A California judge has denied state medical authorities’ emergency request to revoke the license of an abortionist following an undercover sting conducted by Board investigators which caught abortionist Andrew Rutland doing first trimester chemical abortions even though he has been banned from the procedure. Despite this decision, Rutland still faces a full hearing on the state’s accusation of negligence over the abortion related death of Ying Chen, who fell into a coma after a toxic reaction to a drug Rutland administered. At the time, Rutland was on probation and practicing under another physician’s supervision. That physician happened to be another abortionist with a spotty disciplinary record. The medical board has acknowledged that it violated its own rules by allowing abortionist Christopher Dotson Jr. to serve as Rutland’s monitor. Rutland first surrendered his license in 2002 in a high-profile case involving the deaths of two infants. Medical Board spokeswoman Candis Cohen told the La Times that the board would pursue its effort to revoke Rutland’s license “as expeditiously as possible.”
