Free speech at stake in NAF lawsuit against CMP as judge is set to issue opinion

A federal judge has ruled that secret recordings from a pro-life group who infiltrated a National Abortion Federation meeting to expose a grisly baby parts harvesting operation does not show criminal activity, according to a report by the Associated Press.

In July, the National Abortion Federation (NAF) sued the Center for Medical Progress (CMP) accusing CMP of using fake names, infiltration, and hidden cameras to obtain the damning evidence. San Francisco Judge William Orrick granted NAF a temporary restraining order to prevent the release of the tapes. But, while the effort to suppress the videos were making their way through the courts,GotNews.com published them, claiming they were leaked to them by a hacker.

In their lawsuit, NAF claimed that CMP infiltrators “snuck into” their allegedly secure and supposedly private meetings to obtain video evidence that their members were buying fetal tissue. In response to the lawsuit, CMP claimed that their investigators conducted their investigation legally, and that NAF welcomed lead investigator David Daleiden and the other investigators as dealers in fetal tissue believing that Daleiden’s test company, BioMax, would pay abortion providers for fetal specimens. “NAF even provided Daleiden unsolicited information about the meeting’s agenda and location,” attorney’s for CMP stated.

But, according to the AP report, Judge Orrick does not agree. From the story:

Recordings secretly made by an anti-abortion group at meetings of abortion providers do not show criminal activity and could put the providers at risk, a federal judge said Friday, citing the recent shooting at a Colorado Planned Parenthood clinic.

U.S. District Judge William Orrick made the comments during a hearing over the National Abortion Federation’s request for a preliminary injunction that would continue to block the release of the recordings. Orrick did not immediately issue a ruling. He previously issued a temporary restraining order blocking the recordings pending the outcome of the preliminary injunction hearing.

Pro-lifers who have viewed the leaked tapes say that the NAF lawsuit is equivalent to censorship because NAF does not want the public to know the truth about abortion. The videos show plenty of evidence that NAF members were not only involved in harvesting fetal tissue but were holding presentations about the process during their meetings. A sampling of a few of the recordings show that NAF members:

Continuing with the AP report:

Orrick made a statement that doctors who appeared in CMP’s videos have received death threats. He also cited suspected arson at abortion clinics and the November shooting at the Colorado Springs Planned Parenthood clinic that left three people dead and nine wounded.

Catherine Short, an attorney for the Center for Medical Progress, said there was no evidence the Colorado shooter was motivated by the group’s videos or that doctors have been directly threatened. The release of the recordings is vital to furthering public discussion about topics such as whether the country’s abortion laws are too loosely written, she said. The center says in court documents its work is the equivalent of investigative journalism and protected by the First Amendment.

And, Short is correct, investigative journalism is not only protected by the First Amendment but the tactics used by CMP have been used by journalists in all sorts of investigations as Live Action News has detailed here. In fact, free speech issues in this case are so great that the U.S. Reporters’ Committee filed a ‘friend of the Court’ submission before the district court hearing NAF’s case, protesting that ‘any prior restraint on speech that is issued by a court has the potential to significantly affect the First Amendment rights of the news media and the public at large.’

Tom Brejcha, Thomas More Society President and Chief Counsel which presented arguments against NAF in the case agreed accusing NAF of working with Planned Parenthood to suppress Daleiden’s First Amendment rights.

“Equally as any other investigative journalist working for ABC, NBC, CBS, Fox News, or your local print or electronic media outlet may regularly resort to undercover journalism tactics to ferret out hidden crime, so too David Daleiden should have the right to penetrate the criminal underworld of America’s abortion providers and report all the evidence he has uncovered of criminal wrongdoing to law enforcement and to members of the public.”

The brief that Thomas More Society and co-counsel have filed on behalf of Daleiden in opposition to NAF’s preliminary injunction includes:

    Information about the precedent set by the recent Animal Legal Defense Fund v. Otter case, where the 9th Circuit ruled definitively that investigative journalism is not “fraud” and fully protected by the First Amendment.

    Admissions from NAF and Planned Parenthood abortion providers about their criminal participation in trafficking in aborted baby body parts documented at NAF meetings, redacted from the public filing and prevented from release by court order.

    The blatantly unconstitutional character of prior restraints on speech.

If NAF wins this case, criminals will rejoice and journalists will weep,” Brejcha said.

Both sides are watching for the decision to be released.

Abortion owner joked about fetus bonfire

A recently leaked tape recorded at a National Abortion Federation event captures one abortion owner joking about the need to burn the fetuses her clinic aborted in a field, something that another doctor actually did.

The comments came from Renee Chelian, owner of the Michigan abortion clinic chain, Northland Family Planning who also told her NAF audience that if it weren’t for the “PR nightmare” she thought it would be a “great idea” to burn the remains of aborted babies for energy. Sadly, using aborted children for energy is not a new idea. In 2014, CBS reported that an electricity generated in Oregon may have included aborted babies. And, a 2014 UK Telegraph report found that the remains of more than 15,000 babies were incinerated as ‘clinical waste’ by hospitals in Britain with some used in ‘waste to energy’ plants.

Earlier in the conversation, the abortion owner joked about wanting to take aborted babies from her clinic into a field and burn them. The trouble is, that idea has previously been carried out by another abortion doctor also making headlines this month.

In her speech, Chelian told the NAF audience the following:

“Um…Nobody wants to talk about dead bodies. Um, and nobody but me. I’m just saying. There was a point when Stericycle fired us that I had 5 months worth of fetal tissue in my freezers. We were renting freezers to put them in,” she says about her frustration over where to take her clinic’s aborted preborn babies for disposal.

Chelian continued, “It was all I thought about, was fetal tissue. Like, I was so consumed with fetal tissue, I was ready to drive to upper Michigan and have a bonfire. And I was just trying to figure out, you know, how I wouldn’t get stopped. Or, you know, how far into the woods would I have to go to have this fire that nobody was going to see me…I mean it was the worst, I dreamed about how to dispose of fetal tissue. And the garbage disposal was an option…”

Ironically, although Chelian joked about dumping fetuses somewhere in the woods and burning them, an Oklahoma abortion doctor once admitted doing that precise thing for the exact same reasons that Chelian outlined in her speech. In 1992, Dr. Nareshkumar Patel was investigated for burning a large amount of aborted children in a field near Shawnee.

From the Oklahoman:

    “Patel has been the center of controversy repeatedly since getting his medical license in Oklahoma in May 1984. In the most notorious incident, he burned 55 aborted fetuses in 1992 in a field east of Shawnee. He was investigated over the incident but never charged.”

Well…not so fast.

A 1992 Toledo Blade article on Patel read this way, “Dr.Nareshkumar Patel, an obstetrician-gynecologist told authorities he burned the fetuses because he was having trouble finding someone to handle their disposal.” Did you hear that Renee Chelian? Patel has already disposed of aborted children in the sick way you suggested and guess what, he was never prosecuted for doing so. You just can’t make this stuff up!

In fact, the only reason charges were not brought against Patel at that time was because there were no laws on the books to prohibit the heinous act. “There’s no criminal law that can be applied,” District Attorney Miles Zimmerman said at the time.

Now, almost 23 years later, Patel has found himself in trouble again. This month, Patel was sentenced to several days in jail for performing abortions on women who were not pregnant. Patel, whose sordid history also includes accusations of sexual abuse, was ordered to serve 18 days at a correctional facility after he pleaded guilty to the charges.

Patel also agreed to pay a $20,000 fine and never practice medicine again nor own any interests in any more abortion facilities.

An Oregon county commission has ordered a Marion County waste-to-fuel incinerator to stop accepting boxed medical waste to generate electricity after learning the waste it’s been burning may include tissue from aborted fetuses from British Columbia.

Covanta Marion, Inc., is a waste-to-energy facility which processes approximately 550 tons of garbage each day, including “bio hazard waste”, which they convert to fuel to generate approximately 13.1 megawatts of electricity each hour.

As Life Dynamics discuss in the May edition of Life Talk, hospitals in Britain have reportedly incinerated the remains of more than 15,000 babies alongside rubbish as “clinical waste” with some used in “waste to energy” plants. You can read more on that here.

Marion County commissioners Sam Brentano and Janet Carlson told the AP that they were horrified to learn that the facility might be burning medical waste that includes fetal tissue to generate electricity. Both strongly oppose abortions.

Brentano said that the county ordinance that sets the parameters for what can be accepted at the waste-to-energy plant allows for all human tissue.

“No rule or law has been broken, but there’s an ethical standard that’s been broken,” he said.

Jill Stueck, a Covanta spokeswoman, said the company is cooperating with the suspension, and it does not seek out the waste that mortified commissioners.
“No one is saying bring us fetal tissue,” Stueck said.

Oregon

A former employee of the facility said that he believes certified contractors have been carrying fetuses from British Columbia to Oregon, where state statutes allow fetuses to be disposed.

A TV station in Oregon, KOIN, interviewed the Covanta former temp worker, who said he saw 53-foot tractor trailers carrying bio hazards dropping off loads at the facility in Brooks at least two to three times a week.

Bud Waterman said that he observed the contents of the truck spill out of their containers.

“It would make you sick, especially if you had to clean it up or have to pull a box off the trailer,” said Waterman,”If you had to pull a box off the trailer, there’s so much blood.”

Waterman told the news station he believed that fetuses had been incinerated at the plant for years and used for energy.

“They knew it, they had to,” he said.

Stericycle

Jeff Bickford, environmental services division manager in Marion County, said the facility there has been taking material from British Columbia for five to seven years. He said clinical waste providers such as Stericycle bring in medical waste ranging from syringes and body parts to laboratory cultures and bodily fluids after hospitals and clinics place it into red bags and sealed containers.

Pro-lifers have been exposing Stericycle for picking up abortion clinic waste for years.

The group, Repent America has even launched a campaign to stop Stericycle after recording Stericycle admitting that they pick up aborted babies from abortion clinics.

Mark Crutcher, president of Life Dynamics, Inc. responsible for an undercover investigation which exposed the marketing of aborted baby body parts has responded to the Oregon incinerator story by saying, “What do you expect, these people are ghouls.”

Crutcher says that in some ways we are naive about just how evil this industry is and points out that if abortionists will kill the baby they will do just about anything to make it profitable.

“What we are finding out is that they are not only murderers but they are grave robbers,” he said, “It’s not enough that they kill the babies, they then have to go back and pick the bones.”

In April of 1997, Life Dynamics began their undercover investigation into the marketing of body parts harvested from babies killed by elective abortions. This investigation lasted approximately 31 months.

Most of the information in the report was provided by employees who worked at Comprehensive Health for Women (Comp Health) – a Planned Parenthood abortion clinic located in Overland Park, Kansas.

The wholesalers for the 2007 baby parts investigation were Anatomic Gift Foundation (AGF) and the International Institute for the Advancement of Medicine (IIAM). IIAM was at one time heavily involved in the baby parts business but has since withdrawn. It was founded by Jim Bardsley who eventually left to start AGF.

Life Dynamics has uploaded copies of the orders and additional documents on their website and points out some sickening observations:

First there is a requirement that parts be retrieved within a few minutes of fetal death, which dramatically increases the likelihood of a live birth. This is also an indicator that the purchaser is suggesting that the abortionist alter his procedure in order to meet certain specifications.

Life Dynamics explains that when “no dig” or “no digoxin” is written on the order, the purchaser is telling the abortionist that the baby can’t be killed by injecting digoxin into its heart. Again, this increases the chances of a live birth and is another indicator that the purchaser is trying to control what procedure the abortionist will use.

Although a number of the orders were on aborted unborn babies with fetal anomalies some of the documents showed that abortions – including the very late term ones – are being done on healthy babies.

What the orders do show is that the unborn child in the very early stages of pregnancy has identifiable human body parts.

According to Crutcher, “They have been able for years to tell the lie that the unborn child is this big glob of tissue but the day that they started putting out price lists that said they would buy the ears off of babies less than eight weeks old, what they were saying is that babies less than eight weeks old have ears.”

In an archived episode of Life Talk from 2000, the panel points out that late term abortionist Leroy Carhart was involved in this ghoulish activity. After Life Dynamics conducted their investigation they uncovered that Carhart was providing the University of Nebraska with aborted “tissue.”

Carhart told the media that he “donated” the “tissue” to the University, despite the fact that price lists and tissue logs Life Dynamics uncovered in their investigation reveal that selling these aborted babies can be very lucrative.

Crutcher says that tissue logs show that one baby is often chopped up and sold to many buyers, “For example, babies taken from donors 113968 and 114189 were both killed late in their second-trimester and cut into nine pieces. By applying AGF’s price list, we see that each baby was sold for between $810 and $1,170 depending on whether their parts were shipped fresh or frozen.”

Life Dynamics points out that the ghouling of abortion thrives behind closed doors. Just as in the Oregon incinerator case, shortly after Life Dynamics began releasing information on the marketing of baby parts, AGF announced it would no longer be providing baby parts. Apparently, this was in response to public exposure in the media and protests by pro-life activists at their Maryland headquarters.

Crutcher says that this ghoulish activity continues to this day as Congress has yet to outlaw the harvesting of aborted baby body parts, “Today, we are routinely asked whether aborted baby parts are still being bought and sold. When we respond that they are, we are inevitably asked why the federal laws that prohibit it are not being enforced. The short answer is that there is no political will to enforce these laws.”

As for the ghoulish aspects of the use of these children to heat our homes, Crutcher says that pro-lifers know that before the vultures circle over the dead bodies of these children, the abortion industry is free to murder them, “One thing we pro-lifers need to realize is that we’ve always known they’re killing the baby. Over the years I have asked pro-lifers, ‘ why are you so upset over this when you knew abortions were going on? Really if they are killing the baby what difference does it make if it is inside the womb or outside or if they chop them up and sell them once they are dead or use their dead bodies for electricity? ‘”

CBS News is reporting, that the electricity generated in Oregon may have included aborted babies. Commissioners said they were horrified and disgusted to learn that Covanta Marion was burning abortion waste to generate electricity. The facility is owned and operated by Covanta in a partnership with the county. It processes 550 tons of municipal solid waste a day, with only a small portion coming from medical sources.

This blog previously wrote how news outlets like the UK Telegraph reported that the remains of more than 15,000 babies were incinerated as ‘clinical waste’ by hospitals in Britain with some used in ‘waste to energy’ plants.

Ten NHS trusts admitted burning fetal remains alongside other rubbish while two others used the bodies in ‘waste-to-energy’ plants which generate power for heat.

Back in Oregon, Sam Brentano, chairman of the Marion County board of commissioners, told the CBS affiliate that the board is taking immediate action to prohibit human tissue from future deliveries at the plant that has been turning waste into energy since 1987.

KOIN interviewed Bud Waterman, a former temp worker at Covanta Marion, Inc., who said he saw 53-foot tractor trailers carrying biohazards dropping off loads at the facility in Brooks at least two to three times a week.

On more than one occasion, Waterman said the contents of the truck spilled out of their containers.

“It would make you sick, especially if you had to clean it up or have to pull a box off the trailer,” said Waterman,”If you had to pull a box off the trailer, there’s so much blood.

Waterman told the news station he believed that fetuses had been incinerated at the plant for years and used for energy.

“They knew it, they had to,” Waterman said.

In addition to aborted babies being incinerated there was biohazard waste such as individual human body parts which were used at the plant.

So if someone loses an arm, loses a finger?” Marion County commissioners Janet Carlson asked at the meeting.

That should go in and be burned,” Brentano replied. “As gross as that is.”

According to KOIN, Covanta placed blame on Marion County and said the company is halting the program until answers are given.

“The medical waste program at the Marion County Resource Recovery Facility is County run and managed,” Covanta said in a statement. “Marion County contracts for and delivers medical waste to the facility and Covanta has no responsibility for the program. Covanta is shocked by these allegations and is discontinuing the receipt of this waste stream until we have been assured by the County that this alleged material is not being delivered to the facility.”

Focal Point‘s Bryan Fischer called the practice barbaric and Hitleresque and said that we are no different than Nazi Germany. He compared this practice with those done centuries ago when Ancient Israel babies sacrificed their children to the idol Moloch.

According to ABC NEWS, The Oregon facility is a partnership between the county and Covanta, a New Jersey-based firm that operates energy-from-waste power generation plants. The Marion County plant processes 550 tons of municipal solid waste a day, with only a small portion coming from medical sources. It sells the power to Portland General Electric.
