PateltauntsMillionaire Oklahoma abortionist Nareshkumar Gandalal “Naresh” Patel, who once faced charges of raping and sodomizing his abortion patients, is once again under investigation after Operation Rescue filed a five-count complaint against him with the State Attorney General’s office, the Oklahoma Health Department, and the Oklahoma Medical Board.

The complaints were based on documents and medical waste that had been discarded in a publicly-accessible trash receptacle near Patel’s Outpatient Services for Women abortion clinic in Oklahoma City. The material was received by Operation Rescue from an anonymous source on March 18, 2013.

Allegations include:

1. Record-keeping violations and improper disposal of confidential information.
2. Mandatory reporting violations.
3. Improper disposal of medical waste.
4. Failure to protect and properly dispose of employment applications.
5. Failure to observe 24-hour voluntary and informed consent.

Patel is an abortionist with a long and particularly horrific history of Medical Board disciplinary actions, malpractice claims, and criminal cases. Nevertheless, financial documents found amid the medical records and waste indicate that Patel owns $39.4 million in real estate. His personal income exceeds $1.4 million annually. His net worth is listed at $28 million.

“It’s appalling that Patel has lined his pockets by taking innocent life while flouting the law and cutting corners on women’s health,” said Newman. “Frankly, it’s despicable.”

Board discipline

In 1990, Patel was disciplined by the Oklahoma Medical Board for Unprofessional Conduct for “failing to maintain dispensing records for dangerous drugs and keep complete and accurate records of purchase and dispensing of controlled drugs.”

Records show he was also disciplined for botching an abortion in 1989. Medical Board documents state that Patel “did perform a surgical procedure on patient E.S.B., and said procedure was performed in an unprofessional manner and unprofessional setting.”

Unfortunately, Patel appealed to the Oklahoma Supreme Court, which struck the botched abortion charge from Patel’s record, allowing only the charge of failing to maintain proper drug records to stand.

In 1992, the State of Ohio issued a reprimand of Patel based on Oklahoma’s actions.

History of dumping aborted baby remains

Fetuses in Field

In 1993, Patel admitted that he dumped the remains of nearly 60 babies that had been aborted at his clinic in a field near Shawnee, Kansas, and had attempted to burn them but only the plastic bags around the remains caught on fire. The bodies were discovered by two passers-by. Patel’s excuse that he could not find a service to take away the remains lacked credibility. Because at that time there were no laws in Oklahoma regarding the disposal of aborted baby remains, Patel was never charged.

Abortionist accused of sodomy and rape

According to the Daily Oklahoman (Abortion Doctor Denies Sex Charges: 9/20/1994), Oklahoma abortion doctor Nareshkumar Patel, 42, was charged in Oklahoma County District Court with one count of forcible oral sodomy and one count of sexual battery in an alleged 1993 sexual assault on a patient.

Patel denied that he had sexually abused any of his patients.

The 25-year-old victim testified that Patel attempted to force her to sodomize him after she had been sedated. Two other women previously testified Patel had raped them after he had administered an anesthetic to them.

However, Patel was not charged in those attacks because they allegedly happened in 1989 and 1990. They came forward only after Patel was charged in 1993.

A September 16,1994 article in the same paper, Ex-Patient Claims Rape By Patel Before Abortion, reports that a 26-year-old Moore woman testified that Patel raped her in 1990 shortly before performing an abortion on her. The woman testified that Dr. Patel prepared her for an abortion by sedating her, then raped her on the surgical table. After the assault, Patel began the abortion procedure, the woman testified.

Another woman testified that she had been a patient of Patel’s in 1989 and also had been raped by him under similar circumstances. The woman, then 19, also did not report the alleged attack to law enforcement because she “felt dirty.”

Patel denied all the charges and some of his staff testified that he was never alone with female patients. However, Rochelle Brown, a former employee of Patel’s at his Shawnee clinic, claimed Patel often would conduct pelvic examinations on female patients with no nurse present.

____________________________________________________________________

Examples from OR’s post:

Second patient’s testimony

The second women to come forward alleged that after she was drugged, she was taken to an examination room and put on a table. She said she heard him unzip his pants and saw him pull them down.

“I felt Dr. Patel enter my rectum with his penis,” she said in response to questioning. She indicated that when he finished sodomizing her, he completed her abortion. When she began to come to afterwards, she told the court, “His penis was in my mouth.”

Once fully awake from the sedation, the victim said she was in “severe pain” and bleeding heavily. It was later that she discovered, “I had a tampon in my vagina, and I had a tampon in my rectum.”

Third patient’s testimony

The third patient to make allegations came forward after hearing news reports about Patel and allegations of sexual abuse made by another woman. She noted that she was injected with an unknown drug, after which claimed Paten began to fondle her breasts. While on the examination table, she said, “I heard the zipper of his pants, and he started moving back and forth. And I felt the pressure inside of me.” In response to questioning she indicated that the sensation was in her vagina.

After having his way with her, Patel allegedly called a nurse into the room and completed an abortion on the woman.

Patel was somehow acquitted by the jury that heard this graphic testimony.

“Again and again, Patel has slipped away without consequences. If he really did what the women say, it is an atrocity that he got away with it. What is more disturbing is that Patel continues to be in a position where further abuse of this nature can occur,” said Newman. “People who are sexual deviants just don’t change overnight.”

But that was far from then end of allegations against Patel.

Complaint centers on:

Privacy rights trashed

After analyzing the material from Patel’s abortion clinic trash receptacle, Operation Rescue determined that violations had occurred and filed the appropriate complaints.

Operation Rescue submitted copies of dozens of documents from Patel and Outpatient Services for Women that included original patient consent forms, signed procedure logs, appointment calendars, financial information, and competed abortion forms, all containing patient names, contact information, and other identifying data.

“Abortion clinics claim to be concerned about patient privacy, yet we have found that abortion clinics are among the most negligent when it comes to disposing of detailed patient information,” said Troy Newman, president of Operation Rescue. “Women who get abortions should pretty much expect their contact information, medical records, and financial information to end up where it can be easily accessed by the public, thanks to shoddy abortion clinic practices.”

Failure to report

Also discovered among the cache of documents received by Operation Rescue were numerous original Individual Abortion Forms. Oklahoma requires that abortion clinics report each abortion that is done. The presence of the completed forms in the trash indicate that these abortions may not have been reported and that further investigation is required.

Failing to report abortions within 30 days of the abortion is a crime in Oklahoma punishable with a $500 fine per report.

Bloody refuse

laminaria

Operation Rescue submitted photos to the authorities that showed several large bloody sticks of laminaria dilators that had been improperly discarded along with other bloody refuse from what appeared to be a second trimester abortion. Also discarded with the bloody trash was a blood-stained broken tenaculum, which is a scissor-like grasping instrument.

The discarded laminaria and broken tenaculum both fall within Oklahoma Administrative Code 252:515-23 that prohibits “the improper disposal of regulated medical waste, including untreated sharps and items contaminated with blood or other human body fluids.”

Philadelphia doctor accused of murdering patient, newborns
By Michael Martinez, CNN

January 19, 2011 6:13 p.m. EST

(CNN) — A Philadelphia physician, Kermit Barron Gosnell, was charged Wednesday with murder and other offenses for allegedly causing the death of one of his female patients and killing seven viable babies in illegal, late-term abortions, Philadelphia District Attorney Seth Williams said.

The babies were born alive in the sixth, seventh and eighth months of pregnancy, but their spinal cords were allegedly severed with scissors, Williams said in a statement.
Nine other people who worked in the west Philadelphia medical office, including Gosnell’s wife and sister-in-law, also were charged, Williams said. The practice, called the Women’s Medical Society, served mostly low-income minority women for years, he said.

Williams’ statement provided a grisly scenario of the shuttered abortion clinic: A search of the office last year by authorities found bags and bottles holding aborted fetuses scattered throughout the building. Jars containing the severed feet of babies lined a shelf. Furniture and equipment was blood-stained, dusty and broken.

Gosnell’s attorney, William J. Brennan of Philadelphia, told CNN he was surprised at the “length and breadth” of the grand jury’s presentment and report against Gosnell and the nine other defendants. Gosnell is facing hundreds of counts, according to the grand jury’s 62-page presentment.

“The DA of Philadelphia, Seth Williams, is a good guy, and I have a lot of respect for him, but he played this so close to the vest that we were shocked at the number of charges,” Brennan told CNN.

“I hope there is no rush to judgment in this case,” Brennan continued. “Dr. Gosnell should enjoy the same presumption of innocence anyone in this country, you or me, should get if we were charged with a crime. In the process of reviewing the grand jury’s presentment, which is several hundred pages, I understand that the charges are very serious, and we will need some time to read through the grand jury’s presentment and its report.”

Gosnell, 69, is not a board-certified obstetrician or gynecologist, Williams said.

Originally, he said, the clinic used another doctor as a consultant so it could receive a license to perform abortions in 1979.

Two primary state agencies, the Department of Health and the Department of State, have oversight, Williams said Wednesday at a news conference.

But a grand jury investigation found that health and licensing officials had received repeated reports about Gosnell’s dangerous practices for two decades with no action taken, even after the agencies learned that women had died during routine abortions under Gosnell’s care, the district attorney’s statement said.

“What the (grand) jury found most troubling is that neither of those agencies took the time to investigate, to observe, to view, to go to the clinic itself since 1993,” Williams said during the news conference.

“I am aware that abortion is a hot-button topic,” Williams said in his statement. “But as district attorney, my job is to carry out the law. A doctor who knowingly and systematically mistreats female patients, to the point that one of them dies in his so-called care, commits murder under the law.

“A doctor who cuts into the necks severing the spinal cords of living, breathing babies, who would survive with proper medical attention, is committing murder under the law.”
Gosnell is also accused of reusing unsanitary instruments; performing procedures in filthy rooms, including some having litter boxes and animals present during operations; and allowing unlicensed employees to perform operations and administer anesthesia, including a teenage high school student, Williams said.

Gosnell’s wife, Pearl, 49, of Philadelphia, is also facing charges of providing an abortion at 24 or more weeks, conspiracy and other related charges, Williams said. She has no medical license and is accused of performing illegal abortions at the clinic, he said.

Elizabeth Hampton, 51, of Philadelphia, who is Gosnell’s sister-in-law, is facing charges of hindering prosecution, perjury, false swearing and obstructing administration of law.

Law enforcement officers came upon “the medical abuses” while investigating tips that the doctor had been illegally selling thousands of prescriptions for OxyContin and other narcotics to “patients” that he never examined, Williams said.

The doctor himself was seldom present, the district attorney charged. In his absence, untrained, unsupervised workers, including the teenage girl, routinely injected sedatives into women undergoing illegal late-term abortions, he alleged.

Among numerous charges, Gosnell is accused of third-degree murder in the death of 41-year-old Karnamaya Mongar, Williams said.

Mongar died on November 20, 2009, when she was overdosed with anesthetics prescribed by Gosnell, he said.

Gosnell is also facing seven murder charges in the deaths of infants allegedly killed after being born viable and alive during the sixth, seventh and eighth months of pregnancy in illegal, late-term abortions, Williams said.

Gosnell is also charged with infanticide, conspiracy, abortion at 24 or more weeks of pregnancy, corpse abuse, theft, corruption of minors, solicitation and other related offenses, he said.
Seven other employees at the clinic were also charged, according to the district attorney’s statement:

Lynda Williams, 42, of Wilmington, Delaware, also is charged with third-degree murder in Mongar’s death. Williams is accused of being an unlicensed worker who routinely performed illegal operations and administered anesthesia. She is also facing murder charges for the death of a viable baby born alive, abortion at 24 or more weeks and other related offenses.

Sherry West, 51, of Newark, Delaware, is charged with third-degree murder. She was allegedly an unlicensed worker at the clinic who routinely performed illegal operations and administered anesthesia. She is also facing a charge of providing an abortion at 24 or more weeks and other related offenses.

Adrienne Moton, 33, of Upper Darby, Pennsylvania, is charged with murder in the death of a viable baby born alive. She was allegedly an unlicensed worker at the clinic who routinely and illegally administered anesthesia to patients.

Steven Massof, 48, of Pittsburgh, is facing murder charges for the deaths of two viable babies born alive. Massof, a medical school graduate without a license or any certification, allegedly worked as a doctor at the clinic. He is also facing conspiracy and other related charges.

Eileen O’Neill, 54, of Phoenixville, Pennsylvania, is a medical school graduate who allegedly worked as a doctor at the clinic without a license or certification. She is facing theft by deception, conspiracy, perjury and false swearing charges.

Tina Baldwin, 45, of Philadelphia, is facing charges of racketeering, conspiracy and corruption of a minor. She was allegedly an unlicensed worker at the clinic who illegally administered anesthesia to patients and allowed her 15-year-old daughter to administer anesthesia to patients as well.

— Office manager Maddline Joe, 53, of Philadelphia, is charged with conspiracy.

Inside the ‘baby charnel house’
By DANA DiFILIPPO
Philadelphia Daily News

The grand jury called it “a baby charnel house.”

For more than 30 years, Kermit Gosnell ran an abortion clinic in West Philadelphia that was the “go-to” place for women wanting illegal late-term abortions or for people seeking no-questions-asked prescription drugs, according to a grand jury.

Here are some highlights from the jury’s report:
* Gosnell performed thousands of abortions at his Women’s Medical Society at 38th Street and Lancaster Avenue, even though he was a family practitioner never certified as an obstetrician or gynecologist. Gosnell was rarely present in the clinic, allowing his unlicensed, untrained staff to administer drugs and perform procedures.

* Gosnell routinely induced labor in patients in their second and third trimesters rather than perform risky late-term abortions. That sometimes resulted in live births. He and his staffers killed the babies by stabbing their necks with scissors to sever their spinal cords and sometimes suctioning their skulls, too. About a baby writhing as he cut its neck, Gosnell joked to a staffer: “That’s what you call a chicken with its head cut off.”

* Gosnell is accused of murder in the November 2009 death of Karnamaya Mongar, 41, who died a day after a staffer overdosed her with sedatives. Another woman, Semika Shaw, 22, died after Gosnell punctured her uterus and sent her home. Gosnell allegedly injured “scores” of others, leaving some sterile, perforating the bowels and uteruses of others. He frequently left fetal remains inside women, who then had to seek treatment elsewhere. * Gosnell and his staffers frequently left their patients unattended, so that the dead fetuses or live babies “fell out” wherever the patient was, often the bathroom. One clinic janitor told the grand jury that this happened so often that fetuses frequently clogged the toilet.

* Conditions at the clinic were deplorable. The walls were urine-splattered, and the floors were bloodstained. A janitor testified that the bathrooms were cleaned just once a week, even though patients routinely vomited into sinks and miscarried into toilets.

* White patients waited and were treated in a cleaner room than patients of color. Patients of color who became “too rowdy” got a slap on the thigh from Gosnell, one worker testified. Gosnell photographed his patients’ genitalia before procedures, another told the grand jury.

* A high-schooler, the daughter of staffer Tina Baldwin, worked in the clinic for four years, starting at age 15. She worked as much as 50 hours a week for $8.50 an hour. She routinely operated the ultrasound machine, administered anesthesia, diagnosed sexually transmitted diseases and told grand jurors she often was “in charge” of the clinic at night.

* Investigators say Gosnell made up to $15,000 a night, mostly in cash, for a few hours of work performing abortions. That doesn’t include the money he made as one of the state’s top Oxycontin prescribers. When authorities searched his home, they found a gun and $240,000 in cash stashed in his 12-year-old daughter’s closet.

* Instead of trashing disposable medical supplies, Gosnell directed workers to reuse them over and over until they broke. They were rarely sterilized, allowing venereal disease and other germs to spread among patients. After the raid, inspectors found that the suction source used to perform abortions was the only one available to resuscitate patients.

* Medical waste and fetal remains were supposed to be picked up weekly by a licensed disposal provider. But because Gosnell didn’t pay his bills, months might pass between pickups, leaving leaking bags and boxes to pile up in the clinic’s basement and freezers.

Abortionist Kermit Gosnell arrested and charged…, posted with vodpod

1-19-2011

Eyewitness News has learned that a West Philadelphia doctor, his wife and eight other suspects are now under arrest following a grand jury investigation.

Sources say Dr. Kermit Gosnell faces eight counts of murder in the deaths of a woman following a botched abortion at his office, along with the deaths of seven other babies who, prosecutors allege, were born alive following illegal late-term abortions and then were killed with scissors.

The grand jury report states that Dr. Gosnell’s office was filthy and cat litter was apparently found inside the office.

Four of the suspects, some improperly licensed, also face multiple counts of murder for allegedly killing the newborns.

All of the suspects are now behind bars after warrants were served overnight.

Dr. Gosnell, who has practiced in the West Philadelphia neighborhood for decades, is also the target of a federal grand jury investigation into illegally prescribing prescription drugs.
Investigators say during a search of his home, they found $240,000 in cash.

The doctor, in past interviews with Eyewitness News, has proclaimed his innocence, predicting if charged, he will be acquitted.

The Philadelphia District Attorney held a press conference Wednesday morning to officially announce details of the arrests and the grand jury presentment.

According to Operation Rescue, abortionist Gosnell killed Karnamaya Mongar, 41, on November 20, 2009, after she was overdosed on painkillers during an abortion in her 18th or 19th week of pregnancy. Mongar’s brother, told reporters that Gosnell’s abortion clinic was “dirty and bloody.” Gosnell’s medical license was suspended and his clinic closed.

A grand jury was convened to investigate. It has charged Gosnell with eight counts of murder for the death of Mongar and seven babies who were born alive during failed illegal late-term abortions then killed by Gosnell or his clinic workers. Some clinic workers have been charged with multiple counts of murder in the deaths of the infants.

When police raided Gosnell’s home and took him into custody, they discovered $240,000 in cash. Gosnell is also the subject of a Federal grand jury that has yet to reach a conclusion of its investigation.

Operation Rescue had urged supporters earlier this month to contact the district attorney as ask for criminal charges.

The Wall Street Journal reports that Dr. Kermit Gosnell, 69, who catered to minoritesmade millions of dollars over 30 years, performing as many illegal, late-term abortions as he could, prosecutors said. State regulators ignored complaints about him and failed to visit or inspect his clinic since 1993, but no charges were warranted against them, District Attorney Seth Williams said.

Dr. Gosnell “induced labor, forced the live birth of viable babies in the sixth, seventh, eighth month of pregnancy and then killed those babies by cutting into the back of the neck with scissors and severing their spinal cord,” Mr. Williams said.

Mr. Williams said patients were subjected to squalid and barbaric conditions at Dr. Gosnell’s Women’s Medical Society.

Authorities went to investigate drug-related complaints at the clinic last year and stumbled on what Mr. Williams called a “house of horrors.”

“There were bags and bottles holding aborted fetuses were scattered throughout the building,” Mr. Williams said. “There were jars, lining shelves, with severed feet that he kept for no medical purpose.”

The clinic was shut down and Dr. Gosnell’s medical license was suspended after the raid.

Workers, some of whom were also charged with murder, were untrained and unlicensed, including a high-school student who performed anesthesia with potentially lethal narcotics, Mr. Williams said.

Dr. Gosnell and nine other employees are in custody, authorities said.

Dr. Gosnell has been named in at least 10 malpractice suits, including one over the death of a woman who died of sepsis and a perforated uterus.

Philly.com reports that Dr. Kermit Gosnell, 69, his wife and 8 other colleagues were arrested overnight following a Grand Jury investigation. Gosnell and his wife are currently being held at headquarters without bail. Also included in that group is a teenager who reportedly administered anesthetic.

According to the DA’s office, Gosnell is facing Murder in the 3rd Degree for the death of 41 year old Karnamaya Mongar. Mrs. Mongar died on November 20, 2009 when she was overdosed with anesthetics prescribed by Gosnell. He is also facing seven Murder charges for the deaths of infants who were killed after being born viable and alive during the 6th, 7th and 8th month of pregnancy. Along with the Murder charges the District Attorney has charged Gosnell with Infanticide, Conspiracy, Abortion at 24 or more weeks, Abuse of Corpse, Theft, Corruption of Minors, Solicitation and other related offenses.

D.A. Seth Williams held a news conference Wednesday morning, where he reviewed the 300-page Grand Jury report, the details of which are incredibly disturbing. “I am aware that abortion is a hot-button topic,” said District Attorney Williams. “But as District Attorney, my job is to carry out the law. A doctor who knowingly and systematically mistreats female patients, to the point that one of them dies in his so-called care, commits murder under the law.”

Last April, the FBI and Drug enforcement agents raided Dr. Gosnell’s 38th and Lancaster Clinic, called the Women’s Medical Society. Inside, they found jars packed with pieces of aborted fetuses and recliners used in a recovery area for women who had abortions.

Dr. Gosnell’s medical license was been suspended because of the conditions at his clinic. He has also been targeted in multiple lawsuits, at least one charging that a woman died from a botched abortion.

Dr. Gosnell is named in nearly four dozen civil suits going back 20 years. Ten of those are malpractice suits, including one by the family of a young woman who died after a March 2000 abortion at Gosnell’s office.

In 1985 after moving to Michigan Tauber’s License to practice osteopathic medicine in that state was revoked following his conviction of First Degree criminal sexual assault, and second degree criminal sexual conduct. In the case of People vs. Ronald Tauber (Michigan Case # 80-46749-FY) the doctor was convicted after the state proved he had forcibly transported a six year old girl in his car against her will. Tauber admitted exposing himself to the girl and placing her hand on his penis. He also lifted the child’s undergarment to expose her vulva. Tauber released the girl when she began to cry. Tauber was also cited for masturbating in his car outside a high school where young girls were exiting. Tauber was released from prison on January 3, 1990 and his parole ended on August 15, 1991. Tauber was licensed to practice by the state of New York in August of 1992 Michigan Medical Board case #82-202 and California Board of Osteopathic Medical Examiners case # 90-6 and OAH # N-37351.

Dr. Chris Simpoulous of the American Women’s Clinic in Norfolk, VA was accused of scheduling dozens of women for abortions who were not pregnant. Simpoulous was arrested in July of 1984 following an attempted abortion on an undercover police woman who was not pregnant. New York Times 7/28/84.

In April of 1992, Dr. Larry Thompson’s Nevada medical license was revoked. The Board of Medical Examiners of Nevada determined that while performing an abortion at The Women’s Place in North Las Vegas, Dr. Thompson lacerated the uterus of his patient. The board said Thompson failed to monitor the woman’s condition adequately, and the clinic did not have adequate medical equipment. As a result of the laceration and inadequate care that followed the woman died. Dr. Thompson also failed to recognize the cause of the patients death. Nevada Board of Medical Examiners case # 8289.

In February of 1993, Dr. Abu Hayat was convicted of performing an illegal third trimester abortion in which he ripped the child’s arm from its body in the abortion attempt. The child was later born alive and has recovered with just one arm. In addition to the above occurrence Dr. Hayat, (an individual member of the National Abortion Federation) was cited by the Medical Board for refusing to complete an abortion on a patient after he demanded an additional payment of $500. The woman left the clinic bleeding and with an incomplete abortion when she told Hayat she could not pay the extra $500. New York Times 2/23/93, New York Department of Health and Professional Conduct, and New York Times 1/22/91.

In January 1993 police arrested the owner of Clinica Feminina de la Cominidad an abortion clinic in Orange County, CA after the suspicious death of a patient at the clinic. News reports alleged Alicia Ruiz Hanna a non-physician performed numerous abortions at the clinic. The body of one of the clinic patients was found outside in the parking lot. Clinic employees have stated that the patient, Angela Sanchez suffered complications and Ruiz refused to call for help and would not allow her employees to call either. The Orange County Register August 24, 1993.

Abortion doctor David Benjamin (A.K.A. Elysa Bonrouhi) was implicated in charges of negligent homicide and tampering with physical evidence following the death of Guadalupe Negron. Police reports said that Negron was bleeding profusely and complaining of pain following her 2nd trimester abortion at the Metro Women’s Clinic in Corona, Queens New York. Benjamin ordered the patient to be cleaned up and began an abortion on another patient. Benjamin delayed calling an ambulance to transport Ms. Negron and attempted emergency treatment in such a negligent manner that Ms. Negron was pronounced dead shortly after her arrival at a local hospital. Associated Press 8/12/93 and New York Times 7/17/93.

If these stories horrify you, they should. Abortion is one of the most unregulated businesses in this country. Minors can walk into the hands of unqualified physicians with questionable and even criminal backgrounds.

The incidents outlined above are just a few incidents involving women and their abortion experiences. Many women never report their negative abortion experiences because of the fear that someone may find out they had an abortion. We have other anecdotal information and more court documents from hundreds of women. The abortion business continues to makes no effort to clean up it’s act.

From San Diego’s News 10 Local Abortion Clinic’s Troubled History Raises Questions

CHULA VISTA, Calif. — A family member expressed outrage Friday over the punishment handed down for two local health care workers, 10News reported.

Longtime Chula Vista resident Maria Hart said everyone knows where to go when they need to get an abortion.

Hart took her cousin to a local clinic when they were younger.

She came out crying; she came out in tears, back then we were young,” said Hart.

Hart and her cousin were afraid to tell anyone. Hart said her cousin was fondled and sexually molested during her abortion.

We kind of just went there and trusted the doctors and that they would treat us correctly, and they didn’t,” said Hart.

The doctor her cousin visited, Bertha Bugarin, was sentenced to seven years in state prison for posing as a doctor and performing illegal abortions.

A court recently sentenced her accomplices, Luz Catalina-Gomez and Paloma Rodriguez, to three years probation.

I don’t think it’s right that they’re just still walking around, free to go,” said Hart.

A new clinic has recently opened up under the name Woman’s Choice Family Planning Clinic, and it is being run by Dr. Andrew Rutland. Sources told 10News that Rutland has had problems in the past and is on probation.

Rutland was accused by the State Medical Board of negligently treating ten patients, including two infants who died. He surrendered his license, but applied for reinstatement five years later.

The medical board granted his request in 2007, and Rutland was placed on five years probation and must now practice under the supervision of another doctor.

How can you say that this particular clinic is continuing Bugarin’s efforts?” asked 10News’ Charisse Yu.

The doctor who is presently here has connections with one of the doctors who used to work for Bugarin who lost his license because of malpractice suits,” said pro-life advocate Luis Mendoza.

Hart said she can only hope history won’t repeat itself at a clinic that left many women with emotional and physical scars.

San Diego, CA – A television news station has reported on outrage expressed by pro-lifers and the cousin of one of the clinic’s sexual assault victims that accomplices of illegal abortionist Bertha Bugarin received no jail time during their sentencing on criminal abortion charges last month then went on to expose dangers at new abortion clinic.

As reported by Operation Rescue, Luz Catalina-Gomez and Paloma Yonna Solorzano-Rodriguez each received 3 years probation for aiding and abetting the commission of illegal abortions at Bugarin’s Chula Vista, California abortion clinic. The agreement was reached between the defense attorneys and San Diego Superior Court Judge Ted Wethers without the input of the District Attorney’s office in a deal that Operation Rescue President Troy Newman called “fishy.” Bugarin is currently serving 6 years, 8 months in a state prison for her crimes.

Sidewalk Counselor Luis Mendoza, who has worked with Operation Rescue to expose wrong-doing at San Diego area abortion clinics, was particularly upset by the light sentences.

As a sidewalk counselor for nearly 4 years at the now defunct abortion mill were these women worked I experienced first-hand how evil and coercive they were,” said Mendoza.

He remembers a young Hispanic couple, not more than 14 years of age, that he tried to help. They were lied to by Solorzano-Rodriguez about legal problems at the clinic and were coerced by her into having the abortion.

The news report included an interview with Maria Hart, whose cousin had been fondled and sexually molested during an abortion when she was only 16 years old.

We kind of just went there and just trusted the doctors that they would treat us correctly, and they didn’t,” said Hart. “And I don’t think it’s right that they’re still walking around, free to go.

But the report didn’t stop there. After Bugarin’s clinic closed, another abortionist, Andrew Rutland, reopened an abortion clinic in the same location under a new name. Reporter Charisse Yu attempted to interview Rutland, who has an extensive history of discipline with the California Medical Board and is currently on probation and prohibited from practicing without the oversight of another physician.

However, there was no supervising physician on duty with him on the day of the interview.

This news report shows yet another in a long line of abortionists operating illegally,” said Newman. “We demand that the Medical Board act immediately to revoke his medical license. We also demand that the District Attorney’s look into filing criminal charges against Rutland.”

Rutland and Bugarin and the rest of their cohorts are not exceptions to the rule, but are what can be expected at our nation’s abortion mills. Jailing these people is the only way to stop them from preying on vulnerable women,” said Newman.

In the meantime, women must be warned of the dangers of abortion clinics in our nation. They are staffed by shoddy abortionists and unqualified workers who are the bottom of the barrel in the medical world that routinely lie to women about the safety of their operations. Some are sexual predators, as Ms. Hart attested to, who use abortion clinics as a means of accessing victims. Women deserve better than this, and we urge anyone considering abortion to instead contact an abortion alternatives center in their area and get the help they need.
