IG audit reveals $129,000 in Medicaid payments to Planned Parenthood did not comply with requirements

The Department of Health and Human Services, Office of the Inspector General, conducted a review which covered 3,251 clients with claims for Medicaid family planning services (Medicaid services) that Planned Parenthood of North Texas ( PPNT ) submitted, totaling $493,112 ($443,800 Federal share), during the period March 1, 2007, through September 30, 2008 (audit period).

The IG conducted their field work at Planned Parenthood locations in Dallas and Ft Worth.

In Texas, the State agency is responsible for administering the Medicaid program. In addition to family planning services for Medicaid recipients, Texas established the waiver under section 1115 of the Social Security Act to provide a limited and defined set of family planning services to uninsured women who are not eligible for Medicaid

The review also covered 5,548 clients with claims for waiver family planning services (waiver services) that PPNT submitted totaling $800,000 ($720,000 Federal share), during their audit period. They selected a stratified random sample of 105 clients from each of these client populations. They then reviewed the services and determined the unallowable Federal share of the payments made.

Here is what they found:

The State agency did not always claim Medicaid reimbursement for family planning services provided by PPNT in accordance with Federal and State Medicaid requirements or the conditions of the waiver, whichever was appropriate.

Of the 210 sampled Medicaid and waiver client records:

    (1) 50 Medicaid client records contained 1 or more deficiencies (totaling $3,983) on insufficient supporting documentation, and 39 waiver client records contained 1 or more deficiencies (totaling $1,855) on insufficient supporting documentation;
    (2) 23 Medicaid client records contained 1 or more deficiencies (totaling $738) on incorrect billing, and 28 waiver client records contained 1 or more deficiencies (totaling $972) on incorrect billing; and
    (3) 5 Medicaid client records contained 1 or more deficiencies (totaling $104) on services unrelated to family planning.

The State agency did not always properly claim Medicaid reimbursement for family planning services because it did not ensure that:

    (1) PPNT maintained the appropriate required supporting documentation,
    (2) PPNT properly billed for family planning services, and
    (3) services claimed had a family planning purpose.

As a result of these errors, the State agency incorrectly claimed a total of $7,651 for Medicaid and waiver services.

On the basis of their sample results, the IG estimated that the State agency improperly claimed a total of $129,028: $67,019 for Medicaid services and $62,009 for waiver services.

The agency is now recommending a refund of $129,028 to the Federal Government: $67,019 for Medicaid services and $62,009 for waiver services that did not comply with Federal and State requirements for family planning service.

According to the audit:

THE STATE AGENCY DID NOT ENSURE THAT PLANNED PARENTHOOD OF NORTH TEXAS HAD SUFFICIENT SUPPORTING DOCUMENTATION

Providers must keep records to fully disclose the extent of services provided to Medicaid beneficiaries. Additionally, all Medicaid records must be kept for 5 years from the date of service or until all pending audit questions are resolved, whichever is longer. Records and supporting documentation must be made available upon request to the Texas Department of Health or its designated agent.

    For 50 of the 105 Medicaid clients in the IG’s sample, PPNT did not have the required supporting documentation for at least 1 family planning service.

    For 39 of the 105 waiver clients in the sample, PPNT did not have the required supporting documentation for at least 1 family planning service.

    For example, all of the medical records for the dates of service were missing, or the records did not have sufficient information to support the services claimed.

    These errors occurred because the State agency did not ensure that PPNT maintained the appropriate required supporting documentation for family planning services.

    As a result, the State agency improperly claimed $3,983 for Medicaid services and $1,855 for waiver services.

The Medicaid program pays for services provided to a client only when the extent of the services is fully disclosed.

According to the official coding guidelines,billing codes are determined using several components, including client’s history, examinations, medical decision making, counseling, coordination of care, the nature of the presenting problem, and the amount of time spent with the client.

    For 23 of the 105 Medicaid clients in our sample, at least 1 family planning service was incorrectly billed.

    Examples of this type of error included billing an incorrect office visit code when the client received only a birth control injection, billing a counseling code in addition to another code that already included the counseling, or billing for a service that was claimed during a previous visit and that was not allowed to be billed again.

    These errors occurred because the State agency did not ensure that PPNT correctly billed for family planning services. As a result, the State agency improperly claimed $738 for Medicaid services and $972 for waiver service

The State agency said that it would collect the overpayment from Planned Parenthood North Texas and refund the Federal share.

In 2013, Planned Parenthood’s Houston-based affiliate settled for $4.3 million with the state of Texas after an audit revealed that the agency charged for “fraudulently over billing the taxpayer-funded Medicaid program.”

Planned Parenthood director on Medicaid audit claims “no wrongdoing no fraud”

In 2010, Planned Parenthood of the Inland Northwest agreed to pay the state $345,000 after settling a 2009 audit that uncovered the clinic used incorrect codes and provided insufficient documentation for some claims billed to Medicaid.

The original audit finding estimated the Spokane family-planning organization improperly billed Medicaid more than $629,000 for 333 patient procedures from March 2004 through February 2007.

During that time, the clinic collected about $7.6 million from Medicaid.

Planned Parenthoods in New Jersey were also investigated that same year.

In 2012, a published report said that Illinois Medicaid’s inspector general was investigating the billing practices of Planned Parenthood of Illinois’ medical director.

Crain’s Chicago Business reported more than $3 million in Medicaid funds going to the Planned Parenthood doctor made her the Illinois program’s second-highest-paid doctor.

In 2013, Planned Parenthood’s Houston-based affiliate settled for $4.3 million with the state of Texas after an audit revealed that the agency charged for “fraudulently over billing the taxpayer-funded Medicaid program.

So when Nicole Safar, Planned Parenthood of Wisconsin’s policy director claimed audits in her state of the abortion giant would only turn up compliance, it looked rather suspicious to me.

The investigation stems from a letter 28 Wisconsin State Representatives and 4 State Senators wrote calling for an investigation into family planning centers and Planned Parenthood centers in the state.

As Life Dynamics reports, the letter asked co-chairmen of the non-partisan Joint Legislative Audit Committee, “conduct a comprehensive independent audit of Wisconsin’s Medicaid family planning providers including Planned Parenthood of Wisconsin (PPWI) .”

The letter detailed what it calls “red flags” already discovered by the Office of the Inspector General (OIG) at the Department of Health Services against two family planning facilities, (NEWCAP and Wisconsin Family Planning Health Services) in the state which over-billed the state a combined total of $3.5 million.

The letter states that several other states report, “similar findings with Planned Parenthood and other Medicaid family planning providers.”

They point to a Milwaukee Journal Sentinel article which states, “All of the family planning clinics, including those run by Planned Parenthood of Wisconsin, are paid the same rate by the state.”

In response to the previous investigation of the prior family planning facilities, Nicole Safar, director of policy and legal advocacy for Planned Parenthood of Wisconsin, told the Journal, “We are all doing it the same way.”

The lawmakers write that Planned Parenthood’s statement in that article is troubling, “It is peculiar and deeply troubling,” they said, “that any large recipient of taxpayer dollars would pre-emptively divulge that they are guilty of massively defrauding the government and actively in violation with their billing practices, with no plans to change or reimburse taxpayers–and yet that is precisely what Planned Parenthood of Wisconsin is admitting to.

But, of course, Planned Parenthood is crying foul and the media is listening.

As Safar so boldly stated before the audit has even begun, “Any sort of audit of family planning providers is only going to show widespread compliance. There is no wrongdoing, there is no fraud,” Safar said. “Anyone can shine a light on us.”

Profit no matter whatAlliance Defending Freedom made public Wednesday its latest annual report to Congress that identifies waste, abuse, and potential fraud by Planned Parenthood, state family planning programs, and other organizations. As in 2013 and previous years, the report urges Congress to continue its investigation into the misuse of taxpayer dollars.

“The government should use American tax dollars responsibly and for the common good. The taxpayers who provide that hard-earned money deserve to know if it’s being funneled to groups that are abusing it,” said ADF Litigation Counsel Catherine Glenn Foster. “When it comes to accountability and transparency, Planned Parenthood’s publicly-funded, billion-dollar abortion empire cannot be given a pass. It has to play by the same rules as everyone else.”

The updated report, titled “Profit. No Matter What,” explains that “Planned Parenthood and its affiliates are engaged in a pattern of practices designed to maximize their bottom-line revenues through billings to complex, well-funded federal and state programs that are understaffed and rely on the integrity of the provider for program compliance.”

The report details the 44 known audits or other reviews of Planned Parenthood affiliates’ financial data and practices, as well as 51 known audits of state family planning programs and three known audits of family planning organizations that found overbilling. The audits for fiscal year 2013 found a total of more than $115 million in waste, abuse, and potential fraud in federal and state family planning funding programs, the lion’s share of which goes to Planned Parenthood. Approximately $14.4 billion of federal Medicaid expenditures were improper payments, according to government sources.

The report also identifies 10 types of waste, abuse, and potential fraud Planned Parenthood affiliates have been found to be committing or have been credibly accused of nationwide. The potential fraud includes the illegal practice of billing and being reimbursed by Title XIX agencies for medications and/or services provided in connection with an abortion.

Other alleged billing violations include billing in excess of actual acquisition cost or other statutorily approved costs for contraceptives and Plan B products, inappropriately billing for services that were not medically necessary, billing for multiple initial prenatal care visits, and incorrectly billing initial, follow-up, and postpartum services.

Planned Parenthood must face claims that it defrauded Medicaid with regard to blood tests performed on Texas teens, a federal judge ruled.

According to Court House News, Patricia Carroll brought the complaint in late 2012 after serving as the accounts receivable manager for Houston-based Planned Parenthood Gulf Coast Inc. for five years. In March of that year, she had allegedly noticed that a Planned Parenthood clinic in Huntsville experienced a revenue increase of more than 300 percent.

On July 30,2013 Planned Parenthood Gulf Coast settled a whistle-blower lawsuit that alleged the Houston abortion giant engaged in fraudulent Medicaid billing for $4.3 million.

In finalizing the settlement, which includes total state and federal recovery, the agency claimed the allegations that it submitted more than $30 million in fraudulent bills between 2003 and 2009 were “baseless.”

“This settlement is not an admission of guilt,” Planned Parenthood said in a prepared statement.

The pro-life organization, Life Dynamics has been encouraging pro-lifers to warn abortion and Planned Parenthood workers that illegal activity could send them to prison:

According to Life Dynamic’s press release, it is clear that the pro-life movement has a greater potential for recruiting informants from the abortion industry than ever before. To capitalize on this, Life Dynamics, Inc. a national pro-life organization located in Denton, Texas is re-launching its ClinicWorker.com direct mail campaign.

Since Life Dynamics began the ClinicWorker.com project, they have seen that virtually every abortion clinic in the country is engaged in at least some sort of illegal activity and most are engaged in several. Life Dynamics claims that when this information is brought out into the public, the consequences for the abortion industry can be devastating.

According to Crutcher, “In just one example, several years ago two employees of Petroplex Gynecological – an abortion clinic in Midland, Texas – contacted us with information documenting that the abortionist who owned this facility was underreporting his income and filing false Medicaid claims. Following several days of conversations with these women, we called our contact at the Internal Revenue Service and made arrangements to turn this evidence over to them. Within a few months, that material was used to convict abortionist John Alderman and send him to a federal prison. His abortion clinic was also shut down and never reopened.”

Crutcher continues, “From the abortion industry’s standpoint, it may be that the most damaging outcome of this trial is not that Gosnell went to prison, but that his wife and several employees did as well. This creates trouble for the abortion industry given that (a) it is common for the authorities to get information about an employer’s illegal activity from disgruntled former employees and ex-spouses; and (b) the divorce rate within the abortion industry appears to be well above average and the employee turn-over rate is astronomical. Beyond that, we have also found that, even among those employees who remain on abortion clinic payrolls, the vast majority have an attitude toward their employers that ranges from distrust to loathing.

When prison sentences were handed down against Gosnell’s employees, it was easy to predict that one consequence would be a heightened concern among America’s abortion clinic workers regarding their own vulnerability to criminal charges.

“In the past, most of these people were intimidated into silence because they didn’t know the answers to two questions: “How would I go about telling what I know?” and the most important question of all, “Am I in trouble?” But at Life Dynamics, we know that these issues can be resolved. We also see evidence that clinic employees are starting to be less afraid to come forward.”

On the day after Gosnell was convicted, Life Dynamics released the first part of an interview they taped with three former employees of Houston abortionist, Douglas Karpen. In graphic detail, these women publicly revealed that the same things that were going on in Gosnell’s abortion clinic are going on in Karpen’s. Life Dynamics furnished the unedited footage of this interview to the Houston police resulting in a criminal investigation.

Crutcher, says, “Since the Gosnell trial many abortion employees are looking out there and saying, ‘You know what? I like my job, and I’m pro-choice and all that, but I’m not interested in going to prison. I’m not that committed.’ And they are starting to come out of the abortion industry. Whistleblower files appeal charges Planned Parenthood with fraud

Alliance Defending Freedom filed an appeal Wednesday with the U.S. Court of Appeals for the 9th Circuit on behalf of Jonathan Bloedow, a Washington taxpayer who alleges that Planned Parenthood submitted “repeated false, fraudulent, and/or ineligible claims for reimbursement” to the state’s Department of Social and Health Services.

“American taxpayer dollars should be used responsibly and for the common good, not funneled to groups like Planned Parenthood that abuse the public trust,” said Senior Counsel Michael J. Norton, a former U.S. Attorney. “Compliance with the law should not be sacrificed for the sake of Planned Parenthood’s bottom line. They have cheated the American taxpayer for too long. It’s time the abortion giant is held accountable.”

The federal False Claims Act allows “whistleblowers” with inside information to expose fraudulent billing by government contractors.

In July 2011, Alliance Defending Freedom attorneys filed the lawsuit Bloedow v. Planned Parenthood of the Great Northwest under the act. A federal district judge dismissed the case last month on technical grounds–wrongly concluding that Bloedow’s claims were barred by another lawsuit against an entirely different Planned Parenthood affiliate based in California.

Bloedow’s lawsuit alleges that Planned Parenthood submitted false claims to Washington’s Department of Social and Health Services and its Health and Recovery Services Administration. HRSA runs the state’s Title XIX Medicaid program.

According to the suit, Bloedow discovered through his own research that Planned Parenthood of the Great Northwest filed at least 25,000 false claims with HRSA for reimbursements in excess of the amount allowed for oral contraceptive pills and at least another 25,000 for reimbursements in excess of the amount allowed for “emergency contraceptive” (“Plan B”) pills under the federal government’s 340B drug reimbursement program. Total damages could be as much as $377,134,130.

Alliance Defending Freedom has filed two other unsealed False Claims Act lawsuits to date, Johnson v. Planned Parenthood of Houston and Southeast Texas and Thayer v. Planned Parenthood of the Heartland.

In 2013, Alliance Defending Freedom released its updated report to Congress that identified nearly $108 million in waste, abuse, and potential fraud committed by Planned Parenthood affiliates and other providers.

Christine Quinn endosed by PPMetro US reports that abortion giant Planned Parenthood as well as the National Organization for Women have endorsed City Council Speaker Christine Quinn for mayor over Bill de Blasio and former comptroller Bill Thompson, former U.S. Congressman Anthony Weiner and current comptroller John Liu.

“Chris has shown her commitment to protecting women’s access to life-saving cancer screenings, birth control and safe and legal abortion — and she wholeheartedly shares our belief that medical decisions are best made by women and doctors, not politicians,” Joan Malin, head of the Planned Parenthood of New York City Political Committee political committee, said in a statement.

If elected, Quinn said that she would help provide all students with comprehensive health education ( code word for abortion education). The Washington Times reports that Quinn is perhaps opening the door for middle school girls to receive morning-after contraception, known as the abortion pill. “We need to recognize the reality of what’s happening in children’s lives and give them what they need to make the right choices and protect themselves,” she said.

That flies in the face of mandatory reporting laws – but- so does one of her supporters, Planned Parenthood (go here)

Quinn said she would ensure every school has a health education-certified teacher, which most suspect would come from none other than Planned Parenthood – this the endorsement.

Quinn said she was “proud” to receive the endorsement from the abortion giant who is tangled in medicaid fraud accusations, founded in eugenics and racism, covering for child sexual predators.

“Planned Parenthood and their political committee has a long, amazing history of breaking barriers on behalf of women and has not once through the decades let up on its relentless fight to protect the health of women and girls,” Quinn said in a statement.

In addition to Planned Parenthood and NOW, NARAL pro-choice America also endorsed Quinn.

Planned Parenthood’s top award is called the Margaret Sanger Award, despite the fact that their founder, Margaret Sanger was an admitted Klan speaker. This is what Sanger wrote in her autobiography, “I accepted an invitation to talk to the women’s branch of the Ku Klux Klan…I saw through the door dim figures parading with banners and illuminated crosses…I was escorted to the platform, was introduced, and began to speak…In the end, through simple illustrations I believed I had accomplished my purpose. COVERING FOR CHILD SEXUAL PREDATORS

Recently AnthonyWeiner Anthony Weiner announcedhe’s not dropping out of the New York City mayoral race despite new revelations that he sent additional lewd photos and text messages after he left Congress in disgrace for his prior online chats.

Weiner, who resigned his House seat in June 2011 after acknowledging having sexual conversations with at least a half-dozen women, told a hastily called news conference he would stay in the race despite the new onslaught of negative publicity.

“I’m sure many of my opponents would like me to drop out of the race but I’m not going to do it,” he said, adding, he hoped the people of New York were “willing to still continue to give me a second chance.”

Margaret Sanger: American Eugenicist, Klan Speaker, and Planned Parenthood founder born Sept 14th not celebrated here

Planned Parenthood founder, Margaret Sanger, was a member in good standing with the racist American Eugenics Society. Sanger had board members who were known for their racist writing and Sanger published many of those in her publications. Sanger called for parents to have a QUOTE: LICENSE TO BREED controlled by people who believed in her eugenic philosophy. She wanted all would be parents to go before her eugenic boards to request a “PERMIT TO BREED“.

Margaret Sanger once said, “More children from the fit, less from the unfit — that is the chief aim of birth control.” Birth Control Review, May 1919, p. 12

Sanger also called for those who were poor and what she considered to be “morons and immoral‘ , to be shipped to colonies where they would live in “Farms and Open Spaces” dedicated to brainwashing these so-called “inferior types” into having what Sanger called, “Better moral conduct”.

I consider that the world and almost our civilization for the next twenty-five years, is going to depend upon a simple, cheap, safe contraceptive to be used in poverty stricken slums, jungles, and among the most ignorant people. Even this will not be sufficient, because I believe that now, immediately, there should be national sterilization for certain dysgenic types of our population who are being encouraged to breed and would die out were the government not feeding them.

In addition, Planned Parenthood’s top award is called the Margaret Sanger Award, despite the fact that Sanger was an admitted Klan speaker. This is what Sanger wrote in her autobiography, “I accepted an invitation to talk to the women’s branch of the Ku Klux Klan…I saw through the door dim figures parading with banners and illuminated crosses…I was escorted to the platform, was introduced, and began to speak…In the end, through simple illustrations I believed I had accomplished my purpose.
