Towanda, P.A. – A trial date has been set for a Southern Tier man accused of killing his unborn child back in February. What is unusual about this case is the woman who he did this to is now his wife.

Jury selection for 38-year old Orbin Tercero‘s trial is scheduled for Monday, January 24th at the Bradford County Courthouse in Towanda. Back in February, Tercero gave his girlfriend a drug called Misoprostol without her knowledge or consent during sexual intercourse. This drug is known to cause abortions. Later that night, his girlfriend had a miscarriage. District Attorney Daniel Barrett stated Thursday says this case is unlike anything he’s ever seen.

“When it came in, we realized that we wouldn’t have much guidance from our experiences or of that from other offices on a charge like this,” said Barrett.

The case has become even more complicated since then because the victim is now the suspect’s wife. Tercero, from Bath, is charged with murder of an unborn child, tampering with evidence and aggravated assault of an unborn child. Barrett told WETM 18 News that Tercero was able to get the Misoprostol drug without any troubles because of his job as a pharmacist in New York.

Barrett says if convicted, Tercero faces lifetime in prison without parole. Authorities stated that Tercero was engaged to another woman when the crime happened. Authorities stated that may have been his motive for the crime. Tercero posted bail and is no longer in Bradford County Jail.

Authorities told WETM 18 News that the crime happened in Sayre, at the girlfriend’s apartment. Because of this, it is being prosecuted in Bradford County. According to the New York State Regents Department, Tercero still has his pharmacy license with the state of New York.

Kristan Hawkins, Executive Director of Students for Life of America, remarked: “Make no mistake about it, ella is a dangerous abortion drug. The FDA’s approval of ella for sale within the U.S. shows that the FDA has not done its job protecting women, particularly young women who SFLA serves on a daily basis. Students for Life of America is asking the FDA review and reverse its decision.”

Students for Life and the “ella Causes Abortions Coalition” have serious concerns about the new drug. ella is being deceptively portrayed as a five day “emergency contraceptive” while it has a similar chemical makeup to RU-486, another abortion drug. There is evidence that ella actually prevents implantation of an human embryo and may also kill or injure the unborn child after implantation. In addition to this, SFLA and the Coalition are concerned that similar side effects of the RU-486 pill will occur with ella, such as severe bleeding, ruptured tubal pregnancies, infections, and even death.

The FDA should reverse its decision to approve this dangerous abortion drug.

New Drug Ellaone Billed as Better Morning After Pill, But It Causes Abortions

Washington, DC (LifeNews.com) — Abortion advocates are pushing a new drug that they say is an expanded morning after pill, or emergency contraception. However, pro-life doctors and advocates say Ellaone, also known as Ulipristal, works as an abortion drug and not an agent that prevents conception.

The morning after pill, or Plan B drug, has been around for years and can either prevent fertilization from occurring or can sometimes act as an abortifacient by killing the unique human being fertilization develops.

Ellaone is different — instead of working hours or just a couple of days after sexual relations take place as the morning after pill does, it can be used up to five days afterwards.

The drug is becoming popular in Europe and abortion advocates there are pushing it as a better version of the morning after pill.

Ann Furedi, from the British Pregnancy Advisory Service abortion business in the UK, tells the London Daily Mail, “This new type of emergency contraceptive pill is exciting news.”

But Josephine Quintavalle, of the Pro-Life Alliance, says Ellaone is not an emergency contraception because it causes an abortion rather than preventing pregnancy.

“If you take a morning-after pill within 24 hours, there is always the argument that the sperm may not have fertilized the egg by then, meaning pregnancy has not yet happened,” she told the newspaper. “But if this pill works for five days there is no argument. This is not a contraceptive, it is an abortive agent.”

Dr. Donna Harrison, the president of the American Association of Pro-Life Obstetricians and Gynecologists agrees with the assessment of Ellaone (Ulipristal) as an abortion drug.

“I think it’s important that the pro-life community recognize exactly what Ulipristal is, and how it works, so they are not fooled,” she told LifeNews.com today.
Harrison says she is concerned that the drug will be able to be sold over the counter in the same way the Plan B morning after pill is sold without a doctor’s prescription or consultation.

In England, the Ellaone drug is sold via prescription and costs almost three times as much as the morning after pill.

Abortion advocates, in preparing for a big push to promote Ulipristal to the general public, are touting new research papers showing it to be “more effective” in preventing pregnancy or, in this case, killing unborn children.

Anna Glasier, of NHS Lothian in Edinburgh, led a study of more than 5,500 women in the UK published online in The Lancet medical journal. It found fewer pregnancies among those women given the Ellaone drug within five days of intercourse. And for women who took the drug between 3-5 days after having sex, only women taking the traditional morning after pill became pregnant.

Glasier told the Daily Mail that she doesn’t think the Ellaone drug will become as popular because women like the convenience of getting the morning after pill at a pharmacy without the prescription Ellaone requires.

But if that changes in England or becomes available without a prescription in the United States or other countries, Harrison’s fears will be confirmed.

Pharmacist charged after he allegedly forces girlfriend to miscarry

A Bath pharmacist has been charged with causing his pregnant girlfriend — a Sayre resident — to have a miscarriage.

Sayre police on Wednesday charged Orbin Eeli Tercero, 38, with criminal homicide of an unborn child, first-degree murder of an unborn child, aggravated assault of an unborn child, aggravated assault, hindering apprehension or prosecution, and tampering with or fabricating physical evidence.

Tercero, of Williamson Terrace, was arrested Thursday by state police in Bath as a fugitive from justice.

He was arraigned in Bath Village Court and remanded to Steuben County Jail, pending a hearing on extradition to Pennsylvania.

The charges are based on the following events, according to police:

The victim, a 36-year-old woman from Sayre and a pharmacist at a Wegmans Market, said she had a two-year physical relationship with Tercero, also a Wegmans pharmacist.
Tercero was engaged to another woman at the time.

The victim, whose name is being withheld by this newspaper, told Tercero she was pregnant in mid-January.

Tercero told the woman he could use the drug misoprostol to induce a miscarriage. The victim told Tercero she would get an abortion instead.

The victim, however, made a Feb. 24 appointment for an abortion but changed her mind. She called Tercero to tell him she would keep the baby.

In late February, on the victim’s birthday, Tercero visited her at home and used misoprostol he allegedly stole from Wegmans pharmacy to cause the miscarriage.
Without her knowing it, Tercero put one pill in her vagina, one in her juice and one in her water. She was 13 weeks pregnant at the time.

When the victim began to miscarry, she found a partially dissolved misoprostol tablet among the discharge.

Tercero drove the victim to Robert Packer Hospital in Sayre, where she miscarried.

Jo Natale, director of media relations at Wegmans, said Tercero is a former employee. She would not say when his employment ended.

“He was not assigned to a single store; rather, he floated and worked at all of the stores in our Southern Tier division at one point or another,” Natale said.
That division includes Corning, Elmira, Hornell, Ithaca, Johnson City and Geneseo, she said.

Natale would not comment on whether the drug misoprostol requires a prescription

Baby found dead in bag in closet, mother charged: police

A 25-year-old North Side woman induced the delivery of her baby with pills, ripped the umbilical cord with her hands and then threw the baby girl in a bedroom closet “as if it were a bag of garbage,” Cook County prosectors said Monday.

Marisol Molina, who was seven to nine months into her pregnancy, wrapped the baby in a robe and tied her in a plastic bag Thursday before hiding her at home — where the baby was discovered dead a day later, Assistant State’s Attorney Kevin DeBoni said.

The Medical Examiner’s Office determined the girl had air in the lungs and stomach, which indicated she was born alive and had taken some breaths, DeBoni said.
Molina was charged with murder and could face capital punishment if convicted. She was ordered held in lieu of $200,000 bail Monday.

Molina had ordered the abortion drug Misoprostol on the Internet on Feb. 12, and then took 10 of the pills on Wednesday, DeBoni said. Misoprostol, which causes contractions to expel the embryo, is usually administered after women are given Mifeprex — commonly known as the abortion pill RU-486, which blocks the a hormone that maintains pregnancy. Molina told police she knew about the drug from one of the two prior abortions, DeBoni said.
