Free speech at stake in NAF lawsuit against CMP as judge is set to issue opinion

A federal judge has ruled that secret recordings from a pro-life group who infiltrated a National Abortion Federation meeting to expose a grisly baby parts harvesting operation does not show criminal activity, according to a report by the Associated Press.

Deb Van Derhei NAF Harvesting babies

In July, the National Abortion Federation (NAF) sued the Center for Medical Progress (CMP) accusing CMP of using fake names, infiltration, and hidden cameras to obtain the damning evidence. San Francisco Judge William Orrick granted NAF a temporary restraining order to prevent the release of the tapes. But, while the effort to suppress the videos were making their way through the courts,GotNews.com published them, claiming they were leaked to them by a hacker.

In their lawsuit, NAF claimed that CMP infiltrators “snuck into” their allegedly secure and supposedly private meetings to obtain video evidence that their members were buying fetal tissue. In response to the lawsuit, CMP claimed that their investigators conducted their investigation legally, and that NAF welcomed lead investigator David Daleiden and the other investigators as dealers in fetal tissue believing that Daleiden’s test company, BioMax, would pay abortion providers for fetal specimens. “NAF even provided Daleiden unsolicited information about the meeting’s agenda and location,” attorney’s for CMP stated.

But, according to the AP report, Judge Orrick does not agree. From the story:

Recordings secretly made by an anti-abortion group at meetings of abortion providers do not show criminal activity and could put the providers at risk, a federal judge said Friday, citing the recent shooting at a Colorado Planned Parenthood clinic.

U.S. District Judge William Orrick made the comments during a hearing over the National Abortion Federation’s request for a preliminary injunction that would continue to block the release of the recordings. Orrick did not immediately issue a ruling. He previously issued a temporary restraining order blocking the recordings pending the outcome of the preliminary injunction hearing.

Pro-lifers who have viewed the leaked tapes say that the NAF lawsuit is equivalent to censorship because NAF does not want the public to know the truth about abortion. The videos show plenty of evidence that NAF members were not only involved in harvesting fetal tissue but were holding presentations about the process during their meetings. A sampling of a few of the recordings show that NAF members:

Conference attendees applauding horrific late-term abortion procedure
NAF held presentations on harvesting aborted baby parts
NAF members and a majority of the women they service know they are killing a baby
Abortion clinics dispose of preborn children in garbage disposals
Burning aborted babies for energy fuel may really be happening
A cold and callous disregard for the dead
A Planned Parenthood abortionist and NAF attendee admitted being involved in fetal tissue research with, “independent / individual researchers”

Continuing with the AP report:

Orrick made a statement that doctors who appeared in CMP’s videos have received death threats. He also cited suspected arson at abortion clinics and the November shooting at the Colorado Springs Planned Parenthood clinic that left three people dead and nine wounded.

Catherine Short, an attorney for the Center for Medical Progress, said there was no evidence the Colorado shooter was motivated by the group’s videos or that doctors have been directly threatened. The release of the recordings is vital to furthering public discussion about topics such as whether the country’s abortion laws are too loosely written, she said. The center says in court documents its work is the equivalent of investigative journalism and protected by the First Amendment.

And, Short is correct, investigative journalism is not only protected by the First Amendment but the tactics used by CMP have been used by journalists in all sorts of investigations as Live Action News has detailed here. In fact, free speech issues in this case are so great that the U.S. Reporters’ Committee filed a ‘friend of the Court’ submission before the district court hearing NAF’s case, protesting that ‘any prior restraint on speech that is issued by a court has the potential to significantly affect the First Amendment rights of the news media and the public at large.’

we are compelled to write at this early juncture because any prior restraint on speech that is issued by a court has the potential to significantly affect the First Amendment rights of the news media and the public at large. The ramifications of having such a restraint in place go well beyond the unique facts of this dispute, they wrote.

Tom Brejcha, Thomas More Society President and Chief Counsel which presented arguments against NAF in the case agreed accusing NAF of working with Planned Parenthood to suppress Daleiden’s First Amendment rights.

“Equally as any other investigative journalist working for ABC, NBC, CBS, Fox News, or your local print or electronic media outlet may regularly resort to undercover journalism tactics to ferret out hidden crime, so too David Daleiden should have the right to penetrate the criminal underworld of America’s abortion providers and report all the evidence he has uncovered of criminal wrongdoing to law enforcement and to members of the public.”

The brief that Thomas More Society and co-counsel have filed on behalf of Daleiden in opposition to NAF’s preliminary injunction includes:

Information about the precedent set by the recent Animal Legal Defense Fund v. Otter case, where the 9th Circuit ruled definitively that investigative journalism is not “fraud” and fully protected by the First Amendment.

Admissions from NAF and Planned Parenthood abortion providers about their criminal participation in trafficking in aborted baby body parts documented at NAF meetings, redacted from the public filing and prevented from release by court order.

The blatantly unconstitutional character of prior restraints on speech.

If NAF wins this case, criminals will rejoice and journalists will weep,” Brejcha said.

Both sides are watching for the decision to be released.

CJ Pearson, a young black 12 year-old blasts Obama gets shut down by Facebook

CJ Pearson, a young 12 year-old who blasted Obama last week saying the president does not love America says Facebook has retaliated by pulling down his personal page.

The video link I used last week to post his vid- has also been removed by YouTube:

Thankfully- the original is still online:

CJ Pearson 1

According to the Examiner:

On Friday, C.J. Pearson, a 12-year-old conservative from Georgia who posted a viral video supporting Rudy Giuliani, discovered that his personal Facebook page was locked. In an exclusive interview with Examiner.com on Saturday, Pearson said he received a message from someone about 6 a.m. Friday. That’s when he learned his account and page had been locked for “suspicious activity.”

He jumped through all of Facebook’s hoops, but wasn’t able to recover his account. So he created a new profile to take its place. His public page was not affected, he said, however, he can no longer administer the page. Fortunately, he said, a friend is helping post links to that page.

As is so often the case in these situations, Facebook did not respond to his requests for help. Nor would they tell him what the alleged suspicious activity was. We reached out to Facebook, but the social media giant has so far refused to respond to our request for comments.

Young supporters are already taking action:

His story will get out- he says he will also appear on Hannity:

Sandra Fluke promotes becoming an abortion clinic escort after SCOTUS buffer zone loss !

Who said there is a glass ceiling when it comes to pro-choice feminists?

Sandra_Fluke_BC_Meme

Apparently, birth control activist, Sandra Fluke who is currently seeking a Senate seat in the California State Legislature, has risen from spokesperson for shoving contraception down the wallets of every American to the promoter of escorting outside abortion clinics like Planned Parenthood.

Thursday, the Supreme Court ruled unanimously that left-wing – liberal – “pro-choicers”- could not censor free speech outside abortion clinics with so-called Buffer Zones.

These “zones” limited only the speech of pro-life activists and today the promoters of abortion are having a tizzy.

So twitter is filling up with calls for abortion advocates to #ProtectTheZone and escort patients outside Planned Parenthood and abortion clinics nationwide.

Enter Sandra Fluke’s Tweet:

Her link takes you to Planned Parenthood – Surprised?

Now, one would think that with all the $$$$$ Planned Parenthood takes from the government and private donations – they could afford a slight pay cut to their directors who generally take home a six-figure salary – and they could pay clinic escorts.

But even Planned Parenthood prez – Cecile Richards is crying for free “help” to make sure the abortion giant doesn’t lose ANY Revenue when women turn around from their abortion appointments.

And the tweets keep coming with calls for free speech killing legislation by these pro-choice censors:

Of course, these purveyors of “women’s rights” and “freedom” and “choice” only want limitations on speech that they disagree with them.

When it comes to protesting – Planned Parenthood and their pro-choice supporters like having the freedom to do it themselves:

Student: Planned Parenthood / Left-wing sites available Pro-life / Conservative sites blocked

Posted in Censorship with tags , , , , , , on June 25, 2014 by saynsumthn

According to this news report Planned Parenthood and other left-wing political websites were accessible at a school website but conservative – pro-life and Christian websites were blocked !

Andrew Lampart says that he was researching gun control in May for his studies at Nonnewaug High School in Woodbury, but was unable to view the National Rifle Association’s website from a school computer, he told FoxCt.com.

According to Fox News, Lampart claims the issue went even further down the political divide, to issues including abortion and religion. He told the station he had full access to Planned Parenthood’s website, but could not access pro-life groups’ websites. He was also blocked from Christianity.com and the Vatican’s website, but not Islam-guide.com, he said.

The Woodbury school district issued a statement Thursday, saying that it pressed Dell SonicWall, its filtering provider, as to why the liberal websites fell into a “not rated” category and the conservative sites fell into “political/advocacy group” category, barring them from school computers.

“The district is trying to determine the reason for the inconsistency and if the bias is pervasive enough to justify switching to another content filtering provider,” the statement read. “The district does not block individual sites, only categories of websites. The categories are supposed to be inclusive of all sites that fall into a common description. The district does engage in unblocking sites to provide diverse points of view and balance in the instructional process.”

SonicWallSecurity

According to their website, The Dell SonicWALL Content Filtering Service allows administrators to block any site that has not been rated by providing a category called “Not Rated”. It is important to note that Not Rated means that we have not yet had the opportunity to rate the URL. It does not mean that we have reviewed the site and decided to rate it “Not Rated”. Many organizations block the “Not Rated” category since millions of new URLs are introduced monthly and will not make it into the rating queue until there is sufficient traffic or an end user submits the site for rating. Not Rated should be blocked since millions of new malware sites appear monthly.

Censorship on UC Santa Barbara Campus as Pro-choice Feminist Studies Professor Steals Pro-Life Sign

Posted in Censorship, pro-choice, pro-choice violence, Progressive with tags , , , , , , , , , on March 13, 2014 by saynsumthn

On March 4, 2014 Joan Short of the Survivors of the Abortion Holocaust led a pro-life outreach at UC Santa Barbara.

milleryoungDuring the event pro-lifers say that pro-choice Mireille Miller-Young, a UC Santa Barbara professor of Feminist Studies whose areas of study include Pornography; Sex Work; and Feminist & Queer Theory stole the pro-life sign from a young pro-life activist who was trained by Survivors. Miller then took the sign into an elevator, where she repeatedly pushed, and even pulled the victim, who was attempting to hold the elevator doors open until police arrived, according to members of Survivors.

Miller Young

Joan Short recalls the event, “a woman stopped by and I could see my roommate, Mairead, talking to her with Sarah chiming in now and then. I hoped it was good conversation for Sarah’s first time. Then Thrin came around to the front of the sign and joined in. I was afraid, at this point, that the woman might feel like they were ganging up on her. Boy was I wrong!

As the woman’s shouts of “millions of children in Africa,” “my body,” “foster-care system,” etc. got louder and louder, a crowd of students gathered around. I could tell that Thrin wasn’t getting on very well with the woman, but I still didn’t want to interrupt because she is probably just as experienced as I am. If the students could hear what Thrin was saying, then they would be able to judge who was speaking rationally. I walked along the outer fringes of the crowd, asking what they thought. One girl said, “I’m just listening; that’s my professor.”

The professor was really working the crowd, letting any student ask a question, but not letting Thrin answer anything thoroughly. The professor shouted, “We don’t need to listen to these people. They don’t have our permission to be here. Should we tear down their sign?” She rallied the crowd of about fifteen to chant, “Tear down this sign! Tear down this sign!”

A few of us started talking to the students individually. The chanting stopped as the real conversations began. I asked one girl what she thought about the signs. She said “I’m pro-life, I get it, but this is kind of shocking to see when you come out of class.” Her friend joined in, “You don’t understand; you guys don’t know what it’s like to go through the foster care system.” This was familiar ground for me. Yes, the foster care system has some major flaws and I felt sorry for the girl and told her so.

As I talked to her I noticed that the professor was walking from one group to another saying, “They’re separating us; we’ve got to stick together.” I had gotten to the point in the conversation, where the heart of the issue is laid bare: is the fetus a living human being?

Professor Steals prolife sign 2014

Just then, there was a general shout. The professor had just pulled the sign away from Sarah. Sarah looked shocked. I tried to grab the sign, but she pulled it away from me. Another friend, Clare, stood in her way and grabbed the sign. Not wanting to start a brawl, I told her to let go. The professor kept walking down the sidewalk with two students helping her. I wasn’t sure what was going to happen but kept following them and called 911 on Clare’s phone. As I talked to the police and Thrin videotaped, we followed the thieves into a building.

IMG_3169

Walking down a hallway, the professor turned to two women standing in a doorway and asked them to get in our way so they could get away. Luckily, they did not comply. We turned a corner and found that the fugitives had entered an elevator. Thinking the police might be there any minute, Thrin tried to keep the door open with her foot. The professor tried to push Thrin out, leaving scratches on Thrin’s arms. When she couldn’t get Thrin out of the way of the door, she got out of the elevator and tried to pull Thrin away. Thrin finally let go of the elevator door when she realized that the students inside the elevator were trying to take the video camera out of her hand, which was also holding the door open. The elevator left without the professor, who got in the next elevator.

LEFTARM

This whole time I was trying to explain what was going on to the police. I was in an unfamiliar place, on an unfamiliar phone, trying to deal with a very unfamiliar situation. Eventually, the police came, but the excitement was over. When I got back to our group, they were just finishing passing out the fliers. The police talked to several of us, including Sarah, and watched the video that Thrin had taken. It was time for us to go, so we left everything in the policemen’s hands and packed up. On the way back to our school the policeman called to tell us that they had found the sign, but it had been destroyed.

ucsb

Nothing like this has ever happened to me before and I hope it will never happen again, but it did not destroy the work that we did. We were able to handle individuals. What we did not expect to encounter was a professor inciting a mob. Although we were interrupted, we reached a lot of students. Many of them will not be able to think complacently about abortion ever again. They will not have abortions themselves nor will they counsel their friends to. With babies dying every day, we know that we have to use even our spare time to do something to end abortion. We will continue to bring the truth about abortion to UCSB.”

UPDATE MARCH 19, 2014:

A copy of the Police Report Has been Issued:

In the report, Miller-Young, who is pregnant, said she was “triggered” by the graphic images of aborted fetuses on the large posters and said she felt the demonstrators didn’t have a right to be on the university’s campus, because their messages were upsetting to her and students. When asked by police if there had been a struggle between her and the activists when she took the poster, Miller-Young responded, “I’m stronger, so I was able to take the poster.”

Remembering Grayson, anencephalic baby banned from Facebook whose short life impacted so many people

Posted in Anencephaly, Censorship, Facebook with tags , , , , , , on March 3, 2014 by saynsumthn

In 2012, KCTV reported that a new mother was been banned from Facebook for the photos she posted of her newborn son.

1612388_G

Grayson James Walker was born on February 15, 2012. He was born with Anencephaly, a rare neural tube birth defect in which a baby is born without parts of the brain and skull. Action News 5 shared the Walker’s story about their sons eight hours of life shortly after he died.

Heather Walker then posted pictures of Grayson without his hat on.

1612385_G

“Not long after, Facebook deleted them because of the content” she said. “They allow people to post almost nude pictures of themselves, profanity, and so many other things but I’m not allowed to share a picture of God’s beautiful creation.”

When Walker and her Facebook friends decided to re-post baby Grayon’s photos in protest, the mother was placed on a 24-hour ban from the social networking website.

“I see all kinds of stuff, women’s body parts, almost nudity, which is one of their standards, people cursing each other out, just profanity,” said Walker.

Amazed at the amount of support she received from all over the country, Walker says the photo is raising awareness.

“Just in two days, all these people have messaged me telling me how much God has used Grayson’s life to touch them and to work in their hearts and to make them appreciate the children they have, that they have healthy children,” she explained.

Facebook later apologized to the family. “Upon investigation, we concluded the photo does not violate our guidelines and was removed in error,” Facebook said in a written statement.

“At first, I questioned God and wondered why he would choose us for this,” said Heather Walker.

Sixteen weeks into her pregnancy, Heather Walker found out her baby had a fatal birth defect.

They of course gave us the option to terminate,” said Heather Walker.

The Walkers chose to carry Grayson to full term. Heather Walker said she turned to her faith to prepare herself for the days ahead.

“My husband and I, we started prayer and we knew that God knew since the beginning of time that he had us for this,” said Heather Walker.

“Honestly, just seeing the strength that she had motivated me to be a better husband and a better father to my kids,” said Patrick Walker.

“As soon as they brought him around to me, all those fears and everything were taken away,” she said.

With the help of non-profit organization, Now I Lay Me Down To Sleep, the Walker family had a photographer capture the hours they had with baby Grayson.

By treating his birth like any other special delivery, the Walkers hope to keep Grayson’s memory alive forever.

“Yes, I’m going to cry and I’m probably going to lay in my bed some days, but I have that hope that God has got him in his hands and we’re going to get to meet him again someday,” said Heather Walker.

“You know, my son lived almost eight hours, and he’s already done in eight hours what I could never do in a hundred lifetimes, and that’s awesome,” said Patrick Walker.

Grayson was the family’s third child.

“Just in two days, all these people have messaged me telling me how much God has used Grayson’s life to touch them and to work in their hearts and to make them appreciate the children they have, that they have healthy children.”

Grayson was born on 2-15-2012 at 10:00am and lived for 8 beautiful hours.

Censorship High School over Pro-life Speech

Posted in Censorship, Students for Life with tags , , , , , , , on February 19, 2014 by saynsumthn

Wilson High School has received a letter from the Thomas More Society a Chicago-based public interest law firm, demanding that the school end its discriminatory treatment of a pro-life student group. Wilson Students for Life (“WSFL”), an affiliate of Students for Life of America, was established in the Fall of 2013 by freshman Bryce Asberg to “loudly proclaim the pro-life message.” Since its founding, the group has faced constant hostility from the school’s administration, such as forbidding the group to hang its posters or host certain events, while other student groups have faced no similar restrictions. The school has until February 25th to respond to Thomas More Society’s demand to end its hostility towards Wilson Students for Life, which discrimination violates the federal Equal Access Act.

Asberg’s group selected two posters from the Students for Life of America website to promote its club. In compliance with school procedures, they asked the administration’s permission to hang these posters. The first read “Since Roe v. Wade 1/3 of our generation has been aborted” with a picture of a milk carton and the word “missing” above the photo of a baby. The second poster quotes President Ronald Reagan: “I’ve noticed that everyone who is for abortion is already born.”

Missing

The administration refused to give WSFL permission to hang the posters. The administration stated that the school policy only allows posters that “do not offend staff or students, put others down if they have a different belief/opinion, or otherwise cause disruption.” WSFL’s posters, the administration maintained, would violate this policy because they promote a message rather than solely promoting the group’s meetings.

Despite this policy, however, the administration has permitted the Wilson Gay Straight Alliance (“GSA”) to hang flyers, for example, promoting homosexual relationships by showing conjoined male symbols and conjoined female symbols and stating “Love knows no limits.”

After the administration’s denial of WSFL’s posters, school administrators met with Asberg and the other WSFL leaders to “give them advice” on how to best run their club.
Ronald-Reagan-Quote-Already-Born

Asberg said he left the meeting feeling like his group was encouraged to only host events after school, while other groups were allowed to do what they wanted during the school day. For example, while GSA is permitted to hold a Day of Silence during the school day, the pro-life club was discouraged from doing so as their identical event would be “too controversial.”

“The Wilson High School administration cannot be allowed to trample on the constitutional rights of Wilson Students for Life,” said Kristan Hawkins, President of Students for Life of America. “Our pro-life students will not accept their right to free speech being taken away. Sadly, this case shows that viewpoint discrimination is alive and well in today’s schools and that administrators think they can still get away with it. Students for Life of America is proud to stand with Wilson Students for Life to demand that the Wilson High School administration reverse their unjust decision and give equal treatment to all students and student groups, regardless of their views on abortion.”

The federal Equal Access Act requires that schools give each student group the same opportunities, without discriminating against any group. In 2002, the United States Court of Appeals for the 9th Circuit held that a Washington school which gave one group access to its bulletin boards must give that access to all student groups. Moreover, a number of Supreme Court decisions, such as Tinker v. Des Moines Independent Sch. Dist., have held that students’ speech cannot be silenced simply because the administration has vague fears of disruption.

“Wilson Students for Life is passionate about the pro-life movement,” stated Bryce Asberg, Founder of Wilson Students for Life, “and we will continue to stand for life in our community. We simply desire to be allowed to express our views.”
