The Associated Press has reported that Planned Parenthood of Birmingham has been placed on probation. The AP story reads:
MONTGOMERY, Ala.—A Birmingham abortion clinic that was targeted in an undercover sting by anti-abortion activists has been put on probation by state health officials.
State inspectors, who went to the Planned Parenthood clinic after the sting by the anti-abortion group “Live Action,” cited problems with the reporting of suspected sexual abuse and how parental consent was obtained for minors. ( Sting Video Below)

Rose told the staffer that she was 14 and had been impregnated by a 31-year-old boyfriend. She told the Planned Parenthood official she needed a secret abortion so her parents would not find out about her sexual relationship with the older man.

Rose asks, “Is it a problem about my boyfriend?

The counselor, identified as “Tanisha” in the video, responds, “As long as you consented to having sex with him, there’s nothing we can truly do about that.”

Rose then says that her boyfriend “said he could get in big trouble,” and Tanisha acknowledges that “he could, especially if your parents find out that he’s 31.

The Planned Parenthood official then tells Rose that the center manager, Desiree Bates, “sometimes does bend the rules a little bit” and adds “whatever you tell us stays within these walls” and “we can’t disclose any information to anybody.”

Tanisha also seems to tell Rose that a signature from an “older sister that’s over the age of 18″ or someone “with the same last name” could function as a substitute for parental consent so Planned Parenthood could perform an abortion on a minor.

Yet, Alabama Code 26-21-3 specifies that the written permission of either a parent or legal guardian is necessary before a minor may obtain an abortion.

This is the seventh Planned Parenthood center implicated in a multi-state child abuse scandal involving the deliberate and unlawful suppression of evidence of statutory rape. Alabama is the fourth state to be implicated in the controversy, along with Arizona, Indiana, and Tennessee.

Recently, the investigation of a clinic in Memphis, TN assisted state legislators in their effort to successfully divert nearly $1 million in taxpayer subsidies from Planned Parenthood to law-abiding local health clinics.

When to ‘bend the rules a little’ means hiding a case of statutory rape from Child Protective Services and looking for ways around the parental consent requirement, Planned Parenthood becomes directly responsible for ensuring that statutory rapists can continue their abuse of young girls,” Rose says.

Rick Harris, director of the state’s Bureau of Health Provider Standards, said Wednesday the clinic did more than was required in some ways but failed to get the signature of minors on its forms verifying parental consent, a technical violation.

“To me this is the problem: You would think that an abortion clinic that intended to be law-abiding would have a lawyer or someone in the facility personally sit down and read what the statute requires and that obviously hadn’t been done,” he said in an interview with The Associated Press.

The probation is for one year, and Planned Parenthood of Alabama Inc. spokeswoman Felicia Brown-Williams said they have already given the state a plan to correct the violations.
The clinic is subject to increased inspections while on probation and the health department can start proceedings to revoke its license if the violations aren’t corrected or if more are found during the year.

An activist with the San Jose, Calif.-based “Live Action” posed as a 14-year-old girl who was impregnated by her 31-year-old boyfriend and told employees at the Birmingham clinic she needed to have a secret abortion.

An audiotape of the 2008 visit allegedly has a Birmingham Planned Parenthood staffer saying the clinic sometimes bends the rules and suggested that someone other than a parent or legal guardian could give consent for a minor to have an abortion.

“We have seen this across the country in our investigative work and released videos from several other states showing the same activity,” Lila Rose, president and founder of Live Action, said during break from classes at UCLA. The 21-year-old history major played the part of the pregnant teen at the Birmingham clinic. She said her group applauds the state’s efforts but feels the probation was too lenient.

After the tape was released last year, state health inspectors reviewed clinic records and found that nine minors, ages 13-15, had received abortions without proper verification of parental consent since November 2008.

In one case, health officials said, a 15-year-old received an abortion even though the person claiming to be her mother did not appear to be and presented questionable records, including an expired Alabama driver’s license. Inspectors said Alabama birth records show a different person as the girl’s parent.

There were also concerns about reporting child abuse. One of the 13-year-olds who received an abortion reported starting having sex at age 12 and having three partners in the previous year. She was back at the clinic for another abortion four months later and said she had now had four sexual partners in her life.

“A reasonable person would suspect abuse or neglect of this 13-year-old child, based on the above,” inspectors wrote. “Neither the Registered Nurse, the Medical Doctor, nor any other Center staff reported the suspected abuse or neglect to the authorities as required by law.”

According to the Code of Alabama, minors must present clinics with a consent form and verify that the signature on the form is that of their parent or legal guardian. The code requires the minor to sign the form as verification, but the clinic’s forms don’t have a space for that.

Harris said the clinic was having parents or guardians physically come in with the minor and present identification.

“They were doing stuff that they weren’t required to do, but they weren’t doing the one thing that they were required to do,” Harris said. “That’s why we say they didn’t technically meet the requirements of the parental consent statute.”

Brown-Williams said in an e-mail Wednesday that the organization has outlined steps to “assure that all of the state’s concerns are addressed.”
“We will continue to take every necessary step to ensure that every aspect of our services meets legal and professional standards and is consistent with Planned Parenthood’s high standards of patient care,” she said.

The Alabama Department of Health has put a Planned Parenthood abortion clinic in Birmingham on probation for violating multiple state laws, including performing illegal abortions on minors.

A report by state health officials indicates that Planned Parenthood staff at the Birmingham abortion clinic, “failed to obtain parental consent for 9 of 9 minor patients in a manner that complies with state legal requirements.” The report also states that, “neither the Registered Nurse, the Medical Doctor, nor any other Center staff reported the suspected abuse or neglect [of a 13 year-old child to the authorities as required by law.”

The health department began its investigation after an undercover video was released by Live Action, a youth-led pro-life organization. The video shows an actress posing as a 14-year-old girl who is seeking an abortion. Workers at the Birmingham clinic tell the alleged 14-year-old that she can skirt parental consent laws by getting someone “with the same last name” to sign off on the abortion in place of her parents. When the clinic workers hear that the girl’s “boyfriend” is 31, they refer her to the clinic director, Dr. Desiree Bates, telling her that Bates “does sometimes bend the rules a little bit.”

The video was the sixth in Live Action’s “Mona Lisa Project,” a multi-state undercover audit of Planned Parenthood’s compliance with state laws regarding minor abortion and mandatory reporting of child sexual abuse.

Live Action president and UCLA student Lila Rose, who portrayed the 14-year-old in the video, says law enforcement in other states should follow the lead of the officials in Alabama: “The Health Department report documents the same malpractice that we have found in state after state. Sexually abused minors are being neglected by Planned Parenthood, which puts its own ‘abortion-first mentality’ before child protection. These are outrageous violations of state law and the Alabama Health Department should revoke the Birmingham Planned Parenthood clinic license. Alabama legislators must also ensure that no tax money is funding Planned Parenthood’s illicit activity.”

  2. These pregnant children need to get abortions. I’m sorry, but there is no way that any of these children should be having sex, or having babies. We just can’t afford anymore of this bad genetic matter introduced into the gene pool. Look how stupid people are getting, as it is…give them all abortions, make it secret, and get rid of these pregnancies before they become more immoral children breeding like rats.

      • Oh come on. I’m so tired of people like yourself, who are so judgmental of abortion rights, but YET, you never ever put your money and time where your mouth is.

        The insinuation here is that somehow Planned Parenthood has to be stopped from aborting pregnancies from defective children. Children who are engaged in sex with adults are defective, most likely due to their lack of parental guidence. Children learn sex if they are brought up wrong. That travels in families. Those families need to be stopped from reproducing themselves.

        You can’t tell me that a child of that age should reproduce. That is the most ignorant statement, if that is your point, here.
