Michigan abortion clinic investigation result of pro-life dirt-digger complaint

A Michigan Attorney General lawsuit recently filed to shut down a Detroit abortion clinic for illegally operating can be credited to the hard work of a persistent pro-life activist. Abortion clinics in the state of Michigan are under the watchful eye of Lynn Mills who is using unusual tactics to close them down. Mills has been researching the abortion industry in her state for many years. She spends hours combing through documents connected to either an abortion clinic or the doctor or owner of the facility. Her dirt-digging skills have been credited with the revocation of the licenses of abortion doctors as well as the closure of abortion clinics.

Recently Mills discovered that Summit Women’s Center of Detroit which performs abortions up to 24 weeks, did not have a licensed physician listed on their corporate filings in violation of state law. As a result, the state has moved to not only dissolve the clinic as a corporation but to enjoin the officers from operating a medical facility in the state ever again.

At one time, the abortion clinic chain founded by the Lipton family in 1973, had six locations in 5 states:Connecticut, Michigan, Georgia, Nevada, and Wisconsin. A few years ago the abortion clinic in Wisconsin closed. Eventually the two Connecticut facilities closed along with the Las Vegas center, leaving the Detroit, Michigan and Georgia centers remaining.

In 2013, Mills said she was looking at the Summit website where it stated that their physicians were all OBGYN board certified. Mills was familiar with most of the abortionists and she knew that the statement was false. After the discovery, a complaint was filed with the Michigan Licensing and Regulatory Affairs (LARA) for false advertising. Shortly thereafter Mills rechecked the clinic’s website and noted that it had changed, now stating:

    Most of our Physicians are board-certified obstetrician / gynecologists. Some of our medical personnel are licensed with extensive backgrounds in reproductive health services.

“When they are caught in a lie, we have to speak out
,” Mills said, noting that this incident was pointed out in the current complaint.

According to the complaint filed by the Michigan State Attorney’s Office and provided to Saynsumthn, David Lipton, is listed as Summit’s president, secretary, treasurer, while Anise Burrell was listed as the administrator and contact. But, Mills points out that after the state passed stricter abortion laws, requiring abortion clinics be licensed and inspected, Summit’s corporate filings no longer only listed Lipton as an officer but now included long-time abortionist Alex Pickens Jr. MD. Pickens JR was listed on the corporate filings as far back as 2011.

Mills later discovered that in the most recent filings, Pickens was no longer listed on the corporate filings prompting her to file a complaint with the state’s Attorney General in December of 2015. In that document, provided to Live Action News, Mills points out that by 2015 David Lipton was the only officer listed in the corporate filings, and no physician was listed as an officer of the abortion clinic chain.

Mills pointed out in her complaint with the Attorney General that the corporation’s purpose had changed from “practice of medicine doctor” to “management company” despite the Summit’s records stating that “each shareholder is a licensed person in 1 or more of the professional services provided by the professional corporation.” Mills saw immediately that this was false, since David Lipton was NOT licensed, writing, “there is no Licensed medical doctor as part of its 2015 filing which is required by Michigan state law.”

Michigan statutes state: “A professional corporation shall not engage in any business other than providing the professional service or services for which it was specifically incorporated.”

    “We saw that the corporation papers were not in order and Pickens the abortionist had not signed anything for years.”

Bill Shuette, the State’s Attorney General appears to note the work of Mills in his complaint. According to that complaint, Shutte’s office reviewed Summit’s incorporation in 2011 through its annual report of 2014, noting that Summit P.C.’s sole officer and director was Alex Pickens, Jr., MD, a licensed physician; but on May 11, 2015, the AG’s complaint states that David Lipton filed the 2015 annual report with LARA certifying that he was Summit P.C.’s president, secretary, treasurer, director, and sole shareholder, but no physician was listed as required by law.

Additionally, the complaint alleged that Alex Pickens, Jr., MD had filed for bankruptcy in 2013 and failed to list Summit P.C. as an asset or entity. That bankruptcy document was included in Mill’s original complaint to the AG. The petition required Pickens to disclose “all businesses in which [he] was an officer, director, partner, or managing executive . . . within six years” of commencing the bankruptcy. Pickens disclosed three businesses: one professional corporation, one business corporation, and one nonprofit corporation. But failed to disclose Summit.

The AG’s complaint states:

    Pickens’s failure to disclose his ownership of Summit P.C. to the bankruptcy court, and the subsequent filing of ownership by David Lipton, suggests that Alex Pickens, Jr., MD may never have been the true owner of Summit P.C. and that Summit P.C. was organized through fraud and repeatedly and willfully exceeded its authority.

The Attorney General’s complaint alleges that David Lipton, who is listed on Summit P.C.’s 2015 annual report as its sole officer, director, and shareholder, is not a “licensed person” under the law.

    Therefore, Defendant Lipton’s role as sole shareholder of Summit P.C. violates state law. Likewise, the transfer of ownership from Alex Pickens, Jr., MD to Lipton also violates state law.

The complaint states that the “remedy is dissolution” and that “the failure of a professional corporation to ensure that its shareholders are legally qualified to provided professional services “is grounds for the forfeiture of its articles of incorporation and its dissolution,” which may be brought by the Attorney General.

It also states that the state wants to enjoin all employees of Summit from providing medical services unless they comply with state law:

    The AG Seeks to preliminarily enjoin Defendants David Lipton and Anise Burrell from incorporating, organizing, or doing business in the State of Michigan as an owner, officer, or employee of any other corporation or entity for the purpose of offering or providing medical services to the public, practicing medicine, or contracting to have medical services performed for such corporation or entity, unless and until they obtain the requisite licenses and otherwise complies with Michigan law. [MCL 600.3601]

According to Mills, since the AG filed their complaint and just days prior to the publication of this report, Mills said she pulled Summit’s corporate filings again and noticed that Pickens is now listed as the Medical Director. This comes after, the attorney general cited the clinic for failing to comply with the law. And, Mills states, Pickens has also amended his bankruptcy papers to claim he owned shares in the Summit. But, Mills points out these changes only point out the need to investigate the abortion clinic’s corporate filings further and, she says, anyone can do this. Her vigilance may cause the collapse of another abortion clinic and Mills said she will not stop researching these places until each one is closed permanently.

Florida abortion clinic may close after owner’s arrest and criminal charges

The State of Florida is threatening to close an abortion clinic owned by a notorious late term abortion provider who was recently arrested on drug charges in another state. James Scott Pendergraft, who operates 5 abortion clinics in the state, was arrested in October of 2015 for possession of drugs after being stopped for speeding in South Carolina. As Live Action News previously reported, at the time of his arrest, Pendergraft, was also found to have in his possession surgical implements that were covered in blood and human tissue from abortions he had illegally performed throughout South Carolina. Despite having his medical license revoked at the time, Pendergraft was only charged with being in the possession of illegal narcotics.

Spartanburg County filed the criminal charges against Pendergraft and made his first court appearance in December of last year.

In January 2016, The Agency for Health Car Administration (AHCA), which licenses abortion clinics in the sunshine state, filed an action to revoke Pendergraft’s license to operate the Orlando Women’s Center abortion clinic located at Lucerne Terrace. AHCA’s complaint states that, “with his arrest and criminal charges, Mr. Pendergraft is disqualified and is no longer in compliance with Florida law.”

“It all has to do with drug charges out of South Carolina but unfortunately nothing to do with any of the other things he has done in the state,” Michele Herzog, spokesperson of Pro-life Action Ministries who side walk counsels in front of Pendergraft’s Orlando abortion facilities.

Pendergraft has had his medical license suspended several times by the state’s medical board before it was eventually revoked indefinitely. In 2011, Pendergraft lost a lawsuit after the baby survived a late term abortion attempt. The woman was awarded $36 million in damages to take care of the child who is now severely disabled.

Herzog pointed out that Pendergraft aggressively advertises his late term abortion clinics nationwide, offering women abortion discounts to get them to his door as well appointments on Sunday. But, despite his persistence, Herzog is optimistic that his abortion clinics will eventually be shut down. She said that are a number of faithful Christians are praying in front of Pendergraft’s abortion clinics and reaching out to the women he profits off of.

Pro-lifer and evangelist John Barros and several others ministers outside Orlando Women’s Center (OWS), where pro-lifers have witnessed women taken from the clinic by ambulances. But, they often speak to women who change their mind and choose to keep their baby.

“Through Barros’ faithful ministry many babies are alive today,” Herzog said.

Barros responded to news that OWS might be closed by the state, telling WFTV, “God uses different things in different ways and it usually is in different ways than we could ever have imagined.

Pro-lifers in Florida have watched God close a number of clinics in the state including two already this year. WomanCare in Orlando and Planned Parenthood of Winter Haven closed their doors after years of prayer and hard work from the activists. Herzog said that WomanCare abortion clinic was evicted the end of January just months after she and a group of prayer warriors walked inside the clinic on Good Friday 2015 and prayed for God to close the clinic permanently. Although staff was in the building, no one knew the pro-lifers were in the waiting room until they left.

The Winter Haven Planned Parenthood, which just closed their doors, was also covered in prayer on a regular basis. Herzog said that pro-lifer Scott Newman along with members of Sidewalk Advocates for Life, who originally reported the closing, faithfully prayed and sidewalk counseled in front of that abortion facility as well.

A Texas abortion owner wants to use the abortion suction machines at her closed facility for “show and tell” to reduce what she calls “abortion stigma.”

Texas has been the site where several abortion clinics have closed because they could not comply with state law that requires abortion facilities comply with the minimum health and safety standards adopted by the State for ambulatory surgical centers, and that abortionists have admitting privileges in a local hospital near an abortion clinic.

The radical pro-abortion blog, RH Reality Check spoke to Amy Hagstrom Miller who operates several abortion clinics in Texas under the name Whole Woman’s Health.

Now that pro-life legislation is closing many abortion facilities in the state, Hagstrom Miller has come up with a new scheme to remain “relevant” and “shift abortion stigma,” a program she calls SHIFT.

Shift, according to Hagstrom Miller, is a group “working to strategically shift the stigma around abortion in our culture,” and “committed to fostering open and honest conversations, lifting up all communities, and advocating for reproductive freedom.

To accomplish this goal, the abortion owner has created a non profit she will operate from her now closed Austin facility called, ChoiceWorks, which she describes as “working to strategically shift the stigma around abortion in our culture.”

The idea is to use the closed death camp as a “kind of an Abortion University” where Hagstrom Miller will teach an “Abortion 101” workshop.

Maybe the clinic owner will use her Beaumont center in this “Abortion University” workshop of sorts as well.

A 2013, state inspectors found that Whole Woman’s Health Beamont clinic failed to have some of the same life-saving tools on site that convicted abortionist Kermit Gosnell was cited for in Pennsylvania.

Hagstrom Miller told RH Reality Check that she always fantasize about what it would look like if abortion care were treated as, “legitimate in women’s health care, just like miscarriage management or delivery?”

    Some of our programs are inviting people to come into the clinic—this, where we’re talking, is one of those clinics. We have a safe space where we kind of re-enact a day in the life of a clinic for not just the media, but our allies. We’ll walk through, literally from the phone call all the way through the paperwork, ultrasound, and counseling, so people can see how regulations actually affect the service, experientially. But then we could also have this interaction where people can, in a safe place, say, “But what is that you’re seeing in the ultrasound? What happens in the ultrasound? Can I see the instruments?” And they’ll say things like, “Oh my goodness, there aren’t any sharp instruments,” or “Can I see the fetal tissue?” or whatever. A safe place where we can do education about what actually happens.”

Despite the fact that one of Amy Hagstrom Miller’s own abortion facilities has been cited for safety violations, Hagstroim Miller said this:

    “The bad provider thing is rough. How can we talk about that? Whenever I see the word “access,” I don’t want access to abortion, I want access to quality abortion. I host little debates within the field: Is any abortion a good abortion? I don’t think so. I want us to have those ethical debates.”

The Texas abortion chain owner does subscribe to the ideology that women who have abortions need to talk about them:

    “People say, “People just need to tell their abortion stories,” and I’m like, no they fucking don’t. I mean, I love when they do. But we can’t make shifting the movement that person’s burden. That’s not her fucking job. She doesn’t owe that to us. So I get super animated about this, “Oh we just need to have more patients tell their stories,” you know? No we don’t! We have providers that don’t talk about what they do.”

But she added that she wants men to talk about how abortion benefits them,”Because I want a frame where we can talk about how men benefit from abortion.”

She concluded by stating all the things she believed abortion providers were afriad to be asked about:

    “So that we don’t leave what my friend Charlotte Taft calls the “crumbs at the picnic.” We have a picnic and we don’t clean up and anti-choicers grab every little crumb. Abortion, money! Ooh, “late-term” abortion! Fetal pain! Oh, sex-selection! I could make a list of all the things that all of us are terrified of being asked about. That’s totally by design.”

A woman who will be testifying at a press conference outside a Michigan abortion clinic got her courage to come forward after reading this blog.

Pro-lifers will call for a permanent end to a Lathrup Village abortion clinic when they gather in front of the Women’s Center of Southfield on Tuesday. The clinic is owned by abortionist Jacob Kalo and abortions are performed by abortionist Reginald Sharpe.

In 2013, this blogger posted this story: Ambulance removes woman from Michigan abortion clinic, detailing an ambulance being summoned to the Summit Medical Services abortion clinic in Detroit, where Reginald Sharpe worked at the time.

At the time of that Blog post, Sharpe had been sued at least five times.

The patient, who was injured from the abortion Sharpe performed on her, stumbled onto the Saynsumthn’s blog post.

While there she saw a series of comments from a a woman who claimed she took a patient to the clinic and another who claimed she caught VD because of unsanitary equipment:

Although the woman did not leave a comment herself, she responded to the e-mail address of a local pro-lifer who put her in touch with local pro-life investigator Lynn Mills.

Mills told Saynsumthn, that because she stumbled onto this blog- she is now willing to testify before the state about the treatment she received while under Sharpe’s care for an abortion at Women’s Center of Southfield.

According to Mills, the abortionist perforated the woman’s uterus after she went to him for a 23 week and five day abortion. Mills said after the botched procedure, the woman was removed from the abortion clinic out the back door by ambulance. Mills has a recording of the 911 call placed at the time the ambulance was called, which she hopes state investigators will listen to in deciding whether to allow the clinic to continue operating.

Mills sent Saynsumthn a transcript of the February 28, 2014 911 call were abortionists Reginald Sharpe tells the dispatcher they need to come right away because, “she has a hole and she’s bleeding.

Unidentified female caller: She is 29 years old; she’s a female.

Receiver: Good. We’re going to get the paramedics coming that way. I’m just asking the questions and we’ll get them coming to 28505 Southfield, ok?

Receiver: Ok, gotcha. We’ll get them coming.

According to Mills, the woman had to be hospitalized for several days as a result of her abortion.

Mills said the state Attorney General has since ordered the closure of Sharpe’s Woman’s Center of Southfield pending the outcome of an investigation.

The closure order took place November 21, 2014, and this has been confirmed by a suspension notice on the state’s website:

However, despite this, calls made to the clinic have confirmed they are open and scheduling abortions.

Mills told Saynsumthn Blog that the Women’s Center of Southfield has failed no less than five inspections within the past ten months and she sent Saynsumth a list of some of the violations:

Planned Parenthood Fined for Health and Safety Violations – actions taken against more Abortion clinics

Ohio Right to Life has issued this release:

COLUMBUS, Ohio – Today, Ohio Right to Life obtained documentation of enforcement actions against three abortion facilities by the Ohio Department of Health. Among them is a $25,000 fine issued to Planned Parenthood of Bedford Heights due to severe violations of health and safety standards. Such violations include the facility’s failure to adhere to infection control policies, including exposed urine samples. Other health inspector discoveries include:

no experienced director of nursing on staff
improper storage of eight containers of human tissue
3-month overdue follow-up documentation for hospitalized abortion patient with perforated uterus
incomplete documentation for abortion patient who was hospitalized for bleeding
use of expired and undocumented chemicals and equipment used on surgical suction hoses

Further enforcement actions by the health department were taken against Northeast Ohio Women’s Center, which was denied a license to practice surgical abortions due to multiple health and safety violations, including failure to properly train staff, lack of a director of nursing, and expired medications and pregnancy tests.

“We’re deeply concerned, though admittedly unsurprised, that multiple abortion facilities are jeopardizing the lives and health of women,” said Mike Gonidakis, president of Ohio Right to Life. “The real war on women is being waged everyday in these unsafe and unsanitary abortion mills. These reports shock the conscience and reaffirm our resolve to protect life from Ohio’s abortion industry.”

This week, ODH also issued an administrative order to close the last remaining abortion facility in Toledo. Capital Care Network of Toledo (CCN) was unable to secure a transfer agreement with any Toledo-area hospital which caused health officials to begin the closure process last year. CCN attempted to enter into a transfer agreement with an out-of-state hospital at the University of Michigan. Because the hospital is located 52 miles away from CCN, the Department of Health ruled that it does not meet health and safety standards.

“Without Capital Care Network, life in Toledo will be safer for women and children” said Gonidakis. “This week, our government assured all of us that women’s health and patient safety is priority number one. It is deeply troubling that some people are advocating for this illegal operation to remain open, putting women’s lives at risk.”

Troubled abortion clinic to shift abortion services to Planned Parenthood building for sale

The Raleigh-based Planned Parenthood Health Systems plans to open a new clinic in Asheville after news that FemCare abortion clinic is closing.

The news originally hit the press back in March, but WLOS has just uploaded their report, sparking this blogger to post the story now.

Western North Carolina’s only provider of abortion services, Femcare, put its property up for sale last week. And a patient of the Asheville women’s clinic tells Carolina Public Press that she was told by a clinic staffer that it will close soon.

According to a real estate listing, Femcare’s building, near downtown Asheville, is now for sale for $1.275 million.

Dr. Lorraine Cummings, who owns the business and serves as its sole physician, declined to comment to CPP on the matter when contacted on Monday.

FemCare says they have been in negotiations with Planned Parenthood for months and plans to shift it’s abortion services to them.

“Recognizing the political challenges in today’s environment, Femcare has been in conversation with Planned Parenthood for several months. Both parties want to ensure that women in Western North Carolina have strong, long-term access to full GYN health options, including abortion. With that mutual goal in mind, in the coming year Femcare will shift its abortion services to Planned Parenthood. During the time of transition Femcare will continue to provide abortion services but will not see new gynecology patients.
Femcare has offered comprehensive reproductive health services in the region since 1985. Similarly, Planned Parenthood has played a role in meeting women’s health care needs in Western NC and their patient base is rapidly increasing, providing over 3,000 medical visits during the past fiscal year.”

Melissa Reed, the company’s vice president of public affairs, told the media that, “We have been in constant contact with Dr. (Lorraine) Cummings” — Femcare’s owner — “to ensure her support and make sure that that care continues in the Asheville area.”

According to WLOS, Planned Parenthood officials say they’re working to expand their operations in Asheville. They are working to open a 5,300 sq. ft. clinic that will offer women’s reproductive health services, as well as abortion services.

Pro-choice and Democrat groups attempted to raise funds for the clinic after the state’s Department of Health and Human Services suspended their license, citing nearly two dozen safety violations discovered in a recent inspection.

The North Carolina Department of Health and Human Services announced that it has suspended the license of Femcare for two dozen serious health and safety violations discovered during a routine inspection on July 18 and 19th.

Femcare was last inspected 6½ years ago. The closure is not directly related to the new law.

Raleigh, N.C.-In response to inquiries, the Department of Health and Human Services confirmed today that it has suspended the license of a medical clinic in Asheville, N.C, which specializes in abortions. After a routine survey of FEMCARE, Inc., inspectors found egregious violations of existing rules that revealed an imminent threat to the health and safety of patients.

“Inspectors from Division of Health Service Regulation (DHSR) found the facility failed to comply with 23 separate rules,” said Drexdal Pratt, Director of DHHS’ Division of Health Service Regulation (DHSR). “We take rule violations very seriously and, when necessary, take firm action to prevent harm to patients and clients in the facilities that we license regulate and inspect.”

In addition to other findings, the survey found the facility:

Failed to maintain anesthesia (nitrous oxide gas) delivery systems in good working condition, with torn masks and tubing held together with tape.This could lead to patients not receiving the intended dosage and risk patients not being fully sedated during surgical procedures, leading to pain and physical harm.
Failed to ensure emergency equipment had weekly checks to ensure the equipment was suitable for use in patient care and failed to ensure that emergency medicine wasn’t expired.
Failed to have a resuscitator available.
Failed to sweep and mop the operating room floor and failed to properly clean operating room beds.
Failed to have a director of nursing responsible and accountable for all nursing services.
Failed to have an agreement/contract with an anesthetist or anesthesiologist.
Failed to have an agreement/contract with a registered pharmacist to assure appropriate methods, procedures and controls for obtaining, dispensing, and administering drugs.
FEMCARE, Inc.’s last inspection was on January 16, 2007, a follow up inspection of a previous survey, which found the clinic in violation of personnel and quality assurance rules.
The Division of Health Service Regulation is responsible for licensing, regulating and inspecting healthcare facilities, including hospitals, ambulatory surgical facilities, dialysis facilities, nursing homes and mental health facilities. The Acute Care Licensure Section has ten full time staff who survey hundreds of facilities across the state. The recently passed budget adds 10 full time employees to provide more frequent inspections of acute care facilities.

Abortion capital fails to inspect abortion clinics

The state Health Department is failing to inspect many of New York’s abortion clinics — with some facilities escaping scrutiny for more than a decade, bombshell documents obtained by The Post reveal.

Health inspectors regulate 25 diagnostic and treatment clinics and surgery centers that provide abortion services — though pro-choice advocates say there are 225 abortion service providers in New York state.

Eight of the 25 clinics were never inspected over the 2000-12 span, five were inspected just once, and eight were inspected only twice or three times — meaning once every four or six years.

A total of just 45 inspections were conducted at all 25 facilities during the 12-year period.

By comparison, city eateries are inspected every year and graded, while a new law requires tanning salons to undergo inspections at least once every other year.

Meanwhile, state officials — citing prior threats and violence against abortion providers — refused to identify the names and locations of the clinics it did inspect.

Health officials acknowledged the dearth of inspections, in response to a Freedom of Information lawsuit filed by Chiaroscuro Foundation, a conservative think tank that works to reduce abortions.
