State files complaint against Abortion doc once accused of threatening wife with pistol after failing to report several criminal convictions

A Michigan abortion doctor may be facing possible sanctions after failing to notify the state about several arrests and criminal convictions in violation of state law. Thomas James Gordon performs abortions at Heritage Clinic for Women, a Grand Rapids National Abortion Federation clinic which has failed to publicly distance themselves from Gordon despite Live Action News documenting his criminal history in January. Now, the state’s medical licensing board has filed a formal complaint against Gordon for failing to notify them of the convictions.

According to a search of Michigan Corporations conducted by Live Action News, Gordon is the Registered Agent for the Heritage Clinic for Women abortion clinic. His offenses included domestic violence as well as “Weapons – Firearms – Possession Under the Influence” among other offenses. In addition, Gordon has history of domestic violence directed at his wife which should cause concern for female patients under his care.

WZZM13, a local Grand Rapids news outlet, has reported that Gordon’s failure to report the arrests and convictions could affect his ability to practice:

“Documents we obtained show state experts are concerned the doctor’s past criminal cases could affect his ability to practice in a “safe and competent manner”.

Pro-life researcher, Lynn Mills spoke with Live Action News about the case and said that local activists who regularly pray and counsel outside Gordon’s abortion facility began noticing his absences in January and became suspicious. She provided a copy of the complaint filed by the Michigan Department of Licensing and Regulatory Affairs against Gordon in early March for failing to notify the state within 30 days of a criminal conviction. Michigan state law requires that, “A licensee or registrant shall notify the department of any criminal conviction within 30 days after the date of the conviction. Failure of a licensee or registrant to notify the department under this subsection shall result in administrative action under sections 16221 and 16226.”

According to the complaint , Gordon failed to report the following criminal convictions to the state as required under the law:

April of 1992– Convicted of “Aggravated Assault” (suspended sentence – 90 days in jail a fine and 18 months probation.)

April of 2012– Convicted of “Weapons-Firearms-Possession Under The Influence” and “Domestic Violence” (4 days in jail and 18 months probation.)

May of 2015– Convicted of “Disorderly Person Jostling” (suspended sentence of 90 days in jail contingent of successful one year probation and fines.)

December of 2015 – Convicted of “Operating While Intoxicated” (probation of six months and ordered to pay costs and fines.)

Even more disturbing, WZZM13 dug into the Gordon’s violent history further and discovered that he had allegedly threatened his wife with a pistol. They reported that “In 2010, Gordon’s wife Shelly filed a Personal Protection Order against him. She wrote quote:”Thomas has beat (me) several times in the past 3 years, he has even put his 45 mm pistol to my head when I was sleeping.”

A copy of the order provided to Live Action News from local activists shows that while on a trip to Jamaica, Gordon’s wife alleges that a “layover and wrong transport made him snap.” She describes his anger against her and the hotel front desk clerk. After being escorted to her room, she described how Gordon came back to the room where she was already sleep when, according to the abortion doctor’s wife, he “started hitting me in face, body said he doesn’t like me – hit me and damage my nose…”

Gordon’s wife Shelly writes that she defended herself and told Gordon he had a problem and she accused him of “probably beat his first wife” adding that she had filed for divorce.

A copy of a Kent County Sheriff Department Affidavit of Probable Cause dated November 6, 2011 provided to Live Action News paints a picture of how unstable and violent this Michigan abortionist is, reading :

    Suspect Thomas Gordon, did commit a felonious assault upon his wife, Shelly Gordon. The Gordons were involved in a verbal argument, in the finished basement of their residence. Thomas had a Kimber Combat Carry, semi auto pistol, chambered in .45 ACP, resting on the counter of a kitchenette area. The victim, Shelly Gordon, stated that she was going to go upstairs. Thomas stated “I’ll shoot you and anyone that fucks with me.” He then ran over to the counter top, picked up the pistol, racked the slide and pointed it at Shelly. Shelly then grabbed hold of the pistol and Thomas’ hand. She stated “you are not going to shoot me,” as she tried to pry the pistol from his grasp. They continued the physical struggle and Thomas fell against the wall and then on to the floor. Shelly was able to grab the gun and run upstairs. She secreted the gun under a pillow, on the upstairs couch. Shelly then ran outside and hid, where she called 911. Thomas did submit to a breathalyzer, upon arrival at the jail. This yielded the BAC results of .21. It should be noted that the magazine for the pistol, although loaded with six rounds, was not in the grip of the pistol. Shelly stated that she believed the firearm was loaded.

The affidavit also states that the abortionist told police officers called to the scene of the incident that he is a doctor who makes $1,000,000 per year and “drinks alcohol every day.”

Despite his violent history, the Heritage Clinic for Women website describes Gordon as possessing, “a strong sense of dedication, professionalism and integrity.” Live Action News called Heritage Clinic for Women and has verified that Gordon is still performing abortions at the center. A June 2, 2016 search of “abortion providers” listed at the NAF website reveals that the National Abortion Federation continues to refer to Heritage despite Gordon’s criminal record.

In an effort to persuade authorities to take immediate action against Gordon’s ability to practice medicine, local pro-lifers have set up an online petition asking The Michigan Department of Licensing and Regulatory Affairs (LARA) to act quickly to summarily suspend Gordon’s license. They are also asking concerned pro-lifers to please call Shelly Edgerton who is the Director of Licensing and Regulatory Affairs for the state as well as Michigan Attorney General, Bill Schuette to voice their concern about the abortionist as well. The petition along with additional contact information can be found here. According to WZZM13, Gordon has until June 6 to respond to the complaint filed against him by the state.

According to pro-lifer Michele Herzog who sidewalk counsels at abortion clinics in Florida, Felski doesn’t let his OB patients know about his abortion bound patients.

Wednesday as two pro-lifers stood in front of Felski’s office exposing that Fleski kills babies, the abortionist drove up, parked his car in the lane of a major highway, and proceeded to take one of the signs from pro-life protesters.

According to Herzog, “Shortly after they arrived, they noticed Felski driving toward them on Hwy 436 which is a very busy road. He didn’t pull into the driveway though, he just stopped his car on this highway, got out taking pictures of my friends, Amber and Allura, and then proceeded to pick up one of the signs that said “Repent Emil Felski,” folded in half and put it in the car with him, then driving into the medical complex.”

Herzog said that she received a call from Allura, and after talking it over and seeking counsel, they decided to call 911, here is what Allura had to say: “We called 911 to report that he had taken my property, and had also caused an obstruction to traffic by leaving his car unattended on the Hwy, (He only had to drive a few feet further to pull into the driveway of the medical plaza, and he wouldn’t have caused any danger to us or the drivers on Hwy 436).

“Two unmarked police cars arrived and the officers immediately told us that my sign was illegally leaning against a Department of Transportation sign. We said we hadn’t realized that and wouldn’t do it again The older officer then folded his arms over his chest as he said we couldn’t “harass or prevent people from coming in or going out” of this medical facility. He added that while taking pictures of people isn’t illegal, “maybe these particular people didn’t want their pictures taken and it could be considered a form of harassment.” The only person we took a picture of was Felski, but I assured the officer that we run all these questions and situations by our attorneys to make sure we aren’t breaking any laws.”

“The officers left to talk to Felski, then came back with my sign, with the folds permanently creased in it. The younger officer instructed us to not lean our signs against DOT poles, and it was obvious that they thought they were done now and everything was fine! When Amber mentioned the danger Felski had put us and others in by leaving his car in the street, we were assured that “he has been counseled about that” so it wouldn’t be a problem anymore. I said we wanted to press charges, and laid out the reasons why. The older officer, with a smirk, said, “okay!” And they turned around and walked to the car.

“The younger one brought the report back for me to fill out, and he seemed nicer and more considerate, but the older one was condescending and sarcastic, very authoritative. He treated us both as if we were ignorant children who could be pushed around and intimidated. In fact, he seemed to be very biased against us and our rights. We wonder if there could be some kind of ties between him and the abortionist. But God gave both Amber and me a holy boldness to stand up to these bullies….including Felski….and to not back down out of fear! When God calls us to be a voice for the voiceless, He gives us the grace and strength to go forth in His mighty name!”

This abortionist is hot- according to pro-lifer Patte Smith on May 17, 2008, “Emil Felski has been a notorious abortionist in Central Florida for many, many years. He was seen attending Northland week after week. When I asked him what he was getting out of the sermons Felski flipped me the finger.”

But worse, this gun-toting abortionist Emil Felski has pulled a gun in a threatening fashion on pro-lifers.

According to Herzog, “It happened a couple of years ago when he was performing abortions at Planned Parenthood and flashed his gun around to intimidate pro-lifers. That was not a one time incident and he was carrying this as he was going in to definitely intimidate the pro-lifers.”

Herzog said, that police were not called at the time, although they did snap a picture of Felski as proof.

In addition Herzog says, “We’ve also done awareness campaigns in front of Felski’s gated community three times and two times he got out of his car and into our faces with the camera. His insulted our black friend with racial slurs.”

Herzog says pro-lifers who were there told her that abortionist Emil Felski came out to take a picture and told Herzog’s pro-life friend, “Turn around and let me take a picture of that black ass.”

According to a June 2012 Post and Courier story: Prosecutors are expected to pursue a reduced charge against an abortion doctor accused of waving a handgun at protesters outside a West Ashley clinic in 2010.

Gary Boyle, a 64-year-old doctor from Tennessee, is scheduled to appear Friday in a Charleston County courtroom where plea hearings are generally held on felony cases that are being reduced to misdemeanors.

Boyle has been awaiting trial on a felony charge of pointing a firearm at a person.
But a notice from the 9th Circuit Solicitor’s Office indicates that Boyle will now be appearing Friday on a charge of public disorderly conduct.

Doctor charged with pointing handgun at abortion protesters

A doctor was charged with a felony in South Carolina on Saturday.

Charleston Police said Dr. Gary Boyle, 62 of Blountville, pointed a gun at three abortion protesters near the back entrance of the Charleston’s Women’s Medical Center.
According to the police report, Boyle works at the center. He also practices medicine at the Bristol Regional Women’s Center in Tennessee.

Both offices are the focus of a 40-day protest by anti-abortion activists.

A national organization called ’40 Days for Life’ started their vigil outside Boyle’s Bristol office on September 22nd. Organizer Linda Edwards said she plans to continue through the end of October.

“[The Charleston group] were doing what they were supposed to be doing in a peaceful vigil,” Edwards said. “That is, praying peacefully without interaction with doctors and nurses who are part of an abortion clinic.”

The police report lists three victims: 50-year-old John Karafa, 60-year-old Kenneth Ray Collins, and a male juvenile.

“[The victims] stated they were standing at the back entrance of the building, waiting to hand out their religious literature,” police said.
“The victims advise that the offender pointed a firearm at them from inside his vehicle,” police said.

Boyle could not be reached for comment Monday. His office declined comment.

Boyle told police he drew the gun because he felt threatened.

“The offender admitted that he presented the firearm because he was in fear of his and his wife’s life,” police said.

Collins disagreed with Boyle’s version of their encounter. He said Boyle approached the group of protestors.

“I offered literature to the approaching car,” Collins said. “Then I saw that I was looking down the barrel of a handgun,” he said.

Collins said the protest group was standing on the public right of way. Boyle could have called the office security guard if he felt threatened, he said.
“The guard sometimes stands and talks with us,” Collins said.

Boyle was charged with ‘pointing a firearm at any person,’ a felony in South Carolina. It carries a maximum prison term of five years.

Boyle is scheduled to appear in Charleston County Criminal Court on December 17th, 2010. He is free on a $25,000 bond.

CHARLESTON, SC — A Blountville, Tennessee doctor has been charged with pointing a gun at protesters outside an abortion clinic in Charleston, South Carolina.

Local police say 62-year old Gary Boyle was released on a $25,000 bail Saturday, after they say he pointed a handgun at three abortion protesters in the clinic’s parking lot.

It was not clear whether or not Boyle was actually performing abortions at the Charleston clinic, but the investigation is ongoing.

For the past 11 days, anti-abortion demonstrators have gathered at the Charleston Women’s Medical Center in West Ashley as part of the annual “40 Days for Life” movement against abortion, each of them signing a “statement of peace” before participating.

Police say the protest met a threat Saturday morning when an out-of-state abortion doctor flashed a gun at them.

Police arrested Gary Boyle, 62, a Blountville, Tenn., physician, on charges of pointing a firearm.

Boyle drove into the parking lot of the clinic on Ashley River Road near Fuseler Road at around 8:30 a.m. When three protesters, including a 17-year-old boy, approached him, Boyle brandished a black handgun loaded with 15 rounds, according to a police report.

Boyle then stepped out of his SUV and walked into the clinic without further incident, the report says. One of the three protesters, 50-year-old John Karafa, called 911.

“We were like, ‘Well, that was a gun,’ ” Karafa said. “You can’t do that.”

Boyle appeared by video conference at a bond hearing Saturday afternoon dressed in a light yellow button-down shirt. Charleston County Magistrate Priscilla Baldwin set his bail at $25,000, which he posted later Saturday.

Whether Boyle performed abortions locally is not known. He and another physician operate the Bristol Regional Women’s Center near his Tennessee home.

A woman who came to the courtroom on Boyle’s behalf declined to speak during the proceedings and ignored requests for comment after the hearing.

More than a half-dozen anti- abortion demonstrators also attended

The incident wasn’t the doctor’s first legal snag.

He and his partner operated their clinic without a required certificate of need from the Tennessee Health Department for several years in the 1990s, and the health department tried to shut them down, according to court filings.

The dispute dragged on for years until 2002, when an appeals judge ruled that the state statute requiring the certificate had violated a woman’s right to privacy.

Florida abortionist Walker L. Whaley died on May 31, 2012, at the age of 64. Walker had a 34-year history of aborting babies, as a circuit riding abortionist he was traveling around Florida working for such notorious abortionists as James Scott Pendergraft and Gary Dresden, who both own well-known chains of abortion clinics in a state with more than its share of abortion businesses. At one point, his medical license was suspended indefinitely, and with good cause:

Whaley graduated from the Medical College of Georgia in 1974, but, like most abortionists, he did not seem to be particularly good at his new profession. Whaley was sued for malpractice over a complicated delivery in 1981 that ended in a brain-damaged baby. (Duval County Circuit Court Case #84-10676.) He turned his practice to primarily providing abortions.

Court records show that in 1983, Whaley found trouble with the law when he was arrested for manufacturing cocaine in his basement with the aid of his brother, Jonathan. Money problems followed. In 1984, his first wife, Terri, divorced him and his medical license was suspended indefinitely.

Whaley was released from Federal Prison on April 5, 1988, but any efforts to reform him had failed.

In 1993, his home went into foreclosure and he defaulted on a car loan. He owed nearly $47,000 in unpaid Federal taxes. Creditors lined up to sue him, a trend that continued until his death.

He faced multiple income tax leins. He was sued for malpractice.

In 2009, he was evicted from a Jacksonville business office where he and another doctor operated a “weight loss clinic.” He and his partner were sued for over $26,000 in back rent.

A 2009, Florida Medical Board filed an Administrative Complaint against Whaley recommended suspension or revocation of his medical license after he was caught self-administrating controlled substances for which he had no valid prescription. Police had discovered his use of illicit drugs when they served a search warrant on his home seeking evidence in a fraudulent prescription investigation. According to Forerunner, The Florida Board of Medical Examiners recommended suspension and probation due to Whaley’s 1984 conviction on conspiracy to manufacture cocaine. It ordered his medical license to be suspended for three years or until completion of the federal sentence, whichever was longer, with reinstatement of his license granted only under stipulations. Whaley, his brother, and the brother’s female roommate reportedly were discovered by DEA agents in a drug laboratory in Whaley’s basement.

The following year on February 26, 2010, Whaley was arrested and jailed on five counts of firearms violations. The charges indicated that he was in illegal possession of firearms as a convicted felon and was subject to a Domestic Violence Injunction at the time of his arrest. Remarkably, while convicted, he served only one day in jail.

Charleston County Associate Chief Magistrate James B. Gosnell Jr. has sided with the prosecution, ruling that enough evidence exists for the case to advance to trial, though a date was not set. The state law he is accused of violating contends that it is “unlawful for a person to present or point at another person a loaded or unloaded firearm.” The charge against Boyle is a felony that carries up to five years in prison.

A preliminary hearing for an abortion doctor accused of pointing a firearm at protesters outside a West Ashley clinic in October is scheduled for Thursday.

Charleston police arrested Gary Boyle, 62, of Tennessee, on charges of pointing a firearm after protesters said he brandished a handgun loaded with 15 cartridges, according to a police report. The incident allegedly occurred Oct. 2 during a scheduled vigil by an anti-abortion group.

A preliminary hearing is when a magistrate hears evidence on whether there is enough probable cause for a case to move forward. The hearing is set for 10 a.m. Thursday in front of Charleston County Associate Chief Magistrate James B. Gosnell Jr. at the Preliminary Hearing Court on Leeds Avenue.

Boyle told officers that he showed the gun because he was afraid for his and his wife’s life when three protesters approached his vehicle outside the Charleston Women’s Medical Center, the report said.

He is charged with presenting a firearm, a felony that can carry a penalty of up to five years in jail. The law reads that it’s “unlawful for a person to present or point at another person a loaded or unloaded firearm.”

Boyle, 62, has a Tennessee permit to carry the pistol, according to the police report, a state that has a reciprocal agreement with South Carolina. After his arrest, Boyle was released on $25,000 bond.

Twice a year, members of 40 Days for Life stand vigil at abortion clinics across the country to protest abortion.

“The guard sometimes stands and talks with us,” Collins said.

Boyle was charged with ‘pointing a firearm at any person,’ a felony in South Carolina. It carries a maximum prison term of five years.

Boyle is scheduled to appear in Charleston County Criminal Court on December 17th, 2010. He is free on a $25,000 bond.

CHARLESTON, SC — A Blountville, Tennessee doctor has been charged with pointing a gun at protesters outside an abortion clinic in Charleston, South Carolina.

Local police say 62-year old Gary Boyle was released on a $25,000 bail Saturday, after they say he pointed a handgun at three abortion protesters in the clinic’s parking lot.

It was not clear whether or not Boyle was actually performing abortions at the Charleston clinic, but the investigation is ongoing.

For the past 11 days, anti-abortion demonstrators have gathered at the Charleston Women’s Medical Center in West Ashley as part of the annual “40 Days for Life” movement against abortion, each of them signing a “statement of peace” before participating.

Police say the protest met a threat Saturday morning when an out-of-state abortion doctor flashed a gun at them.

Police arrested Gary Boyle, 62, a Blountville, Tenn., physician, on charges of pointing a firearm.

Boyle drove into the parking lot of the clinic on Ashley River Road near Fuseler Road at around 8:30 a.m. When three protesters, including a 17-year-old boy, approached him, Boyle brandished a black handgun loaded with 15 rounds, according to a police report.

Boyle then stepped out of his SUV and walked into the clinic without further incident, the report says. One of the three protesters, 50-year-old John Karafa, called 911.

“We were like, ‘Well, that was a gun,’ ” Karafa said. “You can’t do that.”

Boyle appeared by video conference at a bond hearing Saturday afternoon dressed in a light yellow button-down shirt. Charleston County Magistrate Priscilla Baldwin set his bail at $25,000, which he posted later Saturday.

Whether Boyle performed abortions locally is not known. He and another physician operate the Bristol Regional Women’s Center near his Tennessee home.

A woman who came to the courtroom on Boyle’s behalf declined to speak during the proceedings and ignored requests for comment after the hearing.

More than a half-dozen anti- abortion demonstrators also attended

The incident wasn’t the doctor’s first legal snag.

He and his partner operated their clinic without a required certificate of need from the Tennessee Health Department for several years in the 1990s, and the health department tried to shut them down, according to court filings.

The dispute dragged on for years until 2002, when an appeals judge ruled that the state statute requiring the certificate had violated a woman’s right to privacy.
