked into clinic with his girlfriend. And in North Carolina police refused to arrest another man who pulled out a weapon to threaten Abortion Abolitionists outside the A Woman’s Choice abortion clinic in Raleigh.

Bud Shaver, Executive Director of Protest ABQ, who is a regular presence outside a late term abortion clinic in Albuquerque, New Mexico, owned by abortionist Curtis Boyd, along with his wife Tara and others, has been a frequent target of violence. He said the real violence comes from abortion advocates.

    We are using every peaceful and legal avenue available to expose the violent atrocities perpetuated against babies in the womb. Abortion is the ultimate act of violence and from our experience here in New Mexico, those who advocate for the extreme position of killing a baby for any reason through all nine months of pregnancy are the violent ones.

Florida passes bills on abortion that could defund Planned Parenthood

Florida has become yet another state to defund Planned Parenthood. Florida Governor Rick Scott signed a law that cuts off state funding to clinics providing abortion and imposes abortion restrictions already being tested before the U.S. Supreme Court.

    Abortion clinics throughout Florida will go without taxpayer funds, face increased reporting requirements and new hurdles for doctors providing the procedure under a bill signed Friday by Gov. Rick Scott.

    Scott, a Republican, did not make any comment on HB 1411, which was signed with 67 other bills, but the flood of statements from abortion rights and anti-abortion groups alternatively condemning and praising the move reflects the sharp divide over the issue.

    “As a result of this bill, thousands of people across Florida may no longer be able to access essential reproductive health care, such as cancer screenings, birth control, and well-woman exams,” said Cecile Richards, president of Planned Parenthood. “This cruel bill is designed to rip health care away from those most at risk. Rick Scott has shown he will do all he can to strip basic care away from those who need it most.”

    But John Stemberger, president of the Florida Family Policy Council, an Orlando-based social conservative advocacy group, hailed the bill as protecting women’s’ health, since more inspections will ensure greater quality care.

    “This is a historic victory and we are thrilled to have been an active part of this effort,” Stemberger said.

    Lawmakers wrote the new measure following last summer’s controversy over videos that appeared to show Planned Parenthood officials talking about their fetal tissue donation program.

    The law redefines the trimesters of a pregnancy, validating claims by state regulators last summer alleging Florida’s Planned Parenthood sites violated their licenses. And the funding cuts could affect six Planned Parenthood clinics.

Years ago, a Planned Parenthood lobbyist said that allowing babies to die on the table after being aborted was between the “Doctor and their patient.”

Florida Planned Parenthood lobbyist Alisa LaPolt Snow testified against a ‘Born Alive’ infant protection bill that would give human rights to babies born after a botched abortion. She said doctors in abortion clinics should not be required to take such babies to a hospital, instead leaving the ‘choice’ of what to do up to them and their patients.

Other clinic regulations have also been proposed.

Starting July 1, abortion clinics will be required to have admitting privileges or transfer agreements with a nearby hospital. They also will face annual inspections by the state as part of a law that sponsor Sen. Kelli Stargel, R-Lakeland, said is about ensuring women’s safety.

“What we did with these clinics is just treat them similar to other surgery centers,” Stargel said.

Florida abortion clinic may close after owner’s arrest and criminal charges

The State of Florida is threatening to close an abortion clinic owned by a notorious late term abortion provider who was recently arrested on drug charges in another state. James Scott Pendergraft, who operates 5 abortion clinics in the state, was arrested in October of 2015 for possession of drugs after being stopped for speeding in South Carolina. As Live Action News previously reported, at the time of his arrest, Pendergraft, was also found to have in his possession surgical implements that were covered in blood and human tissue from abortions he had illegally performed throughout South Carolina. Despite having his medical license revoked at the time, Pendergraft was only charged with being in the possession of illegal narcotics.

Spartanburg County filed the criminal charges against Pendergraft and made his first court appearance in December of last year.

In January 2016, The Agency for Health Car Administration (AHCA), which licenses abortion clinics in the sunshine state, filed an action to revoke Pendergraft’s license to operate the Orlando Women’s Center abortion clinic located at Lucerne Terrace. AHCA’s complaint states that, “with his arrest and criminal charges, Mr. Pendergraft is disqualified and is no longer in compliance with Florida law.”

“It all has to do with drug charges out of South Carolina but unfortunately nothing to do with any of the other things he has done in the state,” Michele Herzog, spokesperson of Pro-life Action Ministries who side walk counsels in front of Pendergraft’s Orlando abortion facilities.

Pendergraft has had his medical license suspended several times by the state’s medical board before it was eventually revoked indefinitely. In 2011, Pendergraft lost a lawsuit after the baby survived a late term abortion attempt. The woman was awarded $36 million in damages to take care of the child who is now severely disabled.

Herzog pointed out that Pendergraft aggressively advertises his late term abortion clinics nationwide, offering women abortion discounts to get them to his door as well appointments on Sunday. But, despite his persistence, Herzog is optimistic that his abortion clinics will eventually be shut down. She said that are a number of faithful Christians are praying in front of Pendergraft’s abortion clinics and reaching out to the women he profits off of.

All 5 Pendergraft abortion facilities are covered in prayer Herzog said noting that she organizes the outreach outside EPOC abortion clinic in Orlando where other faithful pro-lifers join her. Pro-lifer and evangelist John Barros and several others ministers outside Orlando Women’s Center (OWS), where pro-lifers have witnessed women taken from the clinic by ambulances. But, they often speak to women who change their mind and choose to keep their baby.

“Through Barros’ faithful ministry many babies are alive today,” Herzog said.

Barros responded to news that OWS might be closed by the state, telling WFTV, “God uses different things in different ways and it usually is in different ways than we could ever have imagined.

Pro-lifers in Florida have watched God close a number of clinics in the state including two already this year. WomanCare in Orlando and Planned Parenthood of Winter Haven closed their doors after years of prayer and hard work from the activists. Herzog said that WomanCare abortion clinic was evicted the end of January just months after she and a group of prayer warriors walked inside the clinic on Good Friday 2015 and prayed for God to close the clinic permanently. Although staff was in the building, no one knew the pro-lifers were in the waiting room until they left.

The Winter Haven Planned Parenthood, which just closed their doors, was also covered in prayer on a regular basis. Herzog said that pro-lifer Scott Newman along with members of Sidewalk Advocates for Life, who originally reported the closing, faithfully prayed and sidewalk counseled in front of that abortion facility as well.

Operation Rescue has learned that the traveling abortionist that was arrested in South Carolina as the result of a traffic stop is the notorious Florida abortionist James Scott Pendergraft IV.

Pendergraft operates a chain of late term abortion clinics in Florida even though his medical license has been suspended in the state.

According to a report by Operation Rescue at the time of Pendergraft’s arrest on October 5, 2015, he had in his possession surgical implements that were covered in blood and human tissue from abortions he had illegally performed throughout South Carolina.

He was also in the possession of illegal narcotics.

His illegal abortion operation was described as a “mobile abortion clinic.”

Pendergraft, 58, was charged with four drug-related offenses, but remains under criminal investigation for practicing medicine without a license.

Operation Rescue also learned that his accomplice, described by Spartanburg Co. Sheriff Chuck Wright as Pendergraft’s “wife,” is Angela Jackson, 55, of Cary North Carolina.

Jackson was charged with intent to sell marijuana out of the back of Pendergraft’s vehicle.

Pro-lifers in Florida have been trying for years to stop Pendergraft from operating in the state. They say this news is an answer to prayer.

Spartanburg County Sheriff Chuck Wright announced at a press conference on Friday that his deputies arrested an man and his wife, who were operating a mobile abortion clinic out of their vehicle. The unlicensed abortionist was conducting abortions on women up and down the State of South Carolina. The arrests were made as the result of a multi-jurisdictional traffic sweep called Operation Rolling Thunder.

We got a guy and a girl early in the week that was a traveling abortionist. He traveled around the state of South Carolina without a medical license, with drugs and with medical tools, performing in-home abortions,” Wright said. “So basically we got an illegal baby killer.”

In February I posted a video showing Florida abortionist James Gordon Gengelbach outside the Bread and Roses abortion clinic in Clearwater telling a pro-life demonstrator that he is not allowed to take and or post his picture online. He threatened to call his lawyer as well.

This week, the abortionist told a group of demonstrators that showed up at his home, “We know who you are, we know where you live, we know where you work, paybacks are gonna be hell.”

Kinda sounded like a threat.

Paybacks are gonna be hell!” , the abortionists said.
