Florida abortion clinic may close after owner’s arrest and criminal charges

The State of Florida is threatening to close an abortion clinic owned by a notorious late term abortion provider who was recently arrested on drug charges in another state. James Scott Pendergraft, who operates 5 abortion clinics in the state, was arrested in October of 2015 for possession of drugs after being stopped for speeding in South Carolina. As Live Action News previously reported, at the time of his arrest, Pendergraft, was also found to have in his possession surgical implements that were covered in blood and human tissue from abortions he had illegally performed throughout South Carolina. Despite having his medical license revoked at the time, Pendergraft was only charged with being in the possession of illegal narcotics.

Spartanburg County filed the criminal charges against Pendergraft and made his first court appearance in December of last year.

In January 2016, The Agency for Health Car Administration (AHCA), which licenses abortion clinics in the sunshine state, filed an action to revoke Pendergraft’s license to operate the Orlando Women’s Center abortion clinic located at Lucerne Terrace. AHCA’s complaint states that, “with his arrest and criminal charges, Mr. Pendergraft is disqualified and is no longer in compliance with Florida law.”

“It all has to do with drug charges out of South Carolina but unfortunately nothing to do with any of the other things he has done in the state,” Michele Herzog, spokesperson of Pro-life Action Ministries who side walk counsels in front of Pendergraft’s Orlando abortion facilities.

James Pendergraft

Pendergraft has had his medical license suspended several times by the state’s medical board before it was eventually revoked indefinitely. In 2011, Pendergraft lost a lawsuit after the baby survived a late term abortion attempt. The woman was awarded $36 million in damages to take care of the child who is now severely disabled.

Herzog pointed out that Pendergraft aggressively advertises his late term abortion clinics nationwide, offering women abortion discounts to get them to his door as well appointments on Sunday. But, despite his persistence, Herzog is optimistic that his abortion clinics will eventually be shut down. She said that are a number of faithful Christians are praying in front of Pendergraft’s abortion clinics and reaching out to the women he profits off of.

All 5 Pendergraft abortion facilities are covered in prayer Herzog said noting that she organizes the outreach outside EPOC abortion clinic in Orlando where other faithful pro-lifers join her. Pro-lifer and evangelist John Barros and several others ministers outside Orlando Women’s Center (OWS), where pro-lifers have witnessed women taken from the clinic by ambulances. But, they often speak to women who change their mind and choose to keep their baby.

“Through Barros’ faithful ministry many babies are alive today,” Herzog said.

Barros responded to news that OWS might be closed by the state, telling WFTV, “God uses different things in different ways and it usually is in different ways than we could ever have imagined.

In Ft. Lauderdale, John and Tewannah Amen as well as members of Broward County Right to Life pray and sidewalk counsel outside the Ft. Lauderdale Women’s Center. Pendergraft’s Tampa and Ocala abortion facilities are also covered with prayer and pro-life sidewalk counselors on a regular basis.

This abortion empire needs to come to an end,” Herzog said.

Pro-lifers in Florida have watched God close a number of clinics in the state including two already this year. WomanCare in Orlando and Planned Parenthood of Winter Haven closed their doors after years of prayer and hard work from the activists. Herzog said that WomanCare abortion clinic was evicted the end of January just months after she and a group of prayer warriors walked inside the clinic on Good Friday 2015 and prayed for God to close the clinic permanently. Although staff was in the building, no one knew the pro-lifers were in the waiting room until they left.

The Winter Haven Planned Parenthood, which just closed their doors, was also covered in prayer on a regular basis. Herzog said that pro-lifer Scott Newman along with members of Sidewalk Advocates for Life, who originally reported the closing, faithfully prayed and sidewalk counseled in front of that abortion facility as well.

AG files complaint against abortion doc charging negligence and failing to protect patient’s personal information

Michael Roth

An abortion doctor who stored dozens of jars containing “products of conception” (a term used for aborted babies) is the subject of a Michigan Attorney General Office complaint charging him negligence and failing to protect patient’s personal information. Dr. Michael Authur Roth a long time circuit-riding abortion provider in the state made headlines earlier this fall after police found 14 containers identified at the time as “human tissue” and as well as controlled substances in his car after it was involved in a traffic incident.

The administrative complaint, filed with state Board of Medicine’s department of licensing and regulatory affairs for possible disciplinary action and obtained by Live Action News from pro-life advocate Lynn Mills, details the abortion doctor’s sordid past. In the factual allegations, the document states that Roth was disciplined by the state medical board in 2004 following a complaint that he performed an abortion out of a patient’s home. Another issue came before the Board in 2012 over a complication from a procedure resulting in a fine.

Roth abortion home complaint

The Attorney General has accused Roth with being in possession of controlled substances without lawful authority. According to the AG’s complaint, when police searched Roth’s car they discovered 6 prescription bottles containing an antibiotic prescribed by another medical doctor with the initials AO for several patients as well as large amounts of the pain medicine Fentanyl and a partially used bottle of a drug used for anesthesia. In addition they found medication used for uterine bleeding.

In response to the complaint, Mills called the items found in Roth’s car, “a cocktail for abortion.” She told Live Action News that there are many unanswered questions surrounding this case, “Pro-lifers effectively got this abortionist evicted several times last year. So let’s say that he couldn’t find a place to rent that would allow him to do abortions? We know from his history that he has experience doing them in home settings. Could this have been an option he felt was viable?”

Mills said she suspects Roth was doing clandestine abortions, wondering where he was performing them, “Roth was driving around with what he needed the antibiotics, the anesthesia, the bleed control meds and pain meds. Where’s the bloody pads, the cannulas?” While authorities have not specified why Roth was in possession of the medications, Mills speculated a few possible scenarios such as his performing secret abortions on rich women or even on human trafficking victims in secret locations.

mICHAEL RoTH abortion fetus

In addition to the medications, the complaint states that police also found “Fifteen specimen jars containing the “products of conception” in the abortionist’s car. Less than a week later, upon searching Roth’s home, police found additional medications of Fentanyl and and 6 full glass vials of Methylergonovine Maleate (medication used for uterine bleeding). Police also discovered that the Fentanyl, which had expired a year earlier, belonged to another physician. In fact, several of the medications found in Roth’s possession were expired and bore the name of to another prescribing physician where Roth “provides coverage” according to the complaint.

The documents states that the license to dispense medications are “location specific” and that medications cannot be stored in places other than where the license allows. Further, state law requires that medications are to be stored in a locked cabinet or room and not in a person’s home or vehicle. The complaint accuses Roth of failing to protect patient’s personal information as well as disposing of “pathological waste” i.e. aborted babies pursuant to state statutes.

The AG accuses Roth of the following:

    Negligence
    Incompetence
    Lack of Good Moral Character
Possessing a controlled substance without lawful authority
    Betrayal of a Professional Confidence

Asministrative COmplaint Roth Abortion Fetus Car

The complaint requires that Roth has 30 days to submit a written response to the charges against him. And, if he cannot show that he is in compliance of all lawful requirements of retention of his license the AG has requested that formal proceedings be “commenced pursuant to the Public Health Code.”

REPUBLISHED FROM LIFE DYNAMICS BLOG!

As a result of criminal charges against an abortion doctor, an abortion clinic in Indiana has clinic has reportedly closed it’s doors.

According to reports, Friendship Family Planning abortion clinic in Gary closed May 27.

Friendship-GaryIN

The clinic had previously been cited for deficiencies.

Ken Severson, spokesman for the Indiana Department of Health stated that the abortion clinic’s closure came as the abortion doctor, Ulrich Klopfer, was facing charges of failing to timely file a report related to an abortion he performed on a 13-year-old girl in 2012.

IND Law Klopfer Child Pred

As an abortion doctor, Klopfer was required to report such abortions, because of statutory rape laws in Indiana.

Klopfer Complaint News Pic

In 2014, after the criminal complaint became public, Klopfer was summonsed to appear before the Indiana Medical Licensing Board to explain his actions.

But, they allowed him to keep his medical license pending the state’s investigation.

Criminal Charges Klopfer Jan 2014

The unreported abortion was brought to the attention of authorities by Lake County Right to Life in December of 2013.

Unreported abortions on minor girls have also been reported in a complaint filed by representatives of Indiana Right to Life and Allen County Right to Life.

The documents, filed by members of Allen County Right, stated that Klopfer performed an abortion on another 13-year-old in Allen County at the now closed Ft. Wayne Woman’s Health Organization on February 7, 2013 and failed to report that abortion as required by state law as well.

The age of that patient surfaced as Allen County Right to Life Executive Director, Cathie Humbarger, reviewed publicly available terminated pregnancy reports. The pregnancy report, filed with the State Department of Health, appears to confirm the allegation. (Read Allen County RTL Report here)

The criminal charges in Lake County cite Klopfer for failing to timely file a public report about the abortion he performed on a 13 year old child at the Friendship Family Planning abortion Clinic in Gary, In. in September of 2012.

The affidavit states that the report wasn’t sent to the Indiana Department of Health until January of 2013.

Klopfer Probable Cause Criminal

The news led to Klopfer’s back up physician terminating his status with the abortionist. Indiana requires every abortion doctor in the state to have admitting privileges to a local hospital or an agreement with a doctor who does.

Dr--Ulrich--George--Klopfer

Indiana Right to Life recently issued a news release stating that abortionist Klopfer has “surrendered” his license for the Gary clinic:

Klopfer has surrendered his Gary, Ind. abortion license.

Klopfer’s surrender follows the release of an alarming report by the Indiana State Department of Health (ISDH) showing deplorable conditions and safety hazards at his Gary facility.

The surrender also comes just prior to Klopfer’s scheduled hearing on June 25 before the Indiana Medical Licensing Board, where the Board could choose to remove his medical license.

Klofper, who lives in Illinois, still has his Fort Wayne and South Bend abortion sites licensed with the state, despite only doing abortions in South Bend.

Life Dynamics Inc., a national pro-life organization located in Denton, Texas, points out that although they do not know the circumstances of these young girl’s pregnancies, mandatory reporting statutes which require healthcare workers to report reasonable suspicions of child sexual abuse to the authorities are being ignored inside American abortion, Planned Parenthood and family planning centers.

For several years now, Life Dynamics has documented the failure of abortion clinics to report statutory rape.

According to Mark Crutcher, founder of Life Dynamics, “When we began to investigate we found it was even worse than we thought it was. Initially we thought perhaps the abortion clinics were only reporting half of the incidents, but instead we found that they were reporting hardly any of them.”

Crutcher recently published a report of actual cases where clinics did not report suspected child abuse, often leading to repeated rape and assaults on the victims.

You can read that report here.

According to Indiana Right to Life, the license surrender also comes just prior to Klopfer’s scheduled hearing on June 25 before the Indiana Medical Licensing Board, where the Board could choose to remove his medical license.

Undercover abortion stings reveal repeated deception by arrested doc

In early December, an Oklahoma abortion doctor was arrested after an undercover sting revealed that he was offering to perform abortions on women who were not pregnant.

Patel-Arrested-Dec-2014--300x231

News reports indicate that undercover agents set up appointments with 62-year-old Nareshkumar Patel where they say he administered ultrasounds and pregnancy tests and then told them they were pregnant, when they weren’t.

Affidavit Patel

A copy of the probable cause affidavit against Patel has revealed what the sting uncovered.

According to the document, in June, a medical licensure investigator called Patel’s Oklahoma City abortion clinic, Outpatient Services for Women to schedule an abortion and was told it would cost $620.00. She then went to the clinic and gave them the cash for the abortion. Prior to her visit to the abortion clinic, she confirmed she was not pregnant. The investigator says that abortionist Patel gave her an ultrasound and told her she was “very, very pregnant,” giving her five RU486 abortion pills with instructions on how to take them. After her visit with Patel, she immediately left his clinic and went to another physician to confirm she was not pregnant. The entire interaction was caught on video and audio recordings.

Outpatient Services for women Patel

On October 13th, a female Oklahoma City Police Detective confirmed by a licensed physician that she was not pregnant. Then, three days later, the detective along with agents from the state’s Attorney General’s Office, went to Patel’s clinic for an abortion she had previously scheduled, wearing a recording device. She also paid Patel $620.00 for RU486 abortion pills and was given a receipt for her purchase. She was then taken to an exam room where Patel told her she was pregnant. The police detective, who used her own name for the appointment, was allegedly given an ultrasound and a urine test which Patel said came up positive for a pregnancy. Patel then gave her RU486 abortion pills with instructions. Immediately following her visit to the abortion clinic, the detective went to a medical facility which confirmed she was not pregnant.

On October 21st, a female Oklahoma Attorney General Agent scheduled an appointment for an abortion at Patel’s clinic which she recorded. That same day, the agent confirmed with a medical professional that she was not pregnant. The abortion appointment was scheduled for the following day. On October 22nd, the AG representative and other agents went to Patel’s Outpatient Services for Women abortion clinic and under the alias Elizabeth Fitzpatrick paid the receptionist $620.00 for the abortion procedure. The agent was not given a pregnancy test but was taken to an exam room where abortionist Patel asked her for the date of her last menstrual period. According to the agent, Patel performed an ultrasound and told her she was “early in her pregnancy.” He then gave the female agent five RU486 abortion pills with instructions on how to use them. As with the other investigators, the AG agent immediately went to a medical center for a second pregnancy test which turned up negative.

As a result of the undercover stings, in early December, Oklahoma Attorney General Scott Pruitt charged Dr. Naresh G. Patel with three counts of obtaining money under false pretense after improperly prescribing abortion-inducing drugs to patients he said were pregnant, but were not.

Patel was later placed under arrest and is currently not practicing medicine , pending an investigation by the state’s medical board.

A court date is pending but has not been set in the abortion doctor’s fraud case.

Why I want to see this abortion doc prosecuted

I don’t typically personalize the stories I blog about, but, I am going to on this one.

I am what many would call a pro-life activist and journalist. I took to the streets as a young girl to try and reach women seeking abortions over thirty years ago. In addition to my research and writing, I wanted to document the abortion holocaust. This was before social media and blogging was even thought of.

Carole 1235_3178229738438061400_n

One of the abortion clinics I stood in front of for years was a place run by Ft. Lauderdale abortion clinic owner, Joyce Tarnow, called the Women’s Clinic. Tarnow was an anti-immigration enthusiast who died recently. She once said she’d get as many people sterilized that were in her way. I have blogged about Tarnow in the past. She was known for her racist attitudes toward minorities whom she regularly targeted for abortions. Her statements shocked many readers of my blog. You can read those here.

Tarnows clinic 05912794165977827_n

Tarnow had a few abortionists that killed babies at her abortion clinic over the years I stood on the sidewalk in front of her clinic. One of those abortionists was a doctor by the name of Michael Benjamin. Benjamin was a dedicated abortion provider for Tarnow. In the years and years I protested her abortion clinic, Benjamin was a regular presence.

Tarnow’s clinic eventually closed, but, unfortunately, Michael Benjamin kept on killing children. Even today, the abortionist utilizes his killing tools at his office in Tamarac, Florida at his BSSI clinic where he brags that he is the most experienced abortion provider in Florida.

Michael Benjamin BSSI

I recently discovered that not only is Benjamin killing babies, he was involved in the cover-up of a child pedophile which led to a little’s girl’s continued rape. The shocking fact is that, the suffering this child endured due to Benjamin’s flagrant violation of the law was not vindicated by any criminal investigation, arrest, or conviction of this sleazy child killer.

To explain what happened, I have to thank the Texas pro-life group, Life Dynamics which has published the details on their blog.

The gist of the story is this, in Florida it is a law that physicians report any suspicion of sexual assault, rape, or abuse of a child to the authorities. In fact, failure to do this is a third degree felony punishable by prison time and a large fine. But, in the world of the elites, a physician often escapes prosecution. Why? Good question. Often, if and only if they happen to be discovered breaking a law, they “might” go before the state medical board which is made up of other medical professionals who are often sympathetic to the pitfalls that a doctor could get caught up in. Imagine- if you and I broke a law and we were only investigated by our friends or colleagues? Is this justice. No way!

To complicate matters even more, abortionists are prosecuted even less due to the controversy surrounding the abortion issue. In Broward County, where this illegal act took place, it would be even more complicated given their bias toward the abortion industry politically.

Now that I have set that stage, here are some more details. A 12-year-old child was raped by her mother’s boyfriend in a county a few hours North of Broward County where Benjamin performed abortions. After she ended up pregnant from his rapes, the abuser collaborated with the victim’s mother to cover his crimes.

They went to an abortion clinic in Alachua County first but were turned away only because the pregnancy was further along than that clinic would perform a procedure. That abortion clinic did not report the child to police for an investigation leaving her to remain in the control of her abuser. They did suggest that the couple call the National Abortion Federation for a referral. That is where Benjamin’s name is brought up. At this point, I know you all are wondering if NAF called the authorities to report the child for possible abuse. And the answer to that would be NO! What the NAF counselor did do is to refer the couple to Broward County where they could obtain a late term abortion and they then offered the couple help with paying for the abortion or should I add- paying for the pedophile to cover his crime.

Let’s recap – the scum bag rapist impregnates a little girl and either he or his female accomplice discusses an abortion for the victim with medical staff at one abortion clinic as well as a national organization which refers for abortions. None of those mandatory reporters stepped in to help the victim- their only concern was the abortion.

Michael Benjam operation room abortion

What happened next? The couple raced to Broward County to get the abortion before the 24 week limit was reached. Life Dynamics’ has a detailed timeline on all of this which I posted below- but- to summarize, Benjamin spent only minutes with the little girl – before putting her and her unborn child under the knife. This is not surprising given Benjamin’s previous history of failing to explain abortion procedures to his patients for which he was cited by the medical board year prior. The late term abortionist was one more in a long list of medical professionals to have only one thing on their mind- the abortion! After Michael Benjamin aborted this child – according to the police report of the rapist, Benjamin released the child to the man who impregnated her through rape in the first place.

Now, I don’t know about you- but this angers me. What kind of a monster does such a thing? Apparently an abortionist does. In fact, it wasn’t until the child saw her pediatrician back in Alachua county that the entire thing was exposed. Had it not been for that doctor complying with the state’s mandatory reporting laws, this child possibly could still be living the nightmare of rape.

What is shocking still is that once the police in Alachua County were involved- they contacted not only law enforcement officials in Broward County but the state’s medical board for an investigation of Benjamin. According to state records, Benjamin was cited by the board for his illegal actions, however, to date, no criminal charges have been filed against the abortion doctor.

This is an outrage. I am publishing this blog in hopes that this will change. I would like nothing more than to see Michael Benjamin not only loose his license to practice medicine- but to be criminally investigated and hopefully prosecuted for his flagrant violation of the law. Life Dynamics has called for a criminal investigation of this abortion doctor and so do I.

Please read through the timeline from Life Dynamics below and then contact the Broward County authorities to call for Benjamin’s arrest. Thank you!

Child Predators 2

An abortionist in Florida who returned a child to her sexual abuser after performing an abortion on her is still in business despite his flagrant disregard of mandatory reporting laws in the state.

Life Dynamics Inc., a national pro-life organization located in Denton, Texas discovered this while doing research to document how the abortion industry covers for child sexual predators. That research has been published in a report entitled, The Cover-Up of Child Sexual Abuse which can be read here www.childpredators.com.

The report reveals that the failure of abortion clinics to comply with mandatory reporting laws is having profound, real-world consequences for the victims of child sexual abuse.

Case in point is that of a 12-year-old victim who was taken to a National Abortion Federation clinic operated by Florida abortionist Michael Benjamin by the pedophile her impregnated her, Jermaine Jones, attempting to cover-up his crime.

NAF Michael Benjamin

CONNECTING THE DOTS:

Life Dynamics discovered that the Florida Board of Medicine had an open case against Benjamin who runs an abortion clinic out of his Tamarac office, ( a suburb of Ft. Lauderdale) for not reporting an abortion he performed on a 12-year-old child.

At the same time, Life Dynamics was reviewing a file for a pedophile who had sexually raped a 12-year-old girl and had taken her for an abortion in the same area. Life Dynamics then requested the arrest and offense report for the rapist from the Alachua County Sheriff’s Department and realized that these two cases were the same. The details were shocking, graphic, and tragic.

Although mandatory reporters, the rape of this child was essentially covered-up by two abortion clinics and their staff, the National Abortion Federation, as well as the abortionist.

In response, Life Dynamics has decided to emphasize the importance of prosecuting those who fail to report the sexual abuse of children by publishing a timeline of the events in this case.

To protect her identity, Life Dynamics will refer to the young victim as “Emily.”

Jermaine Jones

In May/June of 2009 Florida authorities say that 34 year-old Jermaine Jones began sexually assaulting the 12-year-old daughter of his girlfriend, Janet Marshall, and, by November, the child was pregnant.

What happened over the next days should horrify the public and law enforcement alike.

ABORTION CLINIC NUMBER ONE

November 2, 2009
“Emily” is pregnant and is taken to an abortion clinic identified in a police report as being on 23rd Avenue in Gainesville, Florida. This is presumed to be the All Women’s Health Center located at 1135 NW 23rd Avenue. This facility is a member of the National Abortion Federation. (NAF)

A member of the clinic staff informs Marshall that her daughter’s pregnancy is too advanced for them to do the abortion. Marshall is then instructed to call the NAF hotline for a referral to another one of its facilities where later abortions are done.

THE NATIONAL ABORTION FEDERATION

NAF paid for Jermaine Jones abortion 12 yr old

A counselor on the hotline refers Marshall to a NAF facility in Tamarac, Florida, operated by abortionist Michael Benjamin. During that call, the counselor also informs Marshall that NAF has a fund she can access that will pay for all but $200 of the cost. Jones and Marshall schedule the abortion and leave with “Emily” for the six-hour drive to Tamarac.

ABORTION CLINIC NUMBER TWO

Jermaine Jones arrest report takes victim to Michael Benjamin for abortion

November 4, 2009
Using ultrasound, Benjamin establishes the pregnancy at 24 weeks and begins a multi-day abortion procedure by installing cervical dilators. It is later determined by state health department investigators that Benjamin’s pre-abortion counseling with “Emily” lasted between six and eight minutes.

“Emily” is brought back to the clinic for additional dilation. At this time, digoxin was injected into the heart of her unborn child in order to cause death.

November 6, 2009
Benjamin completes the abortion by removing the dead baby intact. Afterward, he releases “Emily” to Jones who then leaves with her.

Jermaine Jones abortion fetus pick up at Michael Benjamin clinic

RAPE REPORTED BY PEDIATRICIAN NOT ABORTION CLINICS OR NAF

Mid-November, 2009
During a check-up of “Emily” by a pediatrician in Alachua County, Florida, the doctor determines that she has been sexually active and reports it to the Florida Department of Children and Families. Their investigation confirmed that an illegal sexual relationship had existed and the Alachua County Sheriff’s Department (ACSD) was notified.

January 11, 2010
As part of its investigation, the Sheriff’s Department requests documents from the Medical Quality Assurance division of the Florida Department of Health (FDH) necessary to file a complaint against Benjamin for failing to comply with his duties as a mandated reporter.

February 10, 2010
Jones is arrested by Alachua County Sheriff’s Department detectives.

March 8, 2010
Jones is indicted on two felony charges related to the sexual assaults on “Emily.”

May 27, 2010
Jones pleads guilty and receives a 15-year prison sentence.

MEDICAL BOARD FILES COMPLAINT AGAINST BENJAMIN

January 21, 2011
The Florida Department of Health files an Administrative Complaint against Benjamin related to his failure to comply with the state’s mandatory reporting statute. During the ensuing investigation, an employee of this abortion clinic tells officials that she was not sure why no report was made, saying “Maybe we’ve been hardened with so many kids coming in.”

Michael Benjamin Employee to police maybe weve become hardened

April 14, 2014
In addition to assessing a $10,000 fine against Benjamin, the Florida Department of Health (FDH) ordered Michael Benjamin to pay the costs associated with their investigation and said that he must attend classes regarding his duties to report suspected child sexual abuse.

BENJAMIN TO BE MONITORED BY CO-WORKER FROM ABORTION CLINIC INVOLVED IN SIMILAR INCIDENT

The FDH also put Benjamin’s medical license on probation for two years and assigned Dr. Frank Rodriquez to monitor him during that period. This was done, despite the fact that Rodriquez and Benjamin were known to be co-workers at another NAF abortion clinic where, in 2006, an incident similar to the one involving “Emily” had occurred.

Approximately three months later, the victim’s mother learned of the situation and contacted authorities. Given this gap in time, it is obvious that the clinic did not file a report with the state. It was also found that Foster had not only engaged in a sexual relationship with this girl, but with another minor student at the same time. In 2008, he was convicted on two counts of unlawful sexual contact with a minor and sentenced to five years in prison.

View the cases CP

Let’s Recap:

• Abortionist Michael Benjamin does a 24-week abortion on a 12-year-old child after a six-to-eight minute counseling session with her.

• Following the procedure, Benjamin releases the girl to the adult male who was assaulting her and had driven her six hours to the abortion clinic.

• Although neither of the two abortion clinics where this child was taken complied with the state’s mandatory reporting law, no criminal charges were brought against anyone at either facility. This was also true about the counselor on the NAF hotline even though there can be no doubt that he or she was made aware of the patient’s age.

• Benjamin was given a slap on the wrist by the health department to be overseen by one of his colleagues. Today, Benjamin continues to operate his Tamarac abortion clinic and he is still a member of the National Abortion Federation.

• If the pediatrician who saw “Emily” after the abortion had also ignored the mandatory reporting law, this sexual predator would not have been apprehended. In that case, it is virtually certain that (a) his assaults on this child would have resumed and (b) there would have been additional victims in the future.

Life Dynamics president, Mark Crutcher said that the details of this case, as shocking as they appear are not unique, “Don’t think this case is a one of a kind case. It is actually very typical of what we see on a regular basis from the abortion industry.”

Crutcher encourages the public to review Life Dynamics’ Child Predators website and to pressure law enforcement officials to prosecute those who violate mandatory reporting laws, “It is self-evident that when a minor girl seeks an abortion, she represents a textbook example of why mandatory reporting laws were created in the first place. Despite this, we have consistently found that the law enforcement community is functionally indifferent to the problem of abortion clinics not complying with mandatory reporting statutes even in the face of irrefutable evidence that violations are occurring. Among all the cases we researched we never found one example in which criminal charges were brought against an abortion clinic employee for failing to comply with their state’s mandatory reporting statutes and Michael Benjamin was no exception..”

Today, Life Dynamics, Inc., a national pro-life organization located in Denton, Texas has responded to the indictment of an Ohio abortion doctor with a history of sexually explicit crimes involving children.

According to reports, 69 year-old abortion doctor, Thomas William Michaelis has voluntarily surrendered his medical license after being indicted on Federal charges of receiving and distributing child pornography. Michaelis had recently worked as an abortionist at Capital Care Network abortion clinic in Toledo.

Authorities say they focused on Michaelis’ illegal activities between January and May, 2014.

Michaelis Porn Charges

According to the indictment, Michaelis received and distributed child porn images between April and May of this year. He possessed and accessed one or more websites containing depictions of minors engaged in sexually explicit conduct between January and May.

Public documents show Michaelis is a doctor with a history of abusing minors. Documents state he admitted to sexually explicit crimes involving his teenage daughter’s friends.

According to the pro-life group, Operation Rescue, in 1991, the Ohio Medical Board cited Michaelis after he had been convicted of Attempted Gross Sexual Imposition, Voyeurism, Public Indecency, all involving minor girls. Michaelis had engaged in sexual “touching” and other advances on girls in their early teens who had come to his home to play with his daughter.

In that case, Michaelis gave testimony that he watched a minor girl partially undress, attempted to touch another minor girl on her bottom, and attempted to touch a third minor child on her breasts. The abortion doctor also admitted that he exposed himself to a forth minor child. In 1991, Michaelis was sentenced to 15 months in prison, but ended up serving only 60 days.

Medical Board Docs Michaelis

The Board finally revoked Michaelis’ license but reinstated it a few years later after Michaelis complied with a number of requirements imposed by the Board, including an order for him to submit to counseling.

The abortion doctor was last known to have been working at a Toledo abortion clinic when his license was revoked in May, during the time of the investigation.

Mark Crutcher, president of Life Dynamics, Inc. said this indictment was,” typical of the character of the people we deal with in the abortion industry on a daily basis.”

Crutcher and his team have recently published several criminal case summaries showing that the abortion industry covers for men who sexually abuse children.

The report, entitled, “The Cover-Up of Child Sexual Abuse”, shows clearly that the failure of abortion clinics to comply with mandatory reporting laws is having profound, real-world consequences for the victims of child sexual abuse. Read the report here.

After reviewing Michaelis’ history Crutcher said he was not surprised that he was working at an abortion clinic, Should we be surprised that an industry which protects men who sexually assault children would include men who sexually assault children?” Crutcher asked.

Crutcher has detailed the rape of and sexual assault of abortion patients in a book he authored years ago entitled, Lime 5, and said he and his team are in the process of updating that research.

He said that when he finishes this latest report, the public will be shocked to discover that abortion doctors like Thomas William Michaelis are not isolated.

As a result of that case, in 1984, Ali Azima was convicted for the misdemeanor of culpable negligence andordered to spend 10 days in jail:

According to Legal.com, On December 1, 1977, Azima performed an abortion on Holli Schmidt.

The next day he inserted an IUD into Schmidt.

On June 11, 1979, Schmidt visited Azima’s clinic because she was nine days late on her menstrual period and was exhibiting all of the overt signs of pregnancy. Azima found that Schmidt was not pregnant, and he did not administer any treatment.

On February 23, 1981, Schmidt again visited Azima’s clinic because she was two weeks late on her menstrual period and was exhibiting the same pregnancy symptoms as she had on her June 1979 visit. Azima performed a two-minute urine pregnancy test, which according to the testimony of several experts, is from 85% to 99% accurate. The urine test result was negative. Azima then conducted a pelvic exam, which also showed that Schmidt was not pregnant. Because of the negative pregnancy test, the negative pelvic exam, and his knowledge of Schmidt’s past history of irregular menstrual periods, Azima told Schmidt she was not pregnant. Schmidt then requested that Azima insert an IUD in her. Azima explained to Schmidt the dangers and ramifications inherent in the insertion of the IUD, then inserted one within her.

Schmidt returned to Azima’s clinic again on March 5, 1981 and told him that she was still experiencing various symptoms of pregnancy. Azima performed another two-minute urine pregnancy test and pelvic exam. Both were negative. Azima scheduled another appointment for Schmidt a few weeks later. Schmidt failed to keep the appointment and, instead, went to another doctor on April 27, 1981. That physician, on the basis of a pelvic exam, determined that she was pregnant. A few days later, Schmidt underwent an abortion. She did not suffer any physical damage to her body as a result of the insertion of the IUD inside of her while she was pregnant.

Later, the state charged Azima with the misdemeanor of culpable negligence under section 784.05(1), Florida Statutes…The jury found Azima guilty as charged. The circuit court affirmed the conviction.

Florida Abortionist Harms Two Abortion Patients on Same Day, One Hospitalized
June 9, 2014 By Operation Rescue

Azima’s history of substandard abortion practices makes another case for greater oversight

By Cheryl Sullenger

Port Charlotte, FL — An ambulance as called to the Venice Women’s Health Center in Port Charlotte, Florida, last week to transport an abortion patient to the hospital for emergency care.

Azima-Ambulance-06032012

The patient, who was described as a Caucasian woman in her early 30′s, was removed from the abortion clinic completely covered with a blanket on June 3, 2014. Pro-life activists who witnessed the incident told Operation Rescue that one of the emergency medical technicians who responded to the abortion business’ call for emergency assistance indicated that the patient was going to be “okay.”

“Certainly there are degrees of ‘okay’ and this doesn’t negate the fact that the patient suffered from a serious complication that could not be handled at the clinic,” said Operation Rescue President Troy Newman.

Pro-life sidewalk counselors also noted that another abortion patient was seen earlier in the day leaving the clinic in poor condition and unable to walk on her own. No clinic staff assisted as that woman was held up by a male companion who helped her into a car. She appeared to be in significant pain, and left the scene fully reclined in her seat.

The abortion business is owned and operated by abortionist Ali Azima, who has operated in the Ft. Myers/Port Charlotte area for over 30 years.

The Venice Women’s Health Center was involved in an incident in 2012, where Azima allegedly began a late-term abortion there even though the facility wasn’t licensed for those procedures. The patient was referred to Azima’s other clinic, the Southwestern Florida Women’s Clinic (SFWC) in Ft. Myers, where the abortion was completed. A citation was issued to the SFWC over the incident.

SFWC was also cited in 2012 for multiple health and safety violations. A deficiency report indicated that the autoclave was not being properly cleaned, which made it impossible to properly sterilize surgical instruments. Inspectors also found that first trimester surgical abortion practices fell below the standard of care for such procedures. A secondary inspection found that the facility was still not in compliance with autoclave sterilization protocols.

In 1985, Azima had his medical license suspended for one year and was placed on probation for three years after a Florida Medical Board inquiry found that Azima failed to take a medical history or properly examine an abortion patient, prior to an abortion, then failed to have a pathologists examine the remains to ensure that everything had been removed. Without examining her, Azima continued to insist during subsequent visits with the patient that she was not pregnant. The woman eventually suffered a ruptured ectopic pregnancy that caused her to undergo emergency surgery and hospitalization.

“Once again, we have a woman who walked into a troubled abortion business only to be carried out on a gurney,” said Newman. “Azima and his troubles are all-too-typical of abortion providers in America today and is a case in point for tighter oversight and regulation of the abortion cartel. Instead, abortionists like Azima resist laws to protect women because they know their shoddy abortion operations are incapable of meeting acceptable medical standards and practices.”

Operation Rescue has used official abortion statistics in several states to document the fact that when abortion clinics like Azima’s close, the number of abortions is reduced.

“We urge Florida to enact regulations such as those passed last year in Texas,” said Newman. “If we can pass rules that will save lives now and spare women from suffering live-threatening injuries, it is our moral duty to do so.”

Operation Rescue continues to investigate the June 3 incident.
