Michigan Attorney General seeks closure of 2 abortion clinics

Michigan Attorney General Bill Schuette asked an Eaton County court Monday to shutter abortion clinics in Lansing and Saginaw that he said have been operating in violation of state law.

The two clinics, owned by Womens Choice Clinic of Lansing, have been under scrutiny for more than a year since someone associated with an anti-abortion organization recovered fetal remains from a trash bin behind the Lansing clinic. In the complaint filed Monday, Schuette said the clinics were in violation of state law because they were not incorporated by a medical professional.

He asked the court to order the operations to shut down and to prohibit Richard Remund, the president of Womens Choice, from organizing another company to operate an abortion clinic.

“To ensure accountability and patient safety, Michigan law requires medical facilities to be incorporated with a licensed medical professional at the helm,” Schuette said in a statement. “Strict enforcement of the law ensures medical clinics cannot put profit ahead of responsible patient care.”

Schuette also said he asked state licensing officials to investigate what he said was evidence the clinics were improperly licensed because more than 50% of their business activity was abortion and they were not licensed as freestanding surgical outpatient facilities. The clinics also appeared to have improperly disposed of medical records, Schuette said.

A woman answering the phone at the Lansing clinic, which also is listed as the corporate headquarters of Womens Choice, declined to comment. An attorney listed in corporate records as a representative for Womens Choice also declined to comment.

On October 22, 2010 The Michigan Attorney General, and the Eaton and Saginaw County Sheriff Departments completed a 7 month-long investigation of the Womans Choice abortion clinics located at 6500 Centurion Drive, Ste. 290, Lansing and 3141 S. Cabaret Trail, Ste 400, Saginaw, Michigan—owned by Florida resident Richard Remund.

The Family Planning Council in Philadelphia has made public the theft of personal information of some 70,000 patients, which was stored on a flash drive.

The suspect is a 40-year-old man by the name of Kelly Stanton, a former employee who has been arrested and arraigned. However, the flash drive itself is still missing.
Stanton, who has a history of fraud convictions, was charged with the theft in February.

The theft happened between December 23rd and 27th, 2010 at the council’s offices, which were closed for the Christmas holiday. The discovery of the theft was made on the 28th when police were notified. Police say Stanton was fired on the same day of the discovery.

The data on the stolen flash drive included personal information only from patients who received reproductive health services at these and other providers between October 2, 2008 and November 30, 2010.

Specifically, patient name, address, phone number, social security number, date of birth, and other information including insurance information and medical information were on the flash drive. So far, the Council said, there is no indication of inappropriate use of the information stored on the stolen flash drive.

The Council went on to say that both the Philadelphia Police Department and the Philadelphia District Attorney’s Office requested that notification of patients and the public be delayed while the investigation was ongoing.

A spokesperson explained in a statement that, under government health care programs, the Council gathers and processes patient data from several area health care providers for reporting and billing purposes.

Providers who are affected by this loss of data include: Spectrum Health Services Inc. (Haddington Health Center and the Broad Street Health Center); Public Health Management Corporation (which operates or operated PHMC Care Clinic, PHMC Health Connection, Rising Sun Health Center, Mary Howard Health Center, Community Court, Project Salud and several emergency housing locations in Philadelphia); Planned Parenthood Southeastern Pennsylvania; Planned Parenthood Association of Bucks County; and The Children’s Hospital of Philadelphia.

The Council said it reported the circumstances of the incident to those providers on January 13, 2011, and each of the providers is notifying its patients affected by this incident.
The Council is offering individuals affected by this breach credit-monitoring services and other credit-protection services free-of-charge.

Melissa Weiler Gerber, Executive Director of The Family Planning Council, declined an interview request and refused to answer questions about the hiring of Stanton, whose rap sheet includes multiple convictions for theft, fraud and other crimes.

Weiler Gerber issued a written statement saying, “While no abuse of the stolen data has come to light, we regret deeply even the appearance of a breach. I offer my personal and professional apology to all patients whose confidentiality may have been violated. We are moving swiftly and purposefully to ensure that nothing of this type ever occurs again with respect to Council facilities or information, and to ensure that our procedures comply with all privacy and security laws and satisfy industry best practices.”

A McAllen abortion clinic is under fire. A private company claims they found hundreds of patients’ documents and waste thrown in a dumpster.

The identities of patients at a health clinic in McAllen may be at risk. An anti-abortion group says they found the trash and documents in a dumpster near Whole Women’s Health of McAllen. It’s now in the hands of the attorney general and Texas Commission on Environmental Quality.

Austin, TX – A McAllen, Texas abortion clinic that was the subject of a three month investigation by Operation Rescue and the Survivors is denying any wrong doing and is clearly in damage-control mode after a local television interview. However, a reporter from KRVG Channel 5 in the Rio Grande Valley was unable to verify the clinic’s claims that the Health Department has cleared them.

Last week Operation Rescue released information documenting widespread abortion abuses at a dozen Texas abortion clinics. Among the worst offenders was Whole Women’s Health, which operates five abortion clinics in Texas. The McAllen office discoveries were particularly disturbing. Dumped in the trash were the bloody refuse of several abortions along with the names of patients and other private information. Tuesday evening, KRVG ran the story that showed the reporter digging through the trash and questioning a clinic official.

“Certainly, this abortion clinic will have modified their behavior because they have been caught red-handed,” said Operation Rescue President Troy Newman. “We have not been notified by the Health Department of the outcome of our first complaint. We are still processing some of the information from our investigation, and have filed additional complaints with the health department. More will be coming. We are also preparing complaints that we plan to lodge with the medical board next week. This is far from over.”

Patient logs (click here to view) and other records were discovered on Whole Women’s Health forms and the bloody remains of abortions came in bags with other documents bearing Whole Women’s Health’s name. Operation Rescue has made examples of this evidence public.

In another development, Youtube.com pulled the short video that showed evidence of abortion abuses along with recordings of phone conference calls that violated the 24 hour waiting period and informed consent laws. The video was put on Vimeo.com, which also yanked the video Monday afternoon. Operation Rescue has protested the blocking of the video as censorship. The video is now available on Pro-LifeTube.com and is embedded in the original online report at OperationRescue.org.
