State seeks shutdown of “unlicensed abortion clinic” in Birmingham

BIRMINGHAM, Ala. –The Alabama Department of Public Health today filed a civill complaint in Jefferson County Circuit court seeking to stop the operation of what it says is an unlicensed abortion clinic in Birmingham.

The complaint states that New Woman All Women Health Care on the Southside does not have a license yet it is offering abortions provided by Dr. Bruce Norman.
The state announced last week it was investigating allegations the clinic was performing abortions without a license. The Clinic surrendered its license last year after the health department found problems including two cases where patients were given an overdose of a drug and had to be transported to the hospital.

The clinic “is holding itself as an abortion provider through advertising and offering abortion services to the public without a license,” the complaint states.
Brian Hale, deputy general counsel for the state health department, said the state first learned of abortions advertised on the New Woman All Women website and launched an investigation in February after developing information Norman was performing abortions.

Named as defendants besides Norman are Dipat LLC, Diane W. Derzis, Patrick H. Smith and All Women’s Inc. doing business as New Woman All Women.

Hale said Derzis and Smith are partners in Dipat, which owns the real estate, and are partners in the business All Women’s Inc..

In a consent decree last year, Derzis surrendered the license to perform abortions after revocations proceedings began.

A woman answering the phone this afternoon at the clinic advertised on New Woman All Women website took a message for Norman but said Derzis “doesn’t have anything to do with us.”
