The Medical Examiner testified the autopsy found pockets of air in the baby’s stomach and that the child breathed. “When a fetus is aborted, sometimes there is some activity in the fetus and you normally don’t do anything. You let the fetus expire. The usual thing is just to take your time, don’t immediately do anything,” the abortionist told authorities. Authorities cleared the doctor saying there was no clear evidence the abortionist smothered the baby. Pro-lifers felt authorities never took eye witness testimony into account. Although shivering, whimpering and gasping for air, the baby was forced to fend for herself for 40 minutes until a nurse finally came to her aid. But it was too late to save the child from serious injury. Her adoptive mother, Margaret Renaerts sued the girl’s natural parents, a hospital and seven of its staff, an unnamed abortion clinic, the provincial government and two of its officials.The case alleges that, Ximena’s natural mother, Nadine Bourne, then 22, had been admitted to Vancouver General on after suffering complications from after a botched clinic abortion at a Bellingham, Wash., clinic three days earlier. She was scheduled for a ”dilation and curettage” the next morning to remove what remained in her womb, but gave birth at 3 a.m. to Ximena in a bedpan who was 26 weeks old and weighed less than a kilogram.

Despite the baby crying and gasping for air, a nurse left her to die in a room used to store dead fetuses. The hospital’s supervising nurse came on the scene 40 minutes later and ordered a Code Blue — an emergency resuscitation of the baby.

The baby, suffered permanent brain damage. Her adoptive parents won the lawsuit which, will help pay for her care.

There was one incident where the woman had the baby while she was waiting at the door for the clinic to open. She got there at 7 a.m. The clinic opened at 8 a.m. She said the baby was born alive. The baby was now dead, and she was holding the baby in a bag. She was bleeding.
I was in the room when Dr. X gave the digoxin to stop that baby’s heartbeat beforehand. [Digoxin is a medication inserted by needle through a mother’s abdomen into a baby’s heart to cause instant cardiac arrest.]
Well, he didn’t have an ultrasound machine that day. He inserted the needle blindly. He said he’d been doing it so many years, he knew the location. But he didn’t actually know if he hit the heart.
I know this nurse – Bridget. She was working there when the new doctor held a baby under water in a bucket when she told him the baby was alive. That baby was between 25-26 weeks. Bridget left two months ago because of that.
I left because I got tired of everything going on and the fact Dr. X would coach women into saying they were going to kill themselves if they didn’t abort. Then he said he had a legal right to do it past viability. He did them all the way to 40 weeks.”

“I, too, witnessed a similar incident during one very long night shift in the emergency room. We were summoned to get a “pregnant woman in distress” out of her car. The first to arrive was a paramedic, who reported hearing a little cry as she approached. She tried to give the baby rescue breaths, but a new infant can’t tolerate more than a couple minutes without oxygen before permanent brain damage occurs, as you know. By the time we got the infant inside, she was already cyanotic [blue] and, with the parents’ urging, the ER doc pronounced her [dead] almost immediately.
The focus turned to stabilizing the mom who was bleeding profusely. I felt so badly for her and tried to comfort. She was quite cold to my attempts, which, of course, raised suspicions.
When mom’s “primary physician” arrived on scene, we all realized what was going on – that it was, in fact, an abortion.”

In May of 2006, State Health Officials used an “emergency order” to close the Summit Medical (abortion) Center in Birmingham after the clinic was found dispensing RU-486 without a doctor. News reports indicate that a staff member of the abortion clinic gave a patient RU-486, which, is supposed to be administered only by doctors. The patient was told during the examination that she was only six weeks pregnant. Six days later the woman was rushed to the emergency room of the Birmingham hospital with the head of a baby protruding. While at the hospital the woman delivered a stillborn, macerated, six-pound four-ounce baby. The Baby was well beyond the six-week estimate the clinic issued. “It was nearly full term,” said State health officer, Dr. Donald Williamson. Once state health officials were notified, they found that Summit’s records falsely indicated that the clinic’s abortionist performed the ultrasound and provided the abortion. Investigations revealed that the physician listed on the clinic’s files was not even present at the clinic the day the abortion drug was administered.

Abortionist E. Wyman Garrett told The New York Times that, ”A woman comes to me for a late abortion and I do it the best way I know how.”

Dr. E. Wyman Garrett is an obstetrician in Newark who is (according to the Times) among a growing number of physicians who have developed expertise in performing D and E’s through the 24th week of pregnancy.

He said he prefers this method because it is safer for the woman and because it

avoids the agonizing decision of what to do when an child is born alive

a situation he confronted only last year.

The artcile stated that in that instance, Dr. Garrett performed a saline abortion on a young woman at University Hospital in Newark. The infant that emerged weighed about 1 pound 10 ounces and was alive. It was born Jan. 13 and died April 29 after developing meningitis.

The London Sunday Times reported that , A UK government agency is launching an inquiry into doctors’ reports that up to 50 babies a year are born alive after botched National Health Service abortions.
The investigation, by the Confidential Enquiry into Maternal and Child Health (CEMACH), comes amid growing unease among clinicians over a legal ambiguity that could see them being charged with infanticide.

The paper reported that the number of UK terminations carried out in the 18th week of pregnancy or later has risen from 5,166 in 1994 to 7,432 last year. Prenatal diagnosis for conditions such as Down’s syndrome is increasing and foetuses with the condition are routinely aborted, even though many might be capable of leading fulfilling lives. In the past decade, doctors’ skill in saving the lives of premature babies has improved radically: at least 70%-80% of babies in their 23rd or 24th week of gestation now survive long-term.

In August clinicians in Manchester published an analysis of 31 such babies born in northwest England between 1996 and 2001.

“If a baby is born alive following a failed abortion and then dies (because of lack of care), you could potentially be charged with murder,” said Shantala Vadeyar, a consultant obstetrician at South Manchester University Hospitals NHS Trust, who led the study.

The London Sunday Times reported that Paul Clarke, a neonatal intensive care specialist in Norwich, treated a boy born at 24 weeks after three failed abortion attempts. The mother decided to keep the child, who is now two years old but is suffering what doctors call “significant ongoing medical problems”.

Clarke said.

“The survival of this child was not recorded in any official statistics. There is nothing at the moment to force abortion practitioners to account for their failures.”

Is what abortionist, Raymond Showery told the 12-member district court jury, which included a pregnant woman, before his sentencing in the death of a fetus.

He then burst into tears.

Showery was convicted of drowning a “very alive” 5- to 7-month-old female fetus after an abortion and was sentenced to 15 years in prison for murder.

One witness, former hospital aide Maria Fernandez, testified in the nine-day trial that she watched the abortion on July 28, 1979.

Ms. Fernandez, who was 17 years old at the time, was the only witness to note the fetus’ sex. She testified the fetus was “very alive,” “fat and white,” and weighed about 5 pounds.

Other witnesses estimated the weight at 3 to 6 pounds.Four other former hospital employees testified Showery pulled the fetus, which they said was about 12 inches long, from an unidentified woman during a hysterotomy abortion, similar to a Caesarean section.

Prosecutors said one of Showery’s sons disposed of the 3- to 6-pound fetus _ estimated by nurses at 5 to 7 months old _ after Showery drowned it in a bucket of water and dropped it into a plastic bag.

Dr. Raymond Showery, 55, contended the abortion never took place, despite testimony from hospital workers who said they were there.

3-pound, 9-ounce baby girl survives abortion

According to the LA Times, Philadelphia-area obstetrician Joseph L. Melnick was convicted of infanticide for failing to care for a 3-pound, 9-ounce baby girl born alive after he attempted an abortion. The newborn died within an hour of birth. The doctor said he believed his patient, a 13-year-old, was only 18 weeks pregnant. An autopsy showed the gestational age as 32 weeks. Melnick appealed his conviction.

Waddill, a Westminster obstetrician-gynecologist charged with murdering a 2 1/2-pound infant believed to have been born alive after an abortion attempt. During that sensational trial, the Westminster Community Hospital chief of pediatrics testified that he had seen the physician strangle the apparent abortion survivor — an accusation that Waddill denied. He was freed after the second failure to get a verdict.

Angele was 22 weeks pregnant when she scheduled to have the abortion at a Florida abortion clinic. Angele delivered the child alive in a restroom and says her pleading for help from medical staff went unheeded, even when an employee saw that the tiny boy was moving.
According to her attorneys at The Liberty Counsel, the abortion clinic is known for late-term abortions and its well-known founder, abortionist James Pendergraft. Liberty Counsel stated in a press release that a few years ago Pendergraft served time in a federal prison regarding an alleged scheme to extort the city of Ocala, Florida by means of his other abortion clinic in that city.

On April 1, 2005, Angele went to the EPOC abortion clinic and was given Valium. She also received laminaria, which was inserted in her cervix to begin dilation. The purpose of inserting laminaria is to dilate the cervix overnight in preparation for the abortion. She was told to return the following day.

On April 2, Angele was given pills by the abortion clinic to induce violent labor. Angele told Worldnetdaily that she chose the “labor and delivery process” for her abortion “as opposed to partial birth or having to dismember the child to retrieve him from the uterus/birth canal.”

” The injection burned a lot as it went in. … The discomfort was distracting. I still felt the ‘lams’ as they were being inserted. Dr.(Harry) Perper told me to relax my muscles and noted that my cervix was slightly soft. I asked him what that meant and he said it was good, ” said Angele.

Angele says despite having asked Digoxin, she did not receive the digoxin injection, which she surmises caused the baby to be born alive. Digoxin is a drug injected into an unborn baby to cause his or her heart to stop in preparation for what amounts to a stillborn birth. She says she overheard staff talking about “dig-ing” her – injecting the digoxin – but, after taking a sonogram initially and then quickly taking the machine to another room, the staff, she says, failed to return it to her room. A sonogram machine is used to guide the needle into the unborn baby’s heart.

“I wanted it to be as humane and painless as possible for my son,” she said, choking back tears. “They told me they would guide a needle directly into his heart and it would put him to sleep, and he wouldn’t feel anything.”

Abortionist Harry Perper, is the doctor who inserted the laminaria, a man Angele described as “a very fast-moving, hyperactive type of person.”

Angele says that after she took the pills intended to start labor, “I waited outside, cramping and crying, for the clinic to open. My contractions were close. I had been having them for hours. I knocked repeatedly at the door. There was a burgundy truck in the parking lot. Ten to 15 minutes later, Debbie opened the door and let me in.

“I was directed to ‘the room.’ I had been there for a moment the day before and thought it to be a waiting room for family or driving companions. It had a leather sofa and a fabric sofa, both with a white blanket stretched across the seat cushions, a small television and a few magazines.”

However, noted Angele, “It was not a waiting area – it was the ‘delivery room.’ It was, of course, very cold.”

Cramping and crying, Angele was given a blanket that was still wet. She began to bleed and go into labor. Despite her cries, no one assisted her. After one hard push, the baby was born, fully intact and definitely alive. Angele was shocked and astonished to see that her baby boy was moving … he was ALIVE! Angele said, “His right leg moved. He curled up a bit, like he was cold; I screamed but no one came.” She pleaded for the clinic workers to call 911 but they did not.

Angele described to Worldnetdaily what happened next to her and her baby boy, whom she named Rowan:

“His right leg moved. He curled up a bit like he was cold; I screamed for Violene! No one came. I managed to get to the doorway, pants down, blood everywhere and yelled again. I went back to my baby. I heard her say she’d be right there.

I showed her Rowan, told her he was alive and moving and to call 911! She took a quick look, said he’s not moving now and she’d be back to take care of things while walking out. I called her again. I was touching Rowan softly and he moved again. I called her back. Rowan jumped, I think startled by the loud sound of my calling for help. I showed her that he was moving and alive. I begged her to hurry and call 911, now!

She said for me to lie down and she would get her supervisor. No one came.

I continued to try to caress and comfort my son by rubbing his back, tummy and chest. I stroked his precious little head and kept telling him I loved him and we would be OK. I was afraid to move him because I did not want to do anything that might end up hurting him. I pushed my pinky into his little hand and his fingers curled around me. Still no one was coming. I was terrified but trying not to let him know I was scared. I kept telling him what a beautiful son he was and that we were going to be safe soon.”

Looking into the toilet, Angele immediately regretted her decision to have the abortion. At 22 weeks and five days gestation, the baby, Angele later named, “Rowan” was a perfectly beautiful little boy. Angele stated that abortion clinic employee, Violene dismissed her pleas and walked away, leaving Angele alone with her baby in the bathroom.

In a last ditch effort to save her child’s life, Angele made a frantic call to her friend, who was waiting at a nearby hotel. At 10:22 a.m. and 10:29 a.m., the Orlando Fire Department (OFD) received calls requesting an ambulance to the EPOC Clinic. Here is a portion of the transcript from that 911 call:

Angele’s Friend (AF): It’s a women’s clinic. . . . My friend is having an abortion and the baby was born alive. . . . They’re not allowing her to use the phone there. They’re wanting the baby to die!

OFD: She wants the baby to live?

AF: That’s correct. . . . [She] said the baby was just born and it was alive and they were wanting her to leave it in the toilet and, uh, just let it die, and she’s not wanting that to happen.

According to the OFD’s incident report, Engine 4 (E-4), bearing a paramedic and two EMTs, arrived on the scene at 10:37 a.m. Two police officers also arrived, responding to an OFD call for back-up that said clinic workers wanted “to kill the baby.”

Although the EMTs and paramedics remained on the scene at the EPOC abortion clinic for 22 minutes, they never went into the bathroom to speak with the desperate mother and assess the little infant who was struggling to survive down the hall.

Baby Rowan lived for 11 minutes before perishing in the toilet of the abortion clinic.

“After a few minutes I realized for certain that he was gone. I picked up my son. I held him to my chest. I rocked him and prayed. I could not stop crying,” said Angele. “I felt so bad. I felt so helpless. I had been so wrong to come here … I wanted to fix and change everything once I saw Rowan’s precious little face and body. All we needed was someone to get us to safety,” Angele said.

“He was perfect, slightly pale and a little translucent. His eyebrows were pale but wide and well-defined. You could see little hairs on his face and head. He had the tiniest little fingernails and toenails. I noticed they already had a little bit of growth. His mouth was lovely. He was this perfectly formed one pound, one ounce human being. He was beautiful. He had been so strong.

“I wrapped him in [a] blue pad instead of one of the wet blankets. I just kept kissing him and telling him I loved him so much. I told him I was sorry I couldn’t get anyone to help us and I was so sorry for ever coming here.”

BABY Left to die on roof of abortion clinic:

Oct. 14, 2008, little Shanice Osbourne was finally be laid to rest 27 months after she was allegedly killed on the day she was aborted alive, July 20, 2006, by abortion clinic owner Belkis Gonzalez at A Gyn Diagnostics Center in Hialeah, Fla.

In addition, notice of intent to initiate a civil lawsuit for medical negligence, wrongful death and personal injury has been filed against Gonzalez, abortionist Pierre Jean-Jacques Renelique and their conglomerate of four Dade County abortion clinics by Pennekamp Law in conjunction with the Thomas More Society.

Finally, some semblance of peace and justice?

On a hot summer day a little over two years ago, Sycloria Williams was in the throes of an induced-labor abortion of 22-week-old Shanice when the baby delivered alive.

A clinic worker, along with Williams, witnessed Gonzalez cut the cord and place the moving, breathing baby in a biohazard bag partially filled with chlorine bleach and zip it shut.

It was that worker who developed a conscience and allegedly called police to report the crime, after which Gonzalez tossed the baby in the bag on top of the mill roof so police couldn’t find her.

For nine days, the baby baked in the Florida sun until Gonzalez, thinking the coast was clear, retrieved her only to have the worker call police again, who this time found the baby. DNA evidence linked Shanice to Sycloria.

And then the case hit a wall because the murder victim had been aborted.

While the Miami-Dade County medical examiner determined Shanice was born alive, he concluded her death was “natural” due to “extreme prematurity,” since no one could know exactly why she died burning, drowning, suffocation, or on her own?

The examiner was clearly biased. If one strangles a dying 2-year-old, one still has committed murder. If one shoots a person midair who has just leapt to her death, one has still committed murder. But if one burns, drowns and suffocates a dying premature aborted baby, the death was natural?

Shanice’s short life and death demonstrate the need for the Born Alive Infants Protection Act. While it was legal to kill Shanice pre-birth, it was “wrongful death” to do so after, even if she wasn’t viable.

Shanice was buried at Queen of Heaven Cemetery in Fort Lauderdale.

The Born-Alive Infant Protection Act

The Born-Alive Infant Protection Act was signed into law in 2002. This Act requires doctors and medical staff to treat infants who survive an abortion with dignity and respect. This means that the staff of Orlando Women’s Center must work to keep a baby who survives an abortion alive. They must call 911 and cooperate with emergency medical personnel in providing care for your baby.

HHS Secretary Mike Leavitt said in a statement: “Congress had received testimony that some infants who had been born alive after unsuccessful abortions were left to die. … The Act reaffirms the legal principle that all infants born alive are entitled to the full protection of the law. That is a principle I will vigorously uphold as secretary. … We took the first of these educational steps today by notifying relevant entities that we aggressively enforce federal laws that protect born-alive infants. We issued clear guidance that withholding medical care from an infant born alive may constitute a violation of the federal Emergency Medical Treatment and Labor Act and the Medicare Conditions of Participation.”

The 2002 act established that in all federal laws and regulations, the words “person,” “human being,” “child” and “individual” include “every infant member of the species homo sapiens who is born alive at any stage of development.” The law also defines “born alive” as meaning “the complete expulsion or extraction from his or her mother of that member, at any stage of development, who after such expulsion or extraction breathes or has a beating heart, pulsation of the umbilical cord, or definite movement of voluntary muscles, regardless of whether the umbilical cord has been cut, and regardless of whether the expulsion or extraction occurs as a result of natural or induced labor, cesarean section or induced abortion.”
